Kingsford: I would suggest that you guys ponder your information for the findings that you use as Mr. Jone's has suggested and go through this list and see those that you find offensive and mark them with a C. ITEM #27: DAN WOOD: REQUEST FOR 1 YEAR EXTENSION OF FINAL PLAT FOR WINGATE SUBDIVISION PHASE 2 AND 3: Kingsford: Mr. Wood Wood: What I am doing is requesting an extension phases 2 and 3 on Wingate Subdivision. Part of the reason behind it is when the Preliminary plat and the final plat of phase 1 was approved you requested that I get the problem on Dixie Lane straightened out. It has taken quite a while but finally I've gotten that straightened out, part of the delay also in the next phase is the subdivision Dove. Meadows has been delayed so I am anticipating getting started on phases 2 and 3 next year. So that is what I am requesting. Kingsford: Questions of Dan? Entertain a motion. A record of the hearing, findings made, and action taken shall be maintained. 9-604 F APPROVAL PERIOD 1. Council approval of the Preliminary Development Plan shall become null and void if the applicant fails to submit the Final Development Plan .within one (1) year of Council approval of the Preliminary Development Plan. 2. Upon written request to the Council and filed by the applicant prior to the termination of the said one (1) year period as stated in Section 9-604 F.1 of this Ordinance, the Council may authorize a single extension of the approval of the Preliminary Development Plan for a period not to exceed one (1) year from the end of the said one (1) year period. 3. After meeting with the developers of these three projects at different times, there may be some confusion regarding the various connections between the three. Briefly, the requirements include.: 1. HICKORY WAY Hickory Way will be extended through Dove Meadows as a collector standard roadway from Fairview to the northern boundary of Dove Meadows, exiting the property east of Wingate Park Subdivision's east boundary. In its first phase,Wingate Park has extended a stub street to its eastern boundary for future connection to the extended Hickory Way north of Dove Meadows. 2. CONNECTION BETWEEN DOVE MEADOWS AND WINGATE PARK Dove Meadows and Wingate Park will stub a north-south mutual street connection to their common boundary. The stub will align with the "bulb" on the north side of E. Oakcrest Drive in Wingate Park Subdivision. 3. STUB STREET TO WEST Wingate Park will stub a street to its southern boundary (to the out-parcel in the southwest corner), one lot depth from the western boundary to connect with a future extension of Oakcrest Drive coming east out of Mirage Meadows. 4. Dear Mayor Kingsford: Attached are vicinity maps with regazd to the question that I have. Per Wayne Forrey's suggestion, I am putting my questions in written form. When the city council approved the final plat of Phase I of Wingate Place, it was with the recommendation that the developer clear up the questions regarding the ownership of Dixie Lane and the alignment of Oakcrest with regard to the Akerstrom property before any further phases of this development would be approved. I have employed Attorney Fred Shoemaker of Cosho, Humphrey, Greener & Welsh. We have gone through all legal notifications and no one has stepped forward with any claims regazding Dixie Lane. I am presently negotiating the purchase of the Akerstrom property. This action would place the Wingate Partnership in control of the Akerstrom property as well as Dixie Lane. I need clarification from the City of Meridian on whether I need to again apply for annexation and plat approval of the Akerstrom property and Dixie Lane once it is acquired or was the first annexation sufficient. The property in question is surrounded by annexed property except for the southerly 30 feet which adjoins the Avest Limited Partnership property on the corner of Locust Grove and Fairview Avenue, which at the present time is requesting annexation also. Within the next few months, I plan to present Phase II before the city council. My hope is this small piece of property as well as Dixie Lane can be included in the final plat approval of Phase II of Wingate Place without any further delays. I would like to have this clarification as soon as possible, so that I will know how I must proceed. Dear Larry: With regard to the above meeting, I would like to give you an overall view of my feelings on the above-referenced subject. The letter from Kathleen also included a proposal to ACRD for the alignment of roads between the three subdivisions and Avest's proposed development. If the county is in favor of such an alignment, I strongly suggest, as I have suggested in the past, that Dixie Lane be improved from Fairview Avenue due north to Wingate Subdivision. The reason I feel so strongly on this point is that I know it would more equally distribute the traffic in this area. As discussed in the meeting, future growth indicates a traffic signal will be placed at the intersection of Dixie Lane and Fairview Ave. Why not take advantage of this opportunity now so that Dixie Lane can be of better use to all surrounding property owners.
