Final Occupancy Requirements
In order for the Ada County Highway District to approve the final
occupancy of the above noted project, the following conditions must
be completed.
1. As provided in ACHD Site Specific Requirements on subject
development and Larry Sale's January 30, 1995 letter to you, the
District required dedication of right-of-way along the Meridian
Road and along the proposed Corporate Drive frontage.
2. Provide a deposit of $7,369.50 to the Public Rights -Of -Way
Trust Fund for 1.50 -feet of raised median on E. 1st Street to
enforce right-in/right-out only access and 5 -foot wide sidewalk
along the Meridian Road, Corporate Drive, and the remaining E. 1st
Street frontages. This amount will be reduced to $6,477.00 if the
sidewalk along the E. 1st Street frontage of Bolo's Restaurant is
constructed.

The City of Meridian requested curb, gutter and sidewalk be constructed as a condition of this
development. As Meridian Road design is 95% complete and construction should begin in the
near future (1996?), elevations should be available to the point of allowing sidewalk construction.
In addition, Meridian will require a sidewalk along East First Street. Properties on the west side
of East First Street are now in the process of development all the way north past Gem Avenue
(Les Schwab site). Meridian expects all of this development to provide pedestrian walkways and
will not allow occupancy without such walkways.
Would you please respond in writing as soon as possible as to what ACHD's plans are at this
time and state reasons, if any, pedestrian walkways cannot be constructed at this time. Every
discussion I have had -- from the owner, engineer and contractor -- has been different, so I
would like an official response from you. Taco Bell and Bolo's will not receive occupancy
permits until we have received your response and can condition the development. I would not
be adverse to allowing only asphalt walkways at this time, but that would be the City's minimum
allowance. In addition, the borrow ditches will need to be filled in and landscaped appropriately.

FACTS & FINDINGS:
1. Jonathan Gibbs is seeking conditional use approval to con-
struct a Taco Bell Restaurant located on the east side of
Meridian Street and the west side of E. 1st Street, approxi-
mately 350 -feet north of their intersection. There are no new
streets planned as part of this development. ACHD is in the
design stage for a new public street which will abut the north
property line of this parcel.

3. A new public street is proposed by ACRD to connect Meridian
Street with E. 1st adjacent to the north property boundary of
this parcel. The new roadway project will encompass the inter-
sections and therefore the frontages on E. lst and Meridian
Street. Additional right-of-way may be required along the
north property boundary and along E. 1st and Meridian Street
for this project. Coordinate right-of-way requirements with
District Staff.
4. Two shared access points with the Kentucky Fried Chicken Res-
taurant to the south are proposed for this project, one each
on E. 1st and Meridian. Staff concurs with these locations.
5. This application is scheduled for public hearing by the Meridi-
an Planning & Zoning Commission on October 11, 1994.
The following requirements are provided to Meridian Planning &
Zoning as conditions for approval.
SITE SPECIFIC REQUIREMENTS:
1. Dedicate 60 -feet of right-of-way from the centerline of Meridi-
an Street abutting parcel (5 additional feet). The owner will
be compensated for this additional right-of-way from available
impact fee revenues in this benefit zone.
2. Provide a deposit to the Public Right -of -Way Trust Fund at the
District for the required street improvements (5 -foot side-
walks) on Meridian Street, E. 1st Street, and the proposed new
street.
3. Construct the access point according to the submitted site
plan.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.

2. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACHD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
3. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
4. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
5. Continue existing irrigation and drainage systems across par-
cel.
6. Submit three sets of street construction plans to the District
for review and appropriate action.
7. Submit site drainage plans and calculations for review and
appropriate action by ACRD. The proposed drainage system
shall conform to the requirements of City of Meridian and
shall retain all storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a drainage easement set aside specif-
ically for that use. There shall be no trees, fences, bushes,
sheds, or other valuable amenities placed in said easement.
8. Provide design data for proposed access to public streets for
review and appropriate action by ACRD.
9. Locate driveway curb cuts a minimum of 5 -feet from the side
lot property lines when the driveways are not being shared
with the adjacent property.
10. A right-of-way permit must be obtained from ACRD for all
street and utility construction within the public right-of-

11. A request for modification, variance or waiver of any require-
ment or policy outlined herein shall be made, in writing, to
the Manager of Engineering Services within 15 calendar days of
the original Commission action. The request shall include a
statement explaining why such a requirement would result in
substantial hardship or inequity.

STORMWATER MANAGEMENT
We recommend that the first one half inch of stormwater be
pretreated through a grassy swale prior to discharge to the
subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of
this project should obtain current best management practices for
stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public hearing
October 11, 1994, at the hour of 7:30 o'clock p.m., the Petitioner
appearing through the project's representative, Ron Thurber, the
Planning and Zoning Commission of the City of Meridian having duly
considered the evidence and the matter makes the following
Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for October 11, 1994, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the October 11, 1994,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations.
2. That the property is located within the City of
Meridian; the property is described in the application which
description is incorporated herein.

3. That the property is zoned C -G, General Service and
Retail Commercial, which requires a conditional use permit for a
drive through window facility which the application requests,
using loudspeakers.
4. That the C -G District is described in the Zoning
Ordinance, 11-2-408 B. 9. as follows:
(C -G) GENERAL RETAIL AND SERVICE COMMERCIAL:
The purpose of the (C -G) District is to
provide for commercial uses which are
customarily operated entirely or almost
entirely within a building; to provide for a
review of the impact of proposed commercial
uses which are auto and service oriented and
are located in close proximity to major
highway or arterial streets; to fulfill the
need of travel -related services as well as
retail sales for the transient and permanent
motoring public. All such districts shall be
connected to the Municipal Water and Sewer
systems of the City of Meridian, and shall
not constitute strip commercial development
and encourage clustering of commercial
development.
5. That the use proposed by Applicant is a specifically
allowed conditional use in the Zoning Schedule of Use Control, 11-
2-409 B.
6. That the property is vacant and has no present use; that
the property to the southeast is the Kentucky Fried Chicken
Restaurant; that the property to the north is a vacant building
that has been used for truck sales and repair.
7. That the abutting properties are used for commercial
purposes.

8. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
given and followed.
9. That sewer and water is available to the property, but
the property will have to comply with the commercial sewer and
water rates.
10. That the City Planning Director commented as to the City
Ordinance requiring 19' parking spaces including three handicapped
spaces visibly marked with an eight -foot access aisle; a 25'
driveway aisle, as well as ACHD right-of-way and entrance
corridors; five-foot (51) sidewalks are required; and
communications system volume must not impact adjoining properties
and encourages telephones rather than loudspeakers.
11. That the City Engineer did not file comments on the
Conditional Use Application, but if he does prior to the City
Council hearing they will be incorporated herein as if set forth
in full; that the Meridian Fire Department commented that all
codes, water and hydrant requirements will have to be met; the Ada
County Highway District submitted comments and are incorporated
herein; the Central District Health Department's comments refer to
stormwater management; that the Nampa & Meridian Irrigation
District submitted comments referring to surface drainage being
retained on site and recommending irrigation water be made
available to all developments within the District and the District
requires that a Land Use Change/Site Development application be
filed for review prior to final platting.

12. That there was no testimony objecting to the
application.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property;
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian;
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of
the Revised and Compiled Ordinances of the City of Meridian,
Idaho;
4. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:

a. The use, would in fact, constitute a
conditional use and a conditional use permit
is required by ordinance.
b. The use should be harmonious with and in
accordance with the Comprehensive Plan but
the Zoning Ordinance requires a conditional
use permit to allow the use.
C. The use apparently would be designed and
constructed, to be harmonious in appearance
with the intended character of the general
vicinity.
d. That the use would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive
additional requirements at public cost for
public facilities and services and the use
would not be detrimental to the economic
welfare of the community.
g. The use would not involve a use,
activity, process, material, equipment or
conditions of operation that would be
detrimental to person, property or the
general welfare by reason of excessive
production of traffic or noise.
h. That sufficient parking for the property
and the proposed use will be required.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major
importance.
5. That all ordinances of the City of Meridian must be
met, including but not limited to, the Uniform Building Code,
Uniform Fire Code, Uniform Plumbing Code, the Fire and Life Safety
Codes, all parking and landscaping requirements.

SUBJECT: Request for a Conditional Use Permit to Allow a Drive-thru Window -
Taco Bell by Jonathan Gibbs
I have reviewed the proposed Taco Bell site plan and have the following comments:
City Ordinance requires a 19' parking space with a 25' driveway aisle. Parking design
must ensure landscaping will not be damaged by bumper overhang.
2. City Ordinance requires a minimum of one 3" caliper tree per 1,500 square feet of paved
area. Final landscape design will be reviewed as part of building permit application.
3. The proposed parking area cannot be closer than four feet (4') to the required road right-
of-way per City Ordinance. This is of particular concern in order that landscaping
remains if ACHD wipes out the landscape area shown during future roadway
construction. As Meridian Road and East First Street are both designated as entrance
corridors, the City encourages a 35' landscape setback. Any encroachment into ACHD
right-of-way will need ACHD approval, with evidence of this submitted to the City.
4. Five-foot (5') sidewalks are required to be constructed prior to obtaining a Certificate of
Occupancy. Deposit into the ACHD trust fund for sidewalk construction is not
acceptable.
5. Design and placement of signs has not been shown.
6. A total of 18 parking spaces is required for the Taco Bell portion of the development.
If the proposed restaurant shown is one level and of the approximate dimensions shown,
16 additional spaces would be required, for a total of 34 required (per City Ordinance).
As a total of 70 parking spaces is shown, it would appear parking spaces could be
reduced to allow for additional landscaping. Three handicapped parking spaces would
be required, one of which must be marked and signed as van accessible with an eight -foot

3. A new public street is proposed by ACHD to connect Meridian
Street with E. 1st adjacent to the north property boundary of
this parcel. The new roadway project will encompass the inter-
sections and therefore the frontages on E. 1st and Meridian
Street. Additional right-of-way may be required along the
north property boundary and along E. 1st and Meridian Street
for this. project. Coordinate right-of-way requirements with
District Staff.
4. Two shared access points with the Kentucky Fried Chicken Res-
taurant to the south are proposed for this project, one each
on E. 1st and Meridian. Staff concurs with these locations.
5. This application is scheduled for public hearing by the Meridi-
an Planning & Zoning Commission on October 11, 1994.
The following requirements are provided to Meridian Planning &
Zoning as conditions for approval.
SITE SPECIFIC REQUIREMENTS:
1. Dedicate 60 -feet of right-of-way from the centerline of Meridi-
an Street abutting parcel (5 additional feet). The owner will
be compensated for this additional right-of-way from available
impact fee revenues in this benefit zone.
2. Provide a deposit to the Public Right -of -Way Trust Fund at the
District for the required street improvements (5 -foot side-
walks) on Meridian Street, E. 1st Street, and the proposed new
street.
3. Construct the access point according to the submitted site
plan.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.

2. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACHD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
3. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
4. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
5. Continue existing irrigation and drainage systems across par-
cel.
6. Submit three sets of street construction plans to the District
for review and appropriate action.
7. Submit site drainage plans and calculations for review and
appropriate action by ACHD. The proposed drainage system
shall conform to the requirements of City of Meridian and
shall retain all storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a drainage easement set aside specif-
ically for that use. There shall be no trees, fences, bushes,
sheds, or other valuable amenities placed in said easement.
8. Provide design data for proposed access to public streets for
review and appropriate action by ACHD.
9. Locate driveway curb cuts a minimum of 5 -feet from the side
lot property lines when the driveways are not being shared
with the adjacent property.
10. A right-of-way permit must be obtained from ACHD for all
street and utility construction within the public right-of-

11. A request for modification, variance or waiver of any require-
ment or policy outlined herein shall be made, in writing, to
the Manager of Engineering Services within 15 calendar days of
the original Commission action. The request shall include a
statement explaining why such a requirement would result in
substantial hardship or inequity.

STOR4WATER MANAGEMENT RECOMMENDATIONS
We recommend that the first one half inch of stormwater be
pretreated through a grassy swale prior to discharge to the
subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of
this project should obtain current best management practices for
stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public hearing
October 11, 1994, at the hour of 7:30 o'clock p.m., the Petitioner
appearing through the project's representative, Ron Thurber, the
Planning and Zoning Commission of the City of Meridian having duly
considered the evidence and the matter makes the following
Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That 'a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for October 11, 1994, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the October 11, 1994,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations.
2. That the property is located within the City of
Meridian; the property is described in the application which
description is incorporated herein.

3. That the property is zoned C -G, General Service and
Retail Commercial, which requires a conditional use permit for a
drive through window facility which the application requests,
using loudspeakers.
4. That the C -G District is described in the Zoning
Ordinance, 11-2-408 B. 9. as follows:
(C -G) GENERAL RETAIL AND SERVICE COMMERCIAL:
The purpose of the (C -G) District is to
provide for commercial uses which are
customarily operated entirely or almost
entirely within a building; to provide for a
review of the impact of proposed commercial
uses which are auto and service oriented and
are located in close proximity to major
highway or arterial streets; to fulfill the
need of travel -related services as well as
retail sales for the transient and permanent
motoring public. All such districts shall be
connected to the Municipal Water and Sewer
systems of the City of Meridian, and shall
not constitute strip commercial development
and encourage clustering of commercial
development.
5. That the use proposed by Applicant is a specifically
allowed conditional use in the Zoning Schedule of Use Control, 11-
2-409 B.
6. That the property is vacant and has no present use; that
the property to the southeast is the Kentucky Fried Chicken
Restaurant; that the property to the north is a vacant building
that has been used for truck sales and repair.
7. That the abutting properties are used for commercial
purposes.

8. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
given and followed.
9. That sewer and water is available to the property, but
the property will have to comply with the commercial sewer and
water rates.
10. That the City Planning Director commented as to the City
Ordinance requiring 19' parking spaces including three handicapped
spaces visibly marked with an eight -foot access aisle; a 25'
driveway aisle, as well as ACHD right-of-way and entrance
corridors; five-foot (51) sidewalks are required; and
communications system volume must not impact adjoining properties
and encourages telephones rather than loudspeakers.
11. That the City Engineer did not file comments on the
Conditional Use Application, but if he does prior to the City
Council hearing they will be incorporated herein as if set forth
in full; that the Meridian Fire Department commented that all
codes, water and hydrant requirements will have to be met; the Ada
County Highway District submitted comments and are incorporated
herein; the Central District Health Department's comments refer to
stormwater management; that the Nampa & Meridian Irrigation
District submitted comments referring to surface drainage being
retained on site and recommending irrigation water be made
available to all developments within the District and the'District
requires that a Land Use Change/Site Development application be
filed for review prior to final platting.

12. That there was no testimony objecting to the
application.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property;
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian;
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of
the Revised and Compiled Ordinances of the City of Meridian,
Idaho;
4. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:

a. The use, would in fact, constitute a
conditional use and a conditional use permit
is required by ordinance.
b. The use should be harmonious with and in
accordance with the Comprehensive Plan but
the Zoning Ordinance requires a conditional
use permit to allow the use.
C. The use apparently would be designed and
constructed, to be harmonious in appearance
with the intended character of the general
vicinity.
d. That the use would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive
additional requirements at public cost for
public facilities and services and the use
would not be detrimental to the economic
welfare of the community.
g. The use would not involve a use,
activity, process, material, equipment or
conditions of operation that would be
detrimental to person, property or the
general welfare by reason of excessive
production of traffic or noise.
h. That sufficient parking for the property
and the proposed use will be required.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major
importance.
5. That all ordinances of the City of Meridian must be
met, including but not limited to, the Uniform Building Code,
Uniform Fire Code, Uniform Plumbing Code, the Fire and Life Safety
Codes, all parking and landscaping requirements.

Rountree: Is there someone here for the applicant, I will open the hearing.
Roen Wilson, 1567 Leslie Way, was sworn by the City Attorney.
Wilson: It just says here this will be an antique store, it will be an antique and collectible
store. Diane Lang has been involved in this business for some time and she does a first
class operation. It would really be a great addition to the area. This property is adjacent
to the alley directly across from the post office. ACHD recommended or suggested that
the alley be paved as far back as this piece of property goes. That is fine, however we are
finding out that it is a little difficult to get an engineer to come right out there right away to
address the requirements and we are running into the winter. We would just like to ask
that a little time be allowed to get the paving done in case we have a big freeze and they
can't do it in the middle of winter. Are there any questions?
Rountree: No questions here, you might want to come back if some do come up. Anybody
in attendance want to address this? Seeing none I will close the hearing.

Ronald Thurber, 111 S. 6th, Boise, was sworn by the City Attorney.
Thurber: Gentlemen, you have before you a request for a conditional use permit for a
Taco Bell development, 1 1/2 acres. The zoning is in place for what we are requesting,
the fact that we are putting in a drive in window does require a conditional use permit. We
have reviewed the conditions placed by our Planning and Zoning Administrator Shari
Stiles, we agree with her findings of fact and would abide by her findings. Are there any
questions?
Johnson: Any questions at all?
Shearer: I have one, we have over the past 10 years have done a lot of work to upgrade
downtown Meridian and Corporate Park up there has done a lot of landscaping. As I am
sure you are aware this piece of property and Kentucky Fried Chicken property has a 20
foot weed easement between the road and their property. I am quite concerned with what
you will do in the way of landscaping to bring so that we don't have a weed patch off your
property in your right of way?
Thurber: You will find in your packet the landscape plan that was prepared by Tom South,
landscape architect, if you don't have one (End of Tape). Here is the landscape plan, the
strip over on the East 1 st Street has presently a large (inaudible) which is full of weeds
and we are filling that and we are landscaping as you can see with an automatic sprinkler
system. Any other questions?
Hepper: We have seen several proposals for this new road that you have proposed here
from Ada County Highway District, is this the final draft.
Thurber: This is their latest and greatest, they are doing a fairly large take there and yes
that is correct.
Hepper: You will have curb, gutter and sidewalk (inaudible)
Thurber: Yes sir
Johnson: Are you involved only with the Taco Bell and not the other planned
development?
Thurber: That is correct.

Johnson: I will now open the public hearing, if there is a representative for NEB -i or D &
B Supply would they please come forward at this time.
Dick Schrandt, 2110 Idaho Avenue, Caldwell, was sworn by the City Attorney.
Schrandt: Tonight we are looking for an affirmative vote from the Commission to allow for
the construction of a retail store east of the corner of Fairview and Locust Grove. At this
point in time we have met all the requirements required by the City without any significant
deviation including some additions to the drawings that you have already been given.
Where we have included more trees in the internal part of the parking lot of the store, we
have provided more screening on the south side of the property on Wilson Lane. We have
also met with ACHD and have met all of their requirements as well. We have a
development agreement that has been submitted to the City and it is under review right
now to be completed in this next week is our understanding or within this week. We have
reviewed all the City department comments that have been given to us so far and we have
no problems complying with any of those. For a little background on our business D & B
Supply has been doing business in the valley here for over 30 years. We feel that our
business has a lot to offer in the way of products and services for Meridian. We are going
to have a very positive impact on the tax base of Meridian I think. We are anxious to do
business here in Meridian and we are anxious to contribute to the City of Meridian any way
that we can. Unfortunately though the time is of the essence for us now. We need to get
started on construction this fall before we get into any kind of freezing conditions in order
for us to be open next spring. From the drawings that we have given you we hope we
have convinced you that this is going to be a very attractive store. We think it is going to

3. A new public street is proposed by ACHD to connect Meridian
Street with E. 1st adjacent to the north property boundary of
this parcel. The new roadway project will encompass the inter-
sections and therefore the frontages on E. 1st and Meridian
Street. Additional right-of-way may be required along the
north property boundary and along E. 1st and Meridian Street
for this project. Coordinate right-of-way requirements with
District Staff.
4. Two shared access points with the Kentucky Fried Chicken Res-
taurant to the south are proposed for this project, one each
on E. 1st and Meridian. Staff concurs with these locations.
5. The access point on E. 1st Street does not meet the required
460 -feet from a signalized intersection on an arterial road-
way, therefore staff recommends that the developer provide a
deposit of $3,000 to the Public Rights -of -Way Trust Fund for
150 -feet of raised median to enforce right-in/right-out only
access.
6. This application is scheduled for public hearing by the Meridi-
an Planning & Zoning Commission on October 11, 1994.
The following requirements are provided to Meridian Planning &
Zoning as conditions for approval.
SITE SPECIFIC RE UIPY1 ENTS-
1. Dedicate 60 -feet of right-of-way from the centerline of Meridi-
an Street abutting parcel (5 additional feet). The owner will
be compensated for this additional right-of-way from available
impact fee revenues in this benefit zone.
2. Provide a deposit to the Public Right -of -Way Trust Fund at the
District for the required street improvements (5 -foot side-
walks) on Meridian Street, E. 1st Street, and the proposed new
street.
3. Construct the access points according to the submitted site
plan.

4. Provide a deposit of $3,000 to the Public Rights -of -Way Trust
Fund for 150 -feet of raised median on E. 1st Street to enforce
right-in/right-out only access.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.
2. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACRD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
3. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
4. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
5. Continue existing irrigation and drainage systems across par-
cel.
6. Submit three sets of street construction plans to the District
for review and appropriate action.
7. Submit site drainage plans and calculations for review and
appropriate action by ACRD. The proposed drainage system
shall conform to the requirements of City of Meridian and
shall retain all storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a drainage easement set aside specif-
ically for that use. There shall be no trees, fences, bushes,
sheds, or other valuable amenities placed in said easement.
8. Provide design data for proposed access to public streets for
review and appropriate action by ACRD.
9. Locate driveway curb cuts a minimum of 5 -feet from the side
lot property lines when the driveways are not being shared
with the adjacent property.
10. A right-of-way permit must be obtained from ACRD for all
street and utility construction within the public right-of-

11. A request for modification, variance or waiver of any require-
ment or policy outlined herein shall be made, in writing, to
the Manager of Engineering Services within 15 calendar days of
the original Commission action. The request shall include a
statement explaining why such a requirement would result in
substantial hardship or inequity.

I have had discussions the last several days with the City of Meridian Planning and
Building Departments and Ada County Highway District regarding the curb, gutter and
sidewalk, which was indicated on the site plans along First Street in front of Taco Bell
and Bolo's.
After discussions with ACHD, it was agreed that no curb and gutter would be required.
This is do to the fact that First Street is a collector street and ACHD will place the curb
and gutter when street improvements are contructed along this section of the roadway.
Funding for portions of these improvements will come from impact fees previously paid
by developers and builders. The sidewalk, however, is a City of Meridian issue and a
condition of approval for this project. After discussions with Sherry Styles at the City of
Meridian yesterday, it was agreed that the sidewalk would be constructed now and not
bonded for future construction. The sidewalk will not be constructed as indicated on the
approved plan but, will be placed further west closer to the property line. The reason for
this is that the future roadway section for First Street, indicating where curb, gutter and
sidewalk should go, has not yet been by designed by ACHD. We are going to place the
sidewalk closer to the property line so that it does not interfere with present traffic
conditions and fulfills the required condition of approval.
Wright Brothers will construct the sidewalk along the Taco Bell frontage and Bolo's will
subgrade and construct the sidewalk along it's frontage, based on the dividing line as
indicated on the plans.

Kingsford: At this time I will open that public hearing and invite the owner or his designee
to speak first.
Ron Thurber, 111 South 6th Street, Boise, was sworn by the City Attorney.
Thurber: Gentlemen, you have before you the packet on Taco Bell, this is the second
public hearing. The first one for the Conditional Use Permit we have gone through our
zoning is in order. The reason for the Conditional Use Permit is because of the drive in
window. We have worked closely with Shari Stiles, we have reviewed the staff
recommendations and the owner is willing to abide by the recommendations of the staff.
If you have any questions you would like to ask?
Kingsford: Any questions? Thank you, anyone else from the public that would like to offer
testimony on this issue? Seeing none I will close the public hearing.

Corrie: Mr. Mayor I had one question, City Engineer didn't have any comments on this so
there is no problem with you then?
Smith: No Councilman Corrie, the only thing that needs to be finally resolved with their
building permit would be the connection to sanitary sewer.

as prepared for the Planning and Zoning Commission.

Dan Torfin, 250 S. Beechwood, Boise, was sworn by the City Attorney.
Torfin: Mr. Mayor, members of the Council the applications before you tonight pertain a
request for annexation and zoning of 2 parcels of land. The 2 lowers pieces that are
colored in yellow and approval of a preliminary plat for 118 single family units. Phase.5
which is in the lower left hand comer contains 33 lots, we are proposing a little pocket park
that would be developed with playground equipment in that area. We are also proposing
a green belt along the Five Mile Creek which would be on the westerly side of the project.
We are planning sewer and water for all of these phases. Phase 6 which is the middle
piece contains 73 lots on 18.93 acres, those 2 parcels are the annexation parcels. This
phase 6 the Ada County Highway District has approved the plat for all of this and this

The City of Meridian requested curb, gutter and sidewalk be constructed as a condition of this
development. As Meridian Road design is 95% complete and construction should begin in the
near future (1996?), elevations should be available to the point of allowing sidewalk construction.
In addition, Meridian will require a sidewalk along East First Street. Properties on the west side
of East First Street are now in the process of development all the way north past Gem Avenue
(Les Schwab site). Meridian expects all of this development to provide pedestrian walkways and
will not allow occupancy without such walkways.
Would you please respond in writing as soon as possible as to what ACHD's plans are at this
time and state reasons, if any, pedestrian walkways cannot be constructed at this time. Every
discussion I have had -- from the owner, engineer and contractor -- has been different, so I
would like an official response from you. Taco Bell and Bolo's will not receive occupancy
permits until we have received your response and can condition the development. I would not
be adverse to allowing only asphalt walkways at this time, but that would be the City's minimum
allowance. In addition, the borrow ditches will need to be filled in and landscaped appropriately.

To date, several of my comments on this project have not been addressed. I have attached a
copy of my comments for your use. Among other things, five-foot sidewalks are required along
Meridian Road and East First Street. Approvals from the Ada County Highway District and
irrigation district have not been received by this office.
Please submit a revised site plan detailing needed improvements as soon as possible. No
Certificate of Occupancy will be issued until all improvements have been made as requested.
I would appreciate your immediate attention to this matter.

Dear Ms. Stiles:
In response to your letter of April 3, 1995, I have reviewed the matter with Mike Vance of Wright
Brothers Construction and came to the following conclusion. Sidewalks can be placed in the right-
of-way, located as far back from the street as possible to avoid conflict with the future curb
construction by the District. Mr. Vance understands this and has agreed to design and place the
sidewalk in a location that will not be in the way of future street construction. The sidewalk should
be manufactured from portland cement concrete.
It would be extremely helpful if you could attend our Friday morning Technical Review Committee
meetings. We could work out the solutions to questions/problems such as this at the approval stage
and avoid the sense of crises resolution that develops if the problem is delayed this long.
