Legal Description: A parcel of land in the Northwest corner of Section 19,
Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho.
Buyer: Ron L. Henry or Assignee
Seller(s): Harlow Raymond Minegar, Leonard Dale Reed, Sherri L. Norman
1. $500.00 Earnest Money to be held by Boise Title
2. Buyer to purchase approximately 3.3 acres for development of subdivision, but will
include atl of property (approximately 5 acres) for subdividing.
3. Buyer agrees to pay $25,000.00 per acre.
4. Buyer to pay in cash at time of closing the sum of $84,619.00.
5. Price to be adjusted more or less depending on the actual acreage purchased.
6. Buyer and Seller to share closing and escrow fees equally.
7. This sale contingent on preliminary plat approval and all government agencies

8. Buyer will make sewer and water available to the existing homes.
9. Sellers will be responsible for hooking up to the sewer and water if the City of

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and
the Laws of the State of Idaho, that the City Council of the City of Meridian will hold a
public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the hour
of 7:30 p.m., on September 6, 1994, for the purpose of reviewing .and considering the
Application of Ronald Henry for a variance for land located in the NW 1/4 of Section 19,
T.3N, R.1 E, Boise Meridian, Ada County, Idaho, and which property is generally located
on South Meridian Road near East Calderwood Drive.. The Application requests a
variance to the requirement of the side yard setbacks for Lots 9 and 10 in Fawcett's
Meadow No. 2.
A more particular legal description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the Application is available upon request. Any and all interested persons

APPLICATION OF RONALD HENRY
FOR A VARIANCE FROM THE SIDE YARD SET-BACK RE UIREMENTS
FINDINGS OF FACT AND CONCLUSIONS
The above entitled variance request having come on for
consideration on August 6, 1994, at approximately 7:30 o'clock p.m.
on said date, at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, and the City Council having heard and taken oral
and written testimony, the City Council of the City of Meridian
makes the following:
FINDINGS OF FACT
1. That notice of the public hearing on the variance was
published for two consecutive weeks prior to the scheduled hearing
for August 6, 1994, the first publication of which was fifteen (15 )
days prior to said hearing; that the matter was duly considered at
the August 6, 1994, hearing; that copies of all notices were
available to newspaper, radio and television stations.
2. That the notice of public hearing is required to be sent
to property owners within 300 feet of the external boundaries of
the land being considered pursuant to 11-2-416 E.,
11-2-419 D., and 11-9-612 B. l.b. of the Revised and Compiled
Ordinances of the City of Meridian; that this requirement has been
met.
3. That Ordinance 11-2-410 A, ZONING SCHEDULE OF BULK AND
COVERAGE CONTROLS, requires that residential structures be set back

on the side yard lines 5 feet per story from the property boundary
where the structure to be built.
4. That the Applicant has requested that he be granted a
variance from the above side yard set back requirement and be
allowed to leave the structures in the same place and not relocate
them.
5. The property in question is described as lots 9 and 10 of
Fawcett Meadows Subdivision No. 2.
6. That the property is zoned R-4 Residential.
7. That the two properties have older structures and were
not constructed as part of the subdivision; they have been in the
position that they are in now for some period of time.
8. That the Applicant owns the subdivision property and
Sherri Norman, Harlow Minegar and Leonard Reed own the property
where the structures are located.
10. That the Meridian Fire and Police Departments, Central
District Health Department, Nampa & Meridian Irrigation District,
and U. S. West submitted comments and they are incorporated herein
as if set forth in full; the City Engineer, Ada County Highway
District, the City Planning Administrator may submit comments and
they shall be incorporated herein if submitted.
11. That proper notice was given as required by law and all
procedures before the City Council were given and followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 2
Planning Act and of the Ordinances of the City. of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City has authority to grant variances pursuant
to Section 11-2-419 of the Zoning Ordinance and pursuant to Section
11-9-612 of the Development Ordinances.
3. That the City Council has judged this application by the
guidelines, standards, criteria, and policies contained in the
Zoning Ordinance and upon the record submitted. to it and the things
upon which it may take judicial notice.
4. That the Council may take judicial notice of its own
proceedings, those of the Commission, governmental statutes,
ordinances, and policies, and of actual conditions existing within
the City and the State.
5. That the following provisions of Section 11-2-419 A, of
the Zoning Ordinance is noted which is pertinent to the
Application:
11-2-419 A.
The Council may authorize in specific cases a variance
from the terms of this Ordinance or from the Subdivision
and Development Ordinances as will not be contrary to the
public interest where, owing to special conditions, a
literal enforcement of the provisions of this Ordinance
would result in unnecessary hardship. No non-conforming
use of neighboring lands, structures or buildings in the
same district and no permitted or non-conforming use of
lands, structures or buildings in other districts shall
be considered grounds for issuance of a variance.
Variances shall be granted only where strict application
of the provisions of this Ordinance would result in
unnecessary hardship. A variance application does not go

to the Commission unless directed by the Council.
6. That the specific requirements regarding a variance
that must be evidenced and found by the City Council are as
follows:
11-2-419 C. FINDINGS
A variance shall not be granted unless (as a result of a
public hearing) the Council makes a statement of
supportive reasons based directly on the evidence
presented to it which supports conclusions that the
mentioned standards and conditions of this Ordinance have
been met by the applicant and unless all of the following
exist:
1. That there are such special circumstances
or conditions affecting the property that the
strict application of the provisions of this
Ordinance would clearly be impracticable or
unreasonable;
2. That strict compliance with the
requirements of this Ordinance would result in
extraordinary hardship to the owner,
subdivider or developer because of unusual
topography, other physical conditions or other
conditions which are not self-inflicted, or
that these conditions will result in
inhibiting the achievements or the objectives
of this Ordinance;
3. That the granting of the specified
variance will not be detrimental to the
public's welfare or injurious to other
property in the area in which the property is
situated;
4. That such variance will not have the
effect of altering the interest and purpose of
this Ordinance and the Meridian Comprehensive
Plan.
7. That there does appear to be a specific benefit or
profit, economic gain or convenience to the Applicant in that the
Applicant would not have to relocate the structures that are now on

the property which were in existence at the time the time that he
purchased the property; however, the people that are living in the
structures have lived there for a substantial length of time and it
would be a hardship to cause them to be related; it is not
unreasonable to grant the variance.
8. That regarding Section 11-2-419 C it is specifically
concluded as follows:
a. That there are special circumstances or conditions
affecting the property that the strict application of the
provisions of the set back Ordinance would clearly be
unreasonable since the structures have been there for
some time and relocating them would be a hardship.
b. That strict compliance with the requirements of the
set back Ordinance would not result in extraordinary
hardship to the applicant as a result of factors not
self-inflicted but it would result in extraordinary
hardship on the persons living in the structures, and
they apparently still own the land that there .structures
are on.
c. That the granting of the specified variance would not
be detrimental to the public's welfare or injurious to
other property in the area in which the property is
situated.
d. That such variance would not have the effect of
altering the interests and purposes of the set back
Ordinance or the Meridian Comprehensive Plan.
9. That it is concluded the Application should be granted.

Kingsford: At this time I will open the public hearing and invite Mr. Henry or his designee
to speak first.
Ronald Henry, 6301 Charleston Place, Boise, was sworn by the City Attorney.
Henry: This variance is really a request. for permission to allow existing buildings on Lot
9 and 10 of Fawcett Meadows No. 2 to remain. These buildings are .less than what we
have set up as the set backs, 10 foot setbacks. Both I think ,there are 2 buildings there
that have a total distance of about 10 feet between them. So what this variance is
requesting is permission to leave them as is.
Kingsford: Any questions for Mr. Henry?
Morrow. You have read the comments of staff?
Henry: Yes
Morrow. And are in agreement with those?
Henry: Yes
Morrow. I have no other questions.
Kingsford: Anyone else from the public that would like to offer testimony on this variance

ITEM #16: PUBLIC HEARING: REQUEST FOR ANNEXATION AND ZONING WITH A
PRELIMINARY PLAT FOR BRAMBLE WOOD SUBDIVISION BY HARDEE
CONSTRUCTION:
Kingsford: At this time I will open that public hearing and invite the owner or his designee
to speak first.
Ted Hutchinson, 109 South Fort Street, Boise, was sworn by the City Attomey
Hutchinson: Mr. Mayor, members of the Council, this is a 13 lot residential subdivision
located on the north side of Ustick Road a little more than a 1 /4 mile east of the
intersection of Ustick and Ten Mile. This is contiguous to the city limits which is on the
south side of the centerline of Ustick Road making this parcel contiguous. We are
requesting annexation with a zoning designation of R-4. The preliminary plat has gone
through a number of revisions as we attempt to comply with the requirements and
comments from the City staff and to ensure that the plat is in compliance with the
requirements of the R-4 zoning regulations that are in effect at this time. We have
indicated on the plat the location of an existing flood hazard area, I believe it is in an A
zone. We have provided a 20 foot planting strip easement along the lots adjacent to
Ustick Road, those will be parts of Lots 1, Block 2 and Lot 1, Block 1. I believe that would
satisfy the requirements as called out in the zoning ordinance. I believe the applicant is
here to address some of the things that were in the findings of fact from the Planning and
Zoning Commission. However we do believe that this plat is in compliance with the
regulations that are in effect at this time. Are there any questions from the Council?
Dan Hardee, 6477 Fairview, Boise, was sworn by the City Attorney.
Hardee: The only thing that we would like to have you look at for us is on the the 2 lots
that face Ustick Road, what we would like to do there rather than have an association for
the maintenance maybe put a deed restriction in each lot that would allow for the
maintenance for that lot so it would be a separate lot that would be part of Lot 1 and then
we would put a deed restriction in there so that the owner would have to maintain that
along with his own home. I don't think that would be too much of a problem in that they
