STATEMENT OF COMPLIANCE:
This subdivision will comply with ACRD and the City of Meridian
ordinance concerning streets, curbs, gutters and sidewalks. This
development is also in conformance with the City of Meridian
Comprehensive Plan and it will comply with city ordinances. The
Preliminary Plat includes all appropriate easements as per Note 4 on
the Preliminary Plat. The development will connect to city services.
Furthermore, street names do not conflict with the city grid system.

RE: Preliminary Plat for Layne Industrial Park
The following-are our responses to your comments dated October 7,
1994, for Layne Industrial Park Subdivision.
1. Due to the nature of the development, a variance for
pressurized irrigation will be requested prior to the City
Council public hearing for the preliminary plat.
2. Per your conversation with Gary Lee, a five-foot sidewalk will
be constructed along the east side of Locust Grove Road-and
along the south side of Layne Street.
3. Pending further investigation, the preliminary plat will or
will not reflect a bike path along the Union Pacific Railroad.
Regardless, the developer will support the City of Meridian.
Ordinance.
4. .The preliminary plat will be adjusted to show a temporary
turn-around easement at the east end of Layne Street.
5. The center line of N. Locust Grove Road will be shown on the
preliminary plat.
6. Any ditches requiring tiling will be done so in accordance
with the Meridian. City Ordinance. Approvals will be submitted
to the City prior to site development.

to be no restricting conflicts between the City of Meridian
standards and the development of Layne Industrial Park. After
review of this response and the updated preliminary plat, it would
be greatly appreciated if a recommendation for approval of said
preliminary plat of Layne Industrial Park would be forwarded to the
City Council members.

ITEM #9: PUBLIC HEARING: REQUEST FOR PRELIMINARY PLAT FOR LAYNE
INDUSTRIAL PARK SUBDIVISION BY LAYNE OF IDAHO:
Johnson: I will now open the public hearing, is there a representative for Layne Industrial
Park that would like to address the Commission at this time.
Gary Lee, 250 South Beechwood, Boise, was sworn by the City Attorney.
Lee: The request before you this evening is preliminary plat approval for a project known
as Layne Industrial Park Subdivision. This particular project is located on Locust Grove
Road about a 1/4 north of Franklin Road. It is just adjacent to the railroad tracks and
situated north of Locust Grove Industrial Park as it is today. The project consists of 18
industrial building lots on about 30 acres with a density of about 1.7 lots per acre. The
current zoning here is I-L which is Light Industrial zone. The minimum building lot size
shown on the preliminary plat is about 40,000 square feet, 200 by 200 squares is the
smallest lot. The structures and the uses on these planned industrial lots will comply with
the existing I-L zoning in the City of Meridian ordinances and will comply will all the
requirements for the code. There will be either a landscaped drainage lot as shown on the
preliminary plat or a public right of way disposal system for the storm drain systems. If
there is a common lot required and this will be determined at final design stage. A
business owners association will be formed to maintain those lots. The project has direct
access to Locust Grove Road, there are 2 stub streets planned to the north property line
for future expansion. As 1 mentioned earlier the project is adjoining existing railroad right
of way along its entire southern boundary. All the streets within the development will
comply with ACHD standards with the exception of sidewalks. And there will be a variance
request forthcoming for Council consideration at a later date. Sewer and water on this
development will be extensions of existing City services which are adjacent to the project.
Any irrigation ditches that are required to remain in service will be tiled. Pressure irrigation
is not planned at this time for this development and a variance will be requested at the
Council level. I had a chance to review the responses by City staff, from Shari Stiles.the
Planning director we concur with her responses with the exception of the irrigation and
sidewalks which I mentioned we will be applying for the variance. And we will also sit
down with Ms. Stiles and discuss the pathway requirements as the Comprehensive Plan
addresses. I looked at Gary Smith's comments the City Engineer and concur with his
conclusions with the exception of item 16 and 17. The Ada County Highway District has
reviewed the preliminary plat and during that course of review they saw no reason for

extension of spruce tree to the south boundary. In their planning there is no need for an
additional railroad crossing at that point. And we also discussed the existing private street
which lies to the east of this property and ACRD had some recommendations on how that
intersection could be reconfigured to make it a better situation and we will comply with the
highway district requirements, I would be glad to answer any questions.
Johnson: Any questions of Mr. Lee?
Rountree: What is the setback from centerline of Locust Grove Road, for right of way?
It doesn't show it.
Lee: It is currently, the right of way is situated 50 feet on adjoining properties. ACHD has
requested an additional 10 feet from what is shown on the preliminary plat,. so the right of
way there will be 60 feet total width. The reason for that is they have some long range
plans to realign Locust Grove to the West and install a new railroad crossing and
eventually this particular crossing will be abandoned so they saw no need to have any
wider right of way through there.
Johnson: Any further questions? This is a public hearing, anyone from the public that
would like to address the Commission? Seeing no one then I will close the public hearing.
This is a preliminary plat.
Hepper: Mr. Chairman, I move that we recommend approval of the preliminary plat.

conditional use permit for a day care. Seeing none I will close that public hearing. We
have findings on that?
Crookston: They are the same findings.
Kingsford: So we would address the Conditional use permit when we have the zoning
ordinance at the next meeting.

Kingsford: At this time I will open that public hearing and invite the owner or his designee
to speak first.
Gary Lee, 250 South Beechwood, Boise, was sworn by the City Attorney.
Lee: The application before you this evening is a preliminary plat for Layne Industrial Park
Subdivision. It is located on Locust Grove Road about 1/4 mile north of Franklin, north of
the existing Locust Grove Industrial Park. There are 18 lots planned on 30 acres, a
density of about 1.5 lots per acre in an existing I-L zone which is Light Industrial. The
minimum building lot size shown on the preliminary plat is about 40,000 square feet. the
structures and the uses for the site will comply with the I-L zoning ordinance and
requirements of the city zoning ordinance. All the facilities will be constructed to public

standards for ACRD streets, the sewer and water will be extensions of existing water and
sewer facilities that are currently located on Locust Grove Road. There will be a stub
street planned in this development to the north to access properties adjacent to this parcel.
In the existing irrigation ditches within the development will be tiled and they are required
to be maintained. All utilities will be provided for these facilities. We had addressed some
comments that were made by the City Engineer Gary Smith and the City Planner Shari
Stiles and responded with a revised preliminary plat on a few of their comments which
should be in your packet tonight. If you have any questions I would be glad to entertain
those at this time.
Morrow: 1 have a couple of questions, this project is put together with covenants and
restrictions detailing Light Industrial uses and landscaping requirements and those types
of things?
Lee: Yes
Morrow: And the other thing is the applicant is aware that Locust Grove Road is to be
relocated in the future and that it is unlikely that there will be a rail crossing adjacent at this
point.
Lee: Yes that was made known to us at the ACRD review.
Kingsford: Any other questions for Mr. Lee? My comment there, you need to change, it
is not going to be a co-generating I understand and you have that marked on the plat.
Lee: Oh really.
Corrie: I have some questions, it went my me a little fast, your covenants on Light
Industrial how are you going to have that written up. Since we don't have, our ordinance
doesn't address this properly how is this going to be done?
Morrow: I would suspect that with any subdivision that in the interest of making the
subdivision and the rezone workable for the city to get a good well done subdivision that
it is in their best interest and our best interest to have covenants and restrictions and
architectural reviews that go with each parcel of property. Such as most industrial,
commercial and residential subdivisions are done.
Corrie: Which are we going to use as light industrial, the definition that we have in the
ordinance.
Morrow: In terms of?

Cowie: Well, as you well know, our ordinance doesn't, has a problem, Light Industrial we
just have industrial we have light, we have it defined but we don't have i# straightened out
yet.
Morrow: Well, we have it defined but the covenants and restrictions in terms of what we
are discussing here with Mr. Lee would be with respect to building size or building style
with respect to they might as a subdivision require 10% of the land area of 5% of the land
area to be landscaped. They may wish to have no metal buildings, or if they are going to
have metal buildings they may wish to have some sort of block or stone architecture o the
front of them to break them up to make them look more attractive. We can't as a Council
require certain architectural looks but they certainly can in their CC&R's with respect to the
subdivision. And those would be the things that I am addressing our current zoning and
development ordinances list the acceptable uses in a light industrial zone. And some of
them are permitted and some of them are conditional use. The one that we worked on as
a committee has not yet been adopted. So, their CC&R's can reflect those uses that are
currently available or they can reflect the ones that are to be adopted.
Tolsma: (Inaudible)
Lee: Are there some standards that the City would like to see in these CC&R's. I know
the Attorney will review them, but what specifically will they be looking for?
Cowie: I think he is aware of what we are looking at too so that would be satisfactory with
me.
Kingsford: Gary, I would ask you to get with Shari and look at some of those things in
terms of how it applies in our comprehensive plan as well.
Cowie: Thank you Walt.
Kingsford: Thank you Mr. Lee, anyone else from the public that would like to offer
testimony on the preliminary plat for Layne Industrial Park? Seeing none I will close that

Corrie: Mr. Mayor, I have a question I guess, it may be a little premature here for Shari,. bu#
number 1 of you comments pressurized irrigation needs to be provided to the subdivision

Jim Merkle, 9550 Bethel Court, Boise, was sworn by the City Attorney.
Merkle: Mr. Mayor and members of the Council, I am here this evening on behalf of the
applicant Raven Hill Partnership. This application is for annexation and R-4 zoning of
approximately 19.6 acres of ground with 63 single family lots. It results in a density of
about 3.2 lots per acre. The project is located on the east side of Locust Grove
approximately 1/2 mile south of Overland. The applicant is proposing single family homes
sizes with minimum square footage of 1500 square feet. If I can hold this up, Locust Grove
Road is right here, Overland is up this way. Access to the subdivision will be from Locust
Grove Road with one main access off of Locust Grove and it will tie into the Los Alamitos
subdivision and Sundance Subdivision to the east. The streets within the subdivision will

intersections.
11. Water service to this development is contingent on positive results from a hydraulic
analysis by our computer model.
12. The Preliminary Plat map needs to include the Name, Address, and Phone Number of the
plat preparer, and the Name ,Address, and Phone Number of the person(s) to receive
correspondence and/or Ciry billings (Developer).
13. Please provide a vicinity map that extends a minimum of 1/2 mile each way from the
proposed plat area.
14. Please indicate the existing land use and zoning of the proposed subdivision and adjacent
land.
15. Provide statements of intended use of subdivision, dedications to the public and/or
easements, together with a statement of location, dimension and purpose of such, and
development features.
16. The 30 foot 1/2 Right-of -Way width for Spruce Avenue should be continued to the south
boundary of the proposed development. This would line up with the existing 30 foot 1/2
Right-of--Way that was extended to the north boundary of Locust Grove Industrial Park
Subdivision.
17. Developer needs to coordinate with the adjacent property owner to the east, to see if a
compromise can be reached with regard to the misalignment of the proposed Layne Street
and the existing Private Street. The offset intersection as shown on the Preliminary Plat
Map is undesirable.

SUBJECT: LAYNE INDUSTRIAL PARK SUBDIVISION- PRELIMINARY PLAT
On October 5, 1994, the Commissioners of the Ada County Highway
District ;hereafter called "District") took action on the
Preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable
standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and
approval by the District.
2. If public street improvements are required: Prior to any
construction within the existing or proposed public right-of-
way, the following shall be submitted and subject to review
and approval by the District:
a. Three complete sets of detailed street construction
drawings prepared by an Idaho Registered Professional
Engineer, together with payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and
the District together with initial payment deposit for
inspection and/or testing services.
c. Complete all street improvements to the satisfaction of
the District, or execute Surety Agreement between the
Developer and the District to guarantee the completion of
construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by
the Local Government Agency having such authority together
with payment of fee charged for the manufacturing and
installation of all street signs, as required.
4. If Public Rights-of-Way Trust Fund deposit is required, make
deposit to the District in the form of cash or cashier's check
for the amount specified by the District.
5. Furnish easements, agreements, and all other datum or
documents as required by the District.
6. Furnish Final Plat drawings for District acceptance,
certifications, and endorsement. The final plat must contain
the signed endorsement of the Owner's and Land Surveyor's
certification.
7. Approval of the plat is valid for one year. An extension of
one year will be considered by the Commission if requested
within 15-days prior to the expiration date.

3. The City of Meridian Comprehensive Plan has a goal to extend
Locust Grove over I-84 as a connection from Franklin Road to
Overland Road. This would realign Locust Grove with the exist-
ing Locust Grove north of Pine and south of Franklin. The
portion of Locust Grove abutting the subject parcel will be-
come a Local/Commercial roadway. The District requirements
reflect these changes. When the alignment is completed and a
new railroad crossing is finished, Union Pacific may require
that the existing crossing on Locust Grove be closed.
4. The existing right-of-way for Locust Grove originally came
from the parcel to the west, therefore the 10-additional feet
of right-of-way will be required of the subject parcel.
5. The Ada County Ridge to Rivers Pathway Plan shows a future
pathway along the Union Pacific Railroad which runs along the
south boundary of the subject parcel.
6. Locust Grove Industrial Park directly across the railroad
right-of-way to the south of the subject parcel has public
right-of-way along the eastern property line. The subject
parcel site plan shows an "L" type turnaround to the south of
the proposed Layne Street along the east property boundary and
30-feet of right-of-way extending to the north property bounda-
ry along the east property boundary. Staff does not antici-
pate the need for a railroad crossing at the east property
boundary, therefore staff concurs with the submitted site plan.
A stub street to the north near the center of the property is
also proposed.
7. The preliminary plat proposes one-half of a stub street to the
north and a turnaround along the east property boundary.
Staff recommends the stub street to the north be constructed
as one-half of a 41-foot street section plus 12-feet of paving
with 5-foot sidewalks in 50-feet of right-of-way. The turn-
around can be paved only.
8. It appears that a private street may intersect the proposed
public street along the east property boundary.
9. The preliminary plat indicates drainage retention areas on
Lots 1 and 4, Block 2. Staff recommends that the storm water
retention lots be platted as separate lots to be owned and
maintained by a business owners association.
10. This application is scheduled for public hearing by the Meridi-
an Planning & Zoning Commission on October 11, 1994.

SITE SPECIFIC REQUIREMENTS:
1. Dedicate 10-feet of additional right-of-way from the existing
right-of-way line of Locust Grove abutting parcel.
2. Construct curb, gutter and 5-foot concrete sidewalk and match
paving on Locust Grove abutting the parcel or provide a depos-
it to the Public Rights-of-Way Trust Fund at the District for
the aforementioned roadway improvements. Improvements shall
be constructed to a 41-foot back-to-back street section.
3. Construct the interior streets to a 41-foot back-to-back
street section with vertical curb and 5-foot sidewalks.
4. Plat the storm water retention lots as separate lots to be
owned and maintained by a business owners association.
5. Construct the proposed Spruce Street along the east property
boundary as one-half of a 41-foot street section plus 12-feet
of paving with 5-foot sidewalks in 50-feet of right-of-way.
The turnaround can be paved only.
6. Direct lot or parcel access to Locust Grove is prohibited, in
compliance with District policy. Lot access restrictions
shall be stated on the final plat.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.
2. Dedicated streets and drainage systems shall be designed and
constructed in conformance with District standards and poli-
cies.
3. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACRD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
4. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
5. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-

provements. Authorization for relocations shall be obtained
from the appropriate entity.
6. Continue existing irrigation and drainage systems across par-
cel.
7. Submit three sets of street construction plans to the District
for review and appropriate action.
8. Submit site drainage plans and calculations for review and
appropriate action by ACRD. The proposed drainage system
shall conform to the requirements of Meridian and shall retain
all storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a common lot owned by a homeowners
association set aside specifically for that use. There shall
be no trees, fences, bushes, sheds, or other valuable ameni-
ties placed in said lot. Drainage lots and their use restric-
tions shall be noted on the plat.
9. Provide design data for proposed access to public streets for
review and appropriate action by ACRD.
10. Locate driveway curb cuts a minimum of 5-feet from the side
lot property lines when the driveways are not being shared
with the adjacent property.
11. Developer shall provide the District with a copy of the record-
ed plat prior to the installation of street name signs.
Street signs will not be ordered until all fees have been paid
and a copy of the recorded plat has been provided to ACID
staff. The copy of the recorded plat shall show the recording
information as inscribed by the Deputy County Recorder.
12. Install a stop sign on every unsignalized approach of a
project street to an intersection involving a collector or
arterial as the cross-street. The stop sign shall be in-
stalled when the project street is first accessible to the
motoring public.
13. Aright-of-way permit must be obtained from ACfID for all
street and utility construction within the public right-of-
way. Contact Construction Services at 345-7667 (with zoning

14. A request for modification, variance or waiver of any require-
