Fairview Avenue Proposed Use: 1,961 sq ft addition to existing Animal Care Facility Zoning WWI Comments: Conditions of Approval: Project is subject to all current City of Meridian ordinances. The issuance of this CZC does not release the applicant from any previous requirements of other permits issued for this site. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All changes in occupancy need to comply with the requirements of Building Services. It is unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from Building Services (208) 887-2211 after inspections are complete and the field inspection record is returned to Building Services. Alternative Compliance: The applicant is requesting alternative compliance from two UDC standards. The first request deals with the parking location. Per UDC 11-3A-19.3, no more than 50 percent of the total off-street parking area for the site shall be located between building facades and abutting streets. Currently, the existing parking lot is located between the building and Fairview Avenue. Because the property is an irregular shaped lot, encumbered by irrigation easement and current access is being taken from Fairview Avenue, redesigning the parking area is not feasible. The second request is to deviate from the landscape requirements of UDC 11-3B. In particular, the applicant is unable to comply with the 25 -foot landscape buffers that are required along Fairview Avenue and the southern property boundary. The current site design prohibits conformance with the landscaping requirements. If the applicant was to construct the 25 -foot landscape buffer adjacent to Fairview Avenue it would displace required parking stalls and the site would be under parked. The current parking count exceeds the minimum parking amount by one stall. In addition, the existing building prohibits conformance with the 25 -foot wide buffer along the southern boundary adjacent to the residential homes. However the landscaping along the southern boundary is quite mature and setback between the buildings is quite substantial. In addition there is a substantial grade change between this property and the abutting residential. Per UDC 11-513-513.2f. and UDC 11-513-5A.2b, requests for alternative compliance are allowed when a site design demonstrates consistency with the Meridian Design Manual and an unusual shape lot makes full compliance impossible or impractical. The location of the existing building, parking area, irregular shaped lot and the current access point makes full compliance impossible. Staff finds the applicant's requests have met the intent of the landscape ordinance and the Meridian Design Manual. Therefore, the Planning Director approves the alternative compliance request as submitted on the landscape plans stamped approved on January 14, 2010. Site Plan: The Site Plan prepared by BRS Architects, Inc., labeled Sheet SD1.1, dated 01/13/2010 is approved (stamped "Approved" on January 14, 2010 by the Meridian Planning Department) with the changes: 1) Prior to certificate of occupancy, the applicant shall provide a new photometric plan demonstrating zero lumens at the southern property boundary in accordance with UDC 11 -3A -11C.4. 2) Prior to certificate of occupancy, provide a recorded cross access agreement to the Planning department and construct a 20 -foot wide driveway on the western boundary to provide a future access to Jericho Road. The approved site plan is not to be altered without prior written approval from the Planning Department. Landscaping: The Landscape Plans prepared by South Landscape Architecture for BRS Architects, dated 01/12/2010, labeled Sheet L1.1, is approved (stamped "Approved" on January 14, 2010 by the Meridian Planning Department) withthe following comment: 1) Prior to certificate of occupancy, provide written verification (recorded license agreements from NMID and SID) allowing the proposed and existing improvements within the irrigation easements adjacent to Fairview Road and the eastern property boundary. The approved landscape plan is not to be altered without prior written approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of all material changes is required Prior to final inspection and sign off for this project, a written certificate of completion shall be submitted to the Planning Department, prepared by a landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. Design Review: The site design and building elevations are found to be consistent with the Meridian Design Manual and UDC 11-3A-19; stamped "Approved" on January 14, 2010. Elevations: The elevations submitted for design review, prepared by BRS Architects dated November 23, 2010, labeled Al. I are approved (stamped "Approved" on January 14, 20 10) with no changes. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-313- 10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-313-10-C.5. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-313-11 and UDC 11-3A-18. Ling: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Relocation of the sign will require a separate approval by the Planning Department. Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all federal handicap -accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. Fairview Ave. The current existing building is 2,910 sq. ft. The new addition will consist of a 10' expansion to the west, exterior stair enclosure addition to the south and new upper story addition. The new main floor expansion area will be 300 sq. ft., stair enclosure addition is 130 sq. ft. and the new upper story addition will be 1,460 sq. ft. The total completed building area will be 4,800 sq. ft. The 300 s.f. addition expansion to the west will extend to an adjacent parcel not currently owned by the client. However, it is currently in legal process to purchase this adjacent parcel and consolidate the property by doing a lot line adjustment. This is anticipated to occur mid- December. The building is located in a C -G zone and is appropriate for its existing and future use as an animal care facility. The current design has the roof line (midway between the eave and the ridge) at approximately 23'-0" above finished floor. Parking will remain unchanged as we meet requirements for total building area per 500 gross floor area ratio. Currently, there are 11 spaces provided. I have discussed and received approval from Sanitary Service Company to locate the (3) trash totes on-site near Fairview for trash pickup in lieu of a trash enclosure. Currently the trash totes are being accessed on the adjacent easterly property. It is understood that at some point in the future, there may be cross -access necessary with the easterly property, which would necessitate modification to the existing parking, at which point a trash enclosure would be provided. Existing building finishes will be removed from the north and west sides and replaced with new finishes including stucco, stone and new standing seam metal roofing. Wood bracket elements will also serve as decorative accents as noted on the elevations. Minimal work will be done to the remaining east and south elevations, as these are buffered from an abundant amount of mature vegetation and not prominent elevations from the public. The site has been enhanced with additional trees required as part of mitigation due to the demolition of one tree near the NW corner of the existing building. A new 5' pedestrian walk has been proposed to link the building entry to the main sidewalk fronting Fairview. This walk at Fairview is 10' wide. We have made our best effort to continue this walk at the east and west ends of the property. However, each end presents issues. At the east, an existing sign obstructs the path. This sign was recently approved and constructed. We have proposed to meander the path around the sign (to the south), thus narrowing it to approximately 5', then widening again near the east property line. ACHD has indicated that no sidewalk can be constructed within 53' from the centerline of Fairview. And the future r.o.w. (not yet declared) will be 60'. This prevents us from routing the walk north of the sign. At the west, an exposed, un -tiled, ditch obstructs the path from continuing to the west property line. Currently, a portion of the ditch is within the property, and a portion is within the adjacent parcel. We have proposed to terminate the path as necessary until.further development progresses and necessitates piping and coverage of the ditch. All mechanical equipment is internalized, eliminating the need to provide screening measures on the outside. Other service equipment is located in the rear yard, screened by new or existing fencing. Two existing conditions are non -conforming to the current ordinance and are being addressed through Alternative Compliance applications as concurrently submitted. Through the Alternative Compliance application option, we are submitting and requesting waivers for two specific non-conformance issues, as described below. Fees for two Alternative Compliance applications have been included. Alternative Compliance No. 1: As the building and site exist, we do not comply with the 25' required landscape buffer for both the front and rear yard. The front buffer extends approximately 2 feet into the parking lot. At the rear, the building is located approximately 18 feet from the rear property, as a recent property survey indicates. To address the front yard non-conformance, it is not feasible to remove parking spaces to accommodate additional landscape because this would reduce the number of parking spaces to less than what is required (11 spaces). Regarding the rear non-conformance, given that the building was originally constructed 18' from the property line, we are asking this condition to be waived due to the following. First, the condition has been this way since it was constructed around 1991 and, to our knowledge, has not been an item of complaint by the residents adjacent to the south. Second, there is an abundance of mature trees (30' high) on our property spaced in close proximity along the rear property line and an abundance of existing mature trees (50'-70' high) just south on the adjacent residential property. This provides ample screening of view from the residents at the south. (See attached site plan for reference). Third, there is a landscape berm at the south property, providing a grade difference of approximately 2'-6", our property being lower than the residential property). In addition, there is a 5' high fence atop the berm. Lastly, the resident building is approximately 70- 80' away from the shared property line. These factors help to reduce amount of building face exposed, as viewed from the residential property. As a matter of reference, the existing eave/fascia height from our property grade is 10'. With the additional second story we are proposing, the new eave/fascia height will be 19'. It is for the previous four reasons, that we propose to add an exterior stair enclosure to serve the new second story being added. This stair will encroach 4'-6" further into the landscape buffer, 13'-6" away from the south property line. We feel that the ample screening, grade difference and large distance from the residential building will not worsen the current condition even if we add a second story and a further encroach with a new exterior stair enclosure. Furthermore, the earth tone design color scheme will help to neutralize, or blend in through the screening, and will not be obtrusive in any way, as viewed from the residents. We are asking that this non -conforming condition be waived and further encroachment be allowed. .Alternative Compliance No. 2: As the building and site exist, the current parking configuration does not meet the 50% maximum allowed parking in front of the building per Meridian Zoning Ordinance 11-3A-19. Currently all 100% of parking resides in the front and there is no feasible way to accommodate this requirement, due to the building and site constraints and lack of area to provide parking to the. rear of the building. The east and south facades are less prominent, and currently buffered from an abundance of on-site and off-site mature trees and are not proposed to be embellished to the extent of the more prominent north and west sides. Architectural Character: The building provides various projections and modulations to break up the two-story mass. The main entry has been emphasized with a tall gabled structure with an abundance of glazing. A secondary smaller gabled element helps bring proportion to the north fagade. Another gabled element also serves to enhance the west facade. The roof is stepped, with the lower roof to remain and the additional second story roof above. Overhanging eaves, varying between 24, and thick 12" eaves help to 'weight' the roof down, given the tall eave heights at the second story. The large surface area of wall is broken into horizontal material bands of varying materials and textures, intersected by the vertical elements. Decorative wood brackets articulate the facades and bring a sense of scale. All mechanical equipment is internalized. Color & Materials: Stucco, cultured stone, brick and wood are used at the prominent north and west facades, along with horizontal wood siding to match the existing siding at the less prominent south and east facades. Parking Lots: Parking located between the building and primary street (Fairview Ave.) has remained existing at 100%, exceeding the allowable by the City of Meridian. Pedestrian Walkways: A 5' asphalt paved walkway (separate from the parking lot) has been added from the existing sidewalk near the building, linked to the 10' wide walk fronting Fairview.
