spaces and I currently have 7 open spaces.
Crookston: It is all on street parking.
daRosa: That is correct, but it is available to me. I use it now when it was a residence and
my parents actually had renters in there they were using that parallel parking on both
sides. So it is available to me now. I don't quite understand why 1 need a variance to ask
for it back. I never gave it up really.
Morrow: The issue there is the ordinance requires off street parking for that type of a
project. The purpose of a variance is to take away the need for off street parking. It is true
you do have 6 or 7 spaces of on street parking but if I am understanding Shari and Wayne
correctly the variance is for off street parking requirements. Item 6 on page 5 of the
conclusions it says, talking about (inaudible) all parking and landscaping requirements the
applicant will need to apply for a variance regarding the off street parking.
daRosa: That is correct, you don't
Kingsford: But the ordinance requires that you do.
daRosa: That I need off street parking.
Kingsford: You need off street parking or you need a variance from the Council to
(inaudible).
daRosa: I understand.
ITEM #23: CONDITIONAL USE ,PERMIT REQUEST FOR RED CANYON
CORPORATION:
Gerber: I am Lloyd Gerber, 1 am the President of Red Canyon Corporation. We
purchased the property on 2nd East and Pine, the old medical center. It has been vacant
since 1985. We are now trying to because it was vacant anything we put in there has to
go through a conditional use permit. And that is why we are here now and trying to get it
so we can put tenants in there. We have one tenant that we anticipate going in there we
will still need one more.
Kingsford: Questions for Lloyd?
Morrow. You have read the staff s comments are you are in agreement of complying with
the staff conditions.

Gerber: I have the same problem on the highway, that this gentleman had and I am not
going to sign the agreement. If we can't come to an agreement on it then the highway will
just have to say what they want and do it. (End of Tape) If we have diagonal parking they
are going to, well let me back up. Maybe all of you understand what that looks like down
there with the north side of that building now has right up against coming right off the
street. There are about 17 or 18 feet that are private property and now it is the parking on
private property and backing out into the street. The requirements of the County to put the
new curb in and gutter. in and the sidewalk that will force the same parking out in the street
so instead of being off street parking it is going to be forced off of the property onto the
street which then takes me out of having that for my use. And in addition if it is to be
diagonal parking which would be better for more parking spaces then I have to sign the
hold harmless contract for the county's negligence. The only time the County can get sued
is when they are negligent. I am not willing to do that, they can park wherever they want.
They can put the parallel parking if they want. I simply won't sign it.
Kingsford: Questions of the Council?
Tolsma: This looks similar to what we had downtown also with the bulb work on Pine
Street there (inaudible).
Sale: The difference in this case gentlemen is that Pine is a proposed major street. There
is sufficient right of way there that we don't need any additional right of way, we don't need
that right of way for some time until we widen the street. Mr. Gerber is correct in what he
says in that parking is currently on, partially on 1 guess and partially off of the property but
it is backing into the street. We will allow him to construct curb and gutter in such a way
to continue to have diagonal parking but it will not be in the present location where the
curb is. It will be a widened street section similar to what you have downtown. So there
will be the protection there but it will be similar in location to what is there now. We will
allow that only if he will sign a license agreement with the Highway District because he is
using the right of way for that purpose. And we will require the license agreement so that
when we need that right of way for the widening of Pine Street we will re-construct the
street and he will lose that diagonal parking. Apart of that license agreement is that he
holds the highway district harmless for any actions that may occur on or off his property
within the parking area. So, if he doesn't want to sign the license agreement then he will
build the curb further out in the street and won't be able to have diagonal parking he can
have parallel parking and the curb along (inaudible). We can in this situation make the
bulbs work for a time.
Morrow: It is a short term deal then?
Sale: It is temporary use.

ITEM #24: PRELIMINARY/ FINAL PLAT REQUEST FOR CENTRAL VALLEY
CORPORATE PARK:
Shrewsberry: We are requesting a (inaudible) approval of a 2 lot subdivision being
phased for Central Valley Corporate Park. It would be about 10 3/4 acres in size. If you
have any questions t would be more than happy to present what expertise 1 have on the
project.
Morrow: You have read staffs comments particularly the ones from City Engineer's
department?
Shrewsbeny: Yes sir we have no problem with complying with those provisions. They are
basically just
Morrow. The 6 on the preliminary and the 7 on the final.
Cowie: There is a comment from ACRD in reference to a traffic study, have you done that?
Shrewsberry: We would request that the traffic study be deferred at this time until such
time as a specific user for this property is identified and the possibility of a need be
addressed at that time. If I may go forward, ACHD's request was based upon a specific
future tenant for this property. That sale is still under negotiation and there is no
guarantee that it will go forward. For the property as it is currently zoned which is CG the
traffic intensities of those uses could be handled by the existing traffic network, the uses
would not be of an intensity that would warrant a traffic study. If this specific user does or
the specific client does in fact purchase the property and comes with a specific
development plan with their needs. My interpretation of the zoning ordinance is a rezone
request would be necessary in order to located the use on this property. At the time of the
rezone request then the traffic study would be accomplished as part of the preliminary
work for that application. I myself had calculated that for a CG type use at this property
would generate something like 200 vehicle trips per acre (inaudible) almost 11 acres. So
it would be about 2,100 trips a day that 1 calculate being a part of this property. If it is used
in a CG context.

professional offices. Retail store at one space per 200 square feet. Number of spaces =
5400 squaze feet _ 200 = 27 for retail. The plan submitted appears to show 26 spaces plus
+ 6 garage spaces. If all of the floor area is retail the spaces provided appeaz to be adequate.
2. Sewer and water reassessments will be made if this CUP is approved to reflect existing or
projected use of water.

SUBJECT: Conditional Use Permit for Red Canyon Corporation -Old Meridian Medical
Building
This request for a Conditional Use Permit is consistent with the goals of the Comprehensive
Plan. The office portion of the building has been vacant for some time and has fallen into
disrepair. Sidewalks are uneven and deteriorated, with improvements needed on the north and
west sides of the property. ACRD will allow diagonal parking along Pine Avenue as long as
a license agreement with the District is entered into so parking may be removed when Pine
Avenue is widened. Landscaping also needs to be provided in accordance with City Ordinance.
I recommend approval of this Conditional Use Permit subject to compliance with staff and
agency requirements.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
July 12, 1994, at the hour of 7:30 o'clock p.m., the Petitioner
appearing in person, the Planning and Zoning Commission of the
City of Meridian having duly considered the evidence and the
matter makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for July 12, 1994, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the July 12, 1994, hearing;
that the public was given full opportunity to express comments and
submit evidence; and that copies of all notices were available to
newspaper, radio and television stations;

2. That the property is located within the City of
Meridian; the property is described in the application which
description is incorporated herein.
3. That the property is zoned Old Town, which requires a
conditional use permit for professional offices and record storage
which the application requests.
4. That the Old Town District is described in the Zoning
Ordinance, 11-2-408 B. 10. as follows:
(OT) Old Town District• The purpose of the
(OT) District is to accommodate and encourage
further expansion of the historical core of
the community; to delineate a centralized
activity center and to encourage its renewal,
revitalization and growth as the public, and
quasi-public, cultural, financial and
recreational center of the City. A variety
of these uses integrated with general
business, medium-high to high density
residential, and other related uses is
encouraged in an effort to provide the
appropriate mix of activities necessary to
establish a truly urban City Center. The
District shall be served by Municipal Water
and Sewer systems of the City of Meridian.
Development in this district must give
attention to the handling of high volumes of
traffic, adequate parking, and pedestrian
movement, and provide strip commercial
development, and must be approved as a
conditional use, unless otherwise permitted.
5. That the use proposed by Applicant is a specifically
allowed conditional use in the Zoning Schedule of Use Control, 11-
2-409 B.
6. That there are properties across E. 2nd Street which are
used for commercial purposes; that the Masonic Lodge is to the

south; that there is an application to use the property kitty-
corner to the subject property for offices.
7. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
given and followed.
8. That sewer and water is available to the property, but
the property will have to comply with the commercial sewer and
water rates.
9. That the City Engineer, City Planning Director, Central
District Health Department, Fire Department, and Ada County
Highway District have submitted comments and they are incorporated
herein as if set forth in full herein.
10. That City Engineer, Gary D. Smith commented to the
parking and the ordinance requirements of one space per 400 square
feet of gross floor area for professional offices and one space
per 200 square feet for retail; that the plan submitted appears to
show 26 spaces plus six (6) garage spaces; that if the floor area
is retail, the spaces provided appear to be adequate; that
landscaping and lighting, etc. shall be in accord with ordinance
requirements; that sewer and water reassessments will be made to
reflect existing or projected use of water.
11. That City Planning Director, Shari Stiles commented the
conditional use permit is consistent with the goals of the
Comprehensive Plan; that the sidewalks are deteriorated; that

12. That there was no testimony objecting to the
application.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property;
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian;
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of
the Revised and Compiled Ordinances of the City of Meridian,
Idaho;
4. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of

those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:
a. The use, would~in fact, constitute a
conditional use and a conditional use permit
is required by ordinance.
b. The use should be harmonious with and in
accordance with the Comprehensive Plan but
the Zoning Ordinance requires a conditional
use permit to allow the use.
c. The use apparently would be designed and
constructed, to be harmonious in appearance
with the intended character of the general
vicinity.
d. That the use would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive
additional requirements at public cost for
public facilities and services and the use
would not be detrimental to the economic
welfare of the community.
g. The use would not involve a use,
activity, process, material, equipment or
conditions of operation that would be
detrimental to person, property or the
general welfare by reason of excessive
production of. traffic or noise.
h. That sufficient parking for the property
and the proposed use will be required.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major
importance.

5. That the comments of the City Engineer and Ada County
Highway District must be met and complied with.
6. That all ordinances of the City of Meridian must be met,
including but not limited to, the Uniform Building Code, Uniform
Fire Code, Uniform Plumbing Code, the Fire and Life Safety Code,
all parking and landscaping requirements.
APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS
The Meridian Planning and Zoning Commission hereby adopts and
approves these Findings of Fact and Conclusions.

FACTS & FINDINGS:
1. Red Canyon Corporation is requesting conditional use approval
to convert an existing commercial building for professional
offices, retail and record storage. Four apartments are cur-
rently in use and the applicant intends to continue that use.
The site is located at the southeast corner of 2nd Street and
Pine Street.
2. A similar proposal for this same site/building was approved by
the Commission on May 4, 1994.

2. Enter into a License Agreement with the District to allow for
the proposed diagonal parking along Pine Street to remain
until such time as the District needs that extra right-of-way
width for future street widening. The diagonal parking will
be required to be set back from Pine Street to prevent vehi-
cles from backing into traffic lanes. Coordinate the stan-
dards for the setbacks with District staff. Diagonal parking
may be required to be removed by the District at any time.
3. Construct pedestrian ramps on the corner of Pine Street and E.
2nd Street in compliance with Idaho Code, Section 40-1335.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.
2. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACRD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
3. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
4. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
5. Continue existing irrigation and drainage systems across par-
cel.
6. Submit three sets of street construction plans to the District
for review and appropriate action.
7. Submit site drainage plans and calculations for review and
appropriate action by ACHD. The proposed drainage system
shall conform to the requirements of City of Meridian and
shall retain all storm water on-site.

502.2b of the Revised and Compiled Ordinance of the City of Meridian.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
July 12, 1994, at the hour of 7:30 o'clock p.m., the Petitioner
appearing in person, the Planning and Zoning Commission of the
City of Meridian having duly considered the evidence and the
matter makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for July 12, 1994, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the July 12, 1994, hearing;
that the public was given full opportunity to express comments and
submit evidence; and that copies of all notices were available to
newspaper, radio and television stations;

2. That the property is located within the City of
Meridian; the property is described in the application which
description is incorporated herein.
3. That the property is~zoned Old Town, which requires a
conditional use permit for professional offices and record storage
which the application requests.
4. That the Old Town District is described in the Zoning
Ordinance, 11-2-408 B. 10. as follows:
(OT) Old Town District: The purpose of the
(OT) District is to accommodate and encourage
further expansion of the historical core of
the community; to delineate a centralized
activity center and to encourage its renewal,
revitalization and growth as the public, and
quasi-public, cultural, financial and
recreational center of the City. A variety
of these uses integrated with general
business, medium-high to high density
residential, and other related uses is
encouraged in an effort to provide the
appropriate mix of activities necessary to
establish a truly urban City Center. The
District shall be served by Municipal Water
and Sewer systems of the City of Meridian.
Development in this district must give
attention to the handling of high volumes of
traffic, adequate parking, and pedestrian
movement, and provide strip commercial
development, and must be approved as a
conditional use, unless otherwise permitted.
5. That the use proposed by Applicant is a specifically
allowed conditional use in the Zoning Schedule of Use Control, 11-
2-409 B.
6. That there are properties across E. 2nd Street which are
used for commercial purposes; that the Masonic Lodge is to the

south; that there is an application to use the property kitty-
corner to the subject property for offices.
7. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
given and followed.
8. That sewer and water is available to the property, but
the property will have to comply with the commercial sewer and
water rates.
9. That the City Engineer, City Planning Director, Central
District Health Department, Fire Department, and Ada County
Highway District have submitted comments and they are incorporated
herein as if set forth in full herein.
10. That City Engineer, Gary D. Smith commented to the
parking and the ordinance requirements of one space per 400 square
feet of gross floor area for professional offices and one space
per 200 square feet for retail; that the plan submitted appears to
show 26 spaces plus six (6) garage spaces; that if the floor area
is retail, the spaces provided appear to be adequate; that
landscaping and lighting, etc. shall be in accord with ordinance
requirements; that sewer and water reassessments will be made to
reflect existing or projected use of water.
11. That City Planning Director, Shari Stiles commented the
conditional use permit is consistent with the goals of the
Comprehensive Plan; that the sidewalks are deteriorated; that
improvements are needed on the north and west sides of the

property; that ACRD will allow diagonal parking along Pine Avenue
as long as a license agreement with the District is entered into
so parking may be removed. when Pine Avenue is widened.
12. That there was no testimony objecting to the
application.
CONCLUSIONS
1. That all the procedural 'requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property;
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian;
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of
the Revised and Compiled Ordinances of the City of Meridian,
Idaho;
4. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of

those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:
a. The use, would~in fact, constitute a
conditional use and a conditional use permit
is required by ordinance.
b. The use should be harmonious with and in
accordance with the Comprehensive Plan but
the Zoning Ordinance requires a conditional
use permit to allow the use.
c. The use apparently would be designed and
constructed, to be harmonious in appearance
with the intended character of the general
vicinity.
d. That the use would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive
additional requirements at public cost for
public facilities and services and the use
would not be detrimental to the economic
welfare of the community.
g. The use would not involve a use,
activity, process, material, equipment or
conditions of operation that would be
detrimental to person, property or the
general welfare by reason of excessive
production of. traffic or noise.
h. That sufficient parking for the property
and the proposed use will be required.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major
importance.

5. That the comments of the City Engineer and Ada County
Highway District must be met and complied with.
6. That all ordinances of the City of Meridian must be met,
including but not limited to, the Uniform Building Code, Uniform
Fire Code, Uniform Plumbing Code, the Fire and Life Safety Code,
all parking and landscaping requirements.

Johnson: I will now open the public hearing, if there is someone representing the
applicant that would like to address the commission please do so.
Lloyd Gerber, 3420 Shadow Hills Drive, Eagle, was sworn by the City Attorney.
Gerber: We are coming, we have purchased the old medical building on the corner of
Second East and Pine which has been vacant for a long time as you all know. So, our
intent now is to get tenants in there, do some cosmetics on the outside and go into
business, that is business of renting that out to whatever kinds of tenants we can get,
vocational schools or professional or retail.
Johnson: Thank you very much, any questions of the applicant? Not at this time we may
have a question if the public comes up with something. Anyone from the public that would
like to address the Commission on this application? Seeing no one I will close the public
hearing.

STREET DEVELOPMENT:
Johnson: I will now open the public hearing, if the applicant is here please address the
Commission.
Ron Walsh, 12002 Fiddler Drive, Boise, was sworn by the City Attorney.
Walsh: Well, Mr. Chairman and members of the Commission we have a parcel of land
there on Locust Grove that we have asked to be annexed and rezoned R-8. We think it is
in line with the Comprehensive Plan and an area that adjoins Danbury Fair. We are
surrounded by R-4 zoning, our position on requesting R-8 is that we feel it is a transition
area between the R-4 zone and the higher density zoning that lies to the east of Locust
Grove. The parcel is somewhat irregular so we feel that the lot lines, some of the widths
and dimensions may fall below what is allowed in an R-4. We don't anticipate any density
much higher than an R-4 probably right at R-4. We have sewer available we are working
on access into Danbury Fair for the main sewer stub. We have good access and in an
area that seems to be growing with residential. Any questions?
Johnson: The obvious question is could you live with R-4?
Walsh: With exception, my engineer would have to state that, with exception of some of
the lot frontages I would say the density would be fine. But I am not sure that we can get,
the rear part of the property has an angle to it and then we are following those 2 laterals
along there. I am not sure that we can get the highest and best use with those
dimensions. She might have to answer that.

frontage. Coordinate the design with District Traffic Servic-
es staff.
2. Enter into a License Agreement with the District to allow for
the proposed diagonal parking along Pine Street to remain
until such time as the District needs that extra right-of-way
width for future street widening. The diagonal parking will
be required to be set back from Pine Street to prevent vehi-
cles from backing into traffic lanes. Coordinate the stan-
dards for the setbacks with District staff. Diagonal parking
may be required to be removed by the District at any time.
3. Construct pedestrian ramps on the corner of Pine Street and E.
2nd Street in compliance with Idaho Code, Section 40-1335.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.
2. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACRD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
3. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
4. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
5. Continue existing irrigation and drainage systems across par-
cel.
6. Submit three sets of street construction plans to the District
for review and appropriate action.
7. Submit site drainage plans and calculations for review and
appropriate action by ACHD. The proposed drainage system
shall conform to the requirements of City of Meridian and
shall retain all storm water on-site.

public right-of-way or in a drainage easement set aside specif-

5. Most of the building is not in use. It was used prior to applicant's purchase 5/16/94 for
professional record storage, plus four apartments and six gazages which are still in use.
6. Currently, the usage is for a professional office. building. The previous owner/physician
ceased seeing patients at this site and now sees patients at Boise State University. All
utilities have remained on and in use, i.e.: water, sewer, electricity, gas, heating, and
cooling aze fully operable and have always remained so even when the office was not
open for patients. All lights, bathroom appliances, doors, etc. aze fully operable. The
building is fully inhabitable at this time. The apartments and gazages have always been
in full use.

NOTICE OF HEARING

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and
the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of
Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 p. m., on July 12, 1994, for the purpose of reviewing
and considering the Application of Red Canyon Corporation for a Conditional Use Permit
for land located at Townsite of Meridian, Block 7 -Lots 5, 6, 7, 8 and 10, Meridian, Ada
County, Idaho, and which property is generally located on East 2nd Street and Pine Street
(Old Meridian Medical). The Application requests a Conditional Use Permit for
professional offices and record storage.
Amore particular legal description of the above properly is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the Application is available upon request. Any and all interested persons
shall be heard at said public hearing and the public is welcome and invited to submit
testimony.
