Tolsma: Mr. Mayor I would move to approve the Final Plat of the Summerfield subdivision 71 lot, subject to the engineers approval of his comments and that the School District site be included in the overall project but not necessarily n the Final Plat of the first phase. Giesler: Mr. Mayor, I guess I'd like to have Gary explain some of his comments. Gary is any of these things been resolved, or is it sill pretty much, a lot of things to take of? Smith: Mr. Mayor, Councilman Giesler, I received an updated Plat that, yesterday or this morning, from the Project Manager of Hubble engineers, and a letter of apology based on the incomplete lat that was submitted, I'm not up to speed on their operation on the computer edited drafting design system that they use nowadays, but apparently part of that program had been turned off ~ ~ ~. , Meridian City Council October 5, 1993 Page 8 when they, a transparency was produced, and it just didn't get checked when it went out the door. They did return a complete Plat to me this morning, and it has on it according to Mr. Cummings the corrections that I requested, but I have not had a chance to look at it. Giesler: How long until that would be? When will that be? Smith: Oh, Giesler: A week or so? Smith: I suspect something like that. Kingsford: Certainly before Gary would sign the Plat. Smith: I think it's just one of those things that happened, it hasn't happened before, so I was ,saturday I was a little taken back by it. I shouldn't work Saturdays. Kingsford: Mr. Tolsma Tolsma: On the street names, did you get that comment sheet from Walt Casey? Where that one little section of street the name is Fuller- Smith: That was an issue Kingsford: That would have to be private, a blue private street anyway. The Recreation District has the pleasure to do that, they pick up the signage from the Highway District it will cost them, the cost of printing a sign. Smith: I have been unable to get a hold of Walt is out of town , but that is exactly what he would want to do. Kingsford: Any other questions from the Council? So the representative of on that issue, the engineer, what's the situation now with Nampa Meridian the sellers district on that since our visit there, have been in contact with them. Kingsford: They claim they resolved the jurisdictional questions on that, and asked the Council at our last meeting in their presentation to help them with that program. Would be nice if they get it going, they claim they do. Still would rather if it's possible to do that to have surface water rather than us service that with well water. We look to go through the hearings and amend our ordinance to do away with the option in the near future. We would appreciate if you would work with us on that. Anything else from the Council? Corrie: Mr. Mayor, I'm sorry but Wayne I need some more information from you in reference to your letter regarding a quest for variance did they request a variance on this Final Plat or is it in there or what, I don't quite understand. The hearing is in November? Forrey: Mr. Mayor, members of the Council, the Final Plat is submitted just shows an easement for the eight mile lateral, but as the developer looked at our ordinance and realized that our ordinance requires tiling they then contacted the city and wanted to propose fencing the eight mile lateral, rather than tiling. That application was then submitted, a public hearing is scheduled for November 3, Will is that correct? So that variance request would be before the city at your first meeting in November. The Final Plat is here as submitted, the Final Plat doesn't show whether it is to be tiled of fenced so it possible the city could approve the Plat tonight and then they would have to the unless they proceed with the variance request for November 3. And then I had-an option in my comments, because in the variance application, the developer indicated the reason was cost, to reduce cost. So I addressed that in the bottom in my comments, as possible way to help him reduce cost but still meet the intent of the ordinance. I hope that helps. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. We ask that you assure the developer will provide walkways, bike paths and safe pedestrian access. In general, these are the creeks and drains° which traverse the Meridian area. During the Comprehensive Plan pcr<blic worksl~ps, the~.Nampa• Meridian Imgation District requested that the Five Mile, Ten Mile, Nine 1Vlile and South Slough Creeks be left open for future recreation and pathway development. They also requested that all laterals, (including the Eight Mile Lateral) be tiled. This Variance request is not in compliance with the Prc~~osed Comprehensive Plan or the Ada County Pathway Plan. Cost is cited by the developer as a reason for requesting the Variance. As a way to help the developer lower the cost of tiling this lateral, the City could deny the variance but approve the Final Plat with the stipulation that the lateral must be tiled within 30 months of the Final Plat recording date. This would allow the developer adequate time to negotiate competitive bids and possibly dovetail this construction with the ACRD Cherry Lane widening project to achieve economy of scale. This should reduce the cost comparable to other subdivisions with ditch tiling conditions. Idaho Street M¢ninaAN CITY ~MGINcER Meridian, ID 83642 Re: Tiling of Eight Mile Lateral Dear Mr. Forrey and Mr. Smith: On behalf of our clients, Gary Lasher and Rod Trumbull of L&R Sales, Hubble Engineering, Inc. has requested a variance to the requirement that new developments must the or cover all canals, ditches, and waterways that abut or adjoin all new projects. Public hearing for this variance was held on Wednesday, November 3rd, at Meridian City Hall. At that time, the City Council returned the variance request to the staff and requested a "findings of fact and conclusions of law". The purpose of the ordinance has been carefully considered and is very much appreciated; however, there is a general feeling throughout the development community that there are other issues that have not been addressed. The section of ditch that is involved travels northwesterly under Ten Mile Road to Cherry Lane in Meridian--commonly known as the Eight Mile Lateral. The existing ditch is open, approximately 8 to 12 feet wide and 4 to 6 feet deep. Calculations show that a 72 inch pipe will be required to adequately carry the amount of water that currently travels through the ditch. Preliminary engineering indicates an approximate cost for the pipeline to be $201,000, the inlet structure $30,000, the trash collection and safety grate $8,000, and engineering $5,000. Total cost is $244,000. A trash collecting and safety grate will need to be installed at every entrance to a section of the pipeline as .portions of the canal are the with each individual new c„hr~l;v;c;r.,, Wayne Forrey Gary Smith November 12, 1993 Page Two Safety Considerations If someone fell into an uncovered section of the canal and became pinned against the grate, the force of the water could trap them. If they were to get through the grate into the pipe, the chances of them drowning becomes 100%. The pipe would be full and there will be no air gap at the top of the pipe in which to breath. Their only chance would be at the top of the pipe as they passed under a manhole and were able to grab hold of the interior lip of the lid. These manholes will not be large enough for ladders. A common occurrence in new developments is the blowing of trash, such as visqueen, styrofoam panels, etc. There is only 12 to 16 inches of free board at the top of this particular section of the canal. Construction debris could get into the open portion of the canal and get wedged against the grate. The water would begin to back up and, if not noticed in time, would overflow the banks. Damage and/or complete loss of a portion of the canal bank could occur. Property damage from flooding could be extensive due to the large amount of water flowing and the amount of time required to divert the water from the canal at the main headgate. Long-Term Maintenance Considerations Nampa-Meridian Irrigation District allows the use of either reinforced concrete pipe or 10 gauge corrugated metal pipe to be installed in their canal systems. If tiling is required, metal pipe is less expensive to install and will be L & R Sales' choice. Corrosion of this metal pipe is assured, eventually a breech of the pipeline will occur. A section of the pipe could collapse or a leak may cause the bank to weaken and erode to cause flooding. Fairness to Pro e~rty Owners The property owned by L&R Sales extends to the middle of the canal on the south side. The north side belongs to another party. This other property will receive the same benefits as the L&R property, at no cost.. Should L&R Sales choose to proceed with the tiling, can they be reimbursed a portion of their investment from the north side property? Are the adjacent property owners allowed to refuse to participate? If so, Parkside Creek, as well as other developments with the same circumstances, would be at a disadvantage to compete with the neighboring property values. Could both of these issues be considered a form of discrimination? Because of the enormous cost involved, there is a possibility that the remaining undeveloped properties along this and other large canals, may become so unattractive and be substantially devalued. In the event the options to Tracts ZI. and III. are not exercised by Buyer, the escrowholder is authorized to xeturn such deed to Sellers at the expiration of the option. The escrowholder is authorized to determine that the option has expired unless Buyer has filed with the escrowholder a return receipt as proof of mailing or a personal receipt signed by Sellers in the case of personal delivery showing that the writing exercising the option has been given as required by this Agreement. Fitzgerald, to agreeing to hold documents in escrow will assume no responsibility, other than as specifically sat forth in this agreement, zn the event of any disagreement between the parties hereto or any parties iiitezested herein, resulting in adverse claims and demands being made by them or any of them fn connection with the escrowholder, such escrowholder shall be entitled at its option to refuse to comply with such demands so long as such disagreement shall continue; and in so refusing, such escrowholder may refuse to deliver any moneys, papers or property involved in or affected by this escrow; and in so refusing, the escrow holder shall not be or become liable to the patties to this escrow, for its failure and/or refusal, to comply with the conflicting or adverse demands of the parties hereto. Further, the escrowhvidez shall be entitled to continue to so refrain to act until: (a) the parietes hereto have xeached an agreement of their differences and :shall have notified the escrowholder in writing of such agreement, oz {b) the rights of the parties have been duly adjudicated by a court of competent jurisdiction. This Agreement may not be amended, ~, modified or changed ~n any way except by a written document signed by all of the parties hereto. 10. TAXES AND ASSESSMENTS. In the event that it is determined that the property is contaminated with substances preventl,ng the development of the property into a residential subdivision, then and in such event Sellezs and buyer shall have the right to terminate this Option Agreement and the option money previously paid by IIuyer shall be refunded to Buyer, The cost of the Environmental Site Assessment shall be shared equally by Sellezs and Buyer, except that if the property is contaminated and cannot be developed into a residential subdivision, Sellers agree to pay the out-of-pocket expense incurred by Auyer in having the Level z Environmental Site Assessment performed. PULLER PAkK. Sellers have dedicated to the public a park which is commonly designated as Fuller's Park and have provided access across their property from Cherry Lane and Ten- Mile Road for the public to reach the same. Auyer acknowledges that it will be required to provide ingress and egress to the Park across the property being purchased and agree to provide that access together with such other utilities as are presently existing and/or may be required by the City of Meridian. 16. ASSIGNMENT--RECORbYNG. This Agreement shall not be recorded by either party and may not be assigned by the Buyers. I7. ENFORCEMENT OF AGREEMENT. If either party hereto defaults n any manner or Fails to fulfill any and all provisions of this Agreement, and if the non--defaulting party places this Agreement with an attorney to exercise any of the rights of the non-defaulting party upon such default or failure, or if suit be instituted or defended by the non-defaulting party by reason of, under oz pertaining to such default or failure, then the non-defaulting party shall be entitled to recover reasonable attorney's fees, costs and expenses from the defaulting party.
