The project is located north of Ustick Road between Locust Grove Road and Meridian Road, just west of The Hollows Subdivision and east of Weaver Acres Subdivision. The Hollows annexation makes the property contiguous to the Meridian City Limits. This two-lot subdivision is for 12.52 acres on which a house and a mobile home currently exist. Apparently the subdivision is a result of the property owner wanting to build an additional single- family home. It appears that this subdivision will be contiguous to the Corporate City Boundary_ at a single . point common to the Hollows Subdivision. This development is within our area of impact, and area of urban service planning. 2. This development is n.~t serviceable at this time with our municipal sewer and water systems. 3. Per 1993 Comprehensive Plan - "land Use" Policy 6.3(b) Dry line sewer and water mains shall be installed within this subdivision, and plans and layouts shall be developed for lots and roads to accommodate for future re-subdivision to an urban density as shown on the 1993 Comprehensive Plan Land Use Map. The site contains 12.60 acres and is located on the north side of Ustick Road, approximately a 1 /4 mile west of Locust Grove Road and legally described as a portion of the SE 1 /4 of Section 31, Township 4N, Range 1 E. The application is comprised of: 1. Application forms prepared and submitted by the applicant's representative. 2. Preliminary plat of Patrick Subdivision 3. All other information contained in file 94-27-PDR. PROCEDURAL ITEMS 1. On March 21, 1994, Development Services accepted application 94-27-PDR and scheduled it for public hearing before the Commission on May 12, 1994. 2. Legal notice of the public hearing was published in the Idaho Statesman on April 25, 1994. On February 22, persons owning property within 300 feet of the site were notified of the hearing by mail. Prior to the hearing, notices were posted on and near the site. 1 /'~ ~ 3. Staff notified other agencies of this application on April 11, 1994, and solicited their comments. Any comments received are incorporated into the staff report. APPLICABLE LAW 1. The site lies within the Meridian Area of Impact where the Meridian Comprehensive Plan has been adopted as the applicable comprehensive plan for this area (§ 5.20, Ada County Comprehensive Plan; § 9-2-2A, Ada County Code). Applicable sections of the Meridian Comprehensive Plan are outlined below: GOALS OF THE COMPREHENSIVE PLAN GOAL 2: To ensure that growth and development occur in an orderly fashion in accordance with adopted policies and procedures governing the use of land, residential development, the provisions of services and the distribution of new housing units within the Urban Service Planning Area. GOAL 4: To provide housing opportunities for all economic groups within the community. GOAL 7: To provide community services to fit existing and projected needs. GOAL 8: To establish compatible and efficient use of land through the use of innovative and functional site design. GOAL 9: To encourage a balance of land use patterns to insure that revenue pay for services. PHYSICAL ENVIRONMENT POLICIES 7. No septic tank systems within the Urban Service Planning Areas shall be approved by Central District Health Department unless the following is demonstrated prior to approval: a. Dry sewer lines have been constructed and installed in preparation of connection to wet sewer lines throughout the parcel of land owned by the person proposing to install the septic system and plans have been prepared for connection to the municipal sewer system. 2 ~"'~, b. Placement of the temporary septic system will not degrade groundwater or surface water aquifers during the interim period. c. The septic system is solely a temporary and interim waste water disposal system. POPULATION GROWTH POLICIES 4. No new residential, commercial, or industrial developments should be approved outside of the Urban Service Planning Area, unless it can be shown that urban services can be reasonably provided. HOUSING DEVELOPMENT 7. Residential developments shall be phased in accordance with their connection to the municipal sewer system. RURAL AREAS 1. The Meridian Comprehensive Plan shall apply in the rural areas which are outside Meridian's City Limits and within the Meridian Area of City Impact, and the Ada County Zoning and Subdivision Ordinances shall apply in the rural areas outside the City Limits. 3. Although it is recognized that urbanized development does exist within the rural areas of the Area of City Impact, the rural lands should be kept in agricultural production as long as possible until urban services (municipal sewer and water facilities and other essential services) can be provided. In that regard to single family dwellings on 5 acre tracts, to wit: 4. Residential development is allowed in the rural areas provided that said development does not exceed the Rural Residential Agricultural density,... 2. Section 8-4C-2 of the Ada County Code states the permitted uses in the RT zone. This section includes: Single Family dwellings or mobile home -one per lot. Section 8-4C-6 specifies the design and dimensional standards for uses in the RT zone. The minimum lot size for a dwelling is listed as five (5) acres with a minimum street frontage of 250 feet. 3. Subdivisions may be permitted in development procedure established County Code). the RT zones only through the planned in Chapter 9 of Title 8 (§ 8-5-2, Ada 3 ~ r"~ 4. Chapter 10 of Title 8, Ada County Code, are the Subdivision Regulations which "apply to the subdivision of land within the unincorporated territory of Ada County" (§ 8-10-2B, Ada County Code). Section 8-10-1A of the Ada County Code (Design Standards) states: These standards shall be followed in all subdivisions regulated by this Title. In addition to these standards, all subdivisions shall meet the design standards and findings of fact listed in Chapter 9 relating to planned developments and shall be in accordance with the Comprehensive Plan. 5. Section 8-9-3C5 specifies the findings which shall be made by the Commission and the Board when considering applications for planned developments. This Section states: Findings of Fact: The Commission, before recommending action on a preliminary development plan, and the Board before taking action on said plan, shall first make findings of fact and conclusions of law which shall be supported by evidence in the hearing record to determine whether: a. The site design conforms to the topography and natural landscape features and shows consideration for the location and function of land uses and structures to achieve this purpose; b. The development is compatible with existing and planned permitted uses and would not cause damage, hazard or nuisance to persons or property in the vicinity; c. The internal street system is designed for the efficient and safe flow of vehicles and pedestrians without having a disruptive influence upon the activities and functions contained within the development nor place an undue burden upon the existing transportation and other public services in the surrounding area; d. Community facilities, such as park, recreational and open space areas are functionally related to all dwelling units and are easily accessible via pedestrian and/or bicycle pathways. Any common usable open space which may be provide (See Section 8-5-7-1 C) shall be directly accessible to the lots which have been reduced in size from the minimum lot size, and to multi-family development(s) within the PD; e. The proposal complies with the lot size and density standards set forth in Section 8-5-7-1. 4 .~ ,~ f. The overall plan is in conformance with the applicable Comprehensive Plan(s), Future Acquisition Maps, Area of City Impact ordinances and other pertinent ordinances; g. For any change of zone, the Commission and Board shall also make the findings outlined in Section 8-18-9B. FINDINGS 1. Location: The site is located on the north side of Ustick Road, approximately a 1 /4 mile west of Locust Grove Road and legally described as a portion of SE 1 /4 of Section 31, Township 4N, Range 1 E., Boise-Meridian, Ada County, Idaho. a. The site is within the Meridian Area of City Impact. b. The site is outside of the Meridian Urban Service Planning Area. 2. Size and Ownership: a. The site is 12.60 acres in size (identified by Tax Parcel # S0531438572). b. The site is owned by Rick and Jane Patrick. 3. Land Use and Zone: a. The site is currently used for minor agricultural pursuits and two single family residences b. The site is zoned RT (Rural Transition Zone). 4. Site Characteristics: a. The site is level. 5. Surrounding Land Use and Zoning: Land Use Zone North: Agricultural RT West: Residential R1 East: Residential RT 5 .°~ i"'~ South: Agri.\Residential R1/RT 6. Transportation and Other Services: a. Ustick Road is classified as a minor arterial street. b. Fire protection is provided by Meridian Fire District. c. The site is within the Nampa-Meridian and Settler's Irrigation District. d. Water is provided by individual wells. e. Waste-water is provided by individual septic systems. 7. The proposed lots will comply with the design and dimensional standards for the RT Zone. 8. The development proposes 2 single family lots on approximately 12.60 acres. 9. The site contains 1 mobile home and 1 site built residence. 10. An existing private lane (92-12-PR) shall provide access to the proposed lots. 11. With regard to the Findings of Fact of Section 8-9-3C5 of the Ada County Code pertaining to planned developments, staff offers the following for the Commission's, and the Board's, consideration: a. The proposed design appears to give consideration to the topography and natural landscape features of the site. b. The proposed development is compatible with the existing and planned uses in the area and will not cause damage, hazard or nuisance to persons or property in the vicinity. The proposed development will not increase the number of dwelling units which already exist on the site. c. The existing private lane appears to be designed for safe and efficient flow of traffic and pedestrians and will not have a disruptive influence upon the development. The proposal will not effect the present location of the private lane. d. No community facilities are proposed with this development. e. The development proposes 2 single family residential lots on approximately 12.60 acres; or .15 dwelling units per acre. This proposal complies with the lot size and density standards established under the RT Zone. 6 ~ r•~ f. The policy plan for the Meridian Comprehensive Area Plan has been adopted as the applicable plan for this site. The Meridian Comprehensive Plan provides for limited residential uses in the agricultural areas. Overall, the proposal appears to comply with goals and objectives of the Meridian Comprehensive Plan. g. This proposal does not involve a zone change request. STAFF ANALYSIS and CONCLUSIONS This is a request for a two (2) lot planned residential development (Patrick Subdivision). The site contains 12.60 acres and is located on the north side of Ustick Road, approximately a 1 /4 mile west of Locust Grove Road. The site has a RT (Rural Transition) zoning designation which requires minimum lot size of 5 acres. Each of the proposed lots exceeds the design and dimensional standards for the RT zone. The site lies within the Meridian Area of Impact, particularly within the Meridian Urban Service Planning Area. Section 5.30 of the Ada County Comprehensive Plan and Section 9-3-3A of the Ada County Code adopt the policy plan for the Meridian Comprehensive Plari as the applicable comprehensive plan for this area. Based on the Findings of Fact outlined in this staff report, staff concludes that this proposal meets the test of Section 8-9-3C5 of the Ada County Code pertaining to planned developments in that: a. (pertaining to site design) The .proposed design appears to give consideration to the topography and natural landscape features of the site. b. (pertaining to compatibility) The proposed development is compatible with the existing and planned uses in the area and will not cause damage, hazard or nuisance to persons or property in the vicinity. The proposed development will not increase the number of dwelling units which already exist on the site. c. (pertaining to street system) The existing private lane appears to be designed for safe and efficient flow of traffic and pedestrians will not have a disruptive influence upon the development. This proposal will not effect the present location of the private lane. 7 ~ ~ d. (pertaining to community facilities) No community facilities are proposed with this development. e. (pertaining to lot size and density) Section 8-4C-6 of the Ada County Code lists the design and dimensional standards for development in the RT (Rural Transition) Zones of Ada County--this proposal complies with the standards listed. f. (pertaining to conformance to the Comprehensive Plan) If this proposal is conducted in compliance with the recommended Conditions of Approval listed in Exhibit A, this proposal will substantially comply with the Meridian Comprehensive Plan and the Ada County Code. g. (pertaining to accompanying zone changes) This proposal does not include a request for a change of zone. Should the Commission make positive findings and vote to recommend approval of this application to the Board, staff recommends that the approval be subject to the conditions of approval listed in Attachment A. Agency comments 8 CONDITIONS OF APPROVAL FILE NO. 94-27-PDR (PATRICK SUBDIVISION) ATTACHMENT A n 1. All public rights of way shall be dedicated and constructed to standards of the Ada County Highway District. Any work within the Ada County Highway District rights of way requires a permit. For information regarding the requirements to obtain a permit, contact the Ada County Highway District Development Services at 345-7662. Your application file number (94-27-PDR) will be required. 2 Prior to submission of the final plat, a surface runoff drainage plan shall be submitted and approved by the Ada County Engineer. ~~ ' Compliance with Section 31-3805 of the Idaho Code pertaining to irrigation water is required. Written proof of compliance with this section shall be submitted to Development Services from the Settler and Nampa-Meridian Irrigation Districts. 4. Installation of fire protection facilities as specifically required by the Meridian Fire District. 5. All new utilities shall be installed underground. Installation of service facilities are to comply with the requirements of the public utility providing the services. . All utility easements shall comply with the utility recommendations and Section 8-10A-6A of the Ada County Code (... easements for the utilities... of a width of a minimum of twelve feet (12')...). All utility easements shall be shown on the final plat. 6. The preliminary and final plats shall be in conformance with Section 8-10-4 and Sections 8-10A-1 through 8-10-A-7 of the Ada County Code. 7. Building setbacks and dimensional standards in this subdivision shall be in compliance with the applicable zoning regulations of Ada County. This statement shall appear on the face of the final plat. 8. All site improvements are prohibited prior to approval of the preliminary plat, approval of the surface runoff drainage plan by the Ada County Engineer, and the approval of the appropriate public agency having jurisdiction over the facility being constructed. 9 . ~ Prior to approval by the Board of County Commissioners, the final plat shall contain the following certificates and endorsements: signature of the owner(s); certificate of the plat engineer; certificate of the County Engineer; certificate of the Meridian .City Clerk; certificate of the Meridian City Engineer; endorsement of the Central District Health Department; and, the endorsement of the Ada County Highway District. The following statement shall appear on the face of the final plat: "Any re- subdivision of this plat shall comply with the applicable regulations in effect at the time of the re-subdivision." 1 1. Irrigation/drainage waters shall not be impeded by any construction on site. 12. All easements and public rights of way shall be shown on the final plat. 13. The development standards (lot size, lot coverage, building heights, setback requirements, and street frontage) of the RT (Rural Transition) Zone shall be used for the development. 14. Any lot having a common boundary with a ditch, lateral or canal shall be fenced or filed in accordance with Section 8-10A-7 of the Ada County Code. he final plat must be approved by the Board within one (1) year of the Board's approval of the preliminary plat, unless a time extension is granted as per Ada County Code Section 8-9-3C7. Time extension for plats in Ada County which are inside the Boise Area of City Impact may also require time extensions from the City of Boise. 16. No building permits shall be issued until the final plat is recorded. 17. The subdivision shall maintain the density requested and approved in the application. In addition, any further divisions or splitting or property will require compliance with both the Ada County Code and the policies of the Ada County Department of Development Services. All subdivision and street names shall be reviewed and approved by the Ada County Street Name Committee prior to submitting the final plat for approval (§ § 2-1-4B2 & 8-10-5-1, Ada County Code). 19 Prior to scheduling the subdivision for approval of the final plat, a letter of acceptance into the Meridian Heights Water and Sewer Association must be submitted with the Department of Development Services. ~` Individual lot irrigation is to be provided. The applicant is encouraged to utilize 10 1'1 any existing irrigation water rights for the individual lot irrigation. An internal irrigation and drainage plan must be submitted and approved by the appropriate irrigation and drainage districts, and by the Ada County Engineer, prior to submitting the final plat for approval. This note shall appear on the face of the final plat: This development recognizes Section 22-4503 of the Idaho Code, Right to Farm Act, which states: "No agricultural operation or an appurtenance to it shall be or become a nuisance, private or public, by any changed conditions in or about the surrounding nonagricultural activities after the same has been in operation for more than one (1) year, when the operation was not a nuisance at the time the operation began; provided, that the provisions of this section shall not apply whenever a nuisance results from the improper or negligent operation of any agricultural operation or appurtenance to it." The project is located north of Ustick Road between Locust Grove Road and Meridian Road, just west of The Hollows Subdivision and east of Weaver Acres Subdivision. The Hollows annexation makes the property contiguous to the Meridian City Limits. This two-lot subdivision is for 12.52 acres on which a house and a mobile home currently exist. Apparently the subdivision is a result of the property owner wanting to build an additional single- family home.
