VO AN ORDINANCE VACATING A PORTION OF ARIEL ESTATES SUBDIVISION, OF RECORD IN ADA COUNTY, IDAHO, SPECIFICALLY A 12 FOOT WIDE IRRIGATION EASEMENT LOCATED IN THE NORTHEAST CORNER OF LOT 6 BLOCK 1 OF ARIEL ESTATES SUBDIVISION, ACCORDING TO THE OFFICIAL PLAT THEREOF, IN BOOK 64 OF PLATS AT PAGES 6582 AND 6583, RECORDS OF ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council and the Mayor of the City of Meridian, Idaho, have concluded that it is in the best interest of said City to vacate a portion of Ariel Estates Subdivision, specifically the twelve foot easement located in the northeast corner of Lot 6, Block 1 thereof. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: Section 1:: That pursuant to Section 50-1306A, specifically, and Title 50, Chapter 13, Idaho Code, generally, the City of Meridian, having held the required hearing and it appearing that proper notice of said hearing was given and there being no objection, hereby: vacates the 12 foot wide irrigation easement located in the northeast corner of Lot 6, Block 1 of Ariel Estates Subdivision, according to the official plat thereof filed in Book 64 of Plats at Pages 6582 and 6583, records of Ada County, Idaho; this vacation of this easement effects no other portion of the plat of Ariel Estates Subdivision. Section 2: WHEREAS, there is an emergency therefor, which emergency is hereby declared to exist, this Ordinance shall take effect and be in full force from and after its passage, approval and publication as required by law. (1967) 50-1304. Essentials of plats. All plats offered for record in any county shall be m black image upon sable base drafting ~th a minimunu~.se thickness of 0.003 inches, by either a photographic rocess using a silver image emul- sion or Iry use of a lplack opaque drafting film ink, by mechanical or handwritten means. The drafting film and image thereon shall be waterproof, tear resistant, fleuble, and capable of withstanding repeated handling, as well, as ding archival permanence. If ink is used of drafting the ink surface shall be coated with a suitable sub- stance massure permanent legibility. The drafting film must be of a type which can be reproduced either a photographic or draw process. Plats shall be ei teen (18) inches by twenty-seven (27) inches in size, with a three 3 inch margin at the left end for binding and a one~ralf (1 2 inch margin on all other edges. No pact of the drawing or certificates shall encroach upon the margins. Signahrres may be in reproducible black ink. The sheet or sheets which contain tbe drawng or diagram representing -the survey of the sulxlivision shall be drawn at a scale sortable bo insure the clarity of all lines, bearings and dimensions. In the event that any subdivision is of such magnitude that the drawing or diagram cannot be place on a single sheet, seriallyy numbered sheets shall be prepared and match lines shall be indicated on the drawing or diagram with appro- priate references to other sheets. The required dedications, acknowledgements and certifications shall appear on one (I) of the serially numbered sheets. The plat shall show: (a) the streets and alleys, with widths and courses clearly spawn; each street named; ~c) all lots numbered consecutively in each block, and each block lettered or numbered, provided, however, in a platted ,that each block, section, district or drvrsron~ burial lot shall be designated by number or letter or name; (d) each and all lengths of the boundaries of each lot shall be shown, provided, however, in a platted cemetery, that lengths of the boundaries of each burial lot may be shown y appropriate legend; (e) ggthe extenor boundaries shown by distance and clescrt'p~ions of survey monuments; (g) initial point and tie to at least twri (2) public land curve comers, or in lieu of public land survey corners, to lwo ~Z) monuments recogmzed by the city engineer or county engineer or surveyor, and also, if required by the city or county governing bodies, give coordinates based on the Idaho coordinate system; (h) the easements; and (i) basis of bearings. (1990) 50-1305. Verification. The county shall choose and require a le ally qualified professional land surveyor to perform land surveying in Idaho to sufficiently check the plat and computations thereon to determine that the requirements herein are met, and said professional land surveyor shall certify such compliance on the plat. For performing such sernce the county shall collect from the subdivider a fee as provided by local ordinance reasonably related to the cost of provid- ing such service. (1989) shall be recorded. Items which may be cxmsidered by the city inchrde, but are not limited to, cxmtinuity of street street widths, and drainage provisions. If the city s~adopted a subdivision ordinance and/or a comprehen- sive plan, then these documents may be used as guidelines for approving plats. Such city royal shall be in addition to county approval. Within one~l) mile of the city, a city subdivision ordnance shall prevail over a county subdivi- sion ordinance unless the city and cormtyty mutually agree upon any differences. Where the juuisdiction of two (2) cities overlaps, then the jurisdiction shall be assumed by the larger city. (1979) 50-1306A. Vacation of plats -Procedure. (1) When any person, persons, firm, association or corporation may desire to vacate a plat or an part thereof which is inside or within ane (1) mile of the boundaries of any city, it shall be laNVful for such person, persons, firm, association or corporation to don the city council to vacate. Such petition shall set to~rflr particular ci~cumstanc- es of the requests to vacate; contain a legal description of the platted area or property to be vaca0ed; the names of the persons affected thereby, and said petition shall be filed with the city clerk. (2) Written notice of public hearing on said petition shall be given, by certified mail with return receipt, at least ten (10) days pnor to the date of public hearing to all pro owners within three hundred (300) feet of the boun~ of the area described in the petition. Such notice of public hearing shall also be published once a week for two (2) successive weeks in the official newspaper of the city, the last of which shall be not less than seven (7) days prior to the date of said hearing; provided, however, that m a proceeding as to the vacation of all or a portion of a cemetery plat where there has been no interment, or in the case of a cemetery being within three hundred (300) feet of another plat for which a vacation is sought, publication of the notice of hearing shall be the only required notice as to the ppeerry owners in the cemetery (When the procedures set forth herein have been fulfilled, the city. council may grant the request to vacate with such restrictions as they deem necessary n the public interest. (4) When the platted area lies more than one (1) mile beyond the city limits, the procedures set forth herein shall be followed with the county commissioners of the county wherein theproperty lies. a county commissioners shall have authonty, comparable to the city council, to grant the vacation, provided, however, when the platted area lies beyond one (1) mile of the city limits, but adjacent to a platted area within one 1) mile of the city, consent of the city council of the affected city shall be necessary in granting any vacation by the county commissioners. (~ In the case of easements granted for gas, sewer, water, telephone, cable television, power, drainage, and slope purposes, public notice of intent to vacate rs not required. Vacation of these easements shall occur upon the recording of the new or amended plat, provided that all affected easem~it holders have been notified by certified mail, return receipt requested, of the proposed vacation and have to the same in writing. At the time of the meeting specified in the notice required by section 50-1807, the mayor and council of such city are hereby constituted a board of correction and for that purpose shall meet and continue in session from day to day as long as may be necessary not to exceed three (3) days, exclusive of hohdays and make such changes in tbe said assessment book as may be necessary to make it c~form to the facts, and such assessments levied for the maintenance, operation, extension and enlargement of die works may be reviewed by the mayor and council of the city during said time upon the request of any person interested, and within five (S) days after the mayor and council, shall have adjowned as a board of correction, die city clerk shall complete the assessment books as the same may have been adjusted and/or corrected by the mayor and council sitting as a board of correction and shall certify to the same and deliver said books to the city treasurer who shall collect the assessments in the manner herein provided. No irrigation water shall be tied to any kits, pieces or parcels or land within the bo~ of such irrigation system until such assessments shall have been paid in full. (1967) 50-1815. Entry of delinquent azsesstrrents and penalties - Amounts of penalty and interest. On or before the second Monday of July of each year in which the assessments are levied, the reasurer of the city shall enter all delinquent assessments and penalties on the assessrnait roll, which entry shall be considered to be dated as of the first day of July of each year, and shall have the force and effect of a sale to the city treasurer of the city as grantee in trust for said city of all the lairds, parcels, pieces or tracts of real estate entered upon such assessment roll upon which such assessments have not been paid before delinquency. The penalty required to be added on delinquent assessments shall be two per cent (29b) of the amount unpaid and the treasurer of such city shall collect such assessments which are delinquent with such penalty added, together with interest on the amount of such delinquent assessment at the rate of eight per cent (8 %} per annum from the date of sale until redemption. Dear Mayor and Council Members, I am requesting the abandonment of the irrigation ditch on this lot because it no longer serves a purpose or function. A pressurized irrigation system has been installed. The one property owner which this ditch previously served, Mr & Mrs Burke have connected to the pressurized irrigation system provided by the Ariel Estates Subdivision. Additionally the section of irrigation ditch that precedes up to lot 6 has already been abandoned and much of it has been filled in with dirt.
