APPLICATION FOR A VARIANCE
FROM THE SIDE YARD SET-BACK RE UIREMENTS

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled variance request having come on for
consideration on February 15, 1994, at approximately 7:30 o'clock
p.m. on said date, at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, the Petitioners appearing through Becky Bowcutt,
and the City Council having heard and taken oral and written
testimony, the City Council of the City of Meridian makes the
following:
FINDINGS OF FACT
1. That notice of the public hearing on the variance was
published for two consecutive weeks prior to the scheduled hearing
for February 15, 1994, the first publication of which was fifteen
(15) days prior to said hearing; that the matter was duly
considered at the February 15, 1994, hearing; that copies of all
notices were available to newspaper, radio and television stations.
2. That the notice of public hearing is required to be sent
to property owners within 300 feet of the external boundaries of
the land being considered pursuant to 11-2-416 E., 11-2-419 D., and
11-9-612 B. l.b. of the Revised and Compiled Ordinances of the City
of Meridian; that this requirement has been met.
3. That Ordinance 11-2-410 A, .ZONING SCHEDULE OF BULK AND
COVERAGE CONTROLS, requires that residential structures in the R-4,

R-8, R-15 zoning district, be set back on the side yard lines 5
feet from the property boundary on which a structure is to be
built.
4. That the Applicant is requesting they be granted a
variance from the above side yard set back requirement and be
allowed to have zero lot lines for patio homes and have applied, in
another application, to have the property zoned R-15 Residential
from the existing R-4 Residential zone; this is what was
represented to the Planning and Zoning Commission at the rezone
hearing; at the City Council hearing Applicant stated they now want
some duplexes on the lots.
5. That 0-lot lines are not specifically allowed under the
Zoning Ordinance but they are addressed in the R-15 description in
11-2-408 B 5. as follows:
(R-151 Medium High Density Residential District: The purpose
of the (R-15) District is to permit the establishment of
medium-high density single-family attached and multi-family
dwellings at a density not exceeding fifteen (15) dwelling
units per acre. All such districts must have direct access to
a transportation arterial or collector, abut or have direct
access to a park or open space corridor, and be connected to
the Municipal Water and Sewer systems of the City of Meridian.
The predominant housing types in this district will be patio
homes, zero lot line single-family dwellings, town houses,
apartment buildings and condominiums.
6. The property in question is described in the application
which is incorporated herein as if set forth in full; the property
is approximately 1/2 mile east of Linder Road on the south side of
Franklin Road, Meridian, Ada County, Idaho.
7. That the Applicant initially proposed to construct some
single family dwellings and mostly patio homes on the lots, each

dwelling to have a two car garage.
8. The Applicant initially planned 26 lots in his rezone
application and in the variance application desired that the lots
receive a 0-lot line variance from the existing set-back ordinance.
Becky L. Bowcutt, Land Use Planner with Briggs Engineering, Inc.
testified that each patio home will be sold as a single family
home, and would meet the front and rear setbacks and one of side
yard setbacks.
9. That originally it was proposed for 26 lots, designed for
patio homes, but because of the odd shape of the parcel, the
developer asked at the Council's public hearing for five (5)
additional units, to include a duplex on one large lot. The R-15
would allow this but the units would be more that what was applied
for and represented at the Planning and Zoning hearing on the
rezone; instead of 4.6 units to the acre it's now approximately 5.5
units per acre.
10. The Applicant's representative indicated at the Planning
and Zoning hearing that there would only be single family dwellings
even though zoned R-15; that the City R-15 Ordinance allows the
2,400 square foot lots but they have an odd size parcel which they
would now like to put a duplex on; and applicant further stated
there would be no disruption of the irrigation water.
11. Ralph Patey and Mr. Kent Shepard testified at the hearing
but their testimony did not relate to the variance issue, only to
the rezone and plating of this property.

CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City has authority to grant variances pursuant
to Section 11-2-419 of the Zoning Ordinance and pursuant to Section
11-9-612 of the Development Ordinances.
3. That the City Council has judged this application by the
guidelines, standards, criteria, and policies contained in the
Zoning Ordinance and upon the record submitted to it and the things
upon which it may take judicial notice.
4. That the Council may take judicial notice of its own
proceedings, those of the Commission, governmental statutes,
ordinances, and policies, and of actual conditions existing within
the City and the State.
5. It is concluded that under 11-2-408 B. 5. 0-lot lines are
contemplated; that the Zoning Ordinance does not speak to 0-lot
lines however and so the Applicant did"need to apply for a
variance.
6. That if the rezone is not granted it appears that the
variance may not be able to be granted since 0-lot lines are only
discussed in the R-15 zoning district.
7. That the following provisions of Section 11-2-419 A, of
the Zoning Ordinance are noted which is pertinent to the

Application:
11-2-419 A.
The Council may authorize in specific cases a variance
from the terms of this Ordinance or from the Subdivision
and Development Ordinances as will not be contrary to the
public interest where, owing to special conditions, a
literal enforcement of the provisions of this Ordinance
would result in unnecessary hardship. No non-conforming
use of neighboring lands, structures or buildings in the
same district and no permitted or non-conforming use of
lands, structures or buildings in other districts shall
be considered grounds for issuance of a variance.
Variances shall be granted only where strict application
of the provisions of this Ordinance would result in
unnecessary hardship. A variance application does not go
to the Commission unless directed by the Council.
8. That the specific requirements regarding a variance
that must be evidenced and found by the City Council are as
follows:
11-2-419 C. FINDINGS
A variance shall not be granted unless (as a result of a
public hearing) the Council makes a statement of
supportive reasons based directly on the evidence
presented to it which supports conclusions that the
mentioned standards and conditions of this Ordinance have
been met by the applicant and unless all of the following
exist:
1. That there are such special circumstances
or conditions affecting the property that the
strict application of the provisions of this
Ordinance would clearly be impracticable or
unreasonable;
2. That strict compliance with the
requirements of this Ordinance would result in
extraordinary hardship to the owner,
subdivider or developer because of unusual
topography, other physical conditions or other
conditions which are not self-inflicted, or
that these conditions will result in
inhibiting the achievements or the objectives
of this Ordinance;

3. That the granting of the specified
variance will not be detrimental to the
public's welfare or injurious to other
property in the area in which the property is
situated;
4. That such variance will not have the
effect of altering the interest and purpose of
this Ordinance and the Meridian Comprehensive
Plan.
9. That there does appear to be a specific benefit or
profit, economic gain or convenience to the Applicant because the
Ordinances of the City do not allow 0-lot line development,
specifically, and Applicant presented no evidence to the Council
that there was extraordinary hardship to the owner, subdivider or
developer because of unusual topography, other physical conditions
or other conditions which are not self-inflicted, or that the set
back requirements would result in inhibiting the achievements or
the objectives of this Ordinance.
10. That regarding Section 11-2-419 C, in conjunction with
the wording of 11-2-408 B. 5., it is specifically concluded as
follows:
a. That there are special circumstances or conditions
affecting the property that the strict application of the
provisions of the set back Ordinance would clearly be
unreasonable since 0-lot lines are mentioned as an
applicable use in the R-15 zone.
b. That strict compliance with the requirements of the
set back Ordinance would not result in extraordinary
hardship to the applicant as a result of factors not
self-inflicted but since O-lot lines are mentioned as an
applicable use in the R-15 zone it would be unnecessary
hardship to deny the use and granting of the variance
would not unduly change the area.
c. That the granting of the specified variance would not
be detrimental to the public's welfare or injurious to
other property in the area in which the property is

situated.
d. That such variance would not have the effect of
altering the interests and purposes of the set back
Ordinance or the Meridian Comprehensive Plan since 0-lot
lines are mentioned as a predominant housing type in the
R-15 district along with patio homes, dwellings,
townhouses, apartment buildings and condominiums.
11. That it is concluded the Application should be granted.
APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS
The City Council of the City of Meridian does hereby adopt
and approves these Findings of Fact and Conclusions.

Alidjani: Mr. Chairman, for the record I have a conflict of
interest.
Johnson: For the record you have a conflict of interest. We won't
ask you to vote. Is there any discussion concerning the Findings
of Fact and Conclusions of Law as prepared by the City Attorney?
Shearer: Oh no, I don't want to do this one.
Rountree: Mr. Chairman, I make the .motion that the Meridian
Planning and Zoning Commission hereby adopts and approves these
Findings of Fact and Conclusions of Law.

Conclusions of Law as prepared by the City Attorney, roll call

Shearer: Could I have a little discussion on this? We've got
these zero lot lines in this property in which we are going to have
buildings abutting buildings and I know we talked about it a little
bit before. I'm concerned that the lots will be sold separate or

something and then we end up with a zero lot line between 2 lots
and who knows what is going to be built unless it is all handled by
one person. There seems like there should be some restrictions on
that and I don't remember seeing any in the Findings of Fact and
Conclusions of Law. This is one where we could have.
Johnson: Item #9 on page 7 addresses zero lot line.
Rountree: And I think the subdivision ordinance itself would take
care of a number of those concerns. '
Johnson: I remember our discussion on this and I believe it was
Commissioner Hepper who brought it up.
Hepper: Could we put something in there that maybe they not share
any common walls. Or have a minimum distance between the buildings
even though there is a zero lot line.
Shearer: .Well, I think this project really should have come up to
us as a PUD planned unit development. I assume that possibly the
owner of this subdivision is planning on having the construction
done and selling after the construction, but what is to guarantee
that is going to happen. Two people buy individual lots and live
next door to each other, the lots are pretty small to be building
without building against 1 lot line. I am pretty uncomfortable
with it we could get ourselves into a
Johnson: Is there any further discussion, we have a motion and a
second.
Rountree: I don't know if the developer is this evening, but maybe
we could that question of them if they are.
Bowcutt: Becky Bowcutt, Briggs Engineering, the applicant couldn't
be here this evening. The developers of the subdivision are
builders, they are the Christensen brothers and they are planning
on building the subdivision themselves. The lots will not be
marketed individually and I can see your concern. If they abandon
a zero lot line concept would the lots be wide enough to
accommodate a single family dwelling and meet the applicable-set
backs. They plan on building these structures by themselves. I
think one way that you could add a condition that might make you
feel a little bit more comfortable with this is possibly putting
some type of a design review condition which I think you placed on
another subdivision that you had some concerns about the type of
structures.
Johnson: Do you think that will alleviate your concerns Mr.
Shearer?

Shearer: Yes, and as long as one person is building the buildings
and selling afterwards I'm not that concerned about it but I guess
my concern is maybe if the developer got part way through and was
in a money crunch and something and decided to sell these lots then
we would have some
Johnson: Well perhaps that is a suggestion, a design review
condition, but we do have a motion we do need to vote on the motion
or have it withdrawn.
Rountree: Mr. Chairman, I'd like to withdraw my motion, and make
another motion. I move that the Meridian Planning and Zoning
Commission hereby adopts and approves these Findings of Fact and
Conclusions of Law with the stipulation added that the dwelling
units be subject to design review by the City of Meridian.
Shearer: I'll second that
Johnson: Its moved and seconded that to approve Findings of Fact
and Conclusions of Law with the stipulation that the dwelling units
be subject to design review by the City of Meridian staff, roll

Rountree: Mr. Chairman, I move the Meridian Planning and Zoning
Commission hereby recommends to the City Council of the City of
Meridian that the City Council approve the requested annexation and
rezoning that as a condition of rezoning the applicant meet the
terms and conditions of these Findings of Fact and Conclusions of
Law including the comments of the City Engineer, water and sewer
requirements, the Fire safety codes and all other Ordinances of the
City of Meridian shall be met and complied with and all irrigation
facilities must be maintained such that they continue to drain
water as it was a part of the development and if there are
irrigation (inaudible) or other means of conveying water located
on the property that they be tiled.

These projects are both infill development projects which need flexible
design considerations to be successful along Franklin Road or within the Old Town
District.
Our current Ordinance does allow residential dwellings to share common
walls however, it does not allow zero lot line development. Zero lot line type
development refers to placing the side of a structure right on the sideyard property
line. In essence, one side of a building or perhaps both sides of a building are right
on the property line. There is no sideyard setback. Most townhouse projects use
the zero lot line concept. Our current Ordinance is deficient regarding zero lot
line, townhouse and condominium developments because they require a minimum
5 yard setback.
I recommend that the Council approve these 2 variance requests with the
condition that the revisions which are now underway to the Meridian Zoning and
Development Ordinance include a section on zero lot line development to allow
unique types of housing construction within our community.

12. The property is an infill parcel which has development to the east, west and along
southern boundary. The parcel has an irregular shape. The developer intends to
construct patio homes with a zero lot line between structures. The development
will be targeted toward senior citizens who desire a small yard and affordable
housing. A patio home with a zero lot line would be similar to a duplex in lot
design.
13. The ordinance requires a 5 foot side yard setback. There are no provisions under
the Meridian Zoning Ordinance for a zero lot line development.
14. If this variance or waiver is not granted, single family dwellings would be the only
alternative. With the irregular shape of the parcel, the number of lots would be
substantially reduced. The lots are deep because of the irregular shape and
therefore an increase in lot width would defeat the intent to provide smaller lots for
senior citizens.
15. The ordinance should provide an avenue for zero lot lines in subdivisions to
provide a variety of housing needs.
16., 17., The parcel has multi-family structures (4-plexes) along the east boundary and
18. duplexes to the west. Tt~e proposed zero lot line concept is not foreign to this
area. This request is more a waiver from a standard where a deficiency exists in
the zoning ordinance than a variance.

This letter is in regard to the above mentioned subdivision. An Application for
Variance has been submitted for the project. The City of Meridian requires a 5
foot per story side yard setback on a dwelling unit. The proposed single family
patio homes will have one common wall, similar to a duplex. Each patio home will
be sold as a single family home and will reside on its own lot with a yard. This
application is necessary because the Meridian Zoning Ordinance has no provisions
for a zero lot-line concept. This type of development is common in the Treasure
Valley area and provides an alternative to the traditional with 5 foot side yard
setbacks on both sides of the home.
