Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. Idaho St. Meridian, ID. 33642 Re: Variance Application ; :Meridian 7,oning Ordinance for Pine St. Development, Ron Walsh Dear Mr. Berg: It is the opinion of Settlers Irrigation District that the Meridian City Council should deny Pine Street Development's request for variance of Section 33 of the Zoning Ordinance as it applies to Settlers South - side Canal. Just for the record Settlers Irrigation District has no jurisdiction over the Jackson Drain, it is managed by the Nampa -Meridian Irrigation District. The valiance application submitted by Pine Street Development states in item # 12 that "The Settler's canal and Jackson Drain are Large waterways which makes it economically unfeasible to pipe." It is our opinion that the safety of the future residents of this development far outweigh any concerns about creating financial hardships for developers. A great many other sections of our South -side Canal have been piped through the City of Meridian as I am sure you are well aware. They also state in # 14 & # 15 that the City of Meridian "does not provide for alternatives such as fencing or water amenities." I think you will agree piping makes for a safer and more aesthetically clean environment than an open, fenced ditch and right-of-way. So far I have yet to see anyone install a fence a child cannot find a way through, over, or under. I consider the option of turning an irrigation canal, which will be dry 5 or 6 months out of the year, into a water amenity an easy `out' for developers, leaving a situation which would soon become a maintenance problem for the future residents, the city or county agencies, and the Irrigation Districts. Water amenities are best left to areas with year round, natural flows. This section of Settlers South -side Canal, will require a 36" pipe of concrete or PVC construction, depending on load requirements, depth, etc. We also require that it be connected to the existing pipe in Danbury Fair Subdivision and extend to, or under, Locust Grove Rd. depending on ACHD's requirements in that area. Also, this property lies within the boundaries of Settlers Irrigation District and therefor will be required to provide an irrigation water delivery system to each lot in the development. if you have any questions please call me at 343-5271. 1 �! We just basically submitted the title report with the existing legal descriptions of record. Some of those maybe old and some of the older (inaudible). Kingsford: Well, I think the appropriate thing is to approve of the findings and conditions and then not prepare an ordinance until an adequate description has been delivered. Morrow. Becky Bowcutt, 1111 South Orchard, Boise, was sworn by the City Attorney. Meridian City Council September 6, 1994 Page 44 Bowcutt: The applicant has requested that 1 withdraw the variance. When we originally submitted it was pertaining to the ditch. We had the Jackson Drain and the Settler's Canal and he had some reservations about trying to tile it and cost. We did research with Settler's I met and talked with Shari concerning the policies of the City of Meridian and it is my understanding that tiles below that 48 inch which you guys have kind of used as a guideline as what is economically feasible to pipe. Therefore we went and proceeded and got some quotes from companies to pipe and the variance issue has moved and it will be required. I would like to withdraw that application. Thank you. Kingsford: Having noticed it I have to ask if there is further public comment. I would hope there would be none since it is being withdrawn. Anyone else from the public that would like to offer testimony on the variance request. It is being withdrawn and they will pipe the ditch so the variance is not required, but it was noticed. Idaho St. Meridian, ID. 83642 Re: Variance Application / Meridian Zoning Ordinance for Pine St. Development, Ron Walsh Dear Mr. Berg: It is the opinion of Settlers Irrigation District that the Meridian City Council should deny Pine Street Development's request for variance of Section 33 of the Zoning Ordinance as it applies to Settlers South - side Canal. Just for the record Settlers Irrigation District has no jurisdiction over the Jackson Drain, it is managed by the Nampa -Meridian Irrigation District. 'The variance application submitted by Pine Street Development states in item #12 that "The Settler's canal and Jackson Drain are large waterways which makes it economically unfeasible to pipe." It is our opinion that the safety of the future residents of this development far outweigh any concerns about creating financial hardships for developers. A great many other sections of our South -side Canal have been piped through the City of Meridian as I am sure you are well aware. They also state in # 14 & # 15 that the City of Meridian "does not provide for alternatives such as fencing or water amenities." I think you will agree piping makes for a safer and more aesthetically clean environment than an open, fenced ditch and right-of-way. So far I have yet to see anyone install a fence a child cannot find a way through, over, or under. I consider the option of turning an irrigation canal, which will be dry 5 or 6 months out of the year, into a water amenity an easy `out' for developers, leaving a situation which would soon become a maintenance problem for the future residents, the city or county agencies, and the Irrigation Districts. Water amenities are best left to areas with year round, natural flows. This section of Settlers South -side Canal, will require a 36" pipe of concrete or PVC construction, depending on load requirements, depth, etc. We also require that it be connected to the existing pipe in Danbury Fair Subdivision and extend to, or under, Locust Grove Rd. depending on ACHD's requirements in that area. Also, this property lies within the boundaries of Settlers Irrigation District and therefor will be required to provide an irrigation water delivery system to each lot in the development.
