Objective: Determine lateral flow and pipe size for flow Approach: • Contact Nampa & Meridian Irrigation District • Cross-Section Lateral • Calculate Probable Flow • Calculate Pipe Size to Accommodate the Highest Expected Flow Solu ion: Minimum pipe size should be 54-inch diameter concrete pipe. This pipe is adequate to pass the calculated flows and could pass additional urban storm runoffthat may be added with or without Nampa & Meridian Irrigation District's knowledge. • Contact Nampa & Meridian Irrigation District Called Bill Henson at 466-0663 Spring-time flow is 50 CFS This flow does not include any storm runofffrom the undeveloped areas that may drain into the lateral. • Cross-Section Lateral Survey crew collected field data from which cross-sections were plotted. Crew picked, up apparent high water and found the average depth to be 1.6 feet, more or less. The cross-sectional area and wetted perimeter were determined from the three cross-sections. The lateral ditch slope was also calculated and a projected pipe slope was determined from the survey field data. The pipe at the Linder Road crossing was measured. The CSP Arch pipe is 75 inches by 44 inches which is approximately equivalent to 60-inch round pipe. The flows for the Kennedy Lateral that were provided the engineer were based on a year in which Nampa and Meridian Irrigation District could provide a full one inch per acre to every delivery. A margin of approximately 3.5 per cent for evaporation water was included. These calculations were used to obtain the site of the pipe in case that we ever have need to deliver this amount of water. However, with the urbanization within the area, the odds of the District ever running maximum flows are slim. Even with the known surface run-off upstream from The Landing No. 7 Subdivision, I do not believe that the District would have a problem with the ditch over flowing during a rain storm. Therefore, in order to clarify what I had written prior to this, I believe that a 48 inch pipe is adequate and I believe that it will work quite well. If the pipe line is installed according to approved plans, Nampa & Meridian Irrigation District will assume responsibility for the operation and maintenance. As we made known in the hearing process in September, 1992, for this subdivision, I sincerely hope they are preparing a proper irrigation drainage for their devetopment, though t haven`t seen them working on that. !n 1992 we made it dear that our irrigation supply tine and drainage rights were to be protected. Last summer we had several problems with irrigation water flooding into the developed part of "The Landing" because the new houses had been built over the previous irrigation fines. The developer had the farmer working his field connect our shared line with another line, but it did not work. An open earthen ditch was dug from the south side of Waltman Lane, connecting our ditch with two other lines on the north side of Waltman Lane. Instead of our Line draining out to the north, the other two fines drained into our tine, and from there into the subdivision, flooding the southeastern most houses, yards and streets. skyline ~arporation has been irresponsible in not providing proper irrigation around its subdivision. ~itached is a copy of the letter we sent to the Qepartment of Planning and Zoning on September 17, 1992. In that letter we stated our concern about the irrigation systems, our ditch rights and the proper drainage of the irrigation system. tf you allow further development of "The Landing" subdivision without attending to the proper drainage of our irrigation system, then the City of Meridian is being negligent. As our property is dependent on irrigation we expect to hear from you on how you Witt honor the agreement you made to us during the hearing prodedure for this subdivision. We currently receive our irrigation water from the west side of our property (the east edge of "The Landing`s" subdivision, which currently has heavy machinery working in it.) Our access is from an open concrete ditch, part of a system that inctudes open earthen ditches and a short, covered portion of concrete ditch. Swenson N~ ~ C ~ • i BEFORE THE MERIDIAN CITY COUNCIL APPLICATION OF SKYLINE DEVELOPMENT FOR A VARIANCE FROM 11-9-605 M TILING OF DITCHES FINDINGS OF FACT AND CONCLUSIONS The above entitled variance request having come on for consideration on December 20, 1994, and was continued for several meetings for additional information and the last Council meeting was on February 21, 1995, at approximately 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, the Applicant appeared through Tucker Johnson, and the City Council having heard and taken oral and written testimony, the City Council of the City of Meridian makes the following: FINDINGS OF FACT 1. That notice of the public hearing on the variance was published for two consecutive weeks prior to the scheduled hearing for February 21, 1995, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the February 21, 1995, hearing; that copies of all notices were available to newspaper, radio and television stations. 2. That notice of public hearing is required to be sent to property owners within 300 feet of the external boundaries of the land being considered pursuant to 11-2-416 E., 11-2-419 D., and 11- 9-612 B. 1. b. of the Revised and Compiled Ordinances of the City of Meridian; that his requirement has been met. 3. That Ordinance 11-9-605 M., PIPING OF DITCHES, requires all irrigation ditches, laterals or canals, exclusive of natural FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 1 C~Op~T • t waterways, intersecting, crossing or lying adjacent and contiguous, or which canals, ditches or laterals touch either or both sides of the area being subdivided, shall be covered and enclosed with tiling or other covering equivalent in ability to restrain access to said ditch, lateral or canal; that the Findings of Fact and Conclusions of Law, adopted by the City on the Annexation Application approval, stated in the Conclusions and in the Decision that the Applicant and owners were specifically required to the all ditches, canals and waterways as a condition of annexation; that when the land was annexed by the City of Meridian, the Annexation Ordinance stated in Section 2. e., that the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular Section 11-9-605 M. 4. That the Applicant has requested that he be granted a variance from the above ditch piping requirements and be allowed not to pipe the Kennedy Lateral but to fence the lateral; that in the Application the Applicant states that the Kennedy Lateral would require at least a 54 inch CMP pipe; that the cost of tiling such a large irrigation lateral would be enormous and cost prohibitive; that in the Application it is stated that the cost would approach *0.00 per foot, that the property line of this application is the centerline of the lateral, that the adjacent property owner does not want the ditch tiled, that when the Applicant started the first phase of the subdivision, tiling of laterals was not an issue and that had tiling been a strict requirement or if it becomes such properties adjacent to larger waterways would experience a FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 2 • • depreciation in value; and states that fending large waterways instead of tiling them has been allowed in other parts of Meridian. 5. The Applicant submitted a report from Keith Jacobs, P.E., attached to the Application, which stated the pipe should be a 54 inch diameter concrete pipe; this size pipe is adequate to pass the calculated flows and could pass additional urban storm runoff that may be added with or without Nampa & Meridian Irrigation District's knowledge. Mr. Jacobs report states that Nampa & Meridian Irrigation District had stated that the spring-time flow of the ditch was 50 CFS; the report is dated December 16, 1993, and is incorporated herein as if set forth in full. 6. Mr. Johnson testified that the Nampa Meridian Irrigation District will only take liability for 50 inches; that they are willing to accept 50 cfs which would fit through 48 inch pipe; that Civil Survey studied the drainage at his request and found that the drainage is full at 50 cfs and that any additional flow will increase the elevation, thus increasing the cubic feet per second which will exceed a 48 inch pipe; he additionally testified that he had conducted research into the construction of the Interstate, which does not border-the parcel but is near the Applicant's land on the south, and that there is drainage from the Interstate that goes into the Kennedy Lateral; that there was other land that drained into the lateral also; that when the Interstate was improved in 1976 the natural drains in the medium which drained into the Kennedy Lateral were removed; that Nampa Meridian Irrigation District puts 50 CFS into the Kennedy Lateral and that FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 3 a • is all that they are willing to take liability for; that the federal government has a discharge agreement with Nampa & Meridian Irrigation District; that he had Civil survey Consultants do a study of the Interstate area and the Kennedy Lateral- which indicated that lateral carries 50 CFS but in addition there are water marks indicting there has been higher water, from what source nobody knows; that they engineered the area from the drain off that would potentially come off the Interstate system and the surrounding hill sides and concluded that there was an additional 8 CFS above and beyond NM's flow of 50 CFS; that Mr. Johnson therefore stated that 50 CFS will go through the pipe (48 inches) and he stated that 50 CFS will go through the pipe but it would be at maximum capacity; and stated that adding the potential for storm water, there is a significant amount (water) that impacts that ditch. 7. That Nampa & Meridian Irrigation District submitted comments, signed by Bill Henson, Assistant Water Superintendent, that were received by the City on December 13, 1994, which stated as follows: "Nampa & Meridian Irrigation District will accept only what is agreed to in a license agreement. This district will not accept water amenities or 4 to 1 sloping. If I can be of further help concerning this variance request for The Landing Subdivision No. 7, please feel free to contact me. 8. That the City received a subsequent letter from John P. Anderson, Nampa & Meridian Irrigation District Water Superintendent dated December 19, 1994, and he stated, in part, as follows: "The 50 cfs figure that Bill Henson gave adequately FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 4 i • reflects the flow needs of the Kennedy Lateral through this development. I do not believe that there is any drainage return to the Kennedy Lateral that would cause the District any difficulty in operating a pipe system through this area if this flow criteria is used in the design. If you feel further discussion is required regarding this matter, please feel free to contact me." 9. That on February 8, 1995, the City received a copy of a letter from Bill Henson, Assistant Water Superintendent, which stated, in part, as follows: "Nampa & Meridian Irrigation District's engineers have reviewed the calculations that were submitted concerning the proposal for the piping of the Kennedy Lateral through The Landing Subdivision. The calculations that were provided to our engineers show that there could be a possible flow of as much as 64.5 cfs in the Kennedy Lateral. However, the District's records indicate that there has never been any more than 50 cfs within this facility and the high water marks on the drawings that were provided indicate that the flow within the existing facility has not been as much as 64.6 cfs. Therefore, Nampa & Meridian Irrigation District will accept and approve 48 inch pipe for the piping of the Kennedy Lateral through The Landing NO. 7 Subdivision. Please feel free to contact me if further information is required." 10. That on March 1, 1995, the City received a letter from John P. Anderson, Nampa & Meridian Irrigation District Water Superintendent dated March 1, 1995, and he stated, in part, as follows: "The flows for the Kennedy Lateral that were provided the engineer were based on a year in which N & M could provide a full one inch per acre to every delivery. A margin of approximately 15 per cent for evaporation water was included. These calculations were used to obtain the size of the pipe in case that we ever have need to deliver this amount of water. Even with the known surface run-off upstream from the Landing No. 7 Subdivision, I do not believe that the District would FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 5 r1 have a problem with the ditch over flowing during a rain storm. Therefore, in order to clarify what I have written prior to this, I believe that a 48 inch pipe is adequate and I believe that it will work quite well. If the pipe line is installed according to approved plans, N & M will assume responsibility for the operation and maintenance." 11. That Meridian City Engineer, Gary Smith submitted comment dated December 16, 1994; he stated that the engineering information presented by the applicant's engineer shows that a 48 inch diameter pipe can carry a springtime flow of 50 CFS as specified by the N & M. However, there isn't any room for any additional flow that may enter the ditch from surface runoff sources, without increasing the water surface elevation upstream of the pipe; that N & M comments that they will accept only what is agreed to in License Agreement and that the existing License Agreement states in part that the Licensee (Skyline Development Co,) will "place a 54 CMP in the Kennedy Lateral where Kennedy Lateral crosses Waltman Lane. He additionally states that he placed a telephone call to Bill Henson at the irrigation district office to further discuss this ditch and the piping thereof and that he will forward that information as soon as it is available. 12. That Gary Fors testified and submitted a letter; he testified that he did not see any need for tiling the ditch; that it was six feet deep and six feet across; that if N & M want a 48 inch pipe why do they have such a large ditch. In his letter he stated that he had testified against the tiling when the subdivision was initially proposed and felt that fencing would provide the purpose as tiling and a fence would suffice; that if FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 6 • • the canal was tiled it would have a detrimental effect on him because he would have to find an alternative way to water the trees that he has along the ditch; that even if tiling is required that a fence should still be put up between his property and the Applicant's; in the letter he also stated that he did not receive notice of the variance request. 13. That the Ordinance requiring that ditches be tiled may be changed so that ditches which require the of over a 48 inches may not have to be tiled; that the Nampa & Meridian Irrigation District has informed the City that the grates required for ditches that require larger the than 48 inches may be more dangerous than not having the ditch tiled. 14. The entire property in question is described in the variance. application and is incorporated herein as if set forth in full. 15. That the property in the area where the variance is requested is zoned R-4 Residential District. 16. That the Application states that Edward A. and Janice M. Johnson are the owners of the property. 17. That no other testimony was heard at the hearing. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. That the City has authority to grant variances pursuant to Section 11-2-419 of the Zoning Ordinance and pursuant to Section 11-9-612 of the Development Ordinances. 3. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Subdivision and Development Ordinance upon which it may take judicial notice. 4. That the Council may take judicial notice of its own proceedings, those of the Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. 5. That the following provisions of Section 11-9-605 M, PIPING OF DITCHES, of the Subdivision and Development Ordinance are noted which are pertinent to the Application: "All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous, on both sides of the area being subdivided, shall be covered and enclosed with tiling or other covering equivalent in ability to detour access to said ditch, lateral or canal. The City may waive this requirement for covering such ditch, lateral or canal, if it finds that the public purpose requiring such will not be served in the individual case. Any covering program involving the distribution system of any irrigation district shall have the prior approval of that affected district. ." 6. That the City Council is considering changing the Ordinance regarding the piping of large ditches; that the Ordinance may be changed but it has not yet and a variance is required to enable a developer to not have to the a ditch, canal or waterway; the City has previously granted variances where the size of the the would be greater than 48 inches; that the City has required FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 8 • • that the Kennedy Lateral be tiled in Elk Run Subdivision which is upstream of the Applicant's property and the owners of that subdivision requested a variance and it was denied by the City Council. 7. That the Applicant claims that there is drainage that enters the Kennedy Lateral south of its property which adds to the amount of water that the ditch carries over and above the amount of water that the ditch carries as it crosses the property in the Elk Run Subdivision; however, it is the input from N & M that even with the surface run-off upstream from The Landing Subdivision No. 7, a 48 inch diameter pipe is adequate if the pipe line is installed according to approved plans and it believes that the District would not have a problem with the ditch over flowing during a rain storm. 8. That the specific requirements regarding a variance that must be evidenced and found by the City Council are as follows: No variance shall be favorably acted upon by the Council unless there is a finding, as a result of a public hearing, that all of the following exist: a. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would be clearly impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. That strict compliance with -the requirements of this Ordinance would result in extraordinary hardship to the subdivider because of unusual topography, the nature or condition of adjacent development, other physical conditions or other conditions that make strict compliance with this Ordinance unreasonable under the circumstances, or that the conditions and requirements of this Ordinance will result in inhibiting the achievement FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 9 • • or objectives of this Ordinance. c. That the granting of the specified variance will be detrimental to the public welfare or injurious to other property in the area in which the property is situated; d. That such variance will not violate the provisions of the Idaho code; and e. That such variance will not have the effect of nullifying the interest and purpose of this Ordinance and the Comprehensive Development Plan. 9. That there does appear to be a specific benefit or profit, economic gain or convenience, to the Applicant if this variance is granted in that the Applicant would not have to expend a significant amount of money to pipe the ditch. 10. That the requirement of tiling ditches is a health and safety requirement; that there has been testimony and evidence in prior applications for variances from this ordinance that it is less safe to have ditches that require a pipe greater than 48 inches the because of the size of grate that is required at the entrance and exit of the pipe and the force and swiftness of ditches that are larger than could be tiled with a 48 inch pipe. 11. That by reason of the size of this ditch, it appears that to require tiling of this ditch would achieve the safety purpose for which tiling is required in the Ordinance. 12. That the irrigation district affected, N & M, has demanded that this ditch be tiled in this subdivision and in one other subdivision, Elk Run. 13. That regarding Section 11-9-612 A. 2., regarding the tiling of ditches, it is specifically concluded as follows: FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 10 • ,' a. That there are no special circumstances or conditions affecting the property that the strict application of the provisions of the ditch tiling Ordinance would clearly be .unreasonable. b. That strict compliance with the requirements of this ditch tiling Ordinance would not result in extraordinary hardship to the Applicant. c. That the granting of a variance would be detrimental to the public's welfare or possibly injurious to the public. d. That the granting of this variance would not violate the Idaho Code. e. That the variance would have the effect of altering the interests and purposes of the ditch tiling Ordinance which is included in the Subdivision and Development Ordinance for safety purposes. 14. That it is concluded that the Application for a variance from 11-9-605 M, PIPING OF DITCHES, should not be granted. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The City Council of the City of Meridian does hereby adopts and approves these Findings of Fact and Conclusions. We both felt fencing the area would serve the name purpose. During the council meeting, I asked the members why they wanted the canal tiled and they indicated it was for safety reasons. I question how many accidents/mishaps have occurred on this canal in the last 70 years? Considering it's limited access by the public, it seems a fence would suffice. IF the canal is tiled, it will have a detrimental effect on me as I have a long row of trees by the canal which serves as a windbreak to protect my nursery stock. With the canal tiled, I will have to find an alternative (and costly) means of watering them. In addition, the canal serves as a boundary and division between my business and a residential neighborhood. Without it, the covered area will become an open roadway. If, however, you decide to go ahead with the tiling, I still request a fence be Constructed between the properties. This seems only reasonable since it is common practice for all of the new ®ubdiviaions to be enclosed. As a matter of fact, when the initial Mallard Landing subdivision was proposed and approved, i asked to have the developer build a fence to the north and east of my property. To date, this has not occurred despite my repeated inquiries. I have had continual problems with the homeowners who encroach and damage my property and expect this will also occur with the new homes. I ask why all the new subdivions in the area are fenced except for this one adjacent to my property. please note that I will need to have easy access to the headgate which is located within the Landing #~7 subdivision boundaries. I also wish to bring to your attention that I iearnsd of this variance only by accident as I was never notified of it. Although the issue of tiling the canal arose when the subdivision was original],y approved, no formal decision was ever made and it was assumed fencing war the acceptable action. Since my property directly adjoins the subdivision, I am the property owner who will be most affected by the variance. I do not understand why no notice was mailed to me to allow me the opportunity to testify. i have attended two recent meetings but have not been acknowledged or allowed to voice my opinion. The calculations that were provided to our engineers show that there could be a possible flow of as much as 64.6 cfs in the Kennedy Lateral. However, the District's records indicate that there has never been any more than 50 cfs within this facility and the high water marks on the drawings that were provided indicate that the flow within the existing facility has not been as much as 64.6 cfs. Therefore, Nampa & Meridian Irrigation District will accept and approve 48 inch pipe for the piping of the Kennedy Lateral through The Landing No. 7 Subdivision. Dear Mayor Kingsford: As you and the City Council requested, I have met with the Board of Directors and the Water Superintendent of the Nampa-Meridian Irrigator District (NMID), as well as NMID's engineer, to review engineering calculators and pipe size requirements of the Kennedy Lateral through The Landing #7 Subdivision. The Irrigator District and their engineer have reviewed the data provided by Mr. Keith Jacobs, P.E., and confirmed Mr. Jacobs' findings that a 48 inch pipe will convey, with no extra capacity, their required delivery of 50 cubic feet per second (cfs) of water in the Kennedy Lateral. Also, the Irrigator District has been informed that drainage water is gettng into the Kennedy Lateral near our property which is over and above their delivery amount of 50 cfs. The Nampa-Meridian Irrigator District has informed me that they exercise no claims of responsibility for, nor jurisdicton over, any drain water from I-84 and the adjacent properties that also drain into the Kennedy Lateral. Because the Irrigator District will only comment. on their SO cfs of irrigator flow, and because drain waters come off of I-84 and the adjacent land--thus increasing the flow in the Kennedy Lateral through our property to a probable high of well over 53 cfs, we have submitted a request that we be granted a variance from the City's ditch fling ordinance. Our engineer has determined that flows over 53 cfs water flow will require a 54 inch pipe to carry this water. Meridian, Idaho 83680 Vice President February 16, 1995 Tucker Johnson Skyline Corporation 10464 Garverdale Ct., Suite 710 Boise, ID 83704 Re: Kennedy Lateral -The Landing Subdivision Dear Tucker: As requested, we have evaluated the Kennedy Lateral between the check structure at the south boundary of Landing Subdivision No. 7 and the freeway in an attempt to confirm the current flow rate in the lateral, and size a pipe to handle the anticipated flow. Based upon this evaluation we believe the lateral currently carries between 49 cfs and 64 cfs. In order to handle the predicted flow range under open channel conditions we believe a 54-inch pipe would be required. Our analysis is based upon the - following: 1. We performed field measurements of the weir structure and water mazks on the structure. Based upon these measurements we have based our calculations on a 6-foot rectangular weir. The weir currently has a 9-inch check boazd. The normal high water mark is 1.91' above the weir board. The highest water mark is 2.17' above the weir board. There aze two types of rectangular weirs, with end contractions and without end contractions. The existing weir configuration is not truly either with end contractions, or without end contractions, therefore both conditions were evaluated. The measuring point for calculation flow over a weir is suppose to be a distance of 3-4 times the head on the weir, which is 6-12 feet upstream of the weir in this case. Since there is no water in the lateral, and no physical feature for establishing water mazks at the desired measurement location, we could only use the water marks on the weir structure. This measurement location will provide a flow value lower than that which is actually occurring due to the draw-down of the water surface as it crosses the weir. Using a weir without end contractions flow would be 53 cfs at the normal high water mark and 64 cfs at the highest water mazk. Using a weir with end contractions flow would be 49 cfs at the normal high water. mazk and 59 cfs at the highest water mark. 2. We based the pipe sizing on a slope of 0.001 ft/ft, a Manning's Equation friction coefficient of 0.012, and open channel flow. For 49 cfs a 48-inch pipe is required for open channel flow. For flows above 50 cfs a 54-inch pipe is required for open channel flow. 3. We have no way of establishing when the water marks were actually made and under what conditions they were created. Therefore, the above figures for flow and pipe size are estimates only. We tried to corm the flows based upon the water marks in the box culvert under the freeway. We found this culvert is installed with adverse grade and does • • I~ , , Johnson February 16, 1995 Page 2 of 2 not operate under open channel flow due to the presence of the weir. Therefore, it was not used for confirmation. The Kennedy Lateral also receives tail water and storm run-off . Tail water enters the Kennedy Lateral from the alfalfa field immediately east of this location downstream of the weir structure.. I do not have sufficient information to quantify the tail water flow at this time. Storm water enters the Kennedy Lateral from the adjacent alfalfa field, area of the freeway east to where Ten Mile Creek crosses the freeway, and the area lying east of the Kennedy Lateral between the freeway and Overland Road east to where the Kennedy Lateral crosses Overland. The total drainage area is approximately 120 acres. Using the Rational formula, a time of concentration of 3 hours, and run-off coefficient of 0.20, runoff from a 25-year event would be 8.4 cfs into the Kennedy Lateral. If a 25-year event were to occur during the summer when the lateral is carrying the 50 cfs maximum flow stated by Nampa Meridian, actual flow at the weir structure could be as high as 58 cfs. A 48-inch pipe installed at the available 0.001 ft1ft slope, will not carry 58 cfs under open channel flow. Once the remainder of the Landing Subdivision is developed the potential run-off area will be reduced to +80 acres. This will result in a 25-year flow of 5.7 cfs from the remaining area and a potential combined flow of 56 cfs in the Kennedy Lateral. A 48-inch pipe will carry the 50 cfs rate indicated as the maximum by Nampa Meridian Irrigation District. Our evaluation of the existing conditions, based upon the weir structure and water marks indicates that the Kennedy Lateral has previously carried between 49 and 64 cfs. Based upon this preliminary analysis, I believe installation of a 48-inch pipe under current conditions would not provide sufficient capacity for open channel flow under all conditions. Therefore, I recommend that the minimum pipe size be 54-inch diameter. I have enclosed copies of our design calculations for your reference. Please call me if I can be of further assistance. The engineering information presented by the applicants engineer shows that a 48 inch diameter pipe can carry a springtime flow of 50 cfs as specified by the Nampa & Meridian Irrigation District. However, there isn't any room for any additional flow that may enter the ditch from surface runoff sources, without increasing the water surface elevation upstream of the pipe. 2. Nampa & Meridian Irrigation District comments that they will accept only what is agreed to in a License Agreement. The existing License Agreement states in part that the Licensee (Skyline Development Co.) will "place a 54" CMP in Kennedy Lateral where Kennedy Lateral crosses Waltman Lane,......." 3. I have placed a telephone call to Bill Henson at the irrigation district office to further discuss this ditch and the piping thereof. The 50 cfs figure that Bill Henson, Assistant Water Superintendent of Nampa & Meridian Irrigation District, gave adequately reflects the flow needs of the Kennedy Lateral through this development. I do not believe that there is any drainage return to the Kennedy Lateral that would cause the District any difficulty in operating a pipe system through this area if this flow criteria is used in the design. Based upon this evaluation we believe the lateral currently carries between 49 cfs and 64 cfs. In order to handle the predicted flow range under open channel conditions we believe a 54-inch pipe would be required. Our analysis is based upon the fallowing: 1. We performed field measurements of the weir structure and water marks on the structure. Based upon these measurements we have based our calculations on a 6-foot rectangular weir. The weir currently has a 9-inch check board. The normal high water mark is 1.91' above the weir board. The highest water mark is 2.17' above the weir boazd. There are two types of rectangular weirs, with end contractions and without end contractions. The existing weir configuration is not truly either with end contractions, or without end contractions, therefore both conditions were evaluated. The measuring point for calculation flow over a weir is suppose to be a distance of 3-4 times the head on the weir, which is 6-12 feet upstream of the weir in this case. Since there is no water in the lateral, and no physical feature for establishing water marks at the desired measurement location, we could only use the water marks on the weir structure. This measurement location will provide a flow value lower than that which is actually occurring due to the draw-down of the water surface as it crosses the weir. Using a weir without end contractions flow would be 53 cfs at the normal high water mark and 64 cfs at the highest water mark. Using a weir with end contractions flow would be 49 cfs at the normal high water mark and 59 cfs at the highest water mark. ~. 2. We based the pipe sizing on a slope of 0.001 ft/ft, a Manning's Equation friction coefficient of 0.012, and open channel flow. For 49 cfs a 48-inch pipe is required for open channel flow. For flows above 50 cfs a 54-inch pipe is required for open channel flow. 3. We have no way of establishing when the water marks were actually made and under what conditions they were created. Therefore, the above figures for flow and pipe size aze estimates only. We tried to confirm the flows based upon the water mazks in the box culvert under the freeway. Therefore, it was not used for confirmation. The Kennedy Lateral also receives tail water and storm run-off . Tail water enters the Kennedy Lateral from the alfalfa field immediately east of this location downstream of the weir structure. I do not have sufficient information to quantify the tail water flow at this time. Storm water enters the Kennedy Lateral from the adjacent alfalfa field, area of the freeway east to where Ten Mile Creek crosses the freeway, and the area lying east of the Kennedy Lateral between the freeway and Overland Road east to where the Kennedy Lateral crosses Overland. The total drainage area is approximately 120 acres. Using the Rational formula, a time of concentration of 3 hours, and run-off coefficient of 0.20, runoff from a 25-year event would be 8.4 cfs into the Kennedy Lateral. If a 25-year event were to occur during the summer when the lateral is carrying the 50 cfs maximum flow stated by Nampa Meridian, actual flow at the weir structure could be as high as 58 cfs. A 48-inch pipe installed at the available 0.001 ftlft slope will not carry 58 cfs under open channel flow. Once the remainder of the Landing Subdivision is developed the potential run-off area will be reduced to ±80 acres. This will result in a 25-year flow of 5.7 cfs from the remaining area and a potential combined flow of 56 cfs in the Kennedy Lateral. A 48-inch pipe will carry the 50 cfs rate indicated as the maximum by Nampa Meridian Irrigation District. Our evaluation of the existing conditions, based upon the weir structure and water marks indicates that the Kennedy Lateral has previously carried between 49 and 64 cfs. Based upon this preliminary analysis, I believe installation of a 48-inch pipe under current conditions would not provide sufficient capacity for open channel flow under all conditions. Therefore, I recommend that the minimum pipe size be 54-inch diameter. ~I have enclosed copies of our design calculations for your reference. Please call me if I can be of further assistance. This request for a variance is about a year old from our standpoint. We wrote a letter in October of 1993 and we didn't have any feedback on that letter and in my discussions further with Mr. Gary Smith in processing the final plat for this phase it was brought to all of our attention that had not been addressed and we had never received a response in regard to that variance request. That is what leads us here tonight, it is the Kennedy Lateral which traverses through a portion. We only own one side of the Kennedy Lateral. Mr. Gary Flores owns the nursery adjacent on the other side. It abuts and portions of it abut, if I can summarize it quickly part of phase 7 was on the preliminary plat approved some 2 years ago, 2 1/2 years ago. A newer portion was annexed approximately 1 year ago with different requirements as opposed to the preliminary plat of the older phases. I don't want to keep this late so if you have any questions I would be more than happy to. Kingsford: Tucker we have had back and forth with the irrigation district on just how much water that lateral moves. Of course our policy has been, or has become 48 inches or less we require piping. I have heard both on that ditch. Johnson: Quite frankly I was a little frustrated to come here this evening and get a copy of the letter that apparently John Anderson sent over here when John and I not 3 weeks ago discussed the matte on the phone. Once again I was asking his position about this ditch and his opinion at the time when 1 was talking to him on the phone was that from Nampa Meridian Irrigation District's perspective safety issues are of the utmost, we cannot conceivably require developers like yourself to pipe such a large ditch. It is such an enormous cost. And to come here this evening, we have a license agreement with them already executed, recorded, all but stapled shut you might say, specifying that the Kennedy Lateral would be fenced to this section. Nampa Meridian may be looking at it from just solely what they project their water or try to allocate to that ditch. From our perspective we have to look at a little broader picture. The fields get flooded with rain water, where is the water going to go. I agree, I am as confused as perhaps you are on why the vacillation on the size requirement. It is a surprise to me this evening and frankly a little disturbing. (Inaudible) Kingsford: Mr. Smith, that is the same ditch that goes through Elk Run and we have discussed that at some length and the irrigation district has assured us constantly that 48 inches will handle that piping. Is there additional water entering this ditch between Elk Run and the Skyline property? Smith: I don't know Mr. Mayor for sure and that is one reason that I called John Anderson was to see if there is any other water that he knew of that would be entering the ditch. Because the quantity of flow that was given by them to this applicant's engineer was 50 CFS and I wanted to find out what that 50 CFS was, what it included. And John Anderson told me on the phone that to his knowledge there was no other water that entered the ditch upstream. That, and in particular he was referring to drainage from the streets, from roadways. And that this 50 CFS did include safety factor of something 10 to 15% beyond what was actually allocated down stream to be used. Kingsford: Mr. Johnson, does that ditch go through any of the other phases in the Landing, I didn't go out and look at that? Johnson: No it doesn't, the portion that we just purchased and annexed a year ago is on part of it, it abuts it on one side, the other side is Gary Flores and then it cuts through phase 7 and then it goes down straight up stream to the freeway which is directly south and we own the property on one side. We are farming that and I know where the water goes, the north side of the interstate, the rain would run off towards the interstate fence which collects immediately in a ditch which is right there which directly dumps into the Kennedy Lateral as soon as the Kennedy Lateral exits the (Inaudible) that ditch not only collects rain water and such from the interstate but up stream the Waltman Lane where Waltman and Meridian meet that area, the property just east of our property is where our irrigation water comes for this 40 acres here. Any excess water or anytime we are not using the water it goes down to the ditch at the interstate and goes down and dumps back into the Kennedy. In addition to that the tail water from 40 acres of our farm ground drains into the Kennedy Lateral back from which it came from if it is not used. So, I don't mean to sound like I am telling John Anderson that he may not know what goes on in that section but that is the way (inaudible) and that is the way it has been draining as long as I can remember and we have owned that for probably 5 years, 6 years. ~~ Meridian City Council December 20, 1994 Page 30 Kingsford: Any other questions for Mr. Johnson? I think that in Elk Run we are requiring that they, we have denied their variance on 2 different occasions and they have had to pipe this Kennedy Lateral and I believe it was with a 48 inch pipe. The issue here is with respect to the ground that Tucker is talking about in the not very distant future that ground will be developed as subdivision ground and we'll be facing that same issue again. And at that point in time obviously there is no tail water that is going to be going into it because (inaudible). A portion that we are dealing with right now has to be which is the phase #7 and we have been fairly consistent in terms of down stream users having to go with the precedence that we have set with the upstream folks. I am thinking in terms of the Hunter Lateral on the other side of town and requiring piping straight through there. So I guess those are my thoughts with respect to this particular piece of property and this ditch. Kingsford: Tucker, the ditch that refer to that you take your irrigation water out of to irrigate, that comes out of the Kennedy Lateral too doesn't it? I mean it would just dump back in? Johnson: I don't know exactly where it comes from, I have never walked back upstream but I know that more than just ourselves get water out of that ditch and if we are not using that water out of that ditch and the people upstream are done with it, it flows. (Inaudible) pressurized or not we still have to allow the water to continue to go where it is going now. Kingsford: The point that I am trying to make now, my recollection again without walking it and that is something that we certainly need to determine, but my recollection is it does come out of Kennedy and goes back into Kennedy if it is not used. If that is true and 48 inches handles it upstream further than 48 inches ought to handle it there too. That shouldn't be a consideration. I am not sure that we have enough information to act on this tonight. I guess it would be my recommendation to Council to table this and we get out this and take a look at that and follow up with Mr. Anderson as to what his logic is too. Again, I don't want us to be in a position like we are over on the northeast side of town where we have maybe not large enough pipe and the irrigation district is the sponsor of that. So I would like to make sure that we are piping it with the right size. You were going to as I recall get us some information, we had conflicting engineering reports on that size of tiling. Johnson: That is correct, we, as I reviewed the minutes (inaudible) everyone involved we were asked to meet with Nampa Meridian to discuss the issue at hand to determine what exactly was in the ditch. We have done so, we have met with Nampa Meridian on I can count of at least 4 instances between when it was tabled initially and their engineer. We met with the Board of Directors for the Nampa Meridian Irrigation District, handed over the calculations which had been made, their resolution was we are no engineers so let's send it to our engineer and if he confirms then that is that. We passed that information along to them and they have since reviewed it. Let me encapsulate it for the sake of time since we all don't want to be here forever. Nampa Meridian has reviewed the data, they sent a fax to us today, at the bottom they indicated they sent a fax to the City today, stating the following, Nampa Meridian is obligated to carry 50 CFS through the Kennedy Lateral, through that section. They have stated in that letter that a 48 inch pipe will carry 50 CFS, the problem with that and we can have Keith Jacobs address that more if you would like * • • Meridian City Council February 7, 1995 Page 15 who is the engineer who did the study. At 50 CFS because of the grade of the pipe, the distance of the pipe and other factors that pipe would be at capacity, would not accommodate any additional water so in essence there would not be any safety factor involved in that pipe. Nampa Meridian does not condone or any extra drainage water that may end up in that Kennedy Lateral, they are liable for their 50 CFS. We however know whether legally or illegally that the Interstate fora 1/4 mile drains into the Kennedy Lateral in addition to approximately I think it was 50 acres of the of the hillside south of the Interstate. I know this because I personally went to Idaho Transportation Department, I have copies of their designs, their as built plans. I have walked it personally (End of Tape) and got my feet wet going through the biduct that goes underneath the Kennedy Lateral, underneath I-84 and found where the Interstate median does drain into the Kennedy lateral. From our perspective it is a safety issue, Mayor Kingsford as I recall from the original hearing the City and certainly no one wants to be in a situation of potentially posing'a danger. You mentioned something about the northeast part of town where there are some piping problems that have caused some flooding and some additional potential flooding. So it is true that the 50 CFS will be carried through this, can be carried in a 48 inch pipe under certain situations. Kingsford: Would you state that again, a 48 inch? Johnson: 48 inch, if it has enough head, it is going uphill slightly and so forth. The engineer, if you would like a clarification on that point could clarify that for you. That would be at maximum capacity but we know there is storm water that comes off the Interstate. Any questions from the Council? Kingsford: We didn't receive that fax. Johnson: I can certainly make any of our comments available or the documentation. Kingsford: Well, I think still as we have pursued all along Mr. Johnson we would like to see that from Nampa Meridian, we want to try and enforce their desires and having not seen that I don't know whether certainly 1 ~nrould be prepared to direct the Council to act on it. Johnson: I understood that you had received it, my apologies if you have not. I received them today. Kingsford: It might very well have been an oversight on their part. Morrow: 1 think Mr. Smith is checking to see if there might be a late fax in from Nampa Meridian. Kingsford: No late arrivals. Johnson: My apologies, I can make it available to you as well as all the information as I understood it. The comments from Councilman Morrow in the minutes refer to the fact that we have needed to come to some common ground, which we have with Nampa Meridian, we recognize that they for their legal purposes will only state 50 CFS in that ditch. Kingsford: And I appreciate that but still as nice a guy as you are and were in class and all of that I would still like to see something from Nampa Meridian. Johnson: That is fine, may I just pass along their comments to me on several occasions were they were not the ones making the determination. Kingsford: I think if they told the Council that is the very maximum they can deal with I think then Council can make some decisions. They have indicated in the past they can easily handle that 50 CFS so I would just like to see their comments. Other questions of the Council? Morrow. Kingsford: I am not real excited about it when we are at a public meeting and dealing with 20 some issues to try to digest whatever it is that showed up the same night. MOTION CARRIED: All Yea ITEM #3: TABLED FEBRUARY 7, 1995: VARIANCE REQUEST FOR THE LANDING NO. 7 SUBDIVISION BY SKYLINE DEVELOPMENT: Kingsford: Council members I put some material that Tucker Johnson brought in and discussed with me last Friday in your boxes. I will let him discuss those with you. Johnson: As the Mayor indicated we did meet together Friday afternoon. The information which I gave to him and you have in your packets is 2 things, one is the larger set of plans that I dug out of the archives with the help of Idaho Transportation Department, these large sheets are the construction as built drawings of Interstate I-84, at the time they built it, it was I-80, so thusly they are labeled I-80. The reason for the choosing of these sheets is because these sheets show the direct impact of drainage from the interstate area as well as help to quantify the other areas off site the interstate that are draining down to the interstate and down into the Kennedy Lateral. You will notice I highlighted on your copies on the first sheet is where the Kennedy Lateral crosses. If you will notice, you can see the way they have drawn that back in 1963 when they built this they had a separate pipe or conduit under each lane under each direction of traffic. The last sheet you have of those is what was done much later, done in 1976 it is this sheet here, the gray areas that are on the sheet show the improvements that Idaho Transportation Department or their contractor did at that time. The improvements were to fill in the median area presumably for safety and to extend the box culverts to the edge of their right of way. When they did that they eliminated the natural drain into the Kennedy Lateral from the median. In which time they put in a 2 inch corrugated metal pipe in the middle there and that is what it highlighted, on the front sheet. I physically went out and risked my life on the interstate and measured the distance from the piping or the viaductor back to the grate where the median drains into the 12 inch cnp pipe. It is a distance of 250 feet I think I kind of sketched that on there. Why that is important, basically for the following reasons. As you know we have addressed or looked at this issue a couple of time already, under the Council's direction vue have met with the directors of Nampa Meridian. In a meeting with them they directed us, we are not engineers so let's have our engineers look at it. The letter which you have a copy of, I have received actually 2 letters in the whole process of this states that Nampa Meridian quant~es the amount that they put in that ditch at 50 cfs. It took me some time to realize that Nampa Meridian, that is what they are required to put in that ditch, that is ,~ , • • Meridian City Council February 21, 1995 Page 5 all that they are willing to take liability for. Whether extra ground drains into that or not they haven't been willing to in a formal manner to discuss or (inaudible). I spent some time down on the microfiche department of the Idaho Transportation Department, because assuming that the federal government was thorough in their pre-construction processes they had a discharge agreement with Nampa Meridian. I found the cover sheet to that agreement but unfortunately the rest of the agreement wasn't there which according to the technician was working with me was mailed to(inaudible) for their records with ITD. 50 CFS which is what Nampa Meridian states is what they are required to flow through there and what they are liable for will fit through a 48 inch pipe without any extra room it will be flowing full. There will not be any safety factor involved with that. In addition to the previous study which was phase 7 specific I asked one of our engineers who also happens to be the engineer for Kuna, Tim Burgess of Civil Survey Consultants to do a study of the Interstate area and the. rest of the Kennedy Lateral from phase 7 down to the interstate. They came back with very similar numbers as the original study which indicated the ditch can'ies according to the water marks and so forth the 50 CFS but in addition to that there are water marks indicating there has been higher water, from what source no one can exactly say. Then they engineered the area from the drain off that would potentially come of the interstate system and the surrounding hill sides particularly south of the interstate and concluded very different events like I think a 25 year event was (inaudible) was approximately, was an additional 8 CFS. above and beyond Nampa Meridian's flow, 8.4. So as I discussed with the Mayor that is what it kind of boils down to, 50 CFS will go through the pipe. The reason it is full at CFS is because the grade has indicated in the study that Councilman Corrie is looking at, the grade is virtually flat. For every 1 foot it falls .001 feet for that whole 1/2 mile, or for the whole 1/4 mile it has a drop structure and then it is virtually flat again for the next 1/2 mile. Because of the grade restrictions the engineers have determined that the 50 CFS flowing through that pipe would be at maximum capacity. Adding to that the potential for storm water, there is a significant amount that impact that ditch. Kingsford: Questions for Mr. Johnson? Yerrington: Yes, I have one question, since you are up on all of the storm water and everything, how much rain will fall during the irrigation season roughly in this valley? Johnson: That is a good question, I am not an engineer, that is why I hire them. Not enough as of late, but of course as we all remember 2 years ago the wet spring that we had that actually delayed the water coming into the ditches. If the ditches were full first and then it started raining it would be a different story. Yerrington: But isn't it true that normally during the irrigation season we normally do not have much rain fall in this valley? P • • Meridian City Council February 21, 1995 Page 6 Johnson: Without being a weatherman, you may be right Councilman. Kingsford: Being an old farmer Max and remembering first crop hay I can tell you it does fall, and likewise if you think back to not last year but the 2 previous years during the City to the east river festival we had a few cloud bursts that certainly would overflow it. Johnson: One of my personal concerns is it is a problem of liability and do we try to shove it through a 48 inch pipe or do we take perhaps a more conservative approach and not open up a can of worms for the future. Who knows what is going to happen in the future. Kingsford: Counselor? Crookston: Mr. Johnson, the drainage from the interstate, where does that enter into the Kennedy Lateral? Johnson: Three places actually, let's start on the north side, the north side has a tail water ditch that parallels the interstate for approximately 1/2 mile. Crookston: On which side of the interstate? Johnson: On the north side, (inaudible) my field or the up stream users using the same (inaudible) then the spill water comes down this ditch right along the north side of the interstate and dumps directly into the Kennedy Lateral. Through a 20 foot section of a 24 inch CMP according to (inaudible). The median, the portion between the 2 lanes east-west drains from about 1/2 mile from the Kennedy Lateral east. It drains to the grate that I have spelled out in the plans, it drops in the grate and goes and dumps in directly in the middle of the divide carrying water underneath the interstate. Then on the south side of the interstate again another open ditch along the fence. This one is a little more unique in the sense that the water running off the hills is because Overland Road is higher than the freeway. And the (inaudible) of the fields that are currently in an agricultural use. (Inaudible) goes north-south so the water runs down hits the fenced ditch and a large area has made that ditch rather wide, approximately 3 feet wide. That picks up water from the Kennedy Lateral east to Mountain View Equipment. company. That whole area drains south or north to the south side of the interstate and into the Kennedy. Now the equipment company and their whole operation of I am not sure how many acres, drains to their northwest comer, drops into a box and goes underneath the interstate. That pipe is actually shown on the plans. That one is, I will tell you what that is, that one is a 24 inch concrete pipe that carries the water off of that hillside underneath the interstate back to my ditch and adds to the volume in my ditch. Crookston: Okay, so what you are saying is the additional water that is draining in to the ,_ • • J ~ Meridian City Council February 21, 1995 Page 7 Kennedy lateral is drainage water that is north of Overland? Johnson: Correct Crookston: Thank you Johnson: And is above and beyond what Nampa Meridian puts in the ditch. Corrie: Mr. Mayor, I have a question, since we don't know sitting here how much rain we are going to get, I have a question for the counselor. What if we go ahead and require this to be tiled in a 48 inch pipe and we find out later that is not enough we are getting a flooding condition that we have had in some other areas here. Where does that put us as far as liability is concerned, replacing that with a bigger pipe? Since we make the decision it is okay fora 48. Kingsford: I think clearly what has happened Mr. Corrie is Nampa Meridian has removed themselves from liability because they are saying that is what their responsibility is. I think as you guys well know you are the ones that will have the visitors in here that are under water. Crookston: I am not sure exactly what the ramifications of that are as to the City. If we say the it with a 48 inch pipe and for some reason there is flooding that would have been handled by say a 60 inch pipe it is kind of one those deals about a 100 year flood. What is a 100 year flood, it doesn't mean it only occurs in 100 years, that is what they are saying is the likelihood of it. I don't know exactly the answer to your question Bob as to how much exposure the City has by declaring that they should put in a 48 inch pipe. There is certainly exposure. Corrie: I agree with the Mayor we will have quite a bit of exposure with the people out front. Morrow. I think the other issue here is if I understand Ada County right development ordinances with respect to Ada County Highway District and ours is as that ground develops both Mr. Johnson's ground and the ground immediately adjacent to Mountain view Equipment they will required to retain all of their drainage on site. Now that having said that, that would indicate that in the longer period of time that pipe should be adequate. The question is how long is it before that occurs, the next question is that we are now beginning to see some changes in how on site drainage is being handled. The conventional wisdom in terms of putting it in the ground may no longer prevail in the next few years. Certainly we are seeing some change in terms of grass swails. I think at this point from my perspective although I would like to see the ditch tiled I also think it is _. • • Meridian City Council February 21, 1995 Page 8 borderline close enough that it maybe makes good sense to not the the ditch for the near term. Primarily of who wins or loses in a liability situation if you have flooding there it is going to impact some homes and streets and those kinds of things ultimately. So maybe it makes more sense in the short term not to do that. Kingsford: Well, just a comment, we are in receipt of a letter from Mr. Gary Fors who is present here this evening who is the property owner to the immediate north. He is against tiling the ditch and is also concerned about the fence. I visited with Mr. Johnson about the fence and if he will re-iterate that is in the process of building up, is that correct, or you are going to put it up? Johnson: That is per our license agreement with Nampa Meridian Irrigation in which we have had signed for some time, almost 8 months. As per working with Gary on the plat itself the fence line has been spelled out specifically on the plat as to where it would go so that the lots in the near area will be 8,000 square feet from the fence towards the street and not counting any area behind the fence but still like technically part of their lot. So the fence, the location of the fence has been directly addressed. As to the timing I would imagine like other things prior to either building permits or occupancy permits the fence would be required to be installed. And Bruce or Gary would certify that it had been installed. Kingsford: We now have an ordinance that requires a fence, it wouldn't necessarily have to be a finished fence, but a fence go up around it to keep debris and so forth in the constnaction area. So I would think that this would be far enough ahead to use that fence for a construction fence or have it up prior to selling any lots. Mr. Fors since you are here did you have anything you wanted to add to you letter? Since you have been so diligent and have been here several evenings have at it. Fors: I don't really know as if I have anything else to add to it other than as far as tiling the ditch I really don't see any need for that. We are looking at private property here, we are not looking at a public access. If you are yourself to walk down that ditch I could get you for trespassing. So as far as safety goes well big deal. Max, brought up a thing about well how much water is going to come down there. Well 3 years ago it flooded out my nursery and it was because of a rain storm. And the other thing is, I don't know how many of you guys have walked down that ditch, it is a big ditch. It is, I have never measured it, it is 6 foot deep, it is 6 foot across. So the Nampa Meridian Irrigation District says that 48 inches is good enough, well why in the hell do they have that big of a ditch there, there is some reason. I have seen that thing, let's put it this way, I have water floating in my building in my nursery. I am not saying the ditch over flooded, we had enough rain to do that and it did happen. The other stuff in this letter is probably immaterial for this hearing, I would like to set up a ditch session with you guys one day if I could for the rest of it. I am just i • Meridian City Council February 21, 1995 Page 9 pertaining to the tiling of the ditch tonight, the rest I have got some complaints and so forth as you can well see. I would like to do that but I think that you have enough on the agenda tonight to probably get to 11:00 or 12:00 tonight. As far as the tiling of the ditpch,platym against it, it isn't needed, safety wise it is needed because it is private ro e (Inaudible) Kingsford: I would probably take a little exception to the private property because kids drown that yet don't know how to read and so we have some real concern about that. Fors: Let me make this statement here, the guy that lives along the east end of my property on the east and south end of my property I talked to him Sunday in fact. He has 2 little kids, and he doesn't want to the it and I said why don't you come up here and testify. He said well, typical homeowner. Kingsford: Of course that got to be our decision of making it 48, if it is a larger ditch you get more safety problems from the inlet structure and that holding a person in. Of course that is our basis for the 48 inch. Fors: There are other places of course in town here that you have real big problems on safety because you have some tiling done and there is no safety precautions here. So, I kind of think, well let's leave it at that. Kingsford: What we had gentleman was a continued hearing, I think it is appropriate that you have findings of fact and conclusions of law prepared.
