MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS OF LAW The above entitled annexation and zoning application having come on for consideration on March 9, 1993, at the hour of 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho • Street, Meridian, Idaho, and the Planning and Zoning Commission having heard and taken oral and written testimony, and the Engineer for the Developer, Jim Merkle, appearing for the Applicant, and the Commission having duly considered the matter, the Planning and Zoning Commission makes the following: FINDINGS OF FACT 1. That notice of public hearing on the annexation and zoning was published for two (2) consecutive weeks prior to the said public hearing scheduled fir March 9, 1993, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the March 9, 1993, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were made available to newspaper, radio and television stations; 2. That the property included in the application for annexation and zoning is described in the application, and by this reference is incorporated herein; that the property is approximately 44.20 acres in size; it is located west of Locust ~-. Grove Road and south of Ustick Road; the legal description is included in the application and is incorporated herein as if set forth in full. 3. That the property is presently zoned by Ada County as R- T, Rural Transition and the proposed use would be for a residential subdivision and the requested zoning is R-8 Residential. 4. The general area surrounding the property is used residentially and agriculturally. 5. That the property is adjacent and abutting to the present City limits. 6. The Applicant, Kevin Howell is not the owner of record but the consents of the record owners, Phillip K. Kotschwar and Elaine M. Kotschwar, Neil S. Borup and Ruth G. Borup, and Jose Luis Rivera and Joyce B. Rivera have consented to annexation. 7. That the property included in the annexation and zoning application is within the Area of Impact of the City of Meridian. 8. That the entire parcel of ground is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 9. That the Application requests that the parcel be annexed and zoned R-8; that the present use of the property is for agricultural uses and residences: that the applicant indicated that the intended development of the property would be for a residential subdivision and has submitted a proposed preliminary plat. 10. There were no property owners in the immediate area that testified objecting to the Application. 11. That the property is in the NORTH CURVE Neighborhood as set forth in Policy Diagram in the Meridian Comprehensive Plan. 12. That the property can be serviced with City water and sewer. 13. Ada County Highway District, Central District Health Department, Nampa & Meridian Irrigation District, City Engineer, Sewer Department, and the City Fire Department may submit comments and such shall be incorporated herein as if set forth in full. 14. That the R-8 Residential District is described in the Zoning Ordinance, 11-2-408 B. 2 as follows: (R-81 MEDIUM DENSITY RESIDENTIAL DISTRICT: The purpose of the (R-8) District is to permit the establishment of single and two (2) family dwellings at a density not exceeding eight (8) dwelling units pre acre. This district delineates those areas where such development has or is likely to occur in accord with the Comprehensive Plan of the City and is also designed to permit the conversion of large homes into two (2) family dwellings in well- established neighborhoods of comparable land use. Connection to the Municipal Water and Sewer systems of the City of Meridian is required. 15. That the applicant submitted a letter with the Application for Annexation and Zoning; that the Applicant states in the letter that the house sizes will meet the Meridian City Ordinance; that the City of Meridian has required, as a condition of annexation, of land in the area where Applicants land is located that the houses be a minimum of 1,300 or 1,350 square feet in size and even zoned R-8 that no duplexes, town houses or condominiums would be allowed. 16. That proper notice was given as required by law and all procedures before the Planning and Zoning Commission were given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met, including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to annex land pursuant to 50-222, Idaho Code, and Section 11-2-417 of the Revised and Compiled Ordinances of the City of Meridian; that exercise of the City's annexation authority is a Legislative function. 3. That the Planning and Zoning Commission has judged this annexation and zoning use application contained in Section 50-222; Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, Meridian Comprehensive Plan, as amended, and the record submitted to it and things of which it can take judicial notice. 4. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been complied with. 5. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 6. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 7. That the annexation application has been initiated with the consent of the owner and the annexation is not upon the r initiation of the City of Meridian. 8. That since the annexation and zoning of land is a legislative function, the City has authority to place conditions upon the annexation of land. 9. That the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular Section 11-9-616 which pertains to development time schedules and requirements; that the Applicant will be required to connect to Meridian water and sewer; that the property will be subject to the Subdivision and Development Ordinance; that any waterways and canals within or adjacent to the property will have to be tiled. 10. That proper and adequate access to the property is available and will have to be maintained. 11. That any comments submitted by the City Engineer will have to be met and complied with as well as the comments of the Ada County Highway District (ACHD) and any other governmental agencies. 12 . That since the Applicant' s property is in the NORTH CURVE NEIGHBORHOOD of the Comprehensive Plan, the annexation and zoning Application is in conformance with the Comprehensive Plan. 13. Therefore, based on the Application, the testimony and evidence, these Findings of Fact and Conclusions, and the Ordinances of the City of Meridian, it is ultimately concluded that Applicant's property should be annexed and zoned as requested; that the conditions should be those stated above and other conditions to be explored at the City Council level; that such annexation would be orderly development and reasonable if the conditions are met. 14. That any ditches, canals, and waterways shall be tiled as a condition of annexation and if not so tiled the property shall be subject to de-annexation. 15. That any of the requirements of the Nampa Meridian or Settlers Irrigation Districts shall be met as well. 16. With compliance of the conditions contained herein, the annexation and zoning of R-8 Residential would be in the best interest of the City of Meridian. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The Meridian Planning and Zoning Commission hereby adopts and approves these Findings of Fact and Conclusions. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask your support for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. If this support is lacking then we ask that additional residential development be denied. Residents of the new subdivision cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. We ask that you assure the developer will provide walkways, bike paths and safe pedestrian access. This plat conforms to the previously approved preliminary plat lot arrangement and number of lots.. 2. New street names are needed fc~r Sagehen, Grouse, Pheasant. Also, Ftarmigan Place was_not approved. 3. Front set• back lines- need to be ahown, with side lot line reference di1l#ensions, for Lot 7 - Block 2; Lots 23, 24, 25, 26 - Block 5; Lot 10_- Block 6. 4. I recommend redueing_the landscaped island length at Locust Grove Road to facilitate access to Lat 2 - Block 4. 5. Show the easement for Onweiler Lateral along back of Block 4? 6. Show graphically or call-out in a note that all lots have a minimum 5 foot wide rear yard easement. 7. Amend Note 4 to include "or as allowed by Conditional Use." 8. Ustick Rd. needs to be shown as E. Ustick Rd. on Sheet 1 and in 3 places in the legal description on Sheet 2. 14. Several spelling errors are in the 3rd paragraph of the Certificate of Owners on sheet 2. Also, re-write the statement about Meridian providing water service. Use wording from Valeri Place Subd. 15. Both of these segments are also eligible for use of ACHD Road Impact Fee revenues to: (a) purchase additional right-of-way as required for future widening; and (b) increase capacity based on current land use and APA traffic projections, according to our Capital Improvements Plan '93 Update. Please provide us the square footage of additional R/W (20 feet along both Ustick and Locust Grove abutting the entire parcel, and a 20' x 20' triangle (appropriate curve) at -the corner, being dedicated by the Plat. The pro-rated value of that dedication will be the greater of the current pre-development assessed value, or the proven acquisition costs of the property; you or the developer should contact our Chief R/W Agent, Mr. Charles Smith at 345-7634, to negotiate that value. Reimbusement (as an "offset" against the Impact Fees which we will be collecting on the homes build within the subdivision) will also be given for any gualified improvements, generally the curb/gutter and pavement widening, and not includincr utility relocations or sidewalk construction. The value for this reimbursement will be based on accepted and paid invoices submitted to us, once the work is completed. A single lump sum payment will be made following recording of the Plat, and ACHD acceptance of the construction. Often these can be simplified without changing the ..Court confirmed status of the rights, if arrangements are made with the Secretary of the District in the advance planning stages. 2. Any alteration. from the original delivery point must be approved by tha Water Suparntendsnt and tranafsrs to accomplish this alteration must be arranged with the Secretary of the District as part of the system plan .acceptance by the Board of Directors. 4. If irrigation .service. is not to be provided to the individual.. properties, ail property owners must•bs notified that the District tax is an obligation of all lands in the Irrigation District. This notification is in compliance with Idaho Law. 6. No destruction, interference, nor limitation upon water flows which are appurtenant to the property rights of others shall be permitted. 7. If development plans include providing irrigation, operation and maintenance of the system may be undertaken by a Lateral Ditch Water User's Association, in which case the District assumes no responsibility beyond the original point of delivery for the tract. 8. The District cannot provide permission for alteration. of waterways belonging to and being a part of the property rights of individual land. owners and to which waters flow from the system of the District. Permission must be granted from each of the-property ownershavinq ditch and water rights in the waterway.. C. REVIEW AND APPROVAL PROCESS 1. Applicant shall complete and submit the attached application form to the Secretary of the District. Two (2) copies of the proposed plans shall. be submitted with the application. 2.
