Johnson, President Skyline Corporation 10464 Garverdale Court #710 Boise, Idaho 83704 Re: The Landing Subdivision No. 8 Deaz Mr. Johnson: This letter is to serve as a "Statement of Conformance" to the City of Meridian as described in their Request for Subdivision Approval. The Final Plat was prepazed in conformance with the Preliminary Plat as approved by the City of Meridian and meets the requirements and conditions thereof; is in conformance with the requirements and provisions of the City of Meridian Subdivision Ordinance and is in conformance with acceptable engineering and surveying practices and local standards. One issue not addressed in our design is the continuation of the existing irrigation ditch along the easterly subdivision boundary. In talking with Tucker, it is our understanding that this ditch is to be abandoned since there aze no down stream users with water rights to the ditch. Tucker indicated the property owner who is pumping water out of this ditch does not have a water right in this ditch. The only water in this ditch is tail water from the concrete lined ditch which irrigates the alfalfa field south of this development. Anew ditch will be constructed by others along the southerly boundary of this development to handle this water. The pressure irrigation system will be provided by others to the lots in this phase. Based upon this information there are no irrigation improvements included in our design. It is also our understanding that the emergency access easement to Waltman Lane. as shown on the Preliminary Plat has been eliminated by the Meridian Fire Department. Morrow: Staff and I think it has been tabled twice before because of no representation on the part of the development team. Kingsford: For the record Tucker Johnson. ff - ' • • Meridian City Council September 20, 1994 Page 9 Morrow: I would just like to have you review the project and bring us up to speed with a little bit of a presentation and confirm that the comments by our staff are agreeable to you. Johnson: Certainly, we apologize that we were out of town, we missed the prior 2 meetings. This is the 8th phase of The Landing Subdivision. We have reviewed staffs comments, we have loosened the density of the plat. The minutes indicate this is a 48 lot subdivision that is currently correct, it used to be a 49 buildable lot phase of the subdivision. And there are some problems that were pointed out by Gary Smith as to the minimum lot size requirements. We are working with a new engineering firm on this project, a few things fell through the cracks. We have adjusted the plat accordingly to ensure that every lot meets the ordinance that required 8,000 square feet with the minimum of 70 foot of frontage. I have given of a copy of that revised plat to Gary and have 3 copies available to any Council members who may like that for their packet. The notes that are refereed to in Gary's memo have been addressed to my knowledge without re-reading them as I stand here I think we have made every attempt to address each problem and certainly will work hand in hand with Gary on getting his approval and his consent. Morrow: I think the biggest thing with respect to his notes was have you addressed the note #5, it says Lot 13 and Block 9 is to be owned and maintained by the homeowners association. The purpose of the lot is a storm drainage retention pond to hold drainage water for the public right of ways. The staffs comment was that they feel quite strongly that homeowners association is very limited in its abilities. Johnson: And I would agree absolutely. Morrow: (Inaudible) drainage system. He goes onto suggest a solution. Johnson: And we strongly agree with that, we have done similar (inaudible) with ACRD before. The plans have been reviewed once by ACHD and we will be working through those additional details, but I am sure if protocol is the standard here a letter from the personnel ACRD prior to Gary signing the plat specifying at this point that ACRD would maintain the (inaudible) the pipes, manholes and have an easement on that property to discharge the homeowners could use it between the 100 year rainstorm to play ball and soccer. Kingsford: Any other questions for Mr. Johnson? Mr. Smith Morrow: I would just ask for your comments with respect to your letter dated August 10th that was sent to us. There was some 8 items there, obviously since the 10th of August there has been some time. Mr. Johnson indicates they are in agreement with those items, • • Meridian City Council September 20, 1994 Page 10 has all of that been taken care of? Smith: Mr. Mayor and Council members, Councilman Morrow, I received a copy of the final plat revised today and all of the comments that we had made in our review of the final plat have been addressed except for the item #8 which is a 15 foot common lot to get water out to Waltman Lane. We will need to have that done but that is a minor item and I assume it is not a problem for the developer to take care of that. Johnson: If I can just make a comment on that item, we would like to work with Gary on this point. Staff has been very swamped as I am sure you are aware. A computer water model has not been run yet, we have been waiting for that for some time as to whether a connection is needed there. My thought is if it is needed there requiring it to be a separate lot who would own, who would maintain it, why not get an easement on that lot so the homeowners could use it with some regulations as to what type of trees or perhaps fencing. But make that available to the homeowners as opposed to becoming a potential nuisance to neighborhood weeds and so forth or another headache to the City to maintain or whoever it may be. That easement we would have no problem with. Smith: I know that the development community doesn't have a problem with easements but we do. It is an access problem, especially on a water line because it is a pressure line. If that water line should break in that easement area and we can't get to it, it is a tremendous liability for us. So we have only in very limited instances do we even allow a common lot area to be used as a water line for water line placement. This particular case the highway District didn't want or the residents of Waltman Lane did not want a direct access connection to the Landing Subdivision. So that original proposal I think was at the preliminary plat stage was not included. The water line however since we run water lines on section lines and quarter section lines and Waltman Lane is a quarter section line in an overall sense they need to continue that 10 inch line to the east into Waltman and continue it onto to Meridian Road and make that connection in order to form our loop. Now I know there is a roadway proposed to the north of Waltman Lane, however when that gets built is anyone's guess. It is going depend on the development out there as to when that happens. So this is an opportunity for us to get a water line stub to Waltman Lane so that it could be extended if indeed the water model does require that we do that at this time. Johnson: I can understand that concern, my only question is it is a separate lot, would the City own and maintain it, would it be a pedestrian path? Smith: Typically they are used as a pedestrian pathway that is paved and is fenced and very little maintenance involved as I understand it. I am very sensitive to the fact that things have been donated over the years and in the early 70's and late 60's and whenever it went on is a completely set of facts than today. It it true that it was $1500 for an acre for the baseball diamond that was fairly given at that time. What we are being asked to do is to give $15,000 worth of credit for an easement and I think the conditions are different, substantially different today than they were 20 years ago, that is my opinion. Meridian Business and Industrial Park is an approximately 55 acre business and industrial park located on Franklin Road just east of Main Street. This is a development that I have been working on and suffering with for approximately 15 years. It is platted and we are now infor a re-plat, vue intend to create smaller lots so we can have more flexibility not necessarily to sell smaller lots but to combine lots to make 1 1/2 to 2 acre lots etc. I am not sure if this is an ordinance or exactly what it is, but as I understand it from our engineer that because of the re-plat request we are required to pipe and cover the Hunter Lateral irrigation supply system that runs through the project. Our request for a variance is to not have to cover it. My hunch is that perhaps and I haven't talked to anyone in the City staff and so on about this I may be incorrect but that perhaps this ordinance or this requirement may have been intended for residential subdivisions as opposed to a subdivision of this kind where there will be no children. I presume it is a safety matter, I am not even sure of that. The ownership of the Lot could still reside with the Home Owners Association, with the Ada County Highway District having a Blanket Easement, The Home Owners Association could then be responsible for the physical appearance of the retention pond just like a common area, ie mowing of the grass, weed maintenance, etc. 8. A 15 foot wide Common Area Lot needs to be created between Lots 6 & 7, Block 14 for the purpose of extending a second municipal water system main line into this development. We also find that this subdivision is located in census tract 103.12 and in the attendance zone for Meridian Elementary, Meridian Middle School and Meridian High School. Using the above information we can predict that these homes, when completed, will house 10 elementary aged children, 9 middle school aged children, and 7 senior high aged students. At the present time Meridian Elementary is 98~ is at capacity, Meridian Middle School is at 130 of capacity and Meridian High School is at 112 of capacity. The Meridian School District is not opposed to growth in our district, however this subdivision will cause increased over- crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. Before we could support this subdivision, we would need land dedicated to the district or at least made available at a minimum price for a school site in this area. The site would need water and sewer service available. In addition we would need to pass another bond issue for the construction of schools. The plans show that a small portion of the subdivision will have run-off flow to a newly constructed retention area while the majority of the run-off will flow to the existing pond. The submitted calculations state that the existing pond has adequate storage for the proposed additional run-off; however, based on the recently reviewed calculations for Phase No. 7, the existing pond will be filled to capacity. The submitted calculations did not include any pre-development flows and the post-development calculations were for a fifteen year storm and not the twenty-five year storm that the District requires. It would be very helpful to the District when performing reviews if we had a breakdown of the entire system and not just the phase that was being submitted. Nampa & Meridian Irrigation District's Ninemile Drain courses along the edge of this phase of the subdivision and the plans show a 60 foot easement with none of the lots encroaching on this easement. The subdivision meets all requirements of the Nampa & Meridian Irrigation District and will require no further review. The District does require a License Agreement to discharge back into the District's Ten Mile Drain. Would you please contact the District's Attorney, Dan Steenson, at 342-4591 and request him to prepare a License Agreement for discharge into the Ten Mile Drain. I believe their are no encroachments within the 100 foot easement; therefore, once the Board of Directors have approved the License Agreement, there will be no further requirements from the Nampa & Meridian Irrigation District.
