Nourses First Addition, Boise Meridian, Ada County, Idaho, and which property is generally located at the comer of E. Pine and E. 2nd. The Application requests a Variance to allow for on street parking along Pine and E. 2nd. Amore particular legal description of the above property is on file in the City Clerk's office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during regular business hours. That notice of the public hearing on the variance was published for two consecutive weeks prior to the scheduled hearing for December 6, 1994, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the December 6, 1994, hearing; that copies of all notices were available to newspaper, radio and television stations. B. That notice of public hearing is required to be sent to property owners within 300 feet of the external boundaries of the land being considered pursuant to 11-2-416 E., 11-2-419 D., and 11- 9-612 B. l.b of the Revised and Compiled Ordinances of the City of Meridian; that his requirement has been met. C. That Ordinance 11-2-414 A, OFF-STREET PARKING AND LOADING FACILITIES, 1., requires that no building or structure shall be erected, altered or its use changed unless permanently maintained DaROSA VARIANCE - FINDINGS & CONCLUSIONS Page - 1 t • • off-street parking and loading have been provided in accordance with the provisions of this Ordinance. 11-2-414 also requires that the parking be paved. D. That Ordinance 11-2-414 A, OFF-STREET PARKING AND LOADING FACILITIES, 1., requires that when the intensity of use of any building, structure or premises shall be increased through addition of dwelling units, gross floor area, seating capacity, parking and loading facilities as required herein shall be provided for such increase of use. E. That the Applicants have requested to be granted a variance from the above Ordinance requirements and so that they will not be required meet the off-street parking requirements. F. The property in question is described in the variance application and is incorporated herein as if set forth in full. G. That the property in the area where the variance is requested is zoned Old Town. H. That the Applicants do own the property. I. That the Meridian Planning Director submitted comment which was that there was no room on the property accommodate on- site parking; that the Ada County Highway District does not want angled parking on Second Street at this location; that seven parallel parking spaces can be made available adjacent to Pine Avenue and Second Street; that professional office space would require 6 parking spaces and 13 for retail; she recommended ghat the variance be granted. J. The Ada County Highway District, for site specific DaROSA VARIANCE - FINDINGS & CONCLUSIONS Page - 2 • • . requirements, commented that parking stalls on 2nd Street shall be parallel to the street. K. That there is angle parking along East Second Street on both sides of the street south of the Applicant's property. L. That the Meridian City Engineer, Gary Smith, submitted no comments . M. That there was no public comment at the public hearing. CONCLUSIONS N. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. O. That the City has authority to grant variances pursuant to Section 11-2-419 of the Zoning Ordinance and pursuant to Section 11-9-612 of the Development Ordinances. P. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Subdivision and Development Ordinance upon which it may take judicial notice. Q. That the Council may take judicial notice of its own proceedings, those of the Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. R. That the specific requirements regarding a variance that must be evidenced and found by the City Council, are as follows: DaROSA VARIANCE - FINDINGS & CONCLUSIONS Page - 3 • • A variance shall not be granted unless the Council makes a statement of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions of this Ordinance have been met by the Applicant and unless all of the following exist: a. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would be clearly impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the subdivider because of unusual topography, the nature or condition of adjacent development, other physical conditions or other conditions that make strict compliance with this Ordinance unreasonable under the circumstances, or that the conditions and requirements of this Ordinance will result in inhibiting the achievement or objectives of this Ordinance; c. That the granting of the specified variance will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated; d. That such variance will not have the effect of nullifying the interest and purpose of this Ordinance and the Comprehensive Development Plan. S. That there does appear to be a specific benefit or profit, economic gain or convenience to the Applicant if this variance is granted. T. That regarding Section 11-2-419, it is specifically concluded as follows: a. That there are special circumstances or conditions affecting the property that the strict application of the provisions of the off-site parking requirements would clearly be unreasonable; there clearly is not enough land to place off-street parking on. b. That strict compliance with the requirements of this off- street parking Ordinance would result in extraordinary hardship to the Applicant. That the variance would not have the effect of altering the interests and purposes of the off-street parking Ordinance. U. That it is concluded that the Application for a variance from 11-2-414, OFF-STREET PARKING, should be granted. V. That it is further concluded that the Applicant should approach the Ada County Highway District to ascertain, definitely, that it will not allow diagonal parking on East Second Street; it is concluded that since there is diagonal parking on East Second Street south of this location that diagonal parking on East Second at this location would be consistent; that the City will assist the Applicant with their approach to the Ada County Highway District for diagonal parking on East Second; it is concluded, however, that there shall be parallel parking on Pine Street. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The City Council of the City of Meridian does hereby adopts and approves these Findings of Fact and Conclusions. Stiles, Planning & Zoning Administrator DATE: July 12, 1994 SUBJECT: Conditional Use Permit for Joseph and Mary DaRosa This project would meet the Comprehensive Plan goals of encouraging new commercial facilities to locate in downtown Meridian and preserving Old Town as a special and unique retailing center within the community. This request for a conditional use permit is the result of a lot of time, effort and money spent by the Applicant to restore a 1903 residence and provide professional office/retail space in the downtown area. No room is available on the 90' x 105' lot to accommodate on-site parking. Additionally, ACRD has indicated they do not want angled parking on Second Street at this location. Our current Zoning Ordinance requires adequate off-street parking be provided. In Old Town, this has more often been the exception than the rule. As the City continues to plan the downtown core and work with developers to provide public parking facilities, this shortfall of parking should be alleviated. In conjunction with 5' sidewalk and pedestrian ramp installation, seven parking spaces could be made available adjacent to Pine Avenue and Second Street this way. Professional office space for this 2,504 s.f. home would require only 6 parking spaces. Retail space would require 13 parking spaces. The existing imgation system will need to be tiled to continue historical flow to downstream users. I would recommend that a conditional use permit for professional office use be granted subject to staff and agency comments. BEFORE THE MERIDIAN PLANNING AND ZONING COMMISSION JOSEPH D. AND MARY F. da ROSA CONDITIONAL USE PERMIT 134 EAST PINE MERIDIAN, IDAHO FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing July 12, 1994, at the hour of 7:30 o'clock p.m., the Petitioner, Manuel da Rosa, appearing in person, the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions: FINDINGS OF FACT 1. That a notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for July 12, 1994, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the July 12, 1994, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations; 2. That the property is located within the City of Meridian; the property is described as a two-story home built in 1903 which applicant would like to turn into professional offices, FINDINGS OF FACT AND CONCLUSIONS OF LAW/da ROSA PAGE 1 n retail and related businesses, whereby keeping the home as a landmark in the City of Meridian. 3. That the property is zoned Old Town, which requires a conditional use permit for the operation of professional offices, retail and or related businesses which the application requests. 4. That the Old Town District is described in the Zoning Ordinance, 11-2-408 B. 10. as follows: jOT1 Old Town District: The purpose of the (OT) District is to accommodate and encourage further expansion of the historical core of the community; to delineate a centralized activity center and to encourage its renewal, revitalization and growth as the public, and quasi-public, cultural, financial and recreational center of the City. A variety of these uses integrated ,with general business, medium-high to high density residential, and other related uses is encouraged in an effort to provide the appropriate mix of activities necessary to establish a truly urban City Center. The District shall be served by Municipal Water and Sewer systems of the City of Meridian. Development in this district must give attention to the handling of high volumes of traffic, adequate parking, and pedestrian movement, and provide strip commercial development, and must be approved as a conditional use, unless otherwise permitted. 5. That the use proposed by' Applicant is a specifically allowed conditional use in the Zoning Schedule of Use Control, 11- 2-409 B. 6 . That proper notice has been given as ,required by law and all procedures before the Planning and Zoning Commission have been given and followed. That sewer, water, electricity, gas and cooling is available to the property and fully operable; that Applicant would like to get the sidewalk condemned and is looking further into that with Ada County Highway District. 9. That the City Engineer, City Planning Director, Ada County Highway District (ACRD), Central District Health Department, and Fire Department have submitted comments and they are incorporated herein as if set forth in full herein. 10. That City Planning Director, Shari Stiles commented to the parking situation in Old Town; that current Zoning Ordinance required adequate off-street parking; that as the City continues to plan the downtown core and work with developers to provide public parking facilities, the shortfall of parking should be alleviated; that for professional office space the required parking spaces would be six (6) and for retail space the requirement is thirteen (13) parking spaces; that in conjunction with a five (5) foot sidewalk and pedestrian ramp installation, seven (7) parking spaces could be made available adjacent to Pine Avenue and Second Street; that the existing irrigation system will need to be tiled to continue historical flow to downstream users; that the Applicant's request for a conditional use permit is the result of a lot of time, effort and money spent by the Applicant's to restore the 1903 residence. 11. That there was no testimony objecting to the application. FINDINGS OF FACT AND CONCLUSIONS OF LAW/da ROSA PAGE 3 CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property; 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian; 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho; 4. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan but FINDINGS OF FACT AND CONCLUSIONS OF LAW/da ROSA PAGE 4 the Zoning Ordinance requires a conditional use permit to allow the use. c . The use apparently would be designed and constructed, to be Harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. That the comments of the City Engineer, Ada County Highway District and Nampa & Meridian Irrigation must be met and complied with. 6. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, the Fire and Life Safety Code, all parking and landscaping requirements; the Applicant will need to apply for a variance regarding the off-street parking. The Findings of Fact and Conclusions of Law request that the Da Rosas now apply for a variance to the Ordinance regarding off-street parking requirements. The Da Rosas were very upfront in their inability to provide off-street parking, their submitted plans indicated this, and the variance application is atime-consuming and costly process for both the Applicant and the City. Either the Conditional Use Permit is approved or it is not. To require an additional application is another hoop to jump through that certainly does not encourage efforts such as those of the Da Rosas to revitalize the downtown area. FINDINGS OF FACT 1. That a notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive weeks prior to the said public hearing scheduled for July 12, 1994, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the July 12, 1994, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations; 2. That the property is~zoned Old Town, which requires a conditional use permit for the operation of professional offices, retail and or related businesses which the application requests. 4. That the Old Town District is described in the Zoning Ordinance, 11-2-408 B. 10. as follows: (OTl Old Town District• The purpose of the (OT) District is to accommodate and encourage further expansion of the historical core of the community; to delineate a centralized activity center and to encourage its renewal, revitalization and growth as the public, and quasi-public, cultural, financial and recreational center of the City. A variety of these uses integrated with general business, medium-high to -high density residential, and other related uses is encouraged in an effort to provide the appropriate mix of activities necessary to establish a truly urban City Center. The District shall be served by Municipal Water and Sewer systems of the City of Meridian. Development in this district must give attention to the handling of high volumes of traffic, adequate parking, and pedestrian movement, and provide strip commercial development, and must be approved as a conditional use, unless otherwise permitted. 5. That the use proposed by Applicant is a specifically allowed conditional use in the Zoning Schedule of Use Control, 11- 2-409 B. 6. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. That sewer, water, electricity, gas and cooling is available to the property and fully operable; that Applicant would like to get the sidewalk condemned and is looking further into that with Ada County Highway District. 9. That the City Engineer, City Planning Director, Ada County Highway District (ACHD), Central District Health Department, and Fire Department have submitted comments and they are incorporated herein as if set forth in full herein. 10. That City Planning Director, Shari Stiles commented to the parking situation in Old Town; that current Zoning Ordinance required adequate off-street parking; that as the City continues to plan the downtown core and work with developers to provide public parking facilities, the shortfall of parking should be alleviated; that for professional office space the required parking spaces would be six (6) and for retail space the requirement is thirteen (13) parking spaces; that in conjunction with a five (5) foot sidewalk and pedestrian ramp installation, seven (7) parking spaces could be made available adjacent to Pine Avenue and Second Street; that the existing irrigation system will need to be tiled to continue historical flow to downstream users; that the Applicant's request for a conditional use permit is the result of a lot of time, effort and money spent by the Applicant's to restore the 1903 residence. 11. That there was no testimony objecting to the application. FINDINGS OF FACT AND CONCLUSIONS OF LAW/da ROSA PAGE 3 • CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing. of notice to owners of property within 300 feet of the external boundaries of the Applicant's property; 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, 'Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian; 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho; 4. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 5. That the comments of the City Engineer, Ada County Highway District and Nampa & Meridian Irrigation must be met and complied with. 6. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, the Fire and Life Safety Code, all parking and landscaping requirements; the Applicant will need to apply for a variance regarding the off-street parking. MORROW SHARI STILES Planner 8 Zoning Administrator JIM JOHNSON Chairman • Planning 8 Zoning This project would meet the Comprehensive Plan goals of encouraging new commercial facilities to locate in downtown Meridian and preserving Old Town as a special and unique retailing center within the community. This request for a conditional use permit is the result of a lot of time, effort and money spent by the Applicant to restore a 1903 residence and provide professional office/retail space in the downtown area. No room is available on .the 90' x 105' lot to accommodate on-site parking. Additionally, ACHD has indicated they do not want angled parking on Second Street at this location. Our current Zoning Ordinance requires adequate off-street parking be provided. In Old Town, this has more often been the exception than the rule. As the City continues to plan the downtown core and work with developers to provide public parking facilities, this shortfall of parking should be alleviated. In conjunction with 5' sidewalk and pedestrian ramp installation, seven parking spaces could be made available adjacent to Pine Avenue and Second Street this way. The applicant has proposed parallel parking on Pine Avenue and angled parking on 2nd Street. Although the businesses to the south Pine Avenue on 2nd Street currently have angled parking (street section is wider at 58-feet), staff recommends that angled parking not be allowed to contiune north on 2nd Street to this parcel. Angled parking is not currently used this section of 2nd Street. Staff does not encourage the use of angled parking in new areas of the city. The accident rate is higher with angled parking. If the City of Meridian approves angled parking for this parcel, the applicant will be required to sign license agreement that includes a hold-harmless agree- ment. 4. Staff recommends that the sidewalk be replaced with a 5-foot sidewalk on Pine Avenue and a 4-foot sidewalk on 2nd Street. 5. This application is scheduled for public hearing by the Meridi- an Planning & Zoning Commission on July 12, 1994. The following requirements are provided to Meridian Planning & Zoning as conditions for approval. SITE SPECIFIC REQUIREMENTS: 1. Construct 5-foot wide, concrete sidewalk on Pine Street abut- ting parcel. 2. Construct 4-foot wide, concrete sidewalk on 2nd Street abut- ting parcel. 3. Construct pedestrian ramp(s) for the sidewalk at the corner of Pine Avenue and 2nd Street. 4. Relocate irrigation facilities out of right-of-way. 5. If the City of Meridian approves angled parking, enter into a License Agreement with the District to allow for the angled parking along 2nd Street until such time as the District needs that extra right-of-way width for future street widening. The angled parking will be required to be setback from 2nd Street to prevent vehicles from backing into traffic lanes. Coordi- nate the standards for the setbacks with Traffic Services Department. Submit site drainage plans •and calculations for review and appropriate action by ACHD. The proposed drainage system shall conform to the requirements of the City of Meridian and shall retain all storm water on-site. 2. A right-of-way permit must be obtained from ACHD for any street or utility construction within the public right-of- way. Utility cuts should be combined where practical to limit pavement damage. A request for modification, variance or waiver of any require- ment or policy outlined herein shall be made, in writing, to the Manager of Engineering Services within 15 calendar days of the original Commission action. The request shall include a statement explaining why such a requirement would result in substantial hardship or inequity. That notice of the public hearing on the variance was published for two consecutive weeks prior to the scheduled hearing for December 6, 1994, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the December 6, 1994, hearing; that copies of all notices were available to newspaper, radio and television stations. B. E. That the Applicants have requested to be granted a variance from the above Ordinance requirements and so that they will not be required meet the off-street parking requirements. F. The property in question is described in the variance application and is incorporated herein as if set forth in full. G. That the property in the area where the variance is requested is zoned Old Town. H. That the Applicants do own the property. I. That the Meridian Planning Director submitted comment which was that there was no room on the property accommodate on- site parking; that the Ada County Highway District does not want angled parking on Second Street at this location; that seven parallel parking spaces can be made available adjacent to Pine Avenue and Second Street; that professional office space would require 6 parking spaces and 13 for retail; she recommended that the variance be granted. K. That there is angle parking along East Second Street on both sides of the street south of the Applicant's property. L. That the Meridian City Engineer, Gary Smith, submitted no comments . M. That there was no public comment at the public hearing. CONCLUSIONS N. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. O. That the City has authority to grant variances pursuant to Section 11-2-419 of the Zoning Ordinance and pursuant to Section 11-9-612 of the Development Ordinances. P. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Subdivision and Development Ordinance upon which it may take judicial notice. Q. That the Council may take judicial notice of its own proceedings, those of the Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. R. That the specific requirements regarding a variance that must be evidenced and found by the City Council, are as follows: DaROSA VARIANCE - FINDINGS & CONCLUSIONS Page - 3 • • A variance shall not be granted unless the Council makes a statement of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions of this Ordinance have been met by the Applicant and unless all of the following exist: a. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would be clearly impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the subdivider because of unusual topography, the nature or condition of adjacent development, other physical conditions or other conditions that make strict compliance with this Ordinance unreasonable under the circumstances, or that the conditions and requirements of this Ordinance will result in inhibiting the achievement or objectives of this Ordinance; c. That the granting of the specified variance will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated; d. That such variance will not have the effect of nullifying the interest and purpose of this Ordinance and the Comprehensive Development Plan. S. That there does appear to be a specific benefit or profit, economic gain or convenience to the Applicant if this variance is granted. T. That regarding Section 11-2-419, it is specifically concluded as follows: a. That there are special circumstances or conditions affecting the property that the strict application of the provisions of the off-site parking requirements would clearly be unreasonable; there clearly is not enough land to place off-street parking on. b. That strict compliance with the requirements of this off- street parking Ordinance would result in extraordinary hardship to the Applicant. DaROSA VARIANCE - FINDINGS & CONCLUSIONS Page - 4 • c. That the granting of a variance would not be detrimental to the public's welfare or possibly injurious to the public. d. That the variance would not have the effect of altering the interests and purposes of the off-street parking Ordinance. U. That it is concluded that the Application for a variance from 11-2-414, OFF-STREET PARKING, should be granted. V. That it is further concluded that the Applicant should approach the Ada County Highway District to ascertain, definitely, that it will not allow diagonal parking on East Second Street; it is concluded that since there is diagonal parking on East Second Street south of this location that diagonal parking on East Second at this location would be consistent; that the City will assist the Applicant with their approach to the Ada County Highway District for diagonal parking on East Second; it is concluded, however, that there shall be parallel parking on Pine Street. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The City Council of the City of Meridian does hereby adopts and approves these Findings of Fact and Conclusions. Manual DaRosa, 2615 Springwood Drive, was sworn by the City Attorney. DaRosa: I don't have anything to proceed with, if you have questions I would be more than happy to answer them. Kingsford: Does the Council have any questions for Mr. DaRosa? Morrow: Can you give us a brief over view of what your project is and why you need the variance and those kinds of things? DaRosa: My parents own a 2 story home built in 1903 here on the comer of East Pine and East 2nd across from the medical center. We wanted to keep it as a land mark in the City of Meridian and decided that residential wasn't the proper way to do that. We put in a conditional use permit to change it professional office space and we have put quite a bit amount of money into it and we feel it would be a nice addition commercial wise to Meridian. It has, we have done the necessary, the Ada County Highway District improvements, 2 new sidewalks and a pedestrian ramps. We are just about complete at this time, however we did have a problem with the parking situation and so we are putting in a variance asking for the on street parking which is on Pine and on East 2nd Street. Kingsford: Any questions of the Council? Corrie: This is a professional building not a commercial, am I correct? DaRosa: It is a residential home being changed into professional offices. Meridian City Council December 6, 1994 Page 24 Morrow: There is no area for off street parking? DaRosa: The lot was cut back in the early 1900's and so what is behind us we don't have towards the alley. And so we don't have enough room to put any parking spaces in there that would be adequate for that particular lot. So the answer is no we don't. Corrie: You have no parking spaces at all is that correct? DaRosa: No we do not. Morrow. Is this not in Old Town? DaRosa: It is. Morrow: Was there a conditional use permit required for the conversion of the residence to a professional building? Stiles: They have done that. Morrow. And this is a variance for one of the conditions in that conditional use permit? DaRosa: That is correct. Kingsford: Do you know at this point who the office space, or what kind of a person that will be in there. Would it be somebody that would track for example a certain amount of traffic or is it an office. For example, is it, say an insurance salesman someone that has people coming and going constantly or do you have somebody that maybe be a firm that takes in accounting and doesn't have walk in traffic? DaRosa: We have had 2 or 3 calls on it so far, one was Crusades for Kids and I was really hoping they would move in because I would like to see that, that would work out really well down there. And that would have been basically administrative, (inaudible) CPA's and such at that point. So it would be less walk in traffic, but it is highly possible somebody would want to come in say as real estate agents or something of that nature. And there may be more of that in and out type of thing. Kingsford: Any other questions? MOTION CARRIED: All Yea ITEM #23: PUBLIC HEARING: REQUEST FOR AN IRRIGATION DITCH ABANDONMENT BY PATRICK AND MARIE MARRON: Kingsford: At this time I will open the public hearing and invite the owner or his designee to speak first. John Powell, 3561 Minuteman Way, Boise, was sworn by the City Attorney. Powell: Mayor and Councilmen, I was requesting an abandonment of this ditch on behalf of owners of Lot 6. I was originally the developer of the Subdivision which is called Ariel Estates. At the point in time that this subdivision was originally platted, the one individual that was served or received irrigation water from that ditch, Mr. and Mrs. Burt it was unclear whether or not he wanted to come into our pressurized irrigation system. At the point that we received our final plat and put the system in they decided that they were actually brought into the pressurized system. So at this point in time that section of ditch in that northeast comer of the property serves no function or purpose. It does not receive any water and it does not deliver any water. Additionally much of the ditch leading up to that point in the process of platting that subdivision was actually abandoned and filled in with dirt. At the time the development was platted there were provisions made such that this service ditch that wound up all across the property was actually going to be straightened out and the water was going to be delivered to that ditch again in the northeast corner there. But because of the pressurized system it eliminated us needing to do that. Kingsford: Any questions of John from the Council? Morrow: The ditch you are asking to vacate doesn't serve anybody now and it is not ~ r . . Meridian City Council November 15, 1994 Page 17 weight that against what the law is and our zoning ordinance and so forth and then make a decision based on that. So, what happens is Wayne will call each of the Councilmen and take their view as to what took place at the public hearing and examine that against the ordinances and see how that measure and make that a public finding. That is another way of saying it is avoiding the legal hassle of being sued and those sorts of things. Is that reasonably appropriate Counselor? Crookston: I will generally agree with your comment. Shoemaker: Because of this off road variance we have given temporary occupancy of the new addition, what does this do for our occupancy? Kingsford: Well, I would assume that your temporary occupancy is based on this variance being granted and so that will be in effect until such time the Council makes a ruling. ITEM #9: PUBLIC HEARING: VARIANCE REQUEST BY JOSEPH AND MARY daROSA: Kingsford: At this time I will open that public hearing and invite them or their representatives to speak first. Is there anyone from the public that would like to offer testimony on this issue? Julie Grapatin, 137 East Pine, was sworn by the City Attorney. Grapatin: Since they are not here does that mean nothing happens? I live right across the street and I am concerned about parking also. Kingsford: It doesn't mean that nothing will happen, this has been noticed and the public has an opportunity to give input this evening and this is the one public hearing that they get a chance to do that. Take whatever shot you would like. Grapatin: Since the beauty school moved in across the street from us, we don't have a chance to park in front of our house anymore or around our house. In fact I can't get in my driveway some days to get to my garage. If another business across the street is going to take more parking I just wonder what is going to happen there at Pine and 2nd. There is a lot of business and a lot of cars, there is not much room left. That was my only comment. Kingsford: Any questions the Council may have. That would be my comment. Corrie: Mr. Mayor, I am a little confused, is this going to be a professional office or a retail space or the possibility of retail. I don't know either I think I agree with Walt and I would like to have a few questions of them. I am in agreement, if he wants to make a motion I will second that. Kingsford: Was there a motion?
