Dear Ms. Stiles:
On behalf of Gary L. Voigt, we hereby submit the property descn'bed in the attached
application and legal description for preliminary plat approval.
The present land use is pasture and farmland. The proposed land use for the property will
be single family residential and a portion of a school/park site.
The zoning will be R-4 in the City of Meridian when the annexation and zoning process is
complete. This parcel was submitted for annexation and zoning on March 10, 1994.
The proposed Sun Dance Subdivision preliminary plat complies with the Meridian City
Comprehensive Plan, and is located on 97.02 acres and contains 298 building lots designated
for single-family development. This provides a gross density of 3.071ots per acre.
The proposed Sun Dance Subdivision will contain new sanitary sewer and domestic water
mains that will be extended to serve this development. The streets are proposed as public
streets and will conform with Ada County Highway District standards and Meridian City
Ordinance. All sidewalks within the subdivision will be five feet in width. The minimum
square footage of the lots and the minimum square footage of the structures will conform
to the requirements of the Meridian City Ordinance.
The applicant is proposing a four (4) acre site to be set aside at the southeast corner of the
parcel as a future school/park site. This property will be combined with other property at
that location being provided by adjacent landowners for future acquisition by the school
district. Also within the subdivision there will be approxnnately a 1.3 acre homeowners park
and approximately 2.8 acres of common landscaped area.

Jim Merkle, 9550 Bethel Court, Boise, was sworn by the City Attorney.
Merkle: Mr. President, members of the Council, I am here this evening on behalf of G.L.
Voigt the applicant. I am sure you are all familiar with this piece of ground but before we
get started I will back up a little bit. This 97 acre annexation is half way between Locust
Grove and Eagle Road on the south side of Overland Road. It is one of the pieces of
ground that makes the St. Luke's annexation over in this area contiguous with the city
limits. The public hearing for the preliminary plat with Planning & Zoning was heard in
June with the recommendation of approval sent onto the City Council with a condition that
a variance be requested. And I will get into that in a minute. The City Council approve the
annexation of this property on July 5th. (End of Tape) The preliminary plat is for 298
single family residential lots on approximately 97 acres for that gives a gross density of
about 3.076 lots per acre. The applicant is proposing lot sizes with a minimum of 8,000
square foot as required by the R-4 zoning which the annexation request is for also. The
lots are generally between 8,000 and 10,000 square foot however some of the lots in this
proposal are in excess of 10,000 square foot. Home sizes were originally proposed to be
per the ordinance at 1400 square foot, but I am under the impression that the findings
were approve for 1500 square foot and that is acceptable at this time. The applicant is
proposing regarding lof sizes, and this is where the variance comes in, a reduction from
the 80 foot width requirement to 70 foot minimum. Not all the lots would be 70 foot
minimum but that would be a minimum we wouldn't go below that. This reduction is being
requested due to the extent of the open space being provided to set aside, and this is one
item the future school or park site. It is a 4 acre site at the southeast comer of the 97 acre
parcel and it will be coordinated with the school district and city in conjunction with Los
Alamitos subdivision. This is a subdivision southeast that is proposed by Greg Johnson
and then eventually when this piece develops this portion in here will be acquired to bring
the total to about 14 to 16 acres. In the center of this section for a combination school and
park site. In exchange for that dedication and also the common space opening that we
have here we also are providing the main access and utilities into that school site. The
other pieces have residential streets which will tie into the school site on this vicinity. Over
here this piece of ground will have no vehicular access into it. I am sure this piece will
have it but we will provide the main collector, main thoroughfare, main pedestrian access
from Overland into the school site. Sewer for this project will be extended from the future
Five Mile Trunk Sewer Line which right now is about a mile and a hall from this subdivision
up by the railroad tracks in Franklin Road. It is my impression that the St. Luke's people
are putting together a group to finance the extension of the Five Mile Trunk Sewer north
side of the freeway and over the St. Luke's. From that point this developer is prepared to
extend it which is approximately about 1/2 to 3/4 of a mile under the freeway and down to
Overland per the city's facility plan for sewer. In accordance with the highway district we
prepared a traffic study for the subdivision, come up with some requirements for some
additional widening on Overland Road (inaudible) there is an 18 acre parcel we are

stubbing to the Los Alamitos we are stubbing to. I am not sure of the size of this parcel but
1 believe it extends the full 1/2 mile we are stubbing 2 streets into that. We have 2
entrances on Overland and one is the main access into the school site. There is
approximately one, I am not sure of the exact dimension but about a 1 acre to 3/4 acre
homeowners park owned and maintained by the homeowners association. It is not a big
destination park because this will be used by the surrounding subdivisions. Also we have
a space over here that was a little unusable as far as lots are concerned and will be kind
of another landscape enclave if you will. We have submitted a traffic study as required,
submitted it and it was reviewed by the highway district and they have used that study to
come up with their requirements. Streets within the subdivision as typical will be built they
will be public streets built to the highway district standards with 50 foot right of way, 36
foot back to back and 5 foot sidewalks. The collector street coming down the middle of the
property will have a 5 foot meandering sidewalk and 20 foot common landscape lots on
each side in full length from here to here so they can meander the sidewalk somewhat.
The highway district doesn't want too much of a meandering sidewalk but we feel that the
people utilizing the school are we can buffer them from our lots with providing that
landscaping, and or fencing and shrubs and what not and provide a nice little attractive
entrance into the subdivision. As I stated earlier the sewer will be provided through the
offsite extension. The water lines will be extended from existing lines from the west about
a 1/2 mile to a mile to the west. Regarding the City Engineer's and Planning and Zoning
Administrator's comments, 1 have provided a written response to each of their comments
which they have received prior to the Planning and Zoning meeting. A couple of the main
points on Gary's comments are item #1 concerning the lot dimension of R-4. As I stated
we are requesting through a variance basically a lot density transfer to allow a reduction
of the width from the 80 to 70 feet. This is in your new comprehensive Plan and we will
get into this later. It takes about one way to a lot density transfer can be allowed in
exchange for open space and set aside schools and park sites which we are trying to
accomplish in this project. The other requirements of the R-4 the overall density we are
only about 3 lots per acre in gross density, they will be in excess of 8,000 square foot
which is the minimum of R-4, the home sizes will be 1500, 1400 is the minimum in the R-4.
In your packet in the very back I have addressed each of Gary's comments. Also on
Shari's comments #8, she talks about, I would like to point out that some of these
comments these were comments made for preliminary plat when it went through Planning
& Zoning so some things said in here I have responded to and now we are here tonight
requesting a variance for the same thing so it might be a little confusing but if bear with us,
#8 she talks about she would support a lot density transfer in the case that if the site is
donated not merely set aside and my response in my letter to her is that is acceptable if
the preliminary plat is approved as presented here tonight. Another piece of information
you should have in your packet is a copy of a letter from the applicant to Dan Mabe at
Meridian School District. We did have a meeting between a representative of G.L. Voigt's
proposal and one from Marty Goldsmith who is doing Los Alamitos and Greg Johnson was

doing this piece down here. They had a meeting with Dan Mabe to iron out the issues
and location and utilities and access into the site and came up with this concept that each
of the developers will pitch in so to speak their portion of the school site. In Mr. Mabe's
comment to us that day was that this school site will not necessarily be needed until this
section develop outs. So basically the lots in this section are providing their own
elementary school site. In your packet the letter to Dan Mabe of Meridian School District
a response to his comment in his letter to the typical packet that you get that says the
district could not support projects like this without school sites being set aside and
sufficient utilities being provided to the site. I think we have accomplished both of those.
If you would approve the preliminary plat as is and the variance which is the next issue
tonight. With the information presented tonight we would request that you approve this
preliminary plat. If you have any other questions I would be happy to try and answer them.
Corrie: Mr. President, just to make sure in this late hour I am hearing you correctly. Your
minimum size house is going to 1500 square feet?
Merkle: Yes sir
Corrie: And that will be on the final plat as such?
Merkle: Yes
Corrie: It is stated here 1400 and you said 1500.
Merkle: Right, when we went through the annexation at Council the very last minute the
Mayor said it was 1500 not 1400.
Yerrington: Gary, did I understand you right did you say that the school site is being
donated to the school district?
Merkle: In the applicants words if the preliminary plat is presented here tonight the site
can be donated as a condition of that approval that will be acceptable. My understanding
is it is a combination school park site so I am not sure if we donate it to the City or the
school district, whatever the case may be as a condition of approval of this project that
would be acceptable.
Morrow: I would think that would in our best interest to have that donated to the City of
Meridian for the short term and then that property can always be transferred to the school
district. Shari and Gary do you have any comments? Shari, would that satisfy your
concerns on #8. You are comfortable with the density transfer with the donation of the 4
acres?

Groves: I am here tonight to represent the applicant G. L. Voigt in regards to the donation
of the 4 acre site to the City. I don't believe the applicant is going to have any problem
with that. We do have a tentative commitment with the farmer that is is possession right
now. That up until the time that 4 acre site is developed as long as there is enough ground
to farm that we would allow him to continue to farm that. So, I would hope that maybe we
could work that into the deal with the city. Our thoughts were that the school may want to
build a site there in 3 years and although they may want the ground right there today He
would be able to still farm it.
Morrow: As I see it could work one of several ways, it could very well be that we would
desire to use that portion of property for a park and do it in a shorter period of time than
what the school would. I think nonetheless that I don't have a problem with Art farming it
while it is obviously it is going to develop in phases and that development to that point
could take anywhere from 18 months to 8 years.
Groves: In our legal agreement with the farmer is that he has the right to farm the property
until December 31, 1996.
Morrow: Well, I can't make a decision on anything from my perspective by obviously if we
opted to develop before then I would think it would be up to you to buy him out not us.
Groves: Thank you.

Merkle: Again I am here this evening on behalf of G.L. Voigt the applicant. This is kind
of a follow up issue to the previous issue obviously. The variance request in your
application packet is for the lot width reduction from 80 feet to 70 feet. We are meeting
all the other R-4 requirements, home size 1500, 8,000 square foot minimum, density is
only 3 units per acre well within the R-4. The way it was explained to me the variance is
the tool that the city has to allow a lot density transfer for the donation and the provision
of open space and donation of the school/park site.
Crookston: How many lots are you talking about?
Merkle: There are 298 total.
Crookston: How many would the street frontage variance apply to?
Merkle: I tried to figure that out, without doing a complete layout the other way I wouldn't
know exactly but not all the lots are 70 they are mid-70's. The culdesac lots don't apply
they all meet the 40 foot on the chord. I would say that there is 60% of the lots and if you
consider that they are 80 instead of 70 that is 15% of 60% of the lots. I think you are
talking in the range of 20 to 30 of the lots probably. You would lose 20 to 30 lots in here
if you had to go to 80 instead of 70.
Crookston: How many lots are you going to only have 70 to 79.99 street frontage of the
298.
Merkle: How-many have less than 80, again without counting specifically I would say it
only affects 50 to 60% of the lots, they are not all 70 some of them are 76, 78, 74.

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the applicant during the hearing process:
1. Lot dimensional design needs to be revised to meet all the requirements of an R-4 caning
classification.
2. Please indicate the name, address, and phone number of the subdivision developer on the
preliminary plat map.
3. Please define the subdivision phase lines, unless you intend on developing the whole area
as detailed on the preliminary plat map.
4. I would strongly recommend an additional stub street be extended to the east property
boundary from Arapaho Drive.
5. Please consider tightening up the curve on the northerly portion of Washakie Way to
provide a perpendicular intersection with Arapaho Drive.
6. Add a name to the street north-west of Block 3.
7. Contour lines need to be referenced to an established Bench Mark.
8. Please indicate proposed fire hydrant and street light locations on the preliminary plat map.
250 Watt high pressure sodium street lights will be required at the entrances to the
subdivision off Overland Road.
9. You will be required to the the Hunter Lateral, and any other ditches on site per City
Ordinance.

10. Submit a master street drainage plan, including method of disposal & approval from the
affected irrigation/drainage district.
11. Please develop and submit estimates of traffic impact on existing adjacent roadways &
intersections.
12. Determine the seasonal high ground water elevation, and profile the sub-surface soil
conditions.
13. Sewer service to this development will need to be by extension of the 5 Mile Creek
Interceptor project being proposed by St Lukes Hospital.
14. Water service to this property will need to be by extension of a 12 inch diameter water
main in Overland Road currently being constructed by "The playground". A 10 inch
diameter water main will be required in Red Cloud Way through the development. The 10
inch diameter main would extend south into the proposed school/park site, as well as east
to the east subdivision boundary. It would also extend west in Smoky Hill Street and south
on Little Crow Avenue to the south boundary.
15. Water main sizing in this development is subject to change upon completion of the water
system modelling.
16. The sewer system within this development must be designed to provide a minimum of 3
foot depth of cover over the sewer mains.

3. Block lengths exceed 1,000 feet. A stub street is needed to the west, as well as an
additional stub street to the east. A variance application is required if block lengths still
exceed 1,000 feet.
4. Hunter Lateral must be piped in accordance with City of Meridian Ordinance. Nampa-
Meridian Irrigation District must approve of final development plans. Provide evidence
of this prior to submittal of final plat.
5. Submit Ada County Street Name Committee approval letter (all streets do not show
names).
6. Show subdivider name, address and telephone number on plat.
7. Development agreement is required as part of the annexation of this property.
8. Lot density transfer as described in Meridian Comprehensive Plan could apply to this
project I.f and only if, proposed school site is donated, not merely "set aside. " I would
support a lot density transfer in that case. However, all lots must contain a minimum 70'
frontage and minimum 8,000 square foot lot area.
9. Submittal of a Conditional Use Permit application for a planned residential development
would make this "cleaner" and solve some of the problems of lots not meeting R-4
requirements.
With above conditions and comments addressed, and conformance with staff and agency
comments, I would recommend approval of this preliminary plat.

I have reviewed the application for Sun Dance Subdivision find
that it includes approximately 311 homes at the median value of
$150,000. We also find that this subdivision is located in
census tract 103.13 and in the attendance zone for Mary
McPherson Elementary, Lake Hazel Middle School and Meridian
High School.
Using the above information we can predict that these homes, when
completed, will house 128 elementary aged children, 96 middle
school aged children, and 87 senior high aged students. At the
present time Mary McPherson Elementary is at 114 of capacity,
Lake Hazel Middle School is at 121 of capacity and Meridian High
School is at 116 of capacity.
The Meridian School District is not opposed to growth in our
district, however this subdivision will cause increased over-
crowding in all three schools. There is little opportunity to
shift attendance boundaries since the surrounding schools are
also well over capacity. Before we could support this
subdivision, we would need land dedicated to the district or at
least made available at a minimum price for a school site in this
area. The site would need water and sewer service available. In
addition we would need to pass another bond issue for the
construction of schools.
Even if we were willing to use portable classrooms for a year or
two, this project would require six classrooms at the elementary
level, four classrooms at the middle school level and three
classroom at the high school level. To build portables ready to
occupy by students will cost approximately $40,000 each. As you
can see the total for thirteen portables would be $520,000. We
would welcome a meeting with you to find ways of mitigating the
projected costs to the school district.

We are in a difficult position and need your help in dealing with
the impact of growth on schools.

On July 6, 1994, the Commissioners of the Ada County Highway
District (hereafter called "District") took action on the
Preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable
standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and
approval by the District.
2. If public street improvements are required: Prior to any
construction within the existing or proposed public right-of-
way, the following shall be submitted and subject to review
and approval by the District:
a. Three complete sets of detailed street construction
drawings prepared by an Idaho Registered Professional
Engineer, together with payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and
the District together with initial payment deposit for
inspection and/or testing services.
c. Complete all street improvements to the satisfaction of
the District, or execute Surety Agreement between the
Developer and the District to guarantee the completion of
construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by
the Local Government Agency having such authority tocrether
with payment of fee charged for the manufacturing and
installation of all street signs, as required.
4. If Public Rights-of-Way Trust Fund deposit is required, make
deposit to the District in the form of cash or cashier's check
for the amount specified by the District.
5. Furnish easements, agreements, and all other datum or
documents as required by the District.
6. Furnish Final Plat drawings for District acceptance,
certifications, and endorsement. The final plat must contain
the signed endorsement of the Owner's and Land Surveyor's

7. Approval of the plat is valid for one year. An extension of
one year will be considered by the Commission if requested

3. The site is bordered on the southeast by Rim `View Subdivision
and Los Alamitos Subdivision and on the south by proposed
Highland Ranch Subdivision.
4. Four acres of this site are proposed for a portion of a
school/park site. The rest of the school/park site will be
coordinated with neighboring developments.
5. A residential collector standard road (Red Cloud Way) is pro-
posed between Overland Road and the school site. Staff recom-
mends that Red Cloud Way be a 41-foot back-to-back street
section from Overland Road to Chickasaw Street with parking
restricted on the west side and a 37-foot back-to-back street
section from Chickasaw Street to Smoky Hill Street with park-
ing restricted.
6. Staff recommends that a four-way stop intersection be required

7. Two access points are proposed off of Overland Road.
8. Staff recommends that center turn lanes be constructed on
Overland Road at Red Cloud Way and Apache Avenue and a deceler-

Alamitos Subdivision.
10. Staff recommends that a stub street be required to the west

14. The ACHD Capital Improvement Plan indicates that Overland Road
is approved for use of Road Impact Fee funds to increase its
capacity; therefore, Road Impact Fee offsets may be given for
construction of the roadway improvements (excluding sidewalk)
along Overland Road and for right-of-way dedication in addi-
tion to what exists now. If the developer wishes to be paid
for the additional right-of-way, he/she must submit an applica-

tion to the impact fee administrator prior to breaking ground,
in accordance with Section 15 of ACRD Ordinance #188.
15. This application is scheduled for public hearing by the Meridi-
an Planning & Zoning Commission on June 23, 1994.
SITE SPECIFIC REQUIREMENTS:
1. The street layout submitted on the preliminary plat dated June
21, 1994, shall be used, except as provided below.
2. Dedicate 45-feet of right-of-way from the centerline of Over-
land Road abutting parcel (20 additional feet). The owner
will be compensated for this additional right-of-way from
available impact fee revenues in this benefit zone.
3. Construct 5-foot sidewalk on Overland Road abutting parcel.
4. Construct center turn lanes on Overland Road at the intersec-
tions of Red Cloud Way and Apache Avenue. Corrdinate with
District staff.
5. Construct a deceleration lane on Overland Road at Red Cloud
Way that is 100-feet in length and tapers to 12-feet in width.
6. Construct Red Cloud Way to a 41-foot back-to-back street sec-
tion within 60-feet of right-of-way with 5-foot sidewalks and
parking on restricted on the east side from Overland Road to
Chickasaw Street.
7. Construct Red Cloud Way to a 37-foot back-to-back street sec-
tion within 50-feet of right-of-way with 5-foot sidewalks with
parking restricted from Chickasaw Street to Smoky Hill Street.
8. Terminate Red Cloud Way at the school site.
9. Provide a stub street to the west property line from Choctaw
Way, located 150-feet south of the southeast corner of Rim
Acres Subdivision. Corrdinate with District staff. Provide a
deposit to the Public Rights-Of-Way Trust Fund for $1,500
(half of the cost to cross the Hunter Lateral).
10. Provide a stub street to the west property line in the proximi-
ty of Paiute Drive. Provide a deposit to the Public Rights-

STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.
2. Dedicated streets and drainage systems shall be designed and
constructed in conformance with District standards and poli-
cies.
3. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACRD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
4. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
5. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
6. Continue existing irrigation and drainage systems across par-
cel.
7. Submit three sets of street construction plans to the District
for review and appropriate action.
8. Submit site drainage plans and calculations for review and
appropriate action by ACHD. The proposed drainage system
shall conform to the requirements of Meridian and shall retain
all storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a drainage easement set aside specif-
ically for that use. There shall be no trees, fences, bushes,
sheds, or other valuable amenities placed in said easement.
Drainage easements and their use restrictions shall be noted
on the plat.
9. Provide design data for proposed access to public streets for
review and appropriate action by ACHD.
10. Locate driveway curb cuts a minimum of 5-feet from the side
lot property lines when the driveways are not being shared
with the adjacent property.

11. Developer shall provide the District with a copy of the record-
ed plat prior to the installation of street name signs.
Street signs will not be ordered until all fees have been paid
and a copy of the recorded plat has been provided to ACRD
staff. The copy of the recorded plat shall show the recording
information as inscribed by the Deputy County Recorder.
12. Install a stop sign on every unsignalized approach of a
project street to an intersection involving a collector or
arterial as the cross-street. The stop sign shall be in-
stalled when the project street is first accessible to the
motoring public.
13. A right-of-way permit must be obtained from ACHD for all
street and utility construction within the public right-of-
way. Contact Construction Services at 345-7667 (with zoning
file number) for details.
14. A request for modification, variance or waiver of any require-
ment or policy outlined herein shall be made, in writing, to
the Manager of Engineering Services within 15 calendar days of
the original Commission action. The request shall include a
statement explaining why such a requirement would result in
substantial hardship or inequity.

ITEM #3: PUBLIC HEARING: REQUEST FOR PRELIMINARY PLAT FOR SUN DANCE
SUBDIVISION BY G.L. VOIGT AND NUBBLE ENGINEERING:
Johnson: I will now open the public hearing, if a representative for the Applicant would
like to come forward please do so at this time.
Jim Merkle, 9550 Bethel Court, Boise, was sworn by the City Attorney.
Merkle: Before starting, I received Shari's comments at a late hour today and I prepared
a written response to them which I have already given to her and I would like to give to the
Commission. I am here this evening on behalf of G.L. Voigt the Applicant. Before getting
into the specifics of the proposal I would like to refresh the Commissioners memory on this
particular piece of property. This 96 acre annexation is one of what I believe is 3 or 4
pieces of property required for the St. Luke's annexation at the Eagle Interchange further
to the east of this piece. The public hearing for those particular annexation and zoning
applications was heard by the Commission on May 10th and the findings of fact were
approved on May 24th with a recommendation of approval sent onto the Council. The City
Council scheduled to hear this annexation and R-4 zoning request on July 5th. This
project is located about midway between Locust Grove Road and Eagle Road on the south
side of Overland. Tonight's preliminary plat application is for 298 single family residential
lots on approximately 97 acres, that gives us a gross density of about 3 lots per acre, well
within the requirements of the R-4 zone. The applicant is proposing lot sizes with
minimum of 8,000 square foot as required. Some of the lots in the proposed subdivision
most of them are between 8,000 and 10,000 square feet and some are in addition of
10,000 square feet. Home sizes will be a minimum of 1400 square feet as required by the
R-4 zone. Also there is a generous amount of landscaping provided along the common
collector street coming into the project on both sides. Also a landscape park area being
proposed for the use by the subdivision in the front of the project. Also, the green
rectangle is a 4 acre parcel set aside for acquisition by the school district or the City for
a future school combination park site. The applicant is proposing a reduction of the 80 foot
lot width requirement to a 70 foot minimum width, this reduction is being requested due to
the extent of the landscape open space and to set aside a portion of the school site and
park site as requested by the school district and the city staff. This set aside for the school
and park is one of 4 pieces that have to come together to provide that site, this is

approximately 4 acres, the school district wants 14 to 16 acres. This is 1/4 of that set
aside. There are also significant off site costs associated with the development of this
property not the least of which is the participation in the extension of the Five Mile Trunk
sewer from north of the freeway under the freeway down to Overland Road to serve this
project and also open up property to the east based upon the City's sewer facility plan.
As shown on the preliminary plat, this project will provide the major access into the center
of the section and also feature a school park site. The other participants who are involved
in the park site have access to the site but is through residential streets and we believe
this will be the main access into the school and park site for uses in the future. We have
added additional stub streets in 3 additional locations from the original submittal in
accordance with requests of city staff and the Highway District. Today I received a list of
comments from the Highway District which we have incorporated in our presentation and
I feel we can meet these requirements in our final design. We have also completed the
traffic study which was required which has been submitted to the City and the Highway
District. The Highway District has reviewed and approved this study and they are using
that to come up with their requirements. The streets within the subdivision are all
proposed to be public streets built to the Highway district's standards 50 foot of right of
way typical 36 foot street 5 foot sidewalks. Also the collector street probably a 1/2 mile
of length from Overland down into the center section for the school this will have a
landscaped 20 foot common area on each side maintained by the homeowners
association. In addition to the front landscape on Overland and the park site and the 2
entrys. As I stated earlier sewer for this project will be to the Five Mile Trunk sewer which
today is probably about a mile and a 1/2 northwest of this site, of Franklin. It is our
understanding that the trunk line will be extended to a point about a 1/4 mile from the site
north of the freeway this winter. Once that is in place from that location the applicant will
be participating in the extending of the trunk sewer south under the freeway to Overland
Road to serve this project. Water lines will be extended along Overland Road from the
existing lines located west of the property. Regarding Gary Smith's and Shari Stiles
comments, t have provided a written response to each of those persons and to each of
you. The main couple items, I think we are in agreement with all of their comments, the
main ones 1 would like to bring up. Gary's item #1 concerning the lot dimensions of R-4,
we are here tonight requesting a lot density transfer to allow a reduction of the width from
80 to 70. All the other requirements of the R-4 are being met we are in excess of lot size,
we are less than the density allowed in R-4 and square footage of homes, setback
everything is in accordance with the R-4 zone. It is the 70 foot width we are requesting.
Also, #8 of Shari's comments regarding the donation in lieu of set aside school and park
site, we are agreeing with it if the donation of the school site is made a condition of
approval of the preliminary plat as presented here this evening. Also, Shari's #9 comment
concerning possible additional application, I would tike some clarification from Shari since
I just got these comments at 4:30. We are requesting this lot with reduction through the
density transfer process and do not wish to have another application basically decide the

same issues we are talking about tonight with this preliminary plat application. Another
piece of information I believe you have in your packet is a letter from the applicant to Dan
Mabe of the Meridian schooi district, the letter responds to the comment in the school
district's letter to the City. Basically stating the district could support projects without
school sites being set aside and sufficient utilities being provided to the site. And this
proposal tonight meets both of those criteria. In conclusion with the information I have
presented tonight I would request that you approve this preliminary plat and if you have
any question I would like to try and answer them and the Applicant is here this evening if
you would like some questions answered of him.
Johnson: Thank you Jim, any question of Mr. Merkle?
Hepper: You said something about requesting a 70 foot frontage variance, I noticed
several of these lots are down to 65 and I even see one that is 58 would you address
that?
Merkle: The proposal we have up here is for 70 foot frontage minimum instead of the 80
and the bulb or culdesac lots which is typical in the R-4 would have 40 minimum on the
chord and that is what the proposal is for.
Hepper: Okay, some of these that show on this plat that show 65.
Merkle: They are 70 on this one, and that responds to some of the issues in Gary's
comments when we got those comments we scrambled to get the information back to
present to you, but they are 70 foot widths.
Hepper: Does that density that you have figured, does that take into account the set aside
land for the school?
Merkle: The entire parcel is 97 acres and 298 by 97 is 3.07, it is the gross density of the
entire parcel
Hepper: I have no other questions.
Johnson: Wayne Crookston
Crookston: My concem is not necessarily a question but a comment, my concern with the
request for the density transfer under our ordinances works in a Planned Unit
Development, but unless you ask for the Planned Unit Development or you ask for a
variance I don't think the Commission can act on that.

Merkle: As I stated earlier I would like some clarification from Shari in her response to me
it says, "Lot density transfer as described in the Comprehensive Plan could apply to this
project if and only if the school site is donated not merely set aside." And that is what we
are responding to.
Crookston: Even with that, you are still going to have to have either a variance or apply
for the Planned Unit Development. We don't have any ability to make a subdivision and
say you are doing this so you can have that, you have to apply for that variance or have
it treated as a Planned Unit Development which requires a conditional use permit.
Merkle: 1 would like to have Shari explain what her comments mean.
Johnson: Okay, any other questions of Jim? Okay we will get to that and give you an
opportunity to come back. This is a public hearing, anyone else from the public like to
address the Commission at this time? Seeing no one then Shari would you like to come
forward and address that comment #9 or 10.
Shari Stiles, 33 East Idaho, Meridian, was sworn by the City Attorney.
Stiles: This comment comes from just what our zoning and development ordinance reads,
a variance can be hard to get apnPoved because it requires a hardship to exist. I think the
Applicant is concerned that it cannot be done. The variance would not hold up the
progress of this development because it is only heard by City Council. if Mr. Crookston,
you think a variance is in order for this I would have no problem with that it is just that the
Ordinance does allow a lot more leniency through a conditional use permit which is
required for a Planned development.
Crookston: I agree with that on the Planned Unit Development, these things are desired
in fact, but under our ordinances they have to apply for the Planned Unit Development
rather than just in the platting process or that a variance be requested and granted for
those differences of the requirements of the R-4 zone.
Johnson: In an effort to encourage of contributions by developers for parks and school
sites doesn't the Comprehensive Plan suggest that trade offs for lack of a better would can
be used in a development and what you are saying is you still have to go through the
Conditional use permit in order to satisfy that.
Crookston: Because of the Comprehensive Plan is a guideline and what controls
development actually is the zoning ordinance and the subdivision and development
ordinance. The Comprehensive Plan I don't think, it is stating what the desires are, but
you have to meet the zoning ordinance and the subdivision and development ordinance

for the details.

Johnson: And the other alternative is an variance which requires proof of hardship.
Crookston: That is correct.
Johnson: Is that the way you read it?
Stiles: Yes
Johnson: Anyone else from the public, Mr. Merkle do you have another comment? Okay,
seeing no one then I will close the public hearing at this time. Is there any discussion?
Rountree: Mr. Chairman I make a motion that we pass a favorable recommendation on this
preliminary plat to the City Council provided the applicant submits a request for variance
to be heard before the City Council.

Johnson: Its been moved and seconded, are you going to restrict it to a variance or are
you using variance in a general term, because he could also come back with a PUD on a
conditional use permit.
Rountree: Wouldn't that have to be heard before us again?
Johnson: It would, I just thought your motion was restrictive to the variance.
Rountree: I suppose if they want to come back with a conditional use permit they can be
re-heard before us anyway. It won't go to the City Council.

SUBJECT: Preliminary Plat for Sun Dance Subdivision
1. Submit proposed restrictive covenants.
2. Include note for minimum house size of 1,400 square feet on final plat.
3. Block lengths exceed 1,000 feet. A stub street is needed to the west, as well as an
additional stub street to the east. A variance application is required if block lengths still
exceed 1,000 feet.
4. Hunter Lateral must be piped in accordance with City of Meridian Ordinance. Nampa-
Meridian Irrigation District must approve of final development plans. Provide evidence
of this prior to submittal of final plat.
5. Submit Ada County Street Name Committee approval letter (all streets do not show
names).
6. Show subdivider name, address and telephone number on plat.
7. Development agreement is required as part of the annexation of this property.
8. Lot density transfer as described in Meridian Comprehensive Plan could apply to this
project if, and only if, proposed school site is donated, not merely "set aside. " I would
support a lot density transfer in that case. However, all lots must contain a minimum 70'
frontage and minimum 8,000 square foot lot area.
9. Submittal of a Conditional Use Permit application for a planned residential development
would make this "cleaner" and solve some of the problems of lots not meeting R-4
requirements.
With above conditions and comments addressed, and conformance with staff and agency
comments, I would recommend approval of this preliminary plat.

9. From our reseazch with NMID, the maximum flow in the Hunter Lateral is 1400 inches
(28 cfs). There is an existing 36" CMP south of our project that the lateral flows through
and it crosses Overland in what appeazs to be a 30" x 44" (approximately a 36"
equivalent) metal pipe.
10. This will be prepazed prior to final design in accordance with the City of Meridian,
ACHD and NMID requirements.

9. From our reseazch with NMID, the maximum flow in the Hunter Lateral is 1400 inches
(28 cfs). There is an existing 36" CMP south of our project that the lateral flows through
and it crosses Overland in what appears to be a 30" x 44" (approximately a 36"
equivalent) metal pipe.
10. This will be prepared prior to final design in accordance with the City of Meridian,
ACHD and NMID requirements.
11. A traffic study has been submitted to you and ACHD.
12. This will be complete prior to the fmal design of our drainage system.
13. This is correct and also this will include about a half mile of offsite sewer and the freeway
crossing in accordance with the City Sewer Facility Plan.
