Hartford Subdivision. The final plat of Hartford Subdivision is in substantial accordance

subdivision is also in substantial conformance with the City of Meridian Comprehensive

the preliminary plat for the Hartford Subdivision, they will enter into a Subdivision
Development Agreement as authorized by the City of Meridian ordinances 11-2416L and
11-2417D.
Vijya Laxmi intends to develop Hartford Subdivision which is a 58 lot, 20 acre subdivision
located at the northeast corner of Ustick and Ten Mile Roads. This subdivision will be
developed in accordance with the City of Meridian's ordinances and said development
agreement will address site specific items required during the approval process.

DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS

The undersigned, being the owners of the property hereinafter described, hereby adopt the following
protective covenants in their entirety to apply to real property subdivided and contained in an estate to be
known as HARTFORD SUBDIVISION, being a portion of Section 35, T 4 N, R 1 W, B.M., Ada
County, Idaho (see attached legal description Exhibit "A'~
HARTFORD SUBDIVISION is divided into single-famiy residential lots in compliance with the local
and state regulations and laws.
The following covenants shall run with the land and be in force and effect for thirty (30) years hereafter
unless sooner terminated or ammended by agreement of the owners of seventy-five percent Q5°b) of the
lots in the estates and are as follows, to wit:
(1) No building, fence, wall, structure, improvement or obstruction shall be placed or permitted to
remain upon any part of said property unless a written request for approval thereof containing the plans and
specifications thereof, including exterior color schemes having no offensive colors, has been approved in
writing by a majority of the Architectural Committee or by its representative designated by a majority of the
Committee. The approval of the Committee shall not be unreasonaby withhekf if the said plan and
specifications are for improvements which are similar in general design and quality, and generally in
harmony with the dwellings then located on said property.
The floor area of a one story house in this estate shall be a minimum of 1400 square feet and the
ground floor area of a split entry or a two-story house in this subdivision shall not be less than 1000 square
feet having a total of a minimum of 1800 square feet. Dwelling structures existing prior to development of
this subdivision shall be excluded from the square footage requirements but shall conform to all other
requirements if remodeled at any time after these covenants have been filed and recorded. No residence
shall be in excess of two stories.
All area requirements shall be exclusive of the garage area and shall be well constructed of good
quality material and workmanship. For the purpose of these covenants, eaves, steps, and open porches
shall not be constructed to permit any portion of a building to encroach upon any other lot, or into the set
back area.
All buildings shall be provided with architectural type shingle roofs or a similar alternate approved
by the Architectural Committee.
The value of any new residence in the subdivision shall exceed $80,000.00 in value not including
the value of the land and improvements thereon, based on June, 1994 values.
Fences shall not exceed the height of 6 feet on any lot and shall not exceed the height of 3 feet
within 20 feet of any street without express approval of the Architectural Committee, and shall be propery
finished and maintained. No fencing or obstructions shall be buiR within Nine Mile Creek so as to obstruct

a 100-year storm; obstructions shall not be constructed below the crest of the bank.
The location of fences, hedges, high plantings, obstructions or barriers shall be so situated as not
to unreasonaby interfere with the enjoyment and use of neighboring properties and streets and shall not
be allowed to constitute an undesirable or noxious or nuisance use. The determination of the Architectural
Committee shall be binding on all parties as to whether an undesirable, noxious or nuisance use exists.
At least ten (10) days prior to any construction being commenced, two sets of plans and
speafication shall be submitted to the Committee. Both sets of plans shall be marked with any pertinent
comments, dated and receipt acknowledged by the Chairman of the Committee with one set returned to
the owner within five (5) working days of receipt.
(2) No building shall be located on any easement or lot nearer to the front lot Nne or nearer to the
side and rear lot lines than the minimum building setback distances as set forth in the Meridian Zoning
Ordinance, however, in any event no building shall be located on any lot nearer than twerrty (20) feet from
the front lot line and fifteen (15) feet from the rear line nor nearer than five (5) feet per story to any side fine.
(3) Construction of any residences on the subdivision shall be diligenty pursued after
commencement thereof, to be completed within one (1) year, including landscaping.
Each house shall have at least one ornamental tree of at least 2-inch caliper in the front yard.
(4) No building shall be moved onto any of the tots in said subdivision.
(5) No shack, tent, or trailer house shall be used within this subdivision for permanent or temporary
living quarters.
(6) Nothing of an offensive, dangerous, odorous, or noisy kind shall be conducted or carried on
nor shall anything be done or permitted in said subdivision which may become an annoyance or nuisance
to the other property owners in said subdivision. All lot owners shall plant grass or sod in yard areas and
maintain to a maximum of 4 inches high.
(~ Keeping or raising of farm animals or poultry shall be prohibited. All dogs or cats or household
pets kept on the premises shall be properly fed and cared for and shall be adequately fenced so as not to
annoy or trespass upon the use of the property of others.
Dogs shall not be allowed to run at large. Not more than two dogs, cats or other pets may be kept
at one time, except that a litter of young may be kept unti18 or nine weeks old.
No business shall be conducted on the above property. No signs shall be installed to advertise any
business. No oil exploitation, development shalt be permitted upon the lots in this subdivision.
(8) Only one outbuilding per lot will be allowed. All outbuildings shall be constructed of good
quaUty building material, completely finished and painted on the outside and shall be of good quality and
character that will be in harmony with the other building on said property and must be approved by the
Architectural Committee.
(9) Easements for installation and maintenance of utilities and drainage facilities are reserved for
the areas as shown on the plat. Within these easements, no structure, planting or other material shall be
placed or permitted to remain which may damage or interfere with the installation and maintenance of the

utilities, or which may change the direction of flow of water through drainage channels in the easement.
Easement areas and all improvements on them shall be maintained continuously by the owner of the lot,
except for those improvements for which a public authority or utility is responsible.
(10) All bathroom, sink and toilet facilities shall be located inside the dwelling house or other
suitable appurtenant building, and shall be connected by underground pipe to the public sewer service.
(11) No sign of any Idnd shall be displayed in public view on any building or building site on said
property of more than six square feet advertising the property for sale or rent, or signs used by the
developer to advertise the property during the construction and sales period. If a property is solo or rented,
any sign relating thereto shall be removed immediatey, except that the Declarant or its agent may post a
"Sold" sign for a reasonable period following a sale.
(12) No lot or building site included within this subdivision shall be used or maintained as dumping
ground for waste material, incinerators are not permitted. Receptacles for storage of trash, garbage etc.
shah be maintained in a sanitary and clean condition.
(13) Parking of boats, trailer, motorcycles, trucks, truck campers and Eke equipment , or junk cars
or other unsighty vehicles, shall not be allowed on any part of said property nor on public ways adjacent
thereto excepting only within the confines of an enclosed garage, or other approved enclosure, and no
portion of same may project beyond the enclosed area. Parking of automobiles or other vehicles on any
part of the property shall be prohibited except within garages, carports, or other approved areas. The
Architectural Committee shall be the sok and exclusive judged of approved parking areas. Their derision
shalt be final and binding.
No machinery, building equipment or material shall be stored upon site until the Grantee is ready
and able to commence the construction with respect to such building upon which such building material
shall be placed within the property qne of such building site upon which the structure is to be erected.
(14) Installation of radio andbr television antenna is prohibited outside any building without written
permission from Architectural Committee.
(15) These covenants shall run with the land and shall be binding on all persons owning under
them for a period of thirty (30) years from the date of the recording hereof, after which time such covenants
shall be automaticaly extended for successive periods often (10) years, unless at any time after the initial
recording of this instrument, an instrument signed by the owners of 7596 of the land of the subdNision has
been recorded agreeing to change or terminate said covenants in whole or in part.
(16) Enforcement of these covenants will be handled by the Homeowners Assoaation. In the evert
of a violation, the offending party will be given a ten (10) day written notice to resolve said violation. In the
event of a judgement against any person for such violation, the Court may award injunction against the
offending party.
Any owner, or the owner of any recorded mortgage upon any part of said property, shall have the
right to enforce, by any proceeding at law or in equity, any or all restrictions, conditions, covenants,
reservations, liens and charge now or hereafter imposed by the provisions of this Declaration. Failure by
any owner to enforce any covenants or restrictions herein contained shall in no event be deemed a waiver
of the right to do so thereafter.
(17) A committee with a minimum of finro persons shall act as an architectural design committee
and shall, prior to any new construction in the subdNision, be famished with detailed plans of any proposed

building to be located in said subdivision and shall be allowed fifteen days to review said plans, drawings,
and specifications. If said Committee shall approve of the proposed building, or any modification or
aRemations thereof, they shall so indicate and their approval shall be construed as full comp~ance with the
provisions of Paragraph 1 of the original Covenarrts, said Committee shall have sole discretion to detemvne
what shall be substantial compliance with said covenants. No buildings shall occupy any portion of said
subdivision without the approval of said committee.
The initial committee shall consist of the following:

A Majority of said committee is empowered to act for the committee. In the event any member of
the committee is unable to act or fails or desires not to act, the remaining committee members shall appoint
an owner of a lot in said subdivision to serve on said committee, all of whom will serve without
compensation.
(18) Invalidation of any one of these covenants shalt in no way affect any of the other provisions
which shall remain in full force and effect.
(19) A Homeowners' Assoaation shall be duly formed by the developers. This assodation, in the
form of a non-profd Corporation, will be for the propose of owning, maintaining and operating an irrigation
distribution system for the subdivision and maintain common areas as delineated on the plat. Membership
in, and payment of dues to this Homeowners' Assoaation shall be mandatory and corrtinuous by all current
and future property owners of the subdivision, which association is dedicated to the. welfare of all property
owners in the HARTFORD SUBDIVISION.

Dear Jim:
Nampa & Meridian Irrigation District has completed a review on the
above mentioned project. The plans indicate that all municipal
storm water will be retained on site. This will be acceptable and
will meet Nampa & Meridian Irrigation District's requirements.
The plans show that the subdivision will have a pressurized
irrigation system although there is not enough information provided
for Nampa & Meridian Irrigation District to do a complete review.
If the District is to operate and maintain the system, we will need
a complete set of drawings which show the proposed pump site, pump
station, service lines, and we will need a contract. To obtain the
contract, please contact Patricia Cooper at Nampa & Meridian
Irrigation District at 343-1884.
The plans do not indicate any crossing or encroachment within the
District's facilities; therefore, we have no further comment
regarding this project. If you feel further discussion is
required, please feel free to contact me.

I have reviewed this submittal and offer the following comments, for your information and consideration
as conditions of the applicant during the hearing process:
1. This Plat generally conforms to the previously approved Preliminary Plat.
2. Please submit Ada County Street Name Committee letter approving the Subdivision Name,
Street Names, and Lot & Block Numbering. Make any revisions necessary to conform.
3. Please revise the general notes as follows:

4. Revise the domestic water service origin note in the Certificate of Owners to read; All Lots
within this plat will be eligible to receive water service from the City of Meridian's Municipal
Water System, and the City has agreed in writing to serve all the Lots in this subdivision.
5. Licensed Professional Land Surveyor needs to stamp, sign, and date sheet 2 of 2 of the Plat.
6. Please indicate on the plat map, "UNPLATTED" areas adjacent to this development.
7. Label the distance along the westerly boundary of Lot 18, Block 3 and northerly boundary of
Lot 19, Block 3 (shown in Detail "A"), also please show the distance along the easterly boundary
of Lot 35, Block 3.
8. It doesn't appear that any provisions have been made for the extension of the sanitary sewer main
that would serve the Bramblewood Subdivision. It has been discussed that this main would enter
this parcel somewhere in the vicinity of Lot 35, Block 3. City policy regarding sewer mains
between lots has been that it pass through a 20 foot wide common area.
9. Please provide the City with information as to plans for dealing with existing Flood Plains.
10. Flease revise the quadrant references in lines 13 & 15 of the legal description in the Certificate
of Owners to read North 00°53'34" fit, and South 00°53'34" West respectively.
11. Street improvements will need to be continued across the frontage of Lot 15, Block 3.
12. Existing use of domestic wells and septic systems within this development will terminate with
this platting. All Lots within this subdivision will be required to connect to the City of
Meridian's Municipal sewer and water systems. Existing wells may be utilized for irrigation.
13. Submit proposed restrictive covenants for review and comment.
14. Any existing irrigation ditches within this development will be tiled per City Ordinance.

Re: Hartford Subdivision
Dear Councilmen:
I have reviewed the application for Hartford Subdivision and find
that it includes approximately 66 homes at a median value of
$115,000. We also find that this subdivision is located in
census tract 103.11 and in the attendance zone for Linder
Elementary, Eagle Middle School and Eagle High School.
Using the above information we can predict that these homes, when
completed, will house 22 elementary aged children, 16 middle
school aged children, and 15 senior high aged students. At the
present time Linder Elementary is at 104 of capacity.
The Meridian School District is not opposed to growth in our
district, however this subdivision will cause increased over-
crowding in all three schools. There is little opportunity to
shift attendance boundaries since the surrounding schools are
also well over capacity. Before we could support this
subdivision, we would need land dedicated to the district or at
least made available at a minimum price for a school site in this
area. The site would need water and sewer services available.
In addition we would need to pass another bond issue for the
construction of schools.
Even if we were willing to use portable classrooms for a year or
two, this project would require one classroom at the elementary
level, one at the middle school level and one at the high school
level. To build portables ready to occupy by students will cost
approximately $40,000 each. As you can see the total for three
portables would be $120,000. We would welcome a meeting with you
to find ways of mitigating the projected costs to the school
district.

We are in a difficult position and need your help in dealing with
the impact of growth on schools.

STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that the first one half inch of stormwater be
pretreated through a grassy Swale prior to discharge to the
subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of
this project should obtain current best management practices for
stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals
that could be used for guidance are:

Stiles: We have not, this is one that we waited until the final plat.
Kingsford: This now is the final plat and they haven't.
Merkle: Mr. Mayor, this is the one that we went through and upon annexation on when to
submit the development agreement for review. In Shari's condition on the final plat it says
subject to approval on the development agreement being approved and executed prior to
signing the final plat. So when 1 read that I didn't resubmit on yet but it is very simple.
Kingsford: Final plat won't be signed until that (inaudible)
Morrow. In essence that is what I am trying to get the motion to. Would you like to restate

can and the wine is by the drink.
Rountree: I see that everyone else issues a permit do we issue a permit as well?
Corrie: Yes

Morrow. An editorial comment, they are anticipating platting to begin in the spring/summer
of 1996 I think. but probably we extend this as normal for one year.
Corrie: I believe the letter is dated December the 18, 1995 so it would be one year from
that point or do you want to extend it from spring/summer of 1996 I guess is my question.

ITEM #18: WATER/SEWER/TRASH DELINQUENCIES:
Corrie: Delinquency for February, turn off scheduled for February 14, 1996. This is to
inform you in writing if you choose to you have the right to apre-determined meeting at
7:30 P.M. February 6, 1996 before the Mayor and Council to be judged on the facts and
defend the claim made by the City that your water, sewer and trash bill are delinquent.
You may retain counsel. Your service will be discontinued on February 14, 1996 unless
payment is received in full. Is there anyone present who wishes to contest their sewer,
water and trash delinquency? Seeing none they are hereby informed they may appeal or
have the decision of the City reviewed by the Fourth Judicial District Court pursuant to
Idaho Code. Even though they appeal their water will be shut off. The amount of the turn
off list is $18,874.87. Council?
Morrow. Mr. Mayor, I would move that we approve the water, sewer, trash delinquency turn
off list.

The undersigned, being the owners of the property hereinafter described, hereby adopt the following
protective covenants in their entirety to apply to real property subdivided and contained in an estate to be

HARTFORD SUBDIVISION is divided into single-family residential lots in compliance with the local
and state regulations and laws.
The following covenants shall run with the land and be in force and effect for thirty (30) years hereafter
unless sooner terminated or ammended by agreement of the owners of seventy-five perceht (75°~) of the
lots in the estates and are as follows, to wit:
(1) No building, fence, wall, structure, improvement or obstruction shall be placed or permitted to
remain upon any part of said property unless a written request for approval thereof containing the plans and
specifications thereof, including exterior color schemes having no offensive colors, has been approved in
writing by a majority of the Architectural Committee or by its representative designated by a majority of the
Committee. The approval of the Committee shall not be unreasonably withheld if the said plan and
specifications are for improvements which are similar in general design and quality, and generally in
harmony with the dwellings then located on said property.
The floor area of a one story house in this estate shall be a minimum of 1400 square feet and the
ground floor area of a split entry or a two-story house in this subdivision shall not be less than 1000 square
feet having a total of a minimum of 1800 square feet. Dwelling structures existing prior to development of
this subdivision shall be excluded from the square footage requirements but shalt conform to all other
requirements if remodeled at any time after these covenants have been filed and recorded. No residence
shall be in excess of two stories.
All area requirements shall be exclusive of the garage area and shall be well constructed of good
quality material and workmanship. For the purpose of these covenants, eaves, steps, and open porches
shall not be constructed to permit any portion of a building to encroach upon any other lot, or into the set
back area.
All buildings shall be provided with architectural type shingle roofs or a similar alternate approved
by the Architectural Committee.
The value of any new residence in the subdivision shall exceed $80,000.00 in value not including
the value of the land and improvements thereon, based on June, 1994 values.
Fences shalt not exceed the height of 6 feet on any lot and shall not exceed the height of 3 feet
within 20 feet of any street without express approval of the Architectural Committee, and shall be properly
finished and maintained. No fencing or obstructions shall be built within Nine Mile Creek so as to obstruct
a 100-year storm; obstructions shall not be constructed below the crest of the bank
The location of fences, hedges, high plantings, obstructions or barriers shall be so situated as not
to unreasonably intertere with the enjoyment and use of neighboring properties and streets and shall not
be allowed to constitute an undesirable or noxious or nuisance use. The determination of the Architectural
Committee shall be binding on all parties as to whether an undesirable, noxious or nuisance use exists.
At least ten (10) days prior to any construction being commenced, two sets of plans and
specification shall be submitted to the Committee. Both sets of plans shall be marked with any pertinent
comments, dated and receipt acknowledged by the Chairman of the Committee with one set returned to
the owner within five (5) working days of receipt.
(2) No building shall be located on any easement or lot nearer to the front lot line or nearer to the
side and rear lot lines than the minimum building setback distances as set forth in the Meridian Zoning
Ordinance, however, in any event no building shall be located on any lot nearer than twenty (20) feet from
the front lot line and fifteen (15) feet from the rear line nor nearer than five (5) feet per story to any side line.
(3) Construction of any residences on the subdivision shall be diligently pursued after
commencement thereof, to be completed within one (1) year, including landscaping.
Each house shall have at least one ornamental tree of at least 2-inch caliper in the front yard.
(4) No building shall be moved onto any of the lots in said subdivision.
(5) No shack, tent, or trailer house shall be used within this subdivision for permanent or temporary
living quarters.
(6) Nothing of an offensive, dangerous, odorous, or noisy kind shall be conducted or carried on
nor shall anything be done or permitted in said subdivision which may become an annoyance or nuisance
to the other property owners in said subdivision. All lot owners shall plant grass or sod in yard areas and
maintain to a maximum of 4 inches high.
(~ Keeping or raising of farm animals or poultry shall be prohibited. All dogs or cats or household
pets kept on the premises shall be properly fed and cared for and shall be adequately fenced so as not to
annoy or trespass upon the use of the property of others.
Dogs shall not be allowed to run at large. Not more than two dogs, cats or other pets may be kept
at one time, except that a litter of young may be kept until 8 or nine weeks okl.
No business shall be conducted on the above property. No signs shall be installed to advertise any
business. No oil exploitation, development shall be permitted upon the tots in this subdivision.
(8) Only one outbuilding per lot will be allowed. All outbuildings shall be constructed of good
quality building material, completely finished and painted on the outside and shall be of good quai'tty and
character that will be in harmony with the other building on said property and must be approved by the
Architectural Committee.
(9) Easements for installation and maintenance of utilities and drainage facilities are reserved for
the areas as shown on the plat. Within these easements, no structure, planting or other material shall be
placed or permitted to remain which may damage or intertere with the installation and maintenance of the

utilities, or which may change the direction of flow of water through drainage channels in the easement.'
Easement areas and all improvements on them shall be maintained continuously by the owner of the lot,
except for those improvements for which a public authority or utility is responsible.
(10) All bathroom, sink and toilet facilities shall be located inside the dwelling house or other
suitable appurtenant building, and shall be connected by underground pipe to the public sewer service.
(11) No sign of any Idnd shall be displayed in public view on any building or building site on said
property of more than six square feet advertising the property for sale or rent, or signs used by the
developer to advertise the property during the construction and sales period. If a property is sold or rented,
any sign relating thereto shall be removed immediately, except that the Declarant or its agent may post a
"Solo" sign for a reasonable period following a sale.
(12) No lot or building site included within this subdivision shall be used or maintained as dumping
ground for waste material. Incinerators are not permitted. Receptacles for storage of trash, garbage etc.
shall be maintained in a sanitary and clean condition.
(13) Parking of boats, trailer, motorcycles, trucks, truck campers and like equipment , or junk cars
or other unsightly vehicles, shall not be allowed on any part of said property nor on public ways adjacent
thereto excepting only within the confines of an enclosed garage, or other approved enclosure, and no
portion of same may project beyond the enclosed area. Parking of automobiles or other vehicles on any
part of the property shall be prohibited except within garages, carports, or other approved areas. The
Architectural Committee shall be the sole and exclusive judged of approved parking areas. Their decision
shall be final and binding.
No machinery, building equipment or material shall be stored upon site until the Grantee is ready
and able to commence the construction with respect to such building upon which such building material
shall be placed within the property Gne of such building site upon which the structure is to be erected.
(14) Installation of radio andlor television antenna is prohibited outside any building without written
permission from Architectural Committee.
(15) These covenants shall run with the land and shall be binding on all persons owning under
them for a period of thirty (30) years from the date of the recording hereof, after which time such covenants
shall be automatically extended for successive periods of ten (10) years, unless at any time after the initial
recording of this instrument, an instrument signed by the owners of 75°~6 of the land of the subdivision has
been recorded agreeing to change or terminate said covenants in whole or in part.
(16) Enforcement of these covenants will be handled by the Homeowners Association. In the event
of a violation, the offending party will be given a ten (10) day written nonce to resolve said violation. In the
event of a judgement against any person for such violation, the Court may award injunction against the
offending party.
Any owner, or the owner of any recorded mortgage upon any part of said property, shall have the
right to enforce, by any proceeding at law or in equity, any or all restrictions, conditions, covenants,
reservations, liens and charge now or hereafter imposed by the provisions of this Declaration. Failure by
any owner to enforce any covenants or restrictions herein contained shall in no event be deemed a waiver
of the right to do so thereafter.
(17) A committee with a minimum of two persons shall act as an architectural design committee
and shall, prior to any new construction in the subdivision, be furnished with detailed plans of any proposed

building to be located in said subdivision and shall be allowed fifteen days to review said plans, drawings;
and specifications. If said Committee shall approve of the proposed building, or any modification or
aftemations thereof, they shall so indicate and their approval shall be construed as full compliance with the
provisions of Paragraph 1 of the original Covenarrts, said Committee shall have sole discretion to determine
what shall be substantial compliance with said covenants. No buildings shall occupy any portion of said
subdivision without the approval of said committee.
The initial committee shall consist of the following:

3. Rick Thurber
A Majority of said committee is empowered to act for the committee. In the event any member of
the committee is unable to act or fails or desires not to act, the remaining committee members shall appoint
an owner of a lot in said subdivision to serve on said committee, all of whom will serve without
compensation.
(18) Invalidation of any one of these covenants shall in no way affect any of the other provisions
which shall remain in full force and effect.
(19) A Homeowners' Association shall be duly formed by the developers. This association, in the
form of anon-profit Corporation, will be for the propose of owning, maintaining and operating an irrigation
distribution system for the subdivision and maintain common areas as delineated on the plat. Membership
in, and payment of dues to this Homeowners' Assoaation shall be mandatory and continuous by all current
and future property owners of the subdivision, which association is dedicated to the. welfare of all property
owners in the HARTFORD SUBDIVISION.
