The site contains 49.22 acres and is located on the south side of Victory Road, approximately a 1/4 mile west of Kuna-Merdian Road and legally described as a portion of NE 1/4 of Section 25, Township 3N, Range 1W. The application is comprised of: 1. Application forms prepared and submitted by the applicant's representative. 2. Preliminary plat of Kentucky Ridge Subdivision. 3. All other information contained in file 94-08-PDR/94-06-ZC. PROCEDURAL ITEMS 1. On February 2, 1994, Development Services accepted application 94-08- PDR/94-06-ZC and scheduled it for public hearing before the Commission on March 10, 1994. Historical agricultural use includes animals with associated noise and odor, and burning of ditches. 2. Provision for hooking on to Meridian central sewer must be incorporated into the project. The proposed method of sewage treatment includes land application of effluent, and the Comprehensive Plan calls for buffering of these waste treatment systems, also. Approvals from various agencies must be received. 3. Only a portion of the proposed development falls within the Impact Area of the Comprehensive Plan currently recognized by Ada County. That Plan called for residential development not to exceed the Rural Residential Agricultural density (one single-family dwelling per five acres). The reasoning at that time was to allow a resubdivision of these parcels to urban density when services were available. The recently adopted Comprehensive Plan calls for densities "as low as 3 units per acre" within the Urban Service Planning Area, so there is a great disparity in the two Plans in this regard. The average lot size of 10,000 square feet is acceptable to the City of Meridian, as is the provision of a central sewer system that will hook up to the City of Meridian at such time as services are available. LA -000067 1ii:.^,ic�psl �7aste�«iter) Kentucky Ridge Subdivision Dear Mr. Preston: You have recently submitted an engineering report for adding additional homes to the Meridian Heights Sewer Association wastewater treatment system. In particular you asked for a clarification of the existing land application permit. The land application permit was written and system approved based on conditions existing at the time of application. Minimum field size, buffers, monitoring requirements, etc. are determined from information provided by the applicant. When conditions change it is necessary to re-evaluate the pertinent conditions in the permit to determine if they are adequate or if modifications are necessary. I have reviewed the preliminary engineering report submitted with the following comments: 1) Design flows: The original application materials estimated a per home design flow of 280 gallons per day. Standard es inat—ing criteria is 2Gn .-►-c -er day for 1J r 1 3 bedroom homes. You have determined from flow measurements an average of 158 gallons per day per home. With a maximum of 61,600 gallons per day allowed you have calculated 343 homes can be connected. Since 158 gpd is much less than the original estimated flows and also much less than typical flows, a conservative approach is warranted. We will allow an additional 70 homes to be connected at the present time. You should continue to monitor flows to determine the long term trends. If additional capacity is determined at some time in the future additional units may be allowed. 2) Ponded water: Ponded water will not be allowed. This is a condition of the existing permit. It is mentioned now only because there is a greater risk of ponding with Mike Preston October 24, 1994 Page 2 surface irrigation methods. No action is required now but this should be monitored closely. 3) Buffers: Given the nature of the wastewater and community, a 150 foot buffer will be required from the land application area and dwellings. Buffer distances to existing and proposed wells are acceptable. 4) Additional monitoring: Future annual reports will be reviewed to determine if additional monitoring will be required. If additional monitoring is required, a modification to the permit will be necessary. Factors that may indicate additional monitoring are: additional well construction with capture zone including land application site, additional home construction in the area, changes in quality of wastewater applied, changes in the perceived reliability of system. 5) Field size: If flows continue as projected no additional acreage is necessary. However, if flows increase above the amount allowed in the permit a modification will be necessary and additional land identified. 6) Meridian Heights Sewer Association approval is required to add additional homes to the treatment system. A potential street connection thru Lot 2 of Block 1 (to serve the undeveloped area) would provide a short-cut to the east so that vehicles would use that route instead of Stoddard Way which is proposed to be constructed to a collector street standard. Staff recommends that no stub streets be provided to the east from this project. 7. If the area to remain zoned as RT (22 acres) were to be re- zoned to R-8 and developed, there could be up to 61 lots (for a total of 121 -lots) added to the street system served by the proposed Stoddard Way. This does not account for the area to the south of this project for which there is a stub street proposed. Stoddard Way should be constructed as a collector street from Victory Road to Strahmoor Drive. The developer is proposing to offset the proposed Stoddard Way from the exist- ing Stoddard Lane to the north of Victory Road in order to encourage vehicles to continue to the east on Victory Road instead of using Stoddard Lane to the north. The new intersection (Stoddard Way/Victory Road) is proposed to be located at the bottom of a sag vertical curve in the gradeline of Victory Road. View from the east is severely hindered because of a hill 350 -feet east of the new intersec- tion. The proposed intersection should be relocated a minimum of 300 -feet to the west, but no nearer than 150 -feet to the Cobble Way intersection. 9. Direct lot or parcel access to Victory Road is prohibited (except the existing dwelling on proposed Lot 1 of Block 1), in compliance with District policy. The site contains 49.22 acres and is located on the south side of Victory Road, approximately a 1/4 mile west of Kuna-Merdian Road and legally described as a portion of NE 1/4 of Section 25, Township 3N, Range 1W. All other information contained in file 94-08-PDR/94-06-ZC. PROCEDURAL ITEMS 1. On February 2, 1994, Development Services accepted application 94-08- PDR/94-06-ZC and scheduled it for public hearing before the Commission on March 10, 1994. 2. Legal notice of the public hearing was published in the Idaho Statesman on February 21, 1994. On February 18, persons owning property within 300 feet of the site were notified of the hearing by mail Prior to the hearing, notices were posted on and near the site. 3. Staff notified other agencies of this application on February 11, orated 4, and the solicited their comments. Any comments received are p staff report. APPLICABLE LAW 1. The site lies within the Meridian Area of Impact where eMeridian plan for Comprehensive Plan has been adopted as the applicable comprehensive this area (§ 5.20, Ada County Comprehensive Plan; § 9-2-2A, Ada County Code). Applicable sections of the Meridian Comprehensive Plan are outlined below: GOALS OF THE COMPREHENSIVE PLAN GOAL 2: To ensure that growth and development occur in an orderly fashion in accordance with adopted policies and procedures governing the use of land, residential development, the provisions of services and the distribution of new housing units within the Urban Service Planning Area. GOAL 4: To provide housing opportunities for all economic groups within the community. GOAL 7: To provide community services to fit existing and projected needs. GOAL 8: To establish compatible and efficient use of land through the use of innovative and functional site design. GOAL 9: To encourage a balance of land use patterns to insure that revenue pay for services. PHYSICAL ENVIRONMENT POLICIES 8. Septic or other approved individual on-site disposal systems may be permitted in the rural areas outside the Meridian Urban Service Planning Area in accordance with permit requirements of Central District Health and in compliance with the Area -Wide Waste Treatment Management Plan and State and Federal water quality standards and regulations. POPULATION GROWTH POLICIES 4,t No new residential, commercial, or industrial developments should be ./ approved outside of the Urban Service Planning Area, unless it can be shown that urban services can be reasonably provided. HOUSING DEVELOPMENT 7. Residential developments shall be phased in accordance with their connection to the municipal sewer system. L AREAS 1. he Meridian Comprehensive Plan shall apply in the rural areas which are utside Meridian's City Limits and within the Meridian Area of City Impact, and the Ada County Zoning and Subdivision Ordinances shall apply in the rural areas outside the City Limits. 3. Although it is recognized that urbanized development does exist within the rural areas of the Area of City Impact, the rural lands should be kept in agricultural production as long as possible until urban services (municipal sewer and water facilities and other essential services) can be provided. In that regard to single family dwellings on 5 acre tracts, to wit: 4. Residential development is allowed in the rural areas provided that said development does not exceed the Rural Residential Agricultural density,... 2. Section 8-4C-2 of the Ada County Code states the permitted uses in the RT zone. This section includes: Single Family dwellings or mobile home -one per lot. Section 8-4C-6 specifies the design and dimensional standards for uses in the RT zone. The minimum lot size for a dwelling is listed as five (5) acres with a minimum street frontage of 250 feet. 3. Section 8-5-1 of the Ada County Code states the purposes for the residential zones in Ada County. For the R8 (Medium Low Density Residential Zone) the following is stated: The purpose of this Zone is to provide for medium low density residential development, from three (3) to eight (8) .dwellings per acre in Urban 3 Service Planning Areas where community water systems and municipal wastewater collection and treatment are available. The predominant character of land use should be detached single-family dwelling units including townhouses, patio homes, zero -lot -line homes, duplexes and other similar residential designs. 4. Section 8-5-7 of the Ada County Code specifies the design, dimensional, and density standards for the residential zones. This Zone is appropriate for use in Urban Service Planning Areas where physical limitations of the environment such as problems with soils, topography, hydrology and flooding make large lot development more appropriate. An individual wastewater 4 treatment system and an individual water system may be permitted, however; community water systems and municipal wastewater collection and treatment are preferred. 6. Section 8-5-7 of the Ada County Code specifies the design, dimensional, and density standards for the residential zones. Subdivisions may be permitted in the R8 and R1 zones only through the planned development procedure established in Chapter 9 of Title 8 ( § 8-5-2, Ada County Code). 8. Chapter 10 of Title 8, Ada County Code, are the Subdivision Regulations which "apply to the subdivision of land within the unincorporated territory of Ada County" (§ 8-10-28, Ada County Code). Section 8-10-1 A of the Ada County Code (Design Standards) states: These standards shall be followed in all subdivisions regulated by this Title. In addition to these standards, all subdivisions shall meet the design standards and findings of fact listed in Chapter 9 relating to planned developments and shall be in accordance with the Comprehensive Plan. 9. Section 8 -8C -5E4 specifies the following requirement: 0 10-b". 1-41 Development at urban densities must be served by a community water system and may utilize an interim wastewater treatment system if reasonably available, as stated in this Article (see 8-8C-6). 10. Section 8-8C-6 and particularly 8 -8C -6F states that a municipal wastewater collection and treatment system shall be reasonably available if it is within one- half (1/2) mile of any property line of the development site. 11. Section 8-9-3C5 specifies the findings which shall be made by the Commission and the Board when considering. applications for planned developments. This Section states: Findings of Fact: The Commission, before recommending action on a preliminary development plan, and the Board before taking action on said plan, shall first make findings of fact and conclusions of law which shall be supported by evidence in the hearing record to determine whether: a. The site design conforms to . the topography and natural landscape features and shows consideration for the location and function of land uses and structures to achieve this purpose; b. The development is compatible with existing and planned permitted uses and would not cause damage, hazard or nuisance to persons or property in the vicinity; C. The internal street system is designed for the efficient and safe flow of vehicles and pedestrians without having a disruptive influence upon the activities and functions contained within the development nor place an undue burden upon the existing transportation and other public services in the surrounding area; d. Community facilities, such as park, recreational and open space areas are functionally related to all dwelling units and are easily accessible via pedestrian and/or bicycle pathways. Any common usable open space which may be provide (See Section 8-5-7-1 C) shall be directly accessible to the lots which have been reduced in size from the minimum lot size, and to multi -family development(s) within the PD; e. The proposal complies with the lot size and density standards set forth in Section 8-5-7-1. f. The overall plan is in conformance with the applicable Comprehensive Plan(s), Future Acquisition Maps, Area of City Impact ordinances and other pertinent ordinances; 5 /t g. The Ada County Code requires new subdivisions to provide two means of access into a new development. The Commission and the Board should consider any comments received from the Ada County Highway District concerning the design of the roadway system. d. The development proposes a 1.84 acre park which is located on the west side of Stoddard Way near the subdivision's entrance. The park is to be maintained by the subdivision homeowner's association. Some temporary open space shall be provided at the southern end of the development, but only until additional services can be provided to those areas. The developer anticipates creating 15 additional lots from these areas. e. The development proposes 53 single family residential lots on approximately 49.22 acres; or 1.07 dwelling units per acre. This proposal complies with the lot size and density standards established under the RT, Al and R8 Zones. f. With regard to the Findings of Fact of Section 8-18-913 of the Ada County Code pertaining to change of zone requests, staff offers the following information for the Commission's and the Board's consideration: 1. The site is in the Meridian City Impact Area where the Meridian Comprehensive Plan has been adopted as the governing comprehensive plan. As stated previously in this report, the Meridian Comprehensive Plan provides for urban density development in areas within the Merdian City Impact Area, if community water service and municipal sewer service are provided. These services will be provided by the Meridian Heights Association. However, residential development shall not exceed the Rural Residential Agricultural density, (one single family dwelling per five acres) until central services can be provided. In this regard, the comprehensive plan does not appear to support the two R1 zone lots proposed for this development. 2. The R8 Zone allows for development of residential lots at a density of up to eight (8) dwelling units per acre in Urban Service Planning Areas where community water service and municipal waste water collection and treatment is available. This proposal is outside the Meridian City Urban Service Planning Area, but will utilize central water and sewer services from the Meridian Heights Water and Sewer Association. This development proposal has an overall density of 1.07 dwelling units per acre. 3. The area immediately surrounding the site is primarily dedicated to agricultural pursuits with some associated single family residents. Similar residential development exists to the east of the proposed site in the Meridian Heights Subdivision. With the exception of the R1 lots and the area to remain zoned RT, the proposed development will be served by sewer and water service from the Meridian Heights Association. 4. As stated above, the Meridian Comprehensive Plan states that residential development shall not exceed the Rural Residential Agricultural density, (one single family dwelling per five acres). until central services can be provided. In this regard, the comprehensive plan does not appear to support the two R1 zone lots proposed for this development. The Commission, and the Board should consider the evidence and testimony presented during the public hearing to determine whether this development, if approved, would constitute a special or privileged treatment of land. 5. The Commission, and the Board should consider the evidence and testimony presented during the public hearing to assess any benefit this proposal will have to the public interest. 6. The subdivision will utilize public streets, central water and sewer services provided by the Meridian Heights Water and Sewer association. The Commission, and the Board must determine if hese factors adequately serve the public health, safety, and welfare. STAFF ANALYSIS and CONCLUSIONS The applicant is seeking approval of planned residential development which consists of a preliminary plat of a seventy (70) lot subdivision (Kentucky Ridge Estates) and a change of zone from RT (Rural Transition) to R1 (Estate Residential) and RS (Medium Low Density Residential). The proposal includes 53 buildable lots, 16 open space lots and 1 well lot. The site is located within the Meridian Area of City Impact and outside the Meridian Urban Service Planning Area. The site contains 49.22 acres and is located on the south side of Victory Road, approximately 1/4 mile west of Kuna-Meridian Road. The area immediately surrounding the site is dedicated to agricultural pursuits with some associated single family residents. Similar residential development exists to the east of the proposed site within the Meridian Heights Subdivision. With the exception of the R1 lots and the area to remain zoned RT, the majority of the lots have an average lot size of 10,000 square feet. Each lot will meet or exceed the minimum size and dimensional requirements for the zones which are proposed with this application. The development also proposes a 1.34 acre park which is located on the west side of Stoddard Way near the subdivision's entrance. The park is to be maintained by the subdivision homeowner's association. The Commission and the Board, should consider the evidence and testimony presented during the public hearing prior to rendering their decision. 9. Prior to approval by the Board of County Commissioners, the final plat shall contain the following certificates and endorsements: signature of the owner(s); certificate of the plat engineer; certificate of the County Engineer; certificate of the Boise City Clerk; certificate of the Boise City Engineer; endorsement of the Central District Health Department; and, the endorsement of the Ada County Highway District. 10. The following statement shall appear on the face of the final plat: "Any re- subdivision of this plat shall comply with the applicable regulations in effect at the time of the re -subdivision." 11. We also find that this subdivision is located in census tract 103.13 and in the attendance zone for Mary McPherson Elementary, Lake Hazel Middle School and Meridian High School. Using the above information we can predict that these homes, when completed, will house 21 elementary aged children, 12 middle, school aged children, and 11 senior high aged students. At the present time Meridian Elementary is at 113% of capacity, Lake Hazel is at 114% of capacity and Meridian High School is at 123% of capacity. The Meridian School District is not opposed to growth in our district, however this subdivision will cause increased over- crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. Before we could support this subdivision, we would need land dedicated to the d_spr=ct or at least made available at a minimum price for a school site in this area. The site would need water and sewer service available. In addition we would need to pass another bond issue for the construction of schools. The cost per student far newly constructed schools, excluding site purchase price and offsite improvements, exceeds 55,000 per elementary student and $10,000 per middle or high school student. 3 We are in a difficult position and need your help in dealing with the impact of growth on schools. Andrus, taovema SUBJECT: Meridian Heights Water and Sewer Association Land Application Permit (Boise) -- LA -000067 (municipal wastewater) Purpose The purpose of this memorandum is to satisfy the requirements of IDAPA 16.01.17400,04 (Wastewater -Land Application Permit Regulations) for issuing land application permits. Process Description Approximately 23 MGA of municipal wastewater from a subdivision is treated in 2. lagoons; one aerated and the other facultative. Evaporation accounts for a loss of 5 MGA. 18 MGA of wastewater is chlorinated and land applied to 20 acres of alfalfa farm land. Summary of Events A land application of wastewater permit modification was received on April 21, 1992. The Department determined the application incomplete on May 28, 1992. A revised application was received in August 1992. A letter was sent to the permittee November 25, 1992 requesting additional information. December 21, 1992 additional information was received from the permittee. On March 3, 1992 the permit application was determined to be complete and a preliminary decision was made to prepare a draft permit. A draft permit was prepared and sent to the permittee for comment on June 29, 1993. Discussion The treatment facility serves a total of 220'homes in a subdivision south of Meridian. Treatment and storage is provided by a 2.27 MG aerated lagoon, a 11.1 MG facultative/storage lagoon, and a large buried pipe chlorination contact facility. Harris September 24, 1993 Page Two The wastewater is to be applied to a 20 acre alfalfa field near the treatment facility. There is sufficient land available to accept the wastewater without excessive deep percolation or overloading the site with nutrients. If fact, the permittee may need to apply supplemental fertilizer and water to obtain maximum crop yields. Wells in the vicinity include 2 community wells serving Meridian Heights and a domestic well on the farm site. Capture zone analyses were performed for all wells in the vicinity. It is not felt there will be any effect on the wells. Buffers are provided from residences to limit risk from aerosol drift from the proposed sprinkler irrigation. The permittee is allowed to apply up to 18 million gallons of wastewater per year (MGA), and treat it on 20 acres of land (referenced in the site map as Field A in Appendix "A" which is incorporated by reference into this permit) in accordance with the conditions of this permit. The wastewater shall be managed substantially in accordance with the plan of operation, except where modified by this permit. The plan of operation shall beincorporated by reference into this permit, and shall be enforceable as a part of this permit. Total coliform shall be limited to a monthly average of 230/100ml. 2. Wastewater shall be applied to the land application site from April 1 through October 31. A 50 foot buffer strip shall be maintained between the wastewater application site and areas accessible by the public. 3. Wastewater(s) or recharge waters applied to the land surface must be restricted to the premises of the application site unless permission has been obtained from the Department authorizing a discharge into the waters of the State as stated in IDAPA 16.01.2600,02. 4. Wastewater must not create a public health hazard or nuisance condition as stated in IDAPA Section 16.01,2600,03. In order to prevent public health hazards and nuisance conditions the permittee shall: a. Apply wastewater as evenly as practicable to the entire treatment area; b. Prevent organic solids (contained in the wastewater) from accumulating on the ground surface to the point where the solids putrefy or support vectors or insects; and C. Prevent wastewater from ponding in the fields to the point where the ponded wastewater putrefies or supports vectors or insects. Permit No.: LA -000067-02 Expiration Date: September 6, 1998 Page 4 of 11 d. Provide sufficient aeration to treatment ponds to prevent objectionable odors. e. Contain all aerosols on site. During periods of high wind, discontinue sprinkler irrigation. 5. As a result of the land application of wastewater, ground waters of the state must not contain contaminants exceeding those values as referenced under IDAPA 16.01.2299,04 and 05 of the Idaho Water 4uality Standards and Wastewater Treatment Rectuirements. In order to comply with the above regulation, the permittee shall: a. Manage the wastewater land.application treatment site as an agronomic operation, where vegetative cover is grown and harvested to utilize the nutrients and minerals in the wastewater, and, b. Not hydraulically overload any particular areas of the wastewater land application treatment.site. 6. The permittee shall at all times properly maintain and operate all structures, systems, and equipment for treatment, control and monitoring, which are installed or used by the permittee to achieve compliance with the permit or the Waste Water Land Application Permit Regulations. 7. All waste solids, including dredgings and sludge, shall be utilized or disposed in a manner which will prevent their entry, or the entry of contaminated drainage or leachate therefrom, into the waters of the state such that health hazards and nuisance conditions are not created. Disposal methods and sites are required to be reviewed and approved by the Department. Samples shall be collected at times and locations that represent typical environmental and process parameters being monitored. Unless otherwise agreed to in writing by the Department, data collected and submitted shall include, but not be limited to, the following parameters and frequencies. 1. The permittee is encouraged to submit data on computer disk in the format established by the Department. It is to include the following: a. All monitoring data required in Schedule B, b. Status of any special compliance condition in Schedule C, and c. Interpretive discussions of monitoring data (hydraulic loading, wastewater, etc.) with particular respect to environmental impacts by the facility. The facility Operation and Maintenance Manual will be submitted within 30 days of final permit issuance date. 2. Facilities will be constructed within 60 days to exclude all extraneous surface water from entering the treatment ponds. Any facilities proposed to be constructed that require approval shall be submitted to DEQ for approval prior to construction. Permit No.: LA -000067-02 Expiration Date: September 6, 1998 Page 8 of 11 SECTION H - STANDARD PERMIT CONDITIONS SCHEDULE D Procedural and Reporting Conditions 1. The permittee shall comply with all conditions of the permit. 2. If the permittee intends to continue operation of the permitted facility after the expiration of an existing permit, the permittee shall apply for a new permit in accordance with these regulations. 3. The permittee shall furnish to the Director within a reasonable time, any information including copies of records, which may be requested by the Director to determine whether cause exists for modifying, revoking, re -issuing, or terminating the permit, or to determine compliance with the permit or these regulations. 4. The permittee shall allow the Director, consistent with Title 39, Chapter 1, Idaho Code, to: a. Enter the permitted facility, b. Inspect any records that must be kept under the conditions of the permit. C. Inspect any facility, equipment, practice, or operation permitted or required by the permit. d. Sample or monitor for the purpose of assuring permit compliance, any substance or any parameter at the facility. 5. The permittee shall report to the Director under the circumstances and in the manner specified in this section: a. In writing thirty (30) days before any planned physical alteration or addition to the permitted facility or activity if that alteration or addition would result in any significant change in information that was submitted during the permit application process. In writing thirty (30) days before any anticipated change which would result in noncompliance with any permit condition or these regulations. C. Orally within twenty-four (24) hours from the time the permittee became aware of any non-compliance which may endanger the public health or the environment at telephone numbers provided in the permit by the Director (see below) DEQ Central Office- (208) 334-5898 Emergency Number- 1-800-424-9067 d. In writing as soon as possible but within five (5) days of the date the permittee knows or should know of any noncompliance unless extended by the Department. This report shall contain: _ i. A description of the noncompliance and its cause; ii. The period of noncompliance including to the extent possible, times and dates and, if the noncompliance has not been corrected, the anticipated time it expected to continue; and iii. Steps taken or planned to reduce or eliminate reoccurrence of the noncompliance. e. In writing as soon as possible after the permittee becomes aware of relevant facts not submitted or incorrect information submitted, in a permit application or any report to the Director. Those facts or the correct information shall be included as a part of this report. 6. The permittee shall take all necessary actions to eliminate and correct any adverse impact on the public health or the environment resulting from permit noncompliance. Permit No.: LA -000067-02 Expiration Date: September 6, 1998 Page 10 of 11 SCHEDULE E Modification. Violation. and Revocation conditions 1. Both minor and major modifications may be made to this permit as stated in IDAPA 16.01.17700,01 and 02 with respect to any conditions stated in this permit upon review and approval of the Department. 2. Whenever a facility expansion, production increase or process modification is anticipated which will result in a change in the character of pollutants to be discharged or which will result in a new or increased discharge that will exceed the conditions of this permit, or if it is determined by the Department that the terms or conditions of the permit must be modified in order to adequately protect the public health or environment, a request for either major or minor modifications must be submitted together with the necessary reports, plans and specifications for the proposed changes. No facility expansion, production increase or process modification which may change the conditions of this permit shall be made until plans have been reviewed and approved by the Department and a new permit or permit modification has been issued. If modifications are proposed which do not require a permit modification, plans and specifications still must be reviewed and approved by the Department before the modification is performed. 3. Permits shall be transferable to a new owner or operator provided that the permittee notifies the Director by requesting a minor modification of the permit before the date of transfer. 4. Any person violating any provision of the Waste Water Land Application Permit Regulations, or any permit or order issued thereunder shall be liable for a civil penalty not to exceed ten thousand dollars ($10,000) or one thousand dollars ($1,000) for each day of a continuing violation, whichever is greater. In addition, pursuant to Title 39, Chapter 1, Idaho Code, any willful or negligent violation may constitute a misdemeanor. 5. The Director may revoke a permit if the permittee violates any permit condition or the Waste Water Land Application Permit Regulations. r1, Permit No.: LA -000067-02 Expiration Date: September 6, 1998 Page 11 of it 6. Except in cases of emergency, the Director shall issue a written notice of intent to revoke to the permittee prior to final revocation. Revocation shall become final within twenty (20) days of receipt of the notice by the permittee, unless within that time the permittee request an administrative hearing in writing. 7. The Director shall notify the permittee in writing of any revocation hearing at least twenty (20) days prior to the date set for such hearing. The hearing shall be conducted in accordance with Title 67, Chapter 52, Idaho Code. 8. If the Director finds the public health, safety or welfare requires emergency action, the Director shall incorporate findings in support of such action in a written notice of emergency revocation issued to the permittee. Emergency revocation shall be effective upon receipt by the permittee. Thereafter, if requested by the permittee in writing the Director shall provide the permittee a revocation hearing and prior notice thereof. Such hearings shall be conducted in accordance with Title 67, Chapter 52, Idaho Code. 9.
