Layne Industrial Park is a 30.2-acre, 18-lot industrial subdi- vision located on the east side of Locust Grove, adjacent to the north side of the Union Pacific Railroad right-of-way 2. On October 5, 1994 the Commission took action on the Layne Industrial Park preliminary plat. The applicant has requested that the requirement for 5-foot sidewalks to be constructed on both sides of the interior streets be revised to require 5- foot sidewalk on one side only. Staff has reviewed the preliminary plat and believes that the requirement for 5-foot sidewalks should only be waived on south side of E. Columbia Street due to the larger size of the industrial lots to the south. 3. IMPACT FEE BENEFIT ZONE - West Ada IMPACT FEE ASSESSMENT DISTRICT - Western Cities 4. The City of Meridian Comprehensive Plan has a goal to extend Locust Grove over I-84 as a connection from Franklin Road to Overland Road. This would realign Locust Grove with the exist- ing Locust Grove north of Pine and south of Franklin. The portion of Locust Grove abutting the subject parcel will be- come a Local/Commercial roadway. The District requirements reflect these changes. When the alignment is completed and a new railroad crossing is finished, Union Pacific may require that the existing crossing on Locust Grove be closed. 5. The existing right-of-way for Locust Grove originally came from the parcel to the west, therefore the 10-additional feet of right-of-way will be required of the subject parcel. 6. The Ada County Ridge to Rivers Pathway Plan shows a future pathway along the Union Pacific Railroad which runs along the south boundary of the subject parcel. 7. Locust Grove Industrial Park directly across the railroad right-of-way to the south of the subject parcel has public right-of-way along the eastern property line. The subject parcel site plan shows an "L" type turnaround to the south of the proposed Layne Street along the east property boundary and 30-feet of right-of-way extending to the north property bounda- ry along the east property boundary. Staff does not antici- pate the need for a railroad crossing at the east property boundary, therefore staff concurs with the submitted site plan. A stub street to the north near the center of the property is also proposed. 8. SITE SPECIFIC REQUIREMENTS: 1. Dedicate 10-feet of additional right-of-way {for a total of 30-feet from centerline) from the existing right-of-way line of Locust Grove abutting parcel. 2. Construct curb, gutter and 5-foot concrete sidewalk and match paving on Locust Grove abutting the parcel or provide a depos- it to the Public Rights-of-Way Trust Fund at the District for the aforementioned roadway improvements. Improvements shall be constructed to a 41-foot back-to-back street section. 3. Construct the interior streets to a 41-foot back-to-back street section with vertical curbs on both sides of the street and 5-foot. sidewalk on the north side of E. Commercial Street, on both sides of N. Webb Avenue and on the west side of N. Thomas Avenue. 4. Plat the storm water retention lots as separate lots to be owned and maintained by a property owners association. 5. Construct the proposed Spruce Street (now N. Thomas Avenue) along the east property boundary as one-half of a 41-foot street section plus 12-feet of paving with 5-foot sidewalks in 50-feet of right-of-way. The turnaround can be pavement only. 6. Direct lot or parcel access to Locust Grove is prohibited, in compliance with District policy. Lot access restrictions shall be stated on the final plat. STANDARD REQUIREMENTS: 1. Street and drainage improvements required in the public right- of-way shall be designed and constructed in conformance. with District standards and policies. 2. Dedicated streets and drainage systems shall be designed and constructed in conformance with District standards and poli- cies. 3. Specifications, land surveys, reports, plats, drawings, plans, design information and. calculations. presented to ACRD shall be. sealed, signed and dated by a Registered Professional Engineer PRELIMINARY PLAT .LAYNE INDUSTRIAL PARK SUB*7ISION April 7, 1995 Page 4 or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 4. Provide written approval from the appropriate irriga- tion/drainage district authorizing storm runoff into their system. 5. Locate obstructions (utility facilities, irrigation and drain- age appurtenances, etc.) outside of the proposed street im- provements. Authorization for relocations shall be obtained from the appropriate entity. 6. Continue existing irrigation and drainage systems across par- cel. 7. Submit three sets of street construction plans to the District for review and appropriate action. 8. Submit site drainage plans and calculations for review and appropriate action by ACHD. The proposed drainage system shall conform to the requirements of Meridian and shall retain all storm water on-site. Public street drainage facilities shall be located in the public right-of-way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable ameni- ties placed in said lot. Drainage lots and their use restric- tions shall be noted on the plat. 9. Provide design data for proposed access to public streets for review and appropriate action by ACHD. 10. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when the driveways are not being shared with the adjacent property. 11. Developer shall provide the District with a copy of the record- ed plat prior to the installation of street name signs. Street signs will not be ordered until all fees have been paid and a copy of the recorded plat has been provided to ACHD staff. The copy of the recorded plat shall show the recording information as inscribed by the Deputy County Recorder. 12. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. MOTION CARRIED: All Yea • ITEM #20: PUBLIC HEARING: REQUEST FOR A VARIANCE FOR THE LANDING SUBDIVISION NO. 7 BY SKYLINE DEVELOPMENT: Kingsford: At this time I will open the public hearing and invite the developer or his representative to speak first. Tucker Johnson, 5635 North Eagle Road, was sworn by the City Attorney. Johnson: I think you are all pretty familiar with the Landing Subdivision. This request for a variance is about a year old from our standpoint. We wrote a letter in October of 1993 and we didn't have any feedback on that letter and in my discussions further with Mr. Gary Smith in processing the final plat for this phase it was brought fo all of our attention that had not been addressed and we had never received a response in regard to that variance request. That is what leads us here tonight, it is the Kennedy Lateral which traverses through a portion. We only own one side of the Kennedy Lateral. Mr. Gary Flores owns the nursery adjacent on the other side. It abuts and portions of it abut, if I can summarize it quickly part of phase 7 was on-the preliminary plat approved some 2 years ago, 2 1/2 - -years ago. A newer portion was annexed approximately 1 year ago with different requirements as opposed to the preliminary plat of the older phases. I don't want to keep this late so if you have any questions I would be more than happy to. Kingsford: Tucker we have had back and forth with the irrigation district on just how much water that lateral moves. Of course our policy has been., or has become 48 inches or less we require piping. I have heard both on that ditch. Johnson: Quite frankly I was a little frustrated to come here this evening and get a copy of the letter that apparently John Anderson sent over here when John and I not 3 weeks ago discussed the matte on the phone. Once again I was asking his position about this ditch and his opinion at the time when 1 was talking to him on the phone was that from Nampa Meridian Irrigation District's perspective safety issues are of the utmost, we cannot conceivably require developers like yourself to pipe such a large ditch. It is such an enormous cost. And to come here this evening, we have a license agreement with them already executed, recorded, all but stapled shut you might say, specifying that the Kennedy Lateral would be fenced to this section. Nampa Meridian may be looking at it from just solely what they project their water or try to allocate to that ditch. From our perspective we have to look at a little broader picture. Persons making the requests must provide the following information: 1) owner/contractor, 2) project location, 3) date and time when the inspection is needed, 4) type of inspection, 5) permit number. The inspection request line is available 24 hours a day, 365 days a year, inspections will be performed Monday - Friday, between 8:00 AM and 5:00 PM, excluding holidays. Other PermltS are Required for the installation of any electrical wiring, plumbing piping and mechanical installations related to gas fired equipment. Permit Revocation/Expiration. The Building Official reserves the~right to revoke any permit issued in error or on the basis of incorrect information. Permits expire in 180 days if: work is never commenced, or is discontinued for a period exceeding 180 days or 6 months. . Declaration -This permit is being issued subject to the ordinances and laws of the City of Meridian, and it is hereby agreed that the work to be performed will conform to the regulations pertaining and applicable thereto.
