Legal Desc.: Lots 5, 6, 7, 8 and 10 of Block 7 of the Townsite of Meridian together with that portion of Pine Street adjacent as vacated by Ordinance No. 72 recorded February 10, 1922. 4. Proof of Ownership: See attached Deed No. 94003761 5. The building is currently used for professional record storage, plus 4 apartments and 6 garages which are used daily. The office space is accessed as necessary to retrieve stored records. 6. Currently the signed usage is for a professional office building. The owner/physician ceased seeing patients at this site and now sees patients at Boise State University. All utilities have remained on and in use, i.e.: water, sewer, electricity, gas, heating and cooling are fully operable and have always remained so even when the office was not open for patients. All lights, bathroom appliances, doors, etc. are fully operable. Other than the outdated decor the building is fully inhabitable at this time. The apartments and garages have always been in full use. 7. Proposed use if for professional offices, record storage and small retail business(s) in the area which was retail prior to office use and is currently used for storage. The apartments and garages will remain unchanged. l T~ ~~ There are a total of twenty eight (28) spaces of which two are for handicap, this represents parking equal to One (1) space for each two hundred (200) sq. feet of gross office/retail space. The gross building area totals five thousand four hundred (5400) square feet which has a maximum requirement of twenty seven (27) spaces under the most stringent of commercial and office uses as set for in Section 2-414 E(b) Commercial. With the additional eleven (11) parking places directly in front of the building on East Second Street, and the fact there is only a single family residence directly across the street there is more than ample parking for both office and retail use of the property. 3. Landscaping will be installed by removal of the existing concrete BETWEEN the sidewalk and the front of the building along East Second Street and installing shrubs, etc. Landscaping will also be reinstalled in the dirt along the South side of the building between the existing sidewalk and the building. An underground sprinkling system is already in place to service this landscaping. An area at the corner of East Second and Pine Streets will also be landscaped so as not to obstruct the line of sight.. A tree and landscaping is proposed in an island created by the 60 degree angled parking along the South side of the building. 4. It is the applicants belief that this application is solely for the purpose of approval of use of the property for the purposes to which it has always been used since the building was constructed on bare land back in the 1940's. At a minimum, the application shall contain the following information where applicable. (Application available from Administrator): 1. Name, address and phone number of applicant; 2. Name, address and phone number of owner of subject property; 3. Legal description of property; 4. Proof of ownership of subject property; 5. Description of existing use; 6. Present use of subject property; 7. Proposed use of the subject property; 8. Twenty-Five (25) copies of a vicinity map of a scale of one (1) inch equals three hundred (300) feet; 9. Characteristics of subject property which make a conditional use desirable; l0. A listing of the mailing addresses of all property owners (from authentic tax records of Ada County) who are within three hundred {300) feet of the external boundaries of the land being considered, and a list of all owners within the area being considered for a Conditional Use; 11. A fee established by the Council; $275.00 + $1.29 each for certified mailings for each property owner listed within the 300 feet = Total Fee. 12. The property will be posted l week before hearing stating they have applied for a Conditional Use Permit or Zoning. There must be a signed affidavit that this has been done as part of the application. n HEARING PROCEDURES FOR CONDITIONAL USE PERMIT i. The Commission Shall: a. Conduct at least one public hearing at which interested persons will have the opportunity to be heard. At least 1.5 days prior to hearing notice of the time and place shall be published in newspaper. b. Within 45 days after hearing the Commission, shall transmit its recommendation to the Council with supportive reasons, the Commission shall recommend the application be approved, approved with conditions or denied. The Commission shall insure that any approval is in accordance with the Comp. Plan, this Ordinance and State Law. 2. The Council: a. The Council shall conduct one public hearing after notice requirements as above. b. After hearing the Council shall approve, approve with conditions or deny, with supportive reasons. c. A Conditional Use Permit in the old town district only requires a public hearing before the P & Z Commission and then is passed on to the Council with the recommendation at which time the Council may approve, deny or modify the recommendation of the Commission. 3. FOR APPLICANTS INFORMATION: Additional water and sewer hookup fees could be required as part of the approval of the Conditional Use Permit. ~ ~ 2-417 E The City Council is hereby. authorized to adopt, by resolution, rules governing the creation, form, recording, modification, enforcement and termination of commitments. 2-418 CONDITIONAL USE 2-418 A GENERAL The Commission shall hold a public hearing on .each Conditional Use application. The Commission shall recommend approval, or approve with conditions, or deny a Conditional Use application under the conditions as herein speci~ied and consider such addi- tional safeguards as will uphold the intent of this Ordinance. B CONTENTS OF CONDITIONAL USE APPLICATION An application for a conditional use permit shall be filed with the Administrator by the owner of the property for which such conditional use is proposed. At a minimum the application shall contain the following information: (Application available from Administrator.) 1. Name, address and phone number of applicant. 2. Name, address and phone number of owner of subject property. 3. Legal description of property. 4. Proof of ownership of subject property. 5. Description of existing use. 6. Present use of subject property. 7. Proposed use of the subject property. 8. The District that pertains to the subject property. 9. Thirty (30) copies of a vicinity map of a scale of one inch equals three hundred feet (1" = 300'). 10. Characteristics of subject property which make a conditional use desirable. 11. A listing of the mailing addresses of all property owners (from authentic tax records of Ada County) who are within three hundred feet (300•) of the external boundaries of the land being considered, and a list of all owners within the area being considered for a conditional use. 193 -79- ;~ 12. A fee established by the Council. 13. A statement that the applicant or the user of the property agrees to pay any additional sewer, water or trash fees or charges, if any, associated with the use, whether that use be residential, commercial or industrial. 14. The application shall be verified by the applicant which shall state that he has read the contents thereof and verifies that the information contained therein is true and correct. 2-418 C GENERAL STANDARDS APPLICABLE TO ALL CONDITIONAL USES The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following and shall find adequate evidence showing that such use at the proposed location: 1. Will, iri fact, constitute a conditional use as determined by City policy; 2. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; 3. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; 4. will not be hazardous or disturbing to existing or future neighboring uses; 5. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; 6. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; 7. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; 193 -8~- i'~, i"~ 8. will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; and 9. will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 2-418 D SUPPLEMENTARY CONDITIONS AND SAFEGUARDS In approving any Conditional Use, the Commission and Council may prescribe appropriate conditions, bonds and safeguards in conformity with this Ordinance. Violations of such conditions, bonds or safeguards, when made a part of the terms under which the Conditional Use is granted, shall be deemed a violation of the Ordinance and grounds to revoke the Conditional Use. The Commission and Council may prescribe a set time period for which a Conditional Use may be in existence. 2-418 E PROCEDURE FOR HEARING AND NOTICE Prior to approving a Conditional Use Permit, the applicant and the Commission. and Council shall follow notice and hearing procedures provided in Section 11-2-416, Zoning Amendment Procedures, of this Ordinance. Provided however, that Conditional Use applications for land in Old Town and in Industrial and Commercial Districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission and after-the recommendation of the Commission is made the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission. 2-418 F ACTION BY THE COMMISSION within forty five (45) days from the hearing, the Commission shall transmit its recommendations to the Council with supportive reasons. The Commission may, however, continue the matter from meeting to meeting if it finds that .it does not have sufficient information to make a decision. The Commission shall recommend that the application be approved, approved with conditions or denied.
