SUBJECT: Annexation and Zoning of R-8 with a Preliminary Plat and Conditional Use
Permit to Allow Zero -lot -line Development of Brandon Creek Estates
This request for annexation and zoning of R-8 generally complies with the goals of the Meridian
Comprehensive Plan to provide a diversity of housing types and higher density near the
downtown core. A conditional use permit has been requested to allow for a planned senior
development with frontages less than 50' and zero side yard setbacks.
1. Include drafting date and initials of designer on plat.
2. Include north arrow on plat.
3. Include names, addresses and telephone numbers of owner, subdivider or subdividers and
engineer, surveyor or planner who prepared the preliminary plat.
4. Include statement of intended use of the proposed subdivision (i.e., residential single-
family, two-family and multiple housing, commercial, industrial, recreational or
agricultural) .
5. Include minimum residential house size on plat.
6. Streetlights need to be shown.
7. Submit proposed restrictive covenants and/or deed restrictions for review by City
Attorney and Council approval.
8. Provide necessary letters of approval from irrigation district/Corps of Engineers.
9. Provide approval letter from Ada County Street Name Committee.
Ada County Highway District has requested a stub street to the north in the northeast portion of
this proposed development. Given the nature of a senior development, such a street would
appear to be detrimental to what the Applicant is trying to achieve. I do have some concern
about the irregular parcels southwest of this property and how access will be achieved. If they
are to be sold and incorporated into the existing commercial area, this should not be a problem.
I have been contacted repeatedly by senior residents that desire to move onto a smaller lot that
will not require as much upkeep. Although the City does not want to create exclusive
neighborhoods that are inaccessible to the rest of the community, our seniors want and need
security. I recommend that the annexation and zoning of R-8 be approved, that the preliminary
plat be approved with changes noted by staff, that the requirement for a stub street proposed by
ACHD be removed, and that the conditional use permit be granted. A development agreement
would be required as a condition of the annexation and zoning.

RE: Brandon Creek Subdivision
Dear Councilmen:
I have reviewed the application for Brandon Creek Estates
Subdivision and find that it includes approximately 79 homes at
the median value of $125,000. We also find that this subdivision
is located in census tract 103.11 and in the attendance zone for
Chief Joseph Elementary, Meridian Middle School and Meridian High
School. Due to overcrowding at Chief Joseph Elementary students
from this subdivision will likely be bused to Ridgewood
Elementary.
Using the above information we can predict that these homes, when
completed, will house 33 elementary aged children, 23 middle
school aged children, and 23 senior high aged students. At the
present time Chief Joseph Elementary is at 118% of capacity,
Meridian Middle School is at 130% of capacity and Meridian High
School is at 116% of capacity.
The Meridian School District is not opposed to growth in our
district, however this subdivision will cause increased over-
crowding in all three schools. There is little opportunity to
shift attendance boundaries since the surrounding schools are
also well over capacity. Before we could support this
subdivision, we would need land dedicated to the district or at
least made available at a minimum price for a school site in this
area. The site would need water and sewer service available. In
addition we would need to pass another bond issue for the
construction of schools.
The cost per student for newly constructed schools, excluding
site purchase price and offsite improvements, exceeds $5,000
per elementary student and $10,000 per middle or high school
student.

residential subdivision for senior citizens located on the
east side of Meridian Road, north of Cherry Lane. There are
2850 -feet of new public streets planned. A bridge is planned
to span Five Mile Creek in the project.
This application also includes annexation by Meridian and
subsequent zone change from RT & R-1 to R-8.
A conditional use permit has been requested to allow for a
reduction of lot widths and for zero lot lines which R-8 zon-
ing does not allow.

3. The ACHD Capital Improvement Plan indicates that Meridian Road
is approved for use of Road Impact Fee funds to increase its
capacity; therefore, Road Impact Fee offsets may be given for
construction of the roadway improvements (excluding sidewalk)
along Meridian Road and for right-of-way dedication in addi-
tion to what exists now. If the developer wishes to be paid
for the additional right-of-way, he/she must submit an applica-
tion to the impact fee administrator prior to breaking ground,
in accordance with Section 15 of ACHD Ordinance #188.
4. Staff anticipates the parcels to the north and the south of
the proposed access (Brandon Drive) from Meridian Road to the
proposed bridge over Five Mile Creek will develop as commer-
cial or multifamily parcels. Therefore staff recommends that
the section of Brandon Drive from Meridian Road east to the
proposed bridge be constructed to a 41 -foot back to back
street section with 5 -foot sidewalks in 60 -feet of right-of-
way. The developer will be given the option to construct the
proposed Brandon Drive to a 36 -foot back-to-back street sec-
tion with 4 -foot sidewalks in 50 -foot of right-of-way. If in
the future the parcels to the north or south develop as commer-
cial or multifamily residential, the developer will be re-
quired to reconstruct the road to a 41 -foot back-to-back
street section with 5 -foot sidewalks in 60 -feet of right-of-
way.
5. Staff anticipates the need for an interneighborhood connection
to the northeast.- Therefore staff recommends the site be
reconfigured to extend a stub street to the north boundary,
the centerline of which should be no more than 55 -feet west of
the northeast corner of the subject parcel.
6. This application is scheduled for public hearing by the Meridi-
an Planning & Zoning Commission on July 12, 1994.
SITE SPECIFIC REQUIREMENTS:
1. Dedicate 45 -feet of right-of-way from the centerline of Meridi-
an Road abutting parcel (15 additional feet). The owner will
be compensated for this additional right-of-way from available
impact fee revenues in this benefit zone.

2. Dedicate 20' Y 20' triangles (or appropriate curve) of right-
of-way at the north and south corners of Meridian Road and the
proposed Brandon Drive abutting parcel to -eep the street

3. Construct the section of Brandon Drive from Meridian Road east
to the proposed bridge to a 41 -foot back to back street sec-
tion with 5 -foot sidewalks in 60 -feet of right-of-way or to a
36 -foot back-to-back street section with 4 -foot sidewalks in
50 -foot of right-of-way. (See Fact and Finding #4)
4. Construct the internal public streets to a 36 -foot back to
back street section with 4 -foot sidewalks in 50 -feet of right-
of-way.
5. Reconfigure the site to extend a stub street to the north
boundary, the centerline of which shall be no more than 55 -
feet west of the northeast corner of the subject parcel.
6. Utility street cuts in the new pavement on Meridian Road will
not be allowed unless approved by the District Commission.
STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.
2. Dedicated streets and drainage systems shall be designed and
constructed in conformance with District standards and poli-
cies.
3. Specifications, land surveys, reports, plats, drawings, plans,
design information -and calculations presented to ACHD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
4. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
5. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
6. Continue existing irrigation and drainage systems across par-
cel.

7. Submit three sets of street construction plans to the District
for review and appropriate action.
8. Submit site drainage plans, and calculations for review and
appropriate action by ACHD. The proposed drainage system
shall conform to the requirements of and shall retain all
storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a drainage easement set aside specif-
ically for that use. There shall be no trees, fences, bushes,
sheds, or other valuable amenities placed in said easement.
Drainage easements and their use restrictions shall be noted
on the plat.
9. Provide design data for proposed access to public streets for
review and appropriate action by ACHD.
10. Locate driveway curb cuts a minimum of 5 -feet from the side
lot property lines when the driveways- are not being shared
with the adjacent property.
11. Developer shall provide the District with a copy of the record-
ed plat prior to the installation of street name signs.
Street signs will not be ordered until all fees have been paid
and a copy of the recorded plat has been provided to ACHD
staff. The copy of the recorded plat shall show the recording
information as inscribed by the Deputy County Recorder.
12. Install a stop sign on every unsignalized approach of a
project street to an intersection involving a collector or
arterial as the cross -street. The stop sign shall be in-
stalled when the project street is first accessible to the
motoring public.
13. A right-of-way permit must be obtained from ACHD for all
street and utility construction within the public right-of-
way. Contact Construction Services at 345-7667 (with zoning
file number) for details.

14. A request for modification, variance or waiver of any require-
ment or policy outlined he shall be made, in writing, to
the Manager of Engineering Services within 15 calendar days of
the original Commission action. The request shall include a
statement explaining why such a requirement would result in
substantial hardship or inequity.

To prevent and treat disease and disability; to promote healthy lifestyles; and to protect and promote the health and quality of our environment
STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that the first one half inch of stormwater be
pretreated through a grassy swale prior to discharge to the
subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of
this project should obtain current best management practices for
stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals
that could be used for guidance are:

Submit a legal description prepared by a licensed land surveyor with a drawing at a scale
of 1" = 300' depicting the area requested for annexation. A legal description was
submitted that describes the subdivision boundary shown on the preliminary plat. Other
descriptions are submitted some showing exclusions. The "excepted" areas shown on
Trustees Deed (8422005) should be included in the annexation request.
The property is contiguous to existing city limit boundaries created by James Court
Apartment complex and the Wheel Inn Mobile Manor.
2. Sewer interceptor easement and sewer lateral easement serving Wheel Inn Mobile Manor
needs to be unfenced and kept open with access for maintenance purposes.

3. A water service line to Wheel Inn Mobile Manor crosses the southerly portion of this
parcel. Coordinates its location and relocation with city water superintendent.
4. Several lots show flag lot frontage. These lots do not resemble a flag as required by
Ordinance.
The bridge structure over Five Mile Creek needs to have an opening sufficient to pass a
100 year frequency flood as determined by FEMA. Their FIRM (Flood Insurance
Rate Map) for this area shows an extensive 100 year flood plain area (Zone AE) caused
by the old structure carrying Five Mile Creek under Meridian Road. This structure was
replaced when Meridian Road was rebuilt but the flood plain boundary has not been
reanalyzed. This needs to be done so a LOMR (Letter of Map Revision) can be issued
if indeed the new structure can pass the 100 year frequency flood.
6. General Note No. 4 needs to be revised to include sewer and to say materials
installation shall conform to City of Meridian standards.
7. Submit a vicinity map showing the land use area for 1/2 mile in all directions
from this project.
8. Submit Ada County letter of approval for subdivision and street names.
9. Who will maintain this off-site subsurface storm water disposal fields?
10. Show a benchmark reference.
11. Show street lights located generally at fire hydrants and street intersections. A 250
watt street light is required at the subdivision entrance from Meridian Road.
12. The highest seasonal groundwater elevation needs to be established for setting
bottom of footing elevation one foot above.
13. All irrigation/ drainage ditches carrying water across this project need to be piped in
accordance with city ordinance.
14. Submit a proposed restrictive covenants.

SUBJECT: Annexation and Zoning of R-8 with a Preliminary Plat and Conditional Use
Permit to Allow Zero -lot -line Development of Brandon Creek Estates
This request for annexation and zoning of R-8 generally complies with the goals of the Meridian
Comprehensive Plan to provide a diversity of housing types and higher density near the
downtown core. A conditional use permit -has been requested to allow for a planned senior
development with frontages less than 50' and zero side yard setbacks.
1. Include drafting date and initials of designer on plat.
2. Include north arrow on plat.
3. Include names, addresses and telephone numbers of owner, subdivider or subdividers and
engineer, surveyor or planner who prepared the preliminary plat.
4. Include statement of intended use of the proposed subdivision (i.e., residential single-
family, two-family and multiple housing, commercial, industrial, recreational or
agricultural).
5. Include minimum residential house size on plat.
6. Streetlights need to be shown.
7. Submit proposed restrictive covenants and/or deed restrictions for review by City
Attorney and Council approval.
8. Provide necessary letters of approval from irrigation district/Corps of Engineers.
9. Provide approval letter from Ada County Street Name Committee.
Ada County Highway District has requested a stub street to the north in the northeast portion of
this proposed development. Given the nature of a senior development, such a street would
appear to be detrimental to what the Applicant is trying to achieve. I do have some concern
about the irregular parcels southwest of this property and how access will be achieved. If they
are to be sold and incorporated into the existing commercial area, this should not be a problem.
I have been contacted repeatedly by senior residents that desire to move onto a smaller lot that
will not require as much upkeep. Although the City does not want to create exclusive
neighborhoods that are inaccessible to the rest of the community, our seniors want and need
security. I recommend that the annexation and zoning of R-8 be approved, that the preliminary
plat be approved with changes noted by staff, that the requirement for a stub street proposed by
ACHD be removed, and that the conditional use permit be granted. A development agreement
would be required as a condition of the annexation and zoning.

Estates Subdivision. The final plat of LaPlaya Manor Estates Subdivision is in substantial
accordance with the approved conditions and development agreement of the City of Meridian.
This single family and single family zero -lot -line residential subdivision is also in substantial
conformance with the City of Meridian Comprehensive Plan and conforms with all acceptable
engineering and surveying practices and local standards.
Existing sewer and water mains will be extended to serve this project. Streets, curbs, gutters
and sidewalks will be constructed to standards as required by the Ada County Highway District

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public hearing
July 12, 1994, at the hour of 7:30 o'clock p.m., that Jim Rees
representing the Petitioner appeared in person, the Planning and
Zoning Commission of the City of Meridian having duly considered
the evidence and the matter makes the following Findings of Fact
and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
said public hearing scheduled for July 12, 1994, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the July 12, 1994, hearing;
that the public was given full opportunity to express comments and
submit evidence; and that copies of all notices were available to
newspaper, radio and television stations;
2. The property is approximately 14.95 acres; the property
is located within the City of Meridian and the Applicant is not the

owner of the property; the owners of record appear to be Leonard W.
Evans and Doris B. Evans, James M. Rees and Eleanor V. Rees, the
RAP Trust, the estates of Richard Melickian and Ara Melickian, and
Carol I. Stiner; that James M. Rees submitted a statement that
stated, "I James R. Rees, being a partner of the property
description of which is attached, do hereby request that the City
of Meridian annex this property with a zone of R -S."; that there is
no evidence that the land is owned by a partnership, that Mr. Rees
is a partner, and there is no request for annexation submitted by
the parties who are the apparent owners as shown in the documents
submitted with the Application.
3. That the property to the east is -the Wheel Inn Mobile
Manor, a mobile home court, the property to the north is James
Court, a subsidized housing project, the property to the south is
the Albertson store, the Cherry Plaza mall and other retail
establishments, the property to the west property used for a day
care and across Meridian Road is vacant ground; there are single
family subdivisions adjacent or nearby; the land in the immediate
area is not developed in any fashion other than as stated above.
4. That the property is adjacent and abutting to the present
City limits.

relationship was evidenced in the documents submitted with the
Application between Pioneer Investments, Inc. and the apparent
owners or any partnership.

application is within the Area of Impact of the City of Meridian.
7. That the entire parcel of.ground is included within the
Meridian Urban Service Planning Area as the Urban Service Planning
Area is defined in the Meridian Comprehensive Plan.
8. That the Application requests that the parcel be annexed
and zoned R-8; that the Applicant also submitted a conditional use
request for planned residential development to allow for a single
family, zero lot line project and the Applicant stated that the
project would contain 79 units with a club house along with
recreational facilities for people over the age of 50; that some of
the lots would have single family detached homes but the majority
would be built on a zero lot line or as a-duplex with each side
being sold to an owner; that they have also submitted the
conditional use request to allow a reduction in the frontage from
50 feet for a two family dwelling and for a planned unit
development; the Applicant also submitted a preliminary plat for
approval which shows most lot widths being
42.5 feet.
9. At the hearing Jim Rees testified that there would be
duplexes or 0-lot line development; that they want R-8 zoning with
0-lot line development; that there were sewer lines that
transversed the property that he hoped would not impede development
that they have to build a bridge across Five Mile Creek; he
commented on the desire of the City
to have sewer line unfenced,
left open and an access road along it; that the unfenced was no
problem but the access road was; that they would like to landscape
Five Mile Creek; and that they would like to fence the property

except along the canal; he later stated that they could work with
the City on access to the sewer line.
10. In the preliminary plat Application it is stated that
there would be 79 lots, 5.28 dwellings per acre, that recreation
easements have been provided for, that any recreation amenities
would only be fore the residents of the area, that there would be
a club house a recreational facilities, that there only be
residential housing in the subdivision, that there would only be
single family and single family 0 -lot line dwellings, that the
minimum square footage of the lots would be 4,250 and the minimum
square footage of the homes would be 1,200 to 1,500, that there
would be garages of 400 square feet, that there would be
landscaping along 5 Mile Drain and around the clubhouse, that trees
would be provided and sprinkler systems, that there would be no
multiple units but there may be two units attached, and that off
street parking would be provided in the form of garages and
driveways.

12. That comments were received from the City Engineer, City
Planning Director, Meridian Police Department, Fire Department,
Meridian School District, Ada County Highway District, Central
District Health Department, Nampa & Meridian Irrigation District,
and Idaho Power; that such comments are incorporated herein by this
reference.
13. The Meridian Planning Director, Shari Stiles, commented

that the Application generally complies with the goals of the
Meridian Comprehensive Plan to provide a diversity of housing types
and higher density near the downtown core; that she had additional
requirements of the platting; that the stub street requested by
ACHD to the north in the northeast corner appeared to be
detrimental to what the Applicant was trying to achieve; that she
had been contacted by many senior citizens that desired to move
onto a smaller lot that will not require as much upkeep; that she
recommended that the Applications be approved and that a
development agreement would be required as a condition of the
annexation and zoning.
Gary Smith, City Engineer, commented that a legal description
need to be submitted by a licensed land surveyor; that the sewer
interceptor easement and sewer later easement servicing the Wheel
Inn Mobile Manor needs to be unfenced and kept open with access
road for maintenance purposes; the bridge structure over Five Mile
Creek needs to have an opening sufficient to pass a 100 year
frequency flood; that the highest seasonal ground water needs to be
determined; that all irrigation/drainages ditches carrying water
across this project need to be piped; and that proposed restrictive
covenants need to be submitted.
14. That Kenny Bowers of the Meridian Fire Department
commented that he had a problem with the "one way in and out"
situation and that there was going to be a lot of traffic for that
and that there should be no parking in cul-de-sacs.
15. There was one person from the public testifying at the

hearing; Raleigh Hawe testified that he had concern over fencing in
the northeast corner around the proposed clubhouse.
16. That Meridian has, and is, experiencing a population
increase; that there are pressures on land previously used for
agricultural uses to be developed into residential subdivision
lots.

that the City of Meridian is concerned with the increase in
population that is occurring and with its impact on the City being
able to provide fire, police, emergency health care, water, sewer,
parks and recreation services to its current residents and to those
moving into the City; the City is also concerned that the increase
in population is burdening the schools of the Meridian School
District which provide school service to. current and future
residents of the City; that the City knows that the increase in
population does not sufficiently increase the tax base to offset
the cost of providing fire, police, emergency health care, water,
sewer, parks and recreation services; and the City knows that the
increase in population does not provide sufficient tax base to
provide for school services to current and future students.
22. That pursuant to the instruction, guidance, and direction
of the Idaho State Legislature, the City may impose either a
development fee or a transfer fee on residential property, which,
if possible, would be retroactive and apply to all residential lots
in the City because of the imperilment to the health, welfare, and
safety of the citizens of the City of Meridian.
24. That Section 11-9-605 C states as follows:
"Right-of-way for pedestrian walkways in the middle of long

blocks may be required where necessary to obtain convenient
pedestrian circulation to schools, parks or shopping areas;
the pedestrian easement shall be at least ten feet (10')
wide."
25. That Section 11-9-605 G 1. states as follows:
"Planting strips shall be required to be placed next to
incompatible features such as highways, railroads, commercial
or industrial uses to screen the view from residential
properties. Such screening shall be a minimum of twenty feet
(20') wide, and shall not be a part of the normal street right
of way or utility easement."
26. That Section 11-9-605 H 2. states as follows:
"Existing natural features which add value to residential
development and enhance the attractiveness of the community
(such as trees, watercourses, historic spots and similar
irreplaceable amenities) shall be preserved in the design of
the subdivision;"
27. That Section 11-9-605 R states as follows:
"The extent and location of lands designed for linear open
space corridors should be determined by natural features and,
to lesser extent, by man-made features such as utility
transportation rights ights of way or water rights of
way. Landscaping, screening or lineal open space corridors
may be required for the protection of residential properties
from adjacent arterial streets, waterways, railroad rights of
way or other features. As improved areas (landscaped), semi -

28. That Section 11-9-605 L states as follows:
Bicycle and pedestrian pathways shall be encouraged within new
developments as part of the public right of way or as separate
easements so that an alternate transportation system (which is
distinct and separate from the automobile) can be provided
throughout the City Urban Service Planning Area. The
Commission and Planning and Zoning Commission shall consider
the Bicycle Pedestrian Design Manual for Ada County_ (as
prepared by Ada County Highway District) when reviewing
bicycle and pedestrian pathway provisions within developments.
29. That proper notice was given as required by law and all
procedures before the Planning and Zoning Commission were given and
followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met, including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to annex land
pursuant to 50-222, Idaho Code, and Section 11-2-417 of the Revised
and Compiled Ordinances of the City of Meridian; that exercise of
the City's annexation authority is a Legislative function.
3. That the Planning and Zoning Commission has judged this
annexation and zoning application under Section 50-222, Idaho Code,
Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, the
Meridian Comprehensive Plan, as amended, and the record submitted
to it and things of which it can take judicial notice.
4. That all notice and hearing requirements set forth in
BRANDON CREEK ESTATES ANNEXATION FF & CL Page - 10
Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of
Meridian have been complied with.
5. That the Commission may take judicial notice of
government ordinances, and policies, and of actual conditions
existing within the City and State.
6. That the land within the proposed annexation is
contiguous to the present City limits of the City of Meridian, and
the annexation would not be a shoestring annexation.
7. That the annexation application has been initiated by the
Applicant with the consent of the titled owners, and the annexation
is not upon the initiation of the City of Meridian.
8. That since the annexation and zoning of land is a
legislative function, the City has authority to place conditions
upon the annexation of land. Burt vs. The City of Idaho Falls, 105
Idaho 65, 665 P.D 1075 (1983).
9. That the development of annexed land must meet and comply
with the Ordinances of the City of Meridian and in particular
Section 11-9-616, which pertains to development time schedules and
requirements, Section 11-9-605 M., which pertains to the tiling of
ditches and water ways, and,Section 11-9-606 B 14, which pertains
to pressurized irrigation; that the Applicant would be required to
connect to Meridian water and sewer; that the development of the
property would be subject to and controlled by the Subdivision and
Development Ordinance; that, as a condition of annexation the
Applicant would be required to enter into a development agreement
as authorized by 11-2-416 L and 11-2-417 D; that the development

agreement would address the inclusion into the subdivision of the
requirements of 11-9-605 C, G., H 2, K, L and prior comments of the
previous Planning Director, Wayne Forrey, relating to the lack of
adequate recreation facilities and that land set aside for a future
park would be desirable, that the City is in need of land set -
asides for future public service use, that a school site was not
reserved; that the development agreement shall, as a condition of
annexation, require that the Applicant, or if required, any
assigns, heirs, executors or personal representatives, pay, when
required, any development fee or transfer fee adopted by the City;
that there shall be no annexation until the requirements of this
paragraph are met or, if necessary, the property would be subject
to de -annexation and loss of City services, if the requirements of
this paragraph were not met.
10. That the Applicant's property is shown on the Generalized
Land Use Map as being in an Existing Urban Area; that development
of the land in a residential capacity would be in compliance with
the Comprehensive Plan, and therefore the annexation would be in
conformance with the Comprehensive Plan; the specific plan for
development and the requested zoning for all of the land is in
conformance with the Comprehensive Plan in that the Plan encourages
higher density development within the Old Town area and lower
density in outlying areas; being behind the Cherry Mall and the
Albertson store and not being adjacent to any existing single
family subdivisions or dwellings, the land is in an area that begs
for development.

11. That the Comprehensive Plans policies -to protect and
maintain residential neighborhood property values, improve each
neighborhood's physical condition and enhance its quality of life
for residents and to maintain compatible land uses to ensure an
optimum quality of life, would apparently be followed as noticed by
the total lack of objecting testimony as compared to the testimony
from owners of property adjacent to the Applicant's development
land objecting to the Meridian Mobile Estates Application, heard
the same night as this Application. The area in which this land is
located is close to the core of the City but has had few
development applications, and this type of development in this area
is beneficial.
14. That the annexation of the property is in the best
interest of the City of Meridian and should be granted.
APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS
The Meridian Planning and Zoning Commission hereby adopts and
approves these Findings of Fact and Conclusions.

RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends
to the City Council of the City of Meridian that they approve the
annexation and zoning as stated above for the property described in
the application with the conditions set forth in the Findings of
Fact and Conclusions of Law, and that the Applicant and owners be
specifically required to tile all ditches, canals and waterways and
install a pressurized irrigation system as a condition of
annexation and that the Applicant meet all of the Ordinances of the
City of Meridian, specifically including the development time
requirements and entering into the required development agreement,
and the conditions of these Findings and Conclusions of Law, and
that if the conditions are not met that the property be de-annexed.

RE: Brandon Creek Subdivision
Dear Councilmen:
I have reviewed the application for Brandon Creek Estates
Subdivision and find that it includes approximately 79 homes at
the median value of $125,000. We also find that this subdivision
is located in census tract 103.11 and in the attendance zone for
Chief Joseph Elementary, Meridian Middle School and Meridian High
School. Due to overcrowding at Chief Joseph Elementary students
from this subdivision will likely be bused to Ridgewood
Elementary.
Using the above information we can predict that these homes, when
completed, will house 33 elementary aged children, 23 middle
school aged children, and 23 senior high aged students. At the
present time Chief Joseph Elementary is at 118% of capacity,
Meridian Middle School is at 130% of capacity and Meridian High
School is at 116% of capacity.
The Meridian School District is not opposed to growth in our
district, however this subdivision will cause increased over-
crowding in all three schools. There is little opportunity to
shift attendance boundaries since the surrounding schools are
also well over capacity. Before we could support this
subdivision, we would need land dedicated to the district or at
least made available at a minimum price for a school site in this
area. The site would need water and sewer service available. In
addition we would need to pass another bond issue for the
construction of schools.
The cost per student for newly constructed schools, excluding
site purchase price and offsite improvements, exceeds $5,000
per elementary student and $10,000 per middle or high school
student.

On July 6, 1994, the Commissioners of the Ada County Highway
District (hereafter called "District") took action on the
Preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable
standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and
approval by the District.
2. If public street improvements are rectuired: Prior to any
construction within the existing or proposed public right-of-
way, the following shall be submitted and subject to review
and approval by the District:
a. Three complete sets of detailed street construction
drawings prepared by an Idaho Registered Professional
Engineer, together with payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and
the District together with initial payment deposit for
inspection and/or testing services.
C. Complete all street improvements to the satisfaction of
the District, or execute Surety Agreement between the
Developer and the District to guarantee the completion of
construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by
the Local Government Agency having such authority together
with payment of fee charged for the manufacturing and
installation of all street signs, as required.
4. If Public Rights -of -Way Trust Fund deposit is required, make
deposit to the District in the form of cash or cashier's check
for the amount specified by the District.
5. Furnish easements, agreements, and all other datum or
documents as required by the District.
6. Furnish Final Plat drawings for District acceptance,
certifications, and endorsement. The final plat must contain
the signed endorsement of the Owner's and Land Surveyor's
certification.
7. Approval of the plat is valid for one year. An extension -of
one year will be considered by the Commission if requested
within 15 -days prior to the expiration date.

1. Brandon Creek Estates is a 14.9 -acre, 79 -lot, single family
residential subdivision for senior citizens located on the
east side of Meridian Road, north of Cherry Lane. There are
2850 -feet of new public streets planned. A bridge is planned
to span Five Mile Creek in the project.
This application also includes annexation by Meridian and
subsequent zone change from RT & R-1 to R-8.
A conditional use permit has been requested to allow for a
reduction of lot widths and for zero lot lines which R-8 zon-
ing does not allow.

3. The ACHD Capital Improvement Plan indicates that Meridian Road
is approved for use of Road Impact Fee funds to increase its
capacity; therefore, Road Impact Fee offsets may be given for
construction of the roadway improvements (excluding sidewalk)
along Meridian Road and for right-of-way dedication in addi-
tion to what exists now. If the developer wishes to be paid
for the additional right-of-way, he/she must submit an applica-
tion to the impact fee administrator prior to breaking ground,
in accordance with Section 15 of ACRD Ordinance #188.
4. Staff anticipates the parcels to the north and the south of
the proposed access (Brandon Drive) from Meridian Road to the
proposed bridge over Five Mile Creek will develop as commer-
cial or multifamily parcels. Therefore staff recommends that
the section of Brandon Drive from Meridian Road east to the
proposed bridge be constructed to a 41 -foot back to back
street section with 5 -foot sidewalks in 60 -feet of right-of-
way. The developer will be given the option to construct the
proposed Brandon Drive to a 36 -foot back-to-back street sec-
tion with 4 -foot sidewalks in 50 -foot of right-of-way. If in
the future the parcels to the north or south develop as commer-
cial or multifamily residential, the developer will be re-
quired to reconstruct the road to a 41 -foot back-to-back
street section with 5 -foot sidewalks in 60 -feet of right-of-
way.
5. This application is scheduled for public hearing by the Meridi-
an Planning & Zoning Commission on July 12, 1994.
SITE SPECIFIC REQUIREMENTS:
1. Dedicate 45 -feet of right-of-way from the centerline of Meridi-
an Road abutting parcel (15 additional feet). The owner will
be compensated for this additional right-of-way from available
impact fee revenues in this benefit zone.
2. Dedicate 20' x 20' triangles (or appropriate curve) of right-
of-way at the north and south corners of Meridian Road and the
proposed Brandon Drive abutting parcel to keep the street
improvements in the public right-of-way.
3. Construct the section of Brandon Drive from Meridian Road east
to the proposed bridge to a 41 -foot back to back street sec-

sheds, or other valuable amenities placed in said easement.
Drainage easements and their use restrictions shall be noted
on the plat.
9. Provide design data for proposed access to public streets for
review and appropriate action by ACHD.
10. Locate driveway curb cuts a minimum of 5 -feet from the side
lot property lines when the driveways are not being shared
with the adjacent property.
11. Developer shall provide the District with a copy of the record-
ed plat prior to the installation of street name signs.
Street signs will not be ordered until all fees have been paid
and a copy of the recorded plat has been provided to ACHD
staff. The copy of the recorded plat shall show the recording
information as inscribed by the Deputy County Recorder.
12. Install a stop sign on every unsignalized approach of a
project street to an intersection involving a collector or
arterial as the cross -street. The stop sign shall be in-
stalled when the project street is first accessible to the
motoring public.
13. A right-of-way permit must be obtained from ACHD for all
street and utility construction within the public right-of-
way. Contact Construction Services at 345-7667 (with zoning
file number) for details.
14. A request for modification, variance or waiver of any require-
ment or policy outlined herein shall be made, in writing, to
the Manager of Engineering Services within 15 calendar days of
the original Commission action. The request shall include a
statement explaining why such a requirement would result in
substantial hardship or inequity.

STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-
of-way shall be designed and constructed in conformance with
District standards and policies.
2. Dedicated streets and drainage systems shall be designed and
constructed in conformance with District standards and poli-
cies.
3. Specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to ACHD shall be
sealed, signed and dated by a Registered Professional Engineer
or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
4. Provide written approval from the appropriate irriga-
tion/drainage district authorizing storm runoff into their
system.
5. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
6. Continue existing irrigation and drainage systems across par-
cel.
7. Submit three sets of street construction plans to the District
for review and appropriate action.
8. Submit site drainage plans and calculations for review and
appropriate action by ACRD. The proposed drainage system
shall conform to the requirements of and shall retain all
storm water on-site.

STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that the first one half inch of stormwater be
pretreated through a grassy swale prior to discharge to the
subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of
this project should obtain current best management practices for
stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals

the upstream bridge on Fairview Avenue and the downstream bridge on Meridian Road. It
was designed for the 100 year flood event, and.believe it is more than adequate for this
purpose as an access to the proposed development. Take Meridian Road exit from I-84
and go north III miles, the site is about 11 block past Fairview Ave.

ATTACHMENT
Addition to Item 6:
In conjunction with the bridge construction, the north side of Five Mile Cr. will be
excavated back to a 3:1 slope and smoothed out in preparation for landscaping. The "new"
slope excavation will begin above the riparian area of the creek in order to avoid disturbing the
wetlands that exist along this creek. The total length of this excavation is about 1500 ft and will
start and end at the corporate limits to the north and south respectively. The area immediately
adjacent to this slope will be raised two feet with on-site fill material and landscaped. This area
is not within the floodway of the creek and can be shown using FEMA FIRM information.
NOTE: The culvert and footings for the proposed bridge were designed for an HS -25 live
load scenario. A soil bearing capacity of 3000 pounds per square foot was used in the design
of the footings.
NOTE: A FEMA FIRM map revision application will be submitted to remove the
floodway designation from the area on the north side of the creek that will be raised.
NOTE: Attached is a copy of a Flood Hazard Notice from the property owner's bank
stating that the property is not in a flood zone and no flood insurance is required.

This subdivision is for a maximum of 79 single-family and duplex dwelling units with an overall
density of 5.28 dwelling units per acre. The DEVELOPER shall:
1. Tile all ditches, canals and waterways, including those that are property boundaries or
only partially located on the property, with the exception of Five Mile Creek, which shall
remain open.
2. Extend and construct water and sewer line extensions to serve the property and connect
to Meridian water and sewer lines as approved by the Meridian City Engineer.
3. Construct streets to and within the property in accordance with Ada County Highway
District and City of Meridian Standards.
4. Dedicate the necessary land from the centerline of Meridian Road for public right-of-way.
5. Pay any development, impact or transfer fee adopted by the CITY.
6. Meet the requirements and conditions of the Findings of Fact and Conclusions of Law
