Broadway Ave, Suite 210 Meridian, Idaho 83642 RE: Treasure Valley Veterinary Hospital — Certificate of Zoning Compliance Submittal Dear Ms. Watters, Please find the enclosed application for the Treasure Valley Veterinary Hospital Certificate of Zoning Compliance. The application and site plan were prepared in accordance with previous City of Meridian approvals for CPA -09-004; AZ -09-002: CUP -09-007; and VAR -09-003. In addition, the applicant entered into a Development Agreement with the City that is recorded as instrument # 1090120013, Ada County Records. The Treasure Valley Veterinary Hospital addition/remodel project includes a remodel and 1,504 sq. ft addition to the existing 2,112 sq. ft. facility. Site improvements will be constructed as shown on the attached CZC site and landscape plans and will include a asphalt pavement parking lot; concrete sidewalk, curb & gutter; a screened trash enclosure; planter landscaping, landscape buffers and pressure irrigation sprinkler system; a 10 -foot wide asphalt multi -use pathway; site utilities; and drainage improvements. The current Comprehensive Land Use designation for the property is "Office" with a L -O zoning designation. This CZC application is an extension of the Conditional Use Permit (CUP -09-007) that was approved for the development on October 6, 2009. The project proposal in consistent with the approved CUP; the following comments address conditions of approval that were set forth in the previous project entitlements. DEVELOPMENT AGREEMENT (Inst # 109120013) Conditions Governing Development of Subject Property 5.1. Owner/Developer shall develop the Property in accordance with the following special conditions: 1. Future development of this site shall substantially comply with the conditions of approval, and design standards in effect at the time of Certificate of Zoning Compliance application. Future construction and development of the site shall comply with the standards listed in UDC 11-3A- 19 and the objectives and guidelines of the Design Manual. The development proposal complies. 2. Subject to the conditions in this paragraph, a cross -access easement shall be recorded that provides driveway access to the property to the north (parcel #R9071450022) (the "Northern Parcel") for connectivity. The effectiveness of the easement shall be conditioned upon the owner of the Northern Parcel granting a reciprocal cross easement to the applicant. The applicant shall have no obligation to improve the easement or to maintain it if it is improved except as part of future development of the applicant's property. The initial location of the easement shall be as set forth in an exhibit attached to the easement document. However, the easement is being granted prior to the development of the applicant's property. Therefore, the applicant shall have the right to relocate the easement upon the applicant's property either before or after the development of the applicant's property, upon thirty (30) days prior written notice to the owner of the Northern Parcel. Applicant then shall execute, deliver and record a superseding easement to evidence the relocation. Facades: The facade that faces the public street incorporates modulation by virtue of the changes in roof heights, wall planes, colors and materials along the entire length of the facades. The existing exposed CMU portion of the wall will be re -painted to a color of light silver (similar to Valspar 4006-1A "Silver Leaf') that will be complimentary to the new color palette. Wall paint color change occurs at the roof break line and downspout to help reduce the large wall surface area. Additionally, window canopies help provide a sense of scale at the west elevation. Existing accent 'bird perch' blocks are painted to match trim color to highlight some of the existing building character. b. Primary public entrance: The Building is a single user/occupancy. There is a single main entrance. The entry is denoted with storefront glazing, an extended eave and an accent color and change of architectural "style". c. Roof lines: The roof design demonstrates overhanging eaves, varying roof heights and changes in direction. d. Pattern variations: The building design incorporates changes in texture via the use of stone veneer, existing CMU painted surfaces, stone watertable sills, window concrete sill blocks at CMU openings, stucco, corrugated metal and wood bracket accents. It incorporates color via the colors of the stone, stucco, roofing, corrugated metal,. wood and glazing; materials via the use of stone, stucco, wood, cmu, metal and glass. e. Fenestration: Windows are articulated and balanced to emphasize the character of the.. building design and give emphasis to various building forms. f. During the progress of all work, traffic control devices shall be erected and maintained as necessary or as directed for the protection of the traveling public. All traffic control devices shall conform to the most current edition of the Manual on Uniform Trac Control Devices for Streets and Highways, as adopted by the state (ITD). Upon completion of the permitted work, all rubbish and debris shall be immediately removed from the work area to the satisfaction of ITD. 7. All work herein permitted shall conform to current government and industry standards and be performed and completed to the satisfaction of ITD. The expense of any required supervision of work performed under this permit shall be borne by the permittee. 8. This permit or privilege granted under ITD 2109 shall not be deemed or held to be an exclusive one and shall not prohibit the state from using any of its highways, streets, or public places or affect its right to full supervision and control over all or any part of them, none of which is hereby surrendered. ITD shall be reimbursed by the permittee for any additional inspection required under the special provisions of this permit. 13. The permittee shall furnish all material, labor, and equipment involved in the construction of the approach and its appurtenances. This shall include furnishing drainage pipe of a size specified on the permit (12 -inch minimum), curb, gutter, concrete sidewalk, etc., where required. Materials and workmanship shall conform to current government and industry standards and are subject to inspection by ITD. 14. No work shall commence until the permittee is given notice to proceed by an authorized representative of ITD. The permittee shall notify ITD five (5) working days prior to commencing the permitted work if work does not commence immediately upon notice by ITD. 15. The original permit or a copy must be kept on the job site whenever work is taking place. Any modification, relocation, or removal of an encroachment or subject granted by this permit shall require a new permit prior to commencement of such work. Only flowers, grasses and shrubs with a mature height not to exceed three (3) feet or trimmed with no limbs between three (3) feet and five (5) feet in urban areas and three (3) feet and seven (7) feet in rural areas will be allowed within the sight triangle at corners and the safety clear zone of the State Highway. Landscaping shall be short enough or trimmed so it doesn't interfere with State Highway signs. No rocks over four (4) inches maximum size will be allowed within the State Highway right of way. Sprinkler heads shall be no closer than five (5) feet from the pavement edge and shall be adjusted so as not to cause water to cover any part of the highway surface. Landscaping shall be placed so as not to disturb the normal drainage patterns within the State Highway Right of Way. The permit holder shall return to original condition and re -seed all areas disturbed by his construction within the State Highway Right of Way to the satisfaction of the District Engineer. Repair of landscaping due to highway maintenance shall be the responsibility of the permittee. The State will not be responsible for or participate in any repair or maintenance costs.
