This parcel is unusually long and narrow. It also allows potential
access to railroad services.
3. Why will a literal interpretation of the provisions of this ordinance
deprive you of rights commonly enjoyed by other properties in the same
district under the terms of this ordinance.
Pressure irrigation systems have not been required for other industrial
projects in Meridian.
4. What special conditions or circumstances exist that were not a result of
your actions?
The parcel is zoned for light industrial activity.
5. Why will the granting of this variance not confer on you any special
privilege that is denied by this ordinance to other lands, structures, or
buildings in the same district?
Since other light industrial subdivisions in the area do not have
pressurized irrigation systems, this application would not be a special

The nature of this development is light industrial. The
property will consist mainly of paved parking lots and
large building pads. Therefore, there will be minimal --
landscaping which would require pressurized irrigation.
13. Minimum requirements of this Ordinance that need to be reduced
to permit proposed use:
The current ordinance requires all subdivisions to include
pressurized irrigation systems. However, pressurized
irrigation would offer no benefit to this industrial
subdivision or the City of Meridian.

this Ordinance were applied to subject property:
If the developer was required to comply, the cost of
.installation and maintenance of such a system to
accommodate a minimal amount of landscaping would be
excessive.
15. Unusual or peculiar circumstances which indicate that
regulations of this Ordinance should not be strictly complied
with:
Due to industrial activities, there will be minimal
landscape that would require pressurized irrigation.
16. Statement that special conditions and circumstances exist which
are peculiar to the land, structure or buildings involved and
which are not applicable to other lands:
The parcel allows potential access to railroad services.
17. Statement that a literal interpretation of the provisions of
this Ordinance shall deprive the applicant of rights commonly

do they show a need to have pressurized irrigation.
Therefore, this application would not be a special

We believe that this Variance complies with the Meridian.

$250.00 - $1.29 for each certified mailing to be sent = total
fee.
A fee of $269.35 was submitted with the application.

they have applied for a Conditional Use Permit or Zoning.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and
the Laws of the State of Idaho, that the City Council of the City of Meridian will hold a
public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the hour
of 7:30 p.m., on December 6, 1994, for the purpose of reviewing and considering the
Application of Layne of Idaho for a Variance application for land located in the N 1/2 of the
SW 1/4 of Section 8, T.3N, R.1E, Boise Meridian, Ada County, Idaho, and which property
is generally located at Locust Grove Road, North of Franklin, South of Pine. The
Application requests a Variance so that the developer not be required to install a
pressurized irrigation system.
Amore particular legal description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the Application is available upon request. Any and all interested persons

OF THE CITY OF MERIDIAN
APPLICATION OF LAYNE OF IDAHO, INC.
FOR A VARIANCE FROM 11-9-606 B 14., PRESSURIZED IRRIGATION
FINDINGS OF FACT AND CONCLUSIONS
The above entitled variance request having come on for
consideration on December 6, 1994, at approximately 7:30 o'clock
p.m. on said date, at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, the Applicant appearing through a representitive,
and the City Council having heard and taken oral and written
testimony, the City Council of the City of Meridian makes the
following:
FINDINGS OF FACT
1. That notice of the public hearing on the variance was
published for two consecutive weeks prior to the scheduled hearing
for December 6, 1994, the first publication of which was fifteen
(15) days prior to said hearing; that the matter was duly
considered at the December 6, 1994, hearing; that copies of all
notices were available to newspaper, radio and television stations.
2. That notice of public hearing is required to be sent to
property owners within 300 feet of the external boundaries of the
land being considered pursuant to 11-2-416 E., 11-2-419 D., and 11-
9-612 B. 1. b of the Revised and Compiled Ordinances of the City of
Meridian; that his requirement has been met.
3. That Ordinance 11-9-606 B. 14. reads as follows:
FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 1
PRESSURIZED IRRIGATION SYSTEM: In each subdivision the
subdivider shall provide by underground tile, or other
like satisfactory underground conduit, pressurized
irrigation- water to each and every lot within the
subdivision; that the pressurized irrigation system
shall be constructed and installed at the same time as
the domestic water lines, but shall not necessarily be
in the same trenches; that there shall be no cross
connections between the domestic water lines and the
irrigation water lines that do not comply with section
4-143 of the Revised and Compiled Ordinances of the City
of Meridian; that the City Engineer is hereby authorized
and directed to establish rules and regulations and
standards for pressurized irrigation systems and that
all pressurized irrigation systems shall comply with
those standards, rules and regulations. Provided,
however, that the requirements of this subsection may be
waived upon proof that any particular lot, parcel, or
piece of land does not have water rights in an existing
irrigation district.
Also, the above requirement may be waived if the
subdivider either 1) deeds to the City land for a well,
drills the well and places the well on line with the
City water system, including the necessary pumps,
piping, valves, pressure equipment, and all other
equipment necessary, and which well depth and capacity
are determined by the City; or 2) the subdivider
deposits, gives and grants sufficient funds with the
City to purchase all necessary equipment to put the well
on line with the City water systems. In many
subdivisions, the latter option may be preferable to the
City so that the City may combine funds to drill and
equip one large well to service several subdivisions,
rather than have several smaller wells of less capacity.

4. That the Applicant, Layne of Idaho, Inc., has requested
that it be granted a variance from the above presurized irrigation
requirement.
5. That Applicant states in the variance application that
it is developing an 18 lot light industrial subdivision; the
parcel is unusually long and narrow; that pressurized irrigation
have not been required for other industrial projects in Meridian;

that the parcel is zoned for light industrial; that since other
light industrial subdivision in the area do not have pressurized
irrigation systems, this application would not be a special
priviledge to the owner.
6. The Applicant also stated the property will consist
mainly of paved parking lots and large building pads; that there
will be minimal landscaping which would .require pressurized
irrigation; that pressurized irrigation would offer no benefit to
this industrial subdivision or the City of Meridian
7. The entire property in question is described in the
variance application and is incorporated herein as if set forth in
full.
8. That the property in the area where the variance is
requested is zoned Light Industrial.
9. That the Applicant does own the property.
10. That the only substantive comment came from the Meridian
Ploanning Administratore, Shari Stiles; she stated thgat
landscaping will be required of this subdivision, as it it
required for all developments. The past trend of large parking
areas without landspcaing must not be continued. I would defer to
Gary Smith and the public works staff as to whether pressurized
irrigation is feasible for this project.
11. That the City has not received a variance application to
allow an applicant to not meet the pressurized irrigation
Ordinance and has not specifically dealt with requiring
pressurized irrigation in light industrial zoned areas.

12. That there is live water water behind this property and
it is assumed that the property has a water right since the
property has been used agriculturally in the recent past.
13. That no other testimony was heard at the hearing.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City has authority to grant variances pursuant
to Section 11-2-419 of the Zoning Ordinance and pursuant to
Section 11-9-612 of the Development Ordinances.
3. That the City Council has judged this application by the
guidelines, standards, criteria, and policies contained in the
Subdivision and Development Ordinance upon which it may take
judicial notice.
4. That the Council may take judicial notice of its own
proceedings, those of the Commission, governmental statutes,
ordinances, and policies, and of actual conditions existing within
the City and the State.
5. That the following provision of Section 11-9-606 B 14.,
Pressurized Irrigation System, of the Subdivision and Development
Ordinance is noted which is pertinent to this Application:
Also, the above requirement may be waived if the subdivider
either 1) deeds to the City land for a well, drills the well
and places the well on line with the City water system,

depth and capacity are determined by the City; or 2) the
subdivider deposits, gives and grants sufficient funds with

on line with the City water systems. In many subdivisions,
the latter option may be preferable to the City so that the
City may combine funds to drill and equip one large well to
service several subdivisions, rather than have several
smaller wells of less capacity.
6. That the specific requirements regarding a variance that
must be evidenced and found by the City Council are as follows:
No variance shall be favorably acted upon by the Council
unless there is a finding, as a result of a public hearing,
that all of the following exist:
a. That there are such special circumstances or conditions
affecting the property that the strict application of
the provisions of this Ordinance would be clearly
impracticable or unreasonable; in such cases, the
subdivider shall first state his reasons in writing as
to the specific provision or requirement involved;
b. That strict compliance with the requirements of this
Ordinance would result in extraordinary hardship to the
subdivider because of unusual topography, the nature or
condition of adjacent development, other physical
conditions or other conditions that make strict
compliance with this Ordinance unreasonable under the
circumstances, or that the conditions and requirements
of this Ordinance will result in inhibiting the
achievement or objectives of this Ordinance.
c. That the granting of the specified variance will be
detrimental to the public welfare or injurious to other
property in the area in which the property is situated;
d. That such variance will not violate the provisions of
the Idaho code; and
e. That such variance will not have the effect of
nullifying the interest and purpose of this Ordinance
and the Comprehensive Development Plan.
7. That there does appear to be a specific benefit or
profit, economic gain or convenience to the Applicant if this

variance is granted since the Applicant would avoid the cost of
installing the pressurized irrigation.
8. That regarding Section 11-9-612 A. 2., regarding the
pressurized irrigation, it is specifically concluded as follows:
a. That there are no special circumstances or conditions
affecting the property that the strict application of
the provisions of the ditch tiling Ordinance would
clearly be unreasonable.
b. That strict compliance with the requirements of this
ditch tiling Ordinance would no result in extraordinary
hardship to the Applicant that other property owners and
developers are required to meet.
c. That the granting of a variance would not be detrimental
to the public's welfare or possibly injurious to the
public.
d. That the granting of this variance would not violate the
Idaho Code.
e. That the variance would not have the effect of altering
the interests and purposes of the ditch tiling Ordinance
which is included in the Subdivision and Development
Ordinance for safety purposes.
12. That it is concluded that the Application for a variance
from 11-9-606 B 14., Pressurized Irrigation, should be denied.
13. It is concluded, however, that the City does have the
authority to waive the pressurized irrigation requirement it the
City receives a deed to land for a well, the well is drilled and
placed on line with the City water system or the the City receives
funds sufficeint to purchase all necessary equipment to put a well
on line with the City water system.
14. That it is further concluded that the City is in need of
additional irrigation water for the new Tulley Park and is
desireous of using irrigation and not City water for the park;

that since the City may waive the pressurized irrigation when a
well or funds are given to the City so that the City either does
not have to use City water for irrigation or has funds to drill
new wells, that the City may waive the pressurized irrigation
requirement if water rights are given to the City and/or measures
are taken to supply additional water to the irrigation districts
so that additional water might become available to the City from
an irrigation district.
15. Therefore, it is concluded that the variance from 11-9-
606 B 14. is denied, however the pressurized irrigation
requirement will be waived if the Applicant conveys any water
rights that the land has to the City, or to the appropriate
irrigation district, such that the City may obtain additional
irrigation water for Tulley Park.
16. It is further concluded that if the irrigation water
rights of the land may not be transfered or conveyed such that the
City may obtain additional irrigation water for Tulley Park, or
the land has no irrigation water right, the denial of the variance
shall still stand.

SUBJECT: Variance Request -Pressurized Irrigation for Layne Industrial Park
Section 11-2-419.A of the Ordinance states:
"No non-conforming use of neighboring lands, structures or buildings in the same
district and no permitted or non-conforming use of lands, structures or buildings
in other districts shall be considered grounds for issuance of a variance.
Variances shall be granted only where strict application of the provisions of this
Ordinance would result in unnecessary hardship. "
Landscaping will be required of this subdivision, as it is required for all developments. The past
trend of large parking areas without landscaping must not be continued. I would defer to Gary

FOR A VARIANCE FROM 11-9-606 B 14. PRESSURIZED IRRIGATION
FINDINGS OF FACT AND CONCLUSIONS
The above entitled variance request having come on for
consideration on December 6, 1994, at approximately 7:30 o'clock
p.m. on said date, at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, the Applicant appearing through a representitive,
and the City Council having heard and taken oral and written
testimony, the City Council of the City of Meridian makes the
following:
FINDINGS OF FACT
1. That notice of the public hearing on the variance was
published for two consecutive weeks prior to the scheduled hearing
for December 6, 1994, the first publication of which was fifteen
(15) days prior to said hearing; that the matter was duly
considered at the December 6, 1994, hearing; that copies of all
notices were available to newspaper, radio and television stations.
2. That notice of public hearing is required to be sent to
property owners within 300 feet of the external boundaries of the
land being considered pursuant to 11-2-416 E. , 11-2-419 D. , and 11-
9-612 B. 1. b of the Revised and Compiled Ordinances of the City of
Meridian; that his requirement has been met.
3. That Ordinance 11-9-606 B. 14. reads as follows:

PRESSURIZED IRRIGATION SYSTEM: In each subdivision the
subdivider shall provide by underground tile, or other
like satisfactory underground conduit, pressurized
irrigation water to each and every lot within the
subdivision; that the pressurized irrigation system
shall be constructed and installed at the same time as
the domestic water lines, but shall not necessarily be
in the same trenches; that there shall be no cross
connections between the domestic water lines and the
irrigation water lines that do not comply with section
4-143 of the Revised and Compiled Ordinances of the City
of Meridian; that the City Engineer is hereby authorized
and directed to establish rules and regulations and
standards for pressurized irrigation systems and that
all pressurized irrigation systems shall comply with
those standards, rules and regulations. Provided,
however, that the requirements of this subsection may be
waived upon proof that any particular lot, parcel, or
piece of land does not have water rights in an existing
irrigation district.
Also, the above requirement may be waived if the
subdivider either 1) deeds to the City land for a well,
drills the well and places the well on line with the
City water system, including the necessary pumps,
piping, valves, pressure equipment, and all other
equipment necessary, and which well depth and capacity
are determined by the City; or 2) the subdivider
deposits, gives and grants sufficient funds with the
City to purchase all necessary equipment to put the well
on line with the City water systems. In many
subdivisions, the latter option may be preferable to the
City so that the City may combine funds to drill and
equip one large well to service several subdivisions,
rather than have several smaller wells of less capacity.

4. That the Applicant, Layne of Idaho, Inc., has requested
that it be granted a variance from the above presurized irrigation
requirement.
5. That Applicant states in the variance application that
it is developing an 18 .lot light industrial subdivision; the
parcel is unusually long and narrow; that pressurized irrigation
have not been required for other industrial projects in Meridian;

that the parcel is zoned for light industrial; that since other
light industrial subdivision in the area do not have pressurized
irrigation systems, this application would not be a special
priviledge to the owner.
6. The Applicant also stated the property will consist
mainly of paved parking lots and large building pads; that there
will be minimal landscaping which would ,require pressurized
irrigation; that pressurized irrigation would offer no benefit to
this. industrial subdivision or the City of Meridian
7. The entire property in question is described in the
variance application and is incorporated herein as if set forth in
full.
8. That the property in the area where the variance is
requested is zoned Light Industrial.
9. That the Applicant does own the property.
10. That the only substantive comment came from the Meridian
Ploanning Administratore, Shari Stiles; she stated thgat
landscaping will be required of this subdivision, as it it
required for all developments. The past trend of large parking
areas without landspcaing must not be continued. I would defer to
Gary Smith and the public works staff as to whether pressurized
irrigation is feasible for this project.
11. That the City has not received a variance application to
allow an applicant to not meet the pressurized irrigation
Ordinance and has not specifically dealt with requiring
pressurized irrigation in light industrial zoned areas.

12. That there is live water water behind this property and
it is assumed that the property has a water right since the
property has been used agriculturally in the recent past.
13. That no other testimony was heard at the hearing.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City has authority to grant variances pursuant
to Section 11-2-419 of the Zoning Ordinance and pursuant to
Section 11-9-612 of the Development Ordinances.
3. That the City Council has judged this application by the
guidelines, standards, criteria, and policies contained in the
Subdivision and Development Ordinance upon which it may take
judicial notice.
4. That the Council may take judicial notice of its own
proceedings, those of the Commission, governmental statutes,
ordinances, and policies, and of actual conditions existing within
the City and the State.
5. That the following provision of Section 11-9-606 B 14.,
Pressurized Irrigation System, of the Subdivision and Development
Ordinance is noted which is pertinent to this Application:
Also, the above requirement may be waived if the subdivider
either 1) deeds to the City land for a well, drills the well

6. That the specific requirements regarding a variance that
must be evidenced and found by the City Council are as follows:
No variance shall be favorably acted upon by the Council
unless there is a finding, as a result of a public hearing,
that all of the following exist:
a. That there are such special circumstances or conditions
affecting the property that the strict application of
the provisions of this Ordinance would be clearly
impracticable or unreasonable; in such cases, the
subdivider shall first state his reasons in writing as
to the specific provision or requirement involved;
b. That strict compliance with the requirements of this
Ordinance would result in extraordinary hardship to the
subdivider because of unusual topography, the nature or
condition of adjacent development, other physical
conditions or other conditions that make strict
compliance with this Ordinance unreasonable under the
circumstances, or that the conditions and requirements
of this Ordinance will result in inhibiting the
achievement or objectives of this Ordinance.
c. That the granting of the specified variance will be
detrimental to the public welfare or injurious to other
property in the area in which the property is situated;
d. That such variance will not violate the provisions of
the Idaho code; and
e. That such variance will not have the effect of
nullifying the interest and purpose of this Ordinance
and the Comprehensive Development Plan.
7. That there does appear to be a specific benefit or
profit, economic gain or convenience to the Applicant if this

variance is granted since the Applicant would avoid the cost of
installing the pressurized irrigation.
8. That regarding Section 11-9-612 A. 2., regarding the
pressurized irrigation, it is specifically concluded as follows:
a. That there are no special circumstances or conditions
affecting the property that the strict application of
the provisions of the ditch tiling Ordinance would
clearly be unreasonable.
b. That strict compliance with the requirements of this
ditch tiling Ordinance would no result in extraordinary
hardship to the Applicant that other property owners and
developers are required to meet.
c. That the granting of a variance would not be detrimental
to the public's welfare or possibly injurious to the
public.
d. That the granting of this variance would not violate the
Idaho Code.
e. That the variance would not have the effect of altering
the interests and purposes of the ditch tiling Ordinance
which is included in the Subdivision and Development
Ordinance for safety purposes.
12. That it is concluded that the Application for a variance
from 11-9-606 B 14., Pressurized Irrigation, should be denied.
13. It is concluded, however, that the City does have the
authority to waive the pressurized irrigation requirement it the
City receives a deed to land for a well, the well is drilled and
placed on line with the City water system or the the City receives
funds sufficeint to purchase all necessary equipment to put a well
on line with the City water system.
14. That it is further concluded that the City is in need of
additional irrigation water for the new Tulley Park and is
desireous of using irrigation and not City water for the park;

that since the City may waive the pressurized irrigation when a
well or funds are given to the City so that the City either does
not have to use City water for irrigation or has funds to drill
new wells, that the City may waive the pressurized irrigation
requirement if water rights are given to the City and/or measures
are taken to supply additional water to the irrigation districts
so that additional water might become available to the City from
an irrigation district.
15. Therefore, it is concluded that the variance from 11-9-
606 B 14. is denied, however the pressurized irrigation
requirement will be waived if the Applicant conveys any water
rights that the land has to the City, or to the appropriate
irrigation district, such that the City may obtain additional
irrigation water for Tulley Park.
16. It is further concluded that if the irrigation water
rights of the land may not be transfered or conveyed such that the
City may obtain additional irrigation water for Tulley Park, or
the land has no irrigation water right, the denial of the variance
shall still stand.

ITEM #25: PUBLIC HEARING: REQUEST FOR VARIANCE BY LAYNE INDUSTRIAL
PARK:
Kingsford: At this time I will open that public hearing and invite to owner and his designee
to speak first.
Gary Lee, 250 South Beechwood, Boise, was sworn by the City Attorney.
Lee: Mayor and Council members, the request before you this evening. is a variance
application for pressurized irrigation for a recently approved preliminary plat called Layne
Industrial Park Subdivision. The nature of this development is light industrial and the
property will consist mostly of paved parking lots and large building pads in the future.
Therefore there will be a minimum of landscaping requirement for this particular site. In
addition CC&R's have been prepared and will be submitted with the final plat that indicate
the future lot owners and builders will be limited to a landscape strip along the street
frontage approximately 5 feet wide in addition to possible low water consumptive
landscape throughout the parking lot. Most of the sites will be as I stated earlier will be
building pads and gravel or paved parking areas or storage areas for the industrial uses.
We have estimated the approximate amount of landscape area that this site will entail, of
the 27 and 3 tenths acre total development there about 31/2 acres of road right of way that
will be taken out and the buildings and parking will comprise about 23 1/2 acres, it leaves
a net irrigated acreage of about 3 tenths of an acre or 2% of the site. Current ordinances
require subdivisions to include pressurized irrigation systems, however in this particular
case due to the small amount of landscaping perceived we believe that there will be
minimal benefits for the future lot owners and the City of Meridian to require pressurized
irrigation. The cost of installation of this magnitude would be quite expensive for the
amount of benefit derived. We have computed an approximate amount of water required
over that landscaped area for this development and it is equivalent to about 2 gallons a
minute over a 24 hour period or about 2800 gallons a day for landscaping. If you were to

look at a like residential development of the same size total consumptive use for irrigation
alone would nan about 33,000 gallons a month. The comparison over a total development
of this size of 27 acres would be about 96 lots would be a little over 3 million gallons of
water required for the whole development. So there are considerable differences in the
amount of water usage needed and we believe that this variance is applicable in this
particular situation. Other industrial subdivisions in the area can-ently don't have or even
have a need for pressurized irrigation system. Therefore this application we believe is not
a special privilege to this owner. If you have any questions I ~nrould be glad to entertain
those at this time.
Corrie: Mr. Mayor, Mr. Lee, how do you propose to water the landscaping area?
Lee: We would submit that to you, the amount of landscaping would be watered through
the City system.
Kingsford: Are you prepared then to pay the current Well Development fee for that as an
alternative then?
Lee: Which is the four hundred and some a lot?
Kingsford: Which I think could be broken out based on your calculations or ours.
Lee: 1 would have to defer that I suppose to the developer, it is his checkbook.
Kingsford: I think that would become a factor, certainly the Council's decision.
Lee: I think it would be considered probably favorably. the owner.
Kingsford: Any other questions by the Council?
Morrow. I have none.
Crookston: Gary, maybe I just misunderstood, you said that the water usage would be
2800 gallons per day?
Lee: For the industrial use.
Kingsford: For the landscaping.
Lee: Just for the landscaping, 2800 gallons a day and about 85,000 gallons a month.

Crookston: Then you had a reference something about 30,000 gallons a month?
Kingsford: On a residential lot. So he would be roughly talking about a well development
on 3 lots based on those calculations. Does the Council have any other questions?
Anyone else from the public that would like to offer testimony on this variance? Seeing
none I will close that public hearing. Council members.
Corrie: Mr. Mayor I do have a question, Shari has to Gary Smith, would it be feasible to
pressurize irrigate this Gary?
Smith: Councilman Corrie, Mr. Mayor I don't think that based on, Gary submitted these
calculations to me to review earlier today and I think they are pretty accurate. He has
done some research of his own on irrigation water usage on his lot where he lives. So I
accept his figures as far as single family dwellings are concerned. The area that he is
devoting to landscape in this industrial subdivision I think is pretty close to what would be
ultimately a 1/3 to a 1/2 acre is probably all the landscape area that they will end up with.
Corrie: Thank you
Kingsford: I guess I would ask Shari, being the Zoning Administrator is that your
calculations for landscaping in that site?
Stiles: It would depend on the parking areas on an individual lot basis, of course I would
like more, but if we would, we roughly calculated 5 feet along the front and that would be
about a 1 /2 acre.
Morrow. That 5 feet represents from the curb, between the curb and the parking basically
it is going to have a little landscape berm that sits off the street, the sidewalk from the
parking lots themselves.
Stiles: Right to contain some trees.
Kingsford: I think Mr. Lee's water usage is pretty accurate, it is about exactly what I use
on my lot. I would suggest to you though Mr. Lee that in event you do that you certainly
want to get a separate meter because in Meridian in commercial zones water usage and
the sewers is the key to that. So if you are an industrial user you will pay for the sewer use
if you don't have a separate meter. You will want to do you engineering for that.

Kingsford: However you want to do it, I would suggest that probably just one meter for the

whole thing and maybe have some sort of a users agreement that they split that out or
whatever.

SUBJECT: Variance Request -Pressurized Irrigation for Layne Industrial Park
Section 11-2-419. A of the Ordinance states
"No non-conforming use of neighboring lands, structures or buildings in the same
district and no permitted or non-conforming use of lands, structures or buildings
in other districts shall be considered grounds for issuance of a variance.
Variances shall be granted only where strict application of the provisions of this
Ordinance would result in unnecessary hardship. "
Landscaping will be required of this subdivision, as it is required for all developments. The past
trend of large parking areas without landscaping must not be continued. I would defer to Gary
Smith and the public works staff as to whether pressurized irrigation is feasible for this project.
