A postponement of the paving requirement for the RV Park and the Parking lot of the golf driving range until Sept. 1996. 2. A waiver of the requirement to the the ditch known as "Hunter Lateral", which traverses the subject property. We plan to pave the RV park and parking lot of the driving range on or before Sept.30, 1996. Until then we will gravel the interior roadways ann the individual stations within the RV park and the parking lot of the driving range. The foregoing is necessitated due to unanticipated cost overruns resulting form the inept performance of our former general contractor. We have dismissed the former general contractor and have engaged a new contractor. We have viable plans to complete the paving, but need the city's indulgence. Regarding the tiling of the Hunter Lateral, we would like to use Hunter Lateral as a landscape feature. Running water would be an attractive asset for the use we have described for the property and is one of the things that attracted us to this particular piece of land. We have gone to considerable expense to trim and preserve the large, mature trees that are growing on the ditch bank and feel that they too are an asset ~ r :., ~ ,:. ,• , r ~5 & ~ \%it 7 1L wed v'L i-~k t~ to be preserved. It would mean they would be destroyed if the ditch had to be tiled. We, also feel Hunter Lateral provides a natural separation of the two uses of the land and will aid us in foot traffic control. We understand the purpose of the tiling requirement to be safety in subdivisions where children may be playing unattended. However, in our situation, there will be employees present from 7AM until 11PM or later during peak times (Apr thru Sept) which is when the water is in the ditch. 17. Tiling would not serve the purpose of enhancing the attractiveness of the community and preserving existing natural features (trees). If agreement is reached with Nampa-Meridian Irrigation District (NMID), evidence of this must be submitted. to the City. I would recommend approval of this portion of the variance pending NMID approval. Asphalt As this project has gone through development, the only questions citizens asked of me related to paving of the parking areas. Problems related to dust, mud, and aesthetics were major concerns. The Applicant has not shown undue hardship because of the characteristics of the site; the variance is in conflict with the public interest. Granting of this portion of the variance would confer on the applicant a special privilege that is denied by Ordinance to other lands, structures or buildings in the community. If Council does desire to grant this variance, I would request that a maximum of one year be placed on the completion date. It looks as if the existing bottom of the lateral was used. The pipe line has several bands where the gasket is showing. At least one bell end is damaged and will cause problems if it is not replaced or fixed. Because we have so many concerns with the portion of the pipe line that is uncovered, we are requesting that the entire pipe line be exposed for inspection before the work continues. Inspections will need to be made when the work resumes. Miller: I am sure you all realize the owner developing this project has made some significant mistakes in trying to develop the project there have been some problems in carrying it forward. Recently we have had a series of meetings with the staff and also faced 2 Councilmen in an effort to get things on a more coherent, logical forward looking tract at a meeting approximately 2 weeks ago. It was suggested that we should bring to the Council a proposal to formerly treat this as a project to be developed in phases. Thank you, I think that is really helpful. I think you will all recognize the project is bounded on the west by Locust Grove and on the South by Eagle Road. As the applicant originally thought they were going to try to develop they had in mind the driving range which is the large area on the east side and which is substantially constructed and the RV park which is the facility right at the intersection of Locust Grove Road and Overland would be constructed simultaneously. The area in the middle which was shown as a tentative miniature golf area would be constructed later. That wasn't accurately, completely, clearly communicated to the City and I believe the staff proceeded with the belief that the entire project was going to be constructed simultaneously. We would like the Council to treat it as a 3 phase project with the driving range which is essentially a stand alone facility being treated as one phase. With the RV Park being treated as a second phase and the area Meridian City Council October 4, 1994 Page 8 between which is future development and probably will be used for batting cages and a miniature golf facility will be treated as the third phase. I certainly would be willing and happy to answer any questions the Council might have. I don't know if the staff has any comments that they would like to add. I would just indicate generally that I believe all 3 phases and certianly the 2 phases now under construction operate substantially independently and one isn't' at least in the short term dependent on the other. We did at the most recent meeting commit to constructing a paved parking area immediately in the center area that is now under construction. We have fumished a bond in the form of a letter of credit to the City ensuring that happening. We are a little embarrassed because we told the staff we were really convinced it could happen last week and it didn't but the contractor is out there, he delivered the gravel this afternoon and he has given us a commitment in virtual blood that subject to whether he will be there to pave Thursday morning. We have furnished Ms. Stiles a written copy of the commitment to that effect from our contractor. That is all. Yerrington: I have one question, I was out there this evening, that ditch from the irrigation ditch that you are going to the in front of your property going down Overland do you intend to the that ditch? Miller: No, at least the most current discussions have not involved tiling that. That ditch is in the Ada County Highway District right-of-way. They have not indicated they think it is helpful or appropriate to the that ditch. Certainly that is an issue I guess can be further discussed, but at least at the present time that is not the plan. The ditch, the so called Hunter Lateral which goes north and south is to be tiled and (inaudible). The plan as I understand it and as the Ada County Highway District explained it to us is that Overland is to be approved relatively quickly as part of the commitment to develop this project we are committed to give the Highway District .that right of way for fairly nominal compensation. At least in discussions with them they felt it appropriate to leave that ditch in its current situation. Kingsford: Counselor, with regard to phasing that, will there be an concessions sold to the driving range. My concern being that of rest rooms. Miller: We have a temporary rest room on site, the only area out there on the driving range is a little ticket shack and a (inaudible) to store golf balls and the golf clubs at night. It is an 8 x 10 or something. I certainly don't, I honestly don't' know. I don't think there is any plan now to sell concessions, whether there is a pop machine there now 1 don't know. Kingsford: My concern is meeting Central District Health's guidelines, if you serve food you have to have a rest room. Meridian City Council October 4, 1994 Page 9 Miller: We are certainly not going to serve food, there again it is about as big as from you to me and it is just a place to put golf clubs and balls. If there is an issue regarding serving food there is a Central District Health problem. It is basically just a ticket booth. One other comment I vwuld like to make just to avoid any possibility of confusion. We have presented this plan to you to show you the phasing that is on this plan. We are not asking for and we don't interpret your action as approval of anything else, on that plan but the phasing. But there have been some problems in the past about who is approving what and agreeing to what and I just want to say for clarity this is close we think to a final landscaping plan but we don't think it is the final landscaping plan. We have been working with Shari Stiles on that and I don't' want to represent to you that this is every single detail like tree sizes have been approved by this staff. It is very close we believe but the only thing we are asking you to approve is the phasing concept that is here. Kingsford: How about utilities specifically water those under our ordinance need to be extended to an thorough property is that going to happen in this phase? Miller: Yes, it is going to happen in the. second phase and our tentative understanding subject to your approval with the staff and the discussion that we had is conditioned to obtaining a certificate of occupancy on the building that is to be constructed in the second phase is extension of the water line to the east boundary of the property along Overland Road if that line isn't extended it is our understanding that we don't' have a certificate of occupancy and cannot use our half million dollar RV Park until it is done. So that has been moved up to not something to happen in the future it is something that will be done by this spring March or April whatever the days we talked about. Kingsford: Thank you, any other questions? Yerrington: Yes, again are you going to have that ditch tiled before the water comes in next Spring? Miller: Yes, the Hunter Lateral is to be tiled and we have some dates on that and I don't want to confuse them. And whatever we talked about we are still going to do, but I believe the understanding was that ditch will be tiled before a certificate of occupancy is issued on the RV Park and in no event later than March 15, I am not trying to change that I just as I remember that is by March 15 no matter what. That is also in discussions with Nampa Meridian that is their deadline too. We understand that it has to be done by the 15th. Thank you very much. Kingsford: Does Council have any questions of staff? Morrow: My only questions of Gary and Shari, everything there is as per the original Meridian City Council -- October 4, 1994 Page 10 discussion and the format which they have written it out in complies substantially with what was discussed at the meeting with Mr. Miller a couple of weeks ago. Smith: I haven't been involved in the discussions up to this point with the Attorney, but I have reviewed the drainage plan for the RV Park and it is satisfactory. What they proposed meets our needs for the drainage on the RV Park. Morrow. And Shari the phasing is as per the discussion essentially. I know the issues with respect all the landscaping details have not been ironed out (inaudible), progressing along? Stiles: That is right we are still continuing discussions about the landscaping that is shown. Kingsford: Is it the Council's decision to approve the phasing? Morrow. MOTION CARRIED: All Yea ITEM #12: PUBLIC HEARING: VARIANCE REQUEST BY MICHAEL AND SUE CLARKE: Kingsford: At this time I will open the public hearing and invite the applicant to speak first. Michael Clarke, 4098 North Jullian Way, Boise, was sworn by the City Attorney. Clarke: We are asking for a variance on tiling the Hunter Lateral which runs across the property and for a postponement of the paving of the interior roads of the RV park that we have. So, at first I would like to address a few items that we have from John Anderson. We spoke with John Anderson about this at the end of April and went over to him and (inaudible) with the site plan and he seemed at that time to feel that was fine to leave that ditch open. And so in the meantime I don't understand why he has changed this. Let me address the things he has put in his remarks. He said there. would be a tremendous amount of trash and debris generated by this facility that would be thrown in the ditch and cause an additional burden to them. We tend to believe in the Disneyland theory that if we can keep the area as clean as possible that it will serve two functions it would be attractive for people to want to come and visit the RV park and stay there and also it will help to keep down other throwing trash. And of course our maintenance will sufficient I believe to make sure there isn't anything thrown into the ditch. The ditch is to be an attractive amenity and we would like to keep it that way. They are talking about a d2y to day maintenance would be an additional burden because of the activity there and they are saying it would be impossible to perform the maintenance. They have that variance on either side of the ditch that the 20 foot right of way that they have that we have told that they would have. At the time we spoke with him in April we let him know that he has access from the street and he can drive right down by the ditch and there will be no barriers to them being able to get into the ditch and doing whatever maintenance they would need to do. That easement exists and I don't understand No. 2. No. 3 children in the park would be curious and play around the ditch which could be hazardous. There will Meridian City Council July 5, 1994 Page 21 undoubtedly be children, however a great deal of the number of people that would be travelling in the RV's are older and their children if they have them are older. However, in the event that isn't the case there will always be people at the park always there to observe the goings on. The ditch runs at less than a foot deep in that lateral, so it is not like there is a huge torrent of water running through there and it is not running really fast. And so I tend to think that is not going to be that great of a concern but we will of course have people there watching that at all times. We have, as I said taken these concerns up with John Anderson in the past and there seemed to have been no problem. We feel like as people come to this area, this RV park will be a lot of people's first experience with the City of Meridian and we want the park to be attractive as possible and to leave a good impression on them. So, we feel like having the water running through creates many things. Number 1 the trees of course that are around it are very attractive and look good, they are nice mature trees. If we the the ditch, according to the contractors those trees would probably have to be pulled out which would leave us with a whole bunch of great mature trees that would have to be eliminated. And which also adds to that effect the overall cleanliness and attractiveness of the park. Also the water has a cooling and calming effect and I think that having that running water going through there would be ideal. Our ideal would be to take and slope the sides of the ditch so that it is not a steep thing and if a child did fall in he would be able to get out. But we feel like it would definitely be an amenity to the park and also make a good impression for the City and of the area. 1 would like now to address on the paving. We are (inaudible) RV park that will be attractive and well maintained and not be substandard, state of the art park that people would be happy to come to and stay in and return to over and over again. We have had some problems in the past and I had a contractor that did not anticipate a lot of cost and has put a burden on us in that way. And so because of that we are not able to do things as quickly as we would like. However, the park will be grassed immediately and we will have the trees planted throughout the park and those things will be well kept. We anticipate good compacted gravel in order to handle the weight of the traffic that would be going through. And so we need time and we need help of you people in order to put this through and see that through. The idea of the park of course is to have it well kept and well maintained and cleaned and at this time we would just like to if possible put it off for 2 years the paving of the interior roads. The area around the entrance and around the building, will all be paved as it is built. One of the things that I wanted to bring up is that many campgrounds do not pave the interior roads and one of the reasons that they do that of course is it helps slow traffic and keep a lot of speed through the park down and of course it increases the safety factor. Kingsford: Any questions for Dr. Clarke? Morrow: What size is the lateral, how big of ditch is it? Meridian City Council July 5, 1994 Page 22 Clarke: The pipe coming into it is a 36 inch pipe and the ditch itself is approximately 8 feet wide. I believe it is 8 to 10 feet wide. Morrow: With respect to the gravel base to your road can you give me a feel for what kind of gravel base that is, how much base is involved? Clarke: No, but I think I have somebody here who can, 8 to 10 inch base. Morrow: A conventional road mix base? Clarke: Yes Kingsford: Would that be something you would look to pave over when you do it, when you put that kind of road base down so that you just have to pave over it? Clarke: Correct Morrow: My comment on that, I think that our primary concern here would be support of our emergency vehicles. And I would think that certainly it would have to be engineered at such a standpoint that it would support our ire trucks and any of our emergency equipment. I think that base in some areas would be adequate and in this area it may be or it may not be. I would think from the City standpoint one of the things that is of paramount importance to us is that we can provide the services that we are hired by the taxpayer to provide safely for those taxpayers and safely for our people that provide those services. Clarke: Well, we feel like some of the RV's that are going to be using that park are such as a (inaudible) that is the size of a blue bird bus I mean I'm sure you have seen those and the road is designed to be able to handle vehicles of that travelling over a day to day basis. I think it would be able to handle the emergency vehicles as well. Kingsford: Other questions? Corrie: Mr. Mayor, you mentioned that you would like to see it stay the gravel to slow traffic down but yet in two years you want to black top it then. Clarke: Yes, and to put in speed bumps. Corrie: So, really what we are doing is delaying a two year project. As far as the variance for the piping and tiling of that ditch t hate to see trees removed we need a lot of them. t am just concerned about the safety factor again plus the fact that we kind of come of with Meridian City Council July 5, 1994 Page 23 a 48 inch or under would be tiled, you are definitely sure that you can get an agreement from Meridian Irrigation District that they would approve leaving it open. Clarke: We had that agreement with John Anderson in the past in April when we sat down and talked to him. He said that it wouldn't be a problem for him if it wasn't. For them they like to have it tiled but I guess I can understand that, that is less that they have to clean up or wont' about maintaining. On the otherhand you have an amenity there that can be used to enhance the area and I think. Corrie: There isn't anyway to the that without removing the trees? Clarke: Not according to the contractor, I have talked to a couple of contractors already about what would have to be done. And they said those trees would have to be removed. Kingsford: With regard to the trash, it is possible to put trash racks so as to remove that part of the problem. Clarke: We had already planned on doing that. Kingsford: As it goes out, likewise then stop the problems that they concems about with regard to children playing. Are you amenable to some sort of license agreement with Nampa Meridian to do those things? Clarke: To do? Kingsford: Hold harmless on the kids at play, the trash racks those sorts of things. Clarke: Yes, I believe so. Kingsford: For my own preference I can see, our concerns are primarily for residential subdivisions to have those ditches taken care of in a safe manner. In this particular kind of endeavor I think my druthers would be that it is open for the reasons that you have outlined. But I share some of those same concerns as John Anderson has with regard to the maintenance. That ought to be your responsibility. Clarke: The thing of it again is Mayor, if it looks ugly that is not going to be a pleasant atmosphere. Of course part of our maintenance would be to make sure that there is no trash going into that ditch or remaining in the ditch or around it. And also keeping down the grass and so on that would be there. Kingsford: Any other questions for Dr. Clarke? Michael Clarke, 4098 North Jullian Way, Boise, was sworn by the City Attorney. Clarke: We are asking for a variance on tiling the Hunter Lateral which runs across the property and for a postponement of the paving of the interior roads of the RV park that we have. So, at first I would like to address a few items that we have from John Anderson. We spoke with John Anderson about this at the end of April and went over to him and (inaudible) with the site plan and he seemed at that time to feel that was fine to leave that ditch open. And so in the meantime I don't understand why he has changed this. Let me address the things he has put in his remarks. He said there. would be a tremendous amount of trash and debris generated by this facility that would be thrown in the ditch and cause an additional burden to them. We tend to believe in the Disneyland theory that if we can keep the area as clean as possible that it will serve two functions it would be attractive for people to want to come and visit the RV park and stay there and also it will help to keep down other throwing trash. And of course our maintenance will sufficient I believe to make sure there isn't anything thrown into the ditch. The ditch is to be an attractive amenity and we would like to keep it tha# way. They are talking about a day to day maintenance would be an additional burden because of the activity there and they are saying it would be impossible to pertorm the maintenance. They have that variance on either side of the ditch that the 20 foot right of way that they have that we have told that they would have. At the time we spoke with him in April we let him know that he has access from the street and he can drive right down by the ditch and there will be no barriers to them being able to get into the ditch and doing whatever maintenance they would need to do. That easement exists and I don't understand No. 2. No. 3 children in the park would be curious and play around the ditch which could be hazardous. There will Meridian City Council July 5, 1994 Page 21 undoubtedly be children, however a great deal of the number of people that would be travelling in the RV's are older and their children if they have them are older. However, in the event that isn't the case there will always be people at the park always there to observe the goings on. The ditch runs at less than a foot deep in that lateral, so it is not like there is a huge torrent of water running through there and it is not running really fast. And so I tend to think that is not going to be that great of a concern but we will of course have people there watching that at all times. We have, as I said taken these concerns up with John Anderson in the past and there seemed to have been no problem. We feel like as people come to this area, this RV park will be a lot of people's first experience with the City of Meridian and we want the park to be attractive as possible and to leave a good impression on them. So, we feel like having the water running through creates many things. Number 1 the trees of course that are around it are very attractive and look good, they are nice mature trees. If we the the ditch, according to the contractors those trees would probably have to be pulled out which would leave us with a whole bunch of great mature trees that would have to be eliminated. And which also adds to that effect the overall cleanliness and attractiveness of the park. Also the water has a cooling and calming effect and I think that having that running water going through there would be ideal. Our ideal would be to take and slope the sides of the ditch so that it is not a steep thing and if a child did fall in he would be able to get out. But we feel like it would definitely be an amenity to the park and also make a good impression for the City and of the area. I would like now to address on the paving. We are (inaudible) RV park that will be attractive and well maintained and not be substandard, state of the art park that people would be happy to come to and stay in and return to over and over again. We have had some problems in the past and I had a contractor that did not anticipate a lot of cost and has put a burden on us in that way. And so because of that we are not able #o do things as quickly as we would like. However, the park will be grassed immediately and we will have the trees planted throughout the park and those things will be well kept. We anticipate good compacted gravel in order to handle the weight of the traffic that would be going through. And so we need time and we need help of you people in order to put this through and see that through. The idea of the park of course is to have it well kept and well maintained and cleaned and at this time we would just like to if possible put it off for 2 years the paving of the interior roads. The area around the entrance and around the building. will all be paved as it is built. One of the things that 1 wanted to bring up is that many campgrounds do not pave the interior roads and one of the reasons that they do that of course is it helps slow traffic and keep a lot of speed through the park down and of course it increases the safe#y factor. Kingsford: Any questions for Dr. Clarke? Morrow: What size is the lateral, how big of ditch is it? Meridian City Council July 5, 1994 Page 22 Clarke: The pipe coming into it is a 36 inch pipe and the ditch itself is approximately 8 feet wide. I believe it is 8 to 10 feet wide. Morrow: With respect to the gravel base to your road can you give me a feel for what kind of gravel base that is, how much base is involved? Clarke: No, but I think I have somebody here who can, 8 to 10 inch base. Morrow: A conventional road mix base? Clarke: Yes Kingsford: Would that be something you would look to pave over when you do it, when you put that kind of road base down so that you just have to pave over it? Clarke: Correct Morrow: My comment on that, I think that our primary concern here would be support of our emergency vehicles. And I would think that certainly it would have to be engineered at such a standpoint that it would support our fire trucks and any of our emergency equipment. I think that base in some areas would be adequate and in this area it may be or it may not be. I would think from the City standpoint one of the things that is of paramount importance to us is that we can provide the services that we are hired by the taxpayer to provide safely for those taxpayers and safely for our people that provide those services. Clarke: Well, we feel like some of the RV's that are going to be using that park are such as a (inaudible) that is the size of a blue bird bus 1 mean Pm sure you have seen those and the road is designed to be able to handle vehicles of that travelling over a day to day basis. I think it would be able to handle the emergency vehicles as well. Kingsford: ether questions? Corrie: ~1llr. Mayor, you mentioned that you would like to see it stay the gravel #o slow traffic down but yet in two years you want to black top it then. Clarke: Yes, and to put in speed bumps. Corrie: So, really what we are doing is delaying a two year project. As far as the variance for the piping and tiling of that ditch I hate to see trees removed we need a lot of them. I am just concerned about the safety factor again plus the fact that we kind of come of with Meridian City Council July 5, 1994 Page 23 a 48 inch or under would be tiled, you are definitely sure that you can get an agreement from Meridian Irrigation District that they would approve leaving it open. Clarke: We had that agreement with John Anderson in the past in April when we sat down and talked to him. He said that it wouldn't be a problem for him if it wasn't. For them they like to have it tiled but I guess I can understand that, that is less that they have to clean up or wont' about maintaining. On the otherhand you have an amenity there that can be used to enhance the area and I think. Corrie: There isn't anyway to the that without removing the trees? Clarke: Not according to the contractor, I have talked to a couple of contractors already about what would have to be done. And they said those trees would have to be removed. Kingsford: With regard to the trash, it is possible to put trash racks so as to remove that part of the problem. Clarke: We had already planned on doing that. Kingsford: As it goes out, likewise then stop the problems that they concems about with regard to children playing. Are you amenable to some sort of license agreement with Nampa Meridian to do those things? Clarke: To do? Kingsford: Hold harmless on the kids at play, the trash racks those sorts of things. Clarke: Yes, I believe so. Kingsford: For my own preference I can see, our concerns are primarily for residential subdivisions to have those ditches taken care of in a safe manner. In this particular kind of endeavor I think my druthers would be that it is open for the reasons that you have outlined. But I share some of those same concerns as John Anderson has with regard to the maintenance. That ought to be your responsibility. Clarke: The thing of it again is Mayor, if it looks ugly that is not going to be a pleasant atmosphere. Of course part of our maintenance would be to make sure that there is no trash going into that ditch or remaining in the ditch or around it. And also keeping down the grass and so on that would be there. Kingsford: Any other questions for Dr. Clarke? That Ordinance 11-2-414, OFF- STREET PARKING AND LOADING FACILITIES, requires that no building or structure shall be erected unless permanently maintained off-street parking and loading have been provided in accordance with the provisions of this Ordinance and that the parking be paved 4. That the Applicants have requested to be granted a variance from the above Ordinance requirements and not be required to pipe the Hunter Lateral, the Cook Lateral or any ditches on the property, and that they not have to pave the parking areas until September 30, 1996. 5. That Mike Clarke stated at the hearing that Nampa- Meridian Irrigation District wants the ditch tiled; that he wants an attractive park; that the water is less than a foot deep; that if it were tiled he would have to remove the trees that are along the ditch; that he stated that there is a 36 inch pipe coming in and the water is 8 feet wide; that he would do a holdharmless agreement for the irrigation district and he would do maintenance of the canal. In regards to the paving he stated that he desires to use compacted gravel for two years instead of paving and that he would pave in two years; that he would pave the road around the CLARKE VARIANCE - FINDINGS & CONCLUSIONS Page - 2 park; that he would have an 8-10 inch gravel base; that he was in a financial problem. 6. The entire property in question is described in the variance application and is incorporated herein as if set forth in full. 7. That the property in the area where the variance is requested is zoned Light Industrial. 8. That the Applicant does own the property. 9. That no testimony other than Mr. Clarke's was heard at the hearing. 10. That the Nampa & Meridian Irrigation District submitted written comment that it requested the City to deny the request for a variance of the piping ordinance for the following reasons: (lj There will be a tremendous amount of trash and debris generated by this facility. The trash will blow into or be thrown into the ditch and will cause an additional maintenance burden on the District. (2) Day-to-day maintenance will be an additional burden because of the activity created by a business such as this one. The activity will almost make it impossible to perform maintenance. (3) There will be children in a park such as this one and they will always be curious and play around and in the ditch which could be hazardous. 11. The Meridian Fire Department commented that as long as there is a good gravel base down, Meridian Fire Department will not have a problem. Gary Smith will need to approve this. CLARKE VARIANCE - FINDINGS & CONCLUSIONS Page - 3 12. That the Central District Health Department submitted comment which was that they had no objection to the variance application. 13. That the comments of the .Meridian City Engineer, Gary Smith, are incorporated herein as if set forth in full. 14. That the City has previously granted variances from the piping of waterways; that all such variances have been where the pipe size to pipe the waterway would be in excess of forty-eight (48) inches; the Council has not granted a variance for any ditch where the pipe size was smaller than forty-eight (48) inches. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City has authority to grant variances pursuant to Section 11-2-419 of the Zoning Ordinance and pursuant to Section 11-9-612 of the Development Ordinances. 3. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Subdivision and Development Ordinance upon which it may take judicial notice. 4. That the Council may take judicial notice of its own CLARKE VARIANCE - FINDINGS & CONCLUSIONS Page - 4 proceedings, those of the Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. 5. That the following provisions of Section 11-9-605 M, PIPING OF DITCHES, of the Subdivision and Development Ordinance are noted which are pertinent to the Application: "All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous, on both sides of the'area being subdivided, shall be covered and enclosed with tiling or other covering equivalent in ability to detour access to said ditch, lateral or canal. The City may waive this requirement for covering such ditch, lateral or canal, if it finds that the public purpose requiring such will not be served in the individual case. Any covering program involving the distribution system of any irrigation district shall have the prior approval of that affected district. ." 6. That the City Council has met to consider changing the Ordinance regarding the piping of large ditches; that the Ordinance may be changed; the decision that was made was that all ditches and waterways, except drainages, which require a larger pipe than forty-eight (48) need not be tiled or piped. 7. That the specific requirements regarding a variance that must be evidenced and found by the City Council, regarding the variance of the piping, are as follows: No variance shall be favorably acted upon by the Council unless there is a finding, as a result of a public hearing, that all of the following exist: a. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would be clearly impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; CLARKE VARIANCE - FINDINGS & CONCLUSIONS Page - 5 b. That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the subdivider because of unusual topography, the nature or condition of adjacent development, other physical conditions or other conditions that make strict compliance with this Ordinance unreasonable under the circumstances, or that the conditions and requirements of this Ordinance will result in inhibiting the achievement or objectives of this Ordinance; c. That the granting of the specified variance will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated; d. That such variance will not violate the provisions of the Idaho code; and e. That such variance will not have the effect of nullifying the interest and purpose of this Ordinance and the Comprehensive Development Plan. 8. That there does appear to be a specific benefit or profit, economic gain or convenience to the Applicant" if this variance is granted. 9. That the requirement of tiling ditches is a health and safety requirement. 10. That the irrigation district affected has demanded that this ditch be tiled. 11. That regarding Section 11-9-612 A. 2., regarding the tiling of ditches, it is specifically concluded as follows: a. That there are no special circumstances or conditions affecting the property that the strict application of the provisions of the ditch tiling Ordinance would clearly be unreasonable. b. That strict compliance with the requirements of this ditch tiling Ordinance would not result in extraordinary hardship to the Applicant and if there is any hardship it is financial and Applicant should have been aware of the financial commitments. CLARKE VARIANCE - FINDINGS & CONCLUSIONS Page - 6 c. That the granting of a variance would be~detrimental to the public's welfare or possibly injurious to the public. d. That the granting of this variance would not violate the Idaho Code. e. That the variance would have the effect of altering the interests and purposes of the ditch tiling Ordinance which is included in the Subdivision and Development Ordinance for safety purposes. 12. That it is concluded that the Application for a variance from 11-9-605 M, PIPING OF DITCHES, should not be granted. 13. That the specific requirements regarding a variance that must be evidenced and found by the City Council, regarding the paving, are as follows: 11-2-419 C. FINDINGS "A variance shall not be granted unless (as a result of a public hearing) the Council makes a statement of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions of this Ordinance have been met by the applicant and unless all of the following exist: 1. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be impracticable or unreasonable; 2. That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the owner, subdivider or developer because of unusual topography, the nature or condition of adjacent development, other physical conditions or other conditions that make strict compliance with this Ordinance unreasonable under the circumstance, or that the conditions and requirements of this Ordinance will result in inhibiting the achievements or objectives of this Ordinance; CLARKE VARIANCE - FINDINGS & CONCLUSIONS Page - 7 3. That the granting of the specified variance will not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated; 4. That such variance .will not have the effect of altering the interest and purpose of this Ordinance and the Meridian Comprehensive Plan. 8. That regarding Section 11-2-419 C it is specifically concluded as follows: a. That no special circumstances or conditions affecting the property that the strict application of the provisions of the paving ordinance would be unreasonable were shown by the Applicant, other than financial reason, which are self-inflicted and not a cause for a variance. b. That strict compliance with the requirement that the parking be paved would not result in extraordinary hardship to the owner because of unusual topography, the nature or condition of adjacent development, other physical condition or other conditions that make strict compliance with the pavement requirement unreasonable under the circumstances, or that the conditions and requirements of the ordinance will result in inhibiting the achievements or objectives of the ordinance. The Applicant made no such showing. c. That the granting of the specified variance would be detrimental to the public's welfare or injurious to other property in the area in which the property is situated. d. That such variance would have the effect of altering the interests and purposes of the paving requirement. 9. The reasons put forth by the Applicant for the variance of the pavement requirement were financial and that compacted gravel would work for two years; that such reasons are not sufficient; that a variance requires that the Council makes a CLARKE VARIANCE - FINDINGS & CONCLUSIONS Page - 8 statement of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions of the pavement Ordinance have been met by the applicant; the standards and .conditions of the pavement requirement would not be met by the Applicant's use of compacted gravel. MOTION CARRIED: All Yea ITEM #12: PUBLIC HEARING: VARIANCE REQUEST BY MICHAEL AND SUE CLARKE: Kingsford: At this time I will open the public hearing and invite the applicant to speak first. Michael Clarke, 4098 North Jullian Way, Boise, was sworn by the City Attorney. Clarke: We are asking for a variance on tiling the Hunter Lateral which runs across the property and for a postponement of the paving of the interior roads of the RV park that we have. So, at first I would like to address a few items that we have from John Anderson. We spoke with John Anderson about this at the end of April and went over to him and (inaudible) with the site plan and he seemed at that time to feel that was fine to leave that ditch open. And so in the meantime I don't understand why he has changed this. Let me address the things he has put in his remarks. He said there. would be a tremendous amount of trash and debris generated by this facility that would be thrown in the ditch and cause an additional burden to them. We tend to believe in the Disneyland theory that if we can keep the area as clean as possible that it will serve two functions it would be attractive for people to want to come and visit the RV park and stay there and also it will help to keep down other throwing trash. And of course our maintenance will sufficient I believe to make sure there isn't anything thrown into the ditch. The ditch is to be an attractive amenity and we would like to keep it that way. They are talking about a day to day maintenance would be an additional burden because of the activity there and they are saying it would be impossible to perform the maintenance. They have that variance on either side of the ditch that the 20 foot right of way that they have that we have told that they would have. At the time we spoke with him in April we let him know that he has access from the street and he can drive right down by the ditch and there will be no barriers to them being able to get into the ditch and doing whatever maintenance they would need #o do. That easement exists and 1 don't understand No. 2. No. 3 children in the park would be curious and play around the ditch which could be hazardous. There will Meridian City Council July 5, 1994 Page 21 undoubtedly be children, however a great deal of the number of people that would be travelling in the RV's are older and their children if they have them are older. However, in the event that isn't the case there will always be people at the park always there to observe the goings on. The ditch runs at less than a foot deep in that lateral, so it is not like there is a huge torrent of water running through there and it is not running really fast. And so I tend to think that is not going to be that great of a concern but we will of course have people there watching that at all times. We have, as I said taken these concerns up with John Anderson in the past and there seemed to have been no problem. We feel like as people come to this area, this RV park will be a lot of people's first experience with the City of Meridian and we want the park to be attractive as possible and to leave a good impression on them. So, we feel like having the water running through creates many things. Number 1 the trees of course that are around it are very attractive and look good, they are nice mature trees. If we the the ditch, according to the contractors those trees would probably have to be pulled out which would leave us with a whole bunch of great mature trees that would have #o be eliminated. And which also adds to that effect the overall cleanliness and attractiveness of the park. Also the water has a cooling and calming effect and I think that having that running water going through there would be ideal. Our ideal would be to take and slope the sides of the ditch so that it is not a steep thing and if a child did fall in he would be able to get out. But we feel tike it would definitely be an amenity to the park and also make a good impression for the City and of the area. I would like now to address on the paving. We are (inaudible) RV park that will be attractive and well maintained and not be substandard, state of the art park that people would be happy to come to and stay in and return to over and over again. We have had some problems in the past and I had a contractor that did not anticipate a lot of cost and has put a burden on us in that way. And so because of that we are not able #o do things as quickly as we would like. However, the park will be grassed immediately and we will have the trees planted throughout the park and those things will be well kept. We anticipate good compacted gravel in order to handle the weight of the traffic that would be going through. And so we need time and we need help of you people in order to put this through and see that through. The idea of the park of course is to have it well kept and well maintained and cleaned and at this time we would just like to if possible put it off for 2 years the paving of the interior roads. The area around the entrance and around the building will all be paved as it is built. One of the things that I wanted to bring up is that many campgrounds do not pave the interior roads and one of the reasons that they do that of course is it helps slow traffic and keep a lot of speed through the park down and of course it increases the safety factor. Kingsford: Any questions for Dr. Clarke? Morrow: What size is the lateral, how big of ditch is it? Meridian City Council July 5, 1994 Page 22 Clarke: The pipe coming into it is a 36 inch pipe and the ditch itself is approximately 8 feet wide. 1 believe it is 8 to 10 feet wide. Morrow: With respect to the gravel base to your road can you give me a feel for what kind of gravel base that is, how much base is involved? Clarke: No, but I think I have somebody here who can, 8 to 10 inch base. Morrow: A conventional road mix base? Clarke: Yes Kingsford: Would that be something you would look to pave over when you do it, when you put that kind of road base down so that you just have to pave over it? Clarke: Correct Morrow: My comment on that, I think that our primary concern here would be support of our emergency vehicles. And I would think that certainly it would have to be engineered at such a standpoint that it would support our fire trucks and any of our emergency equipment. I think that base in some areas would be adequate and in this area it may be or it may not be. I would think from the City standpoint one of the things that is of paramount importance to us is that we can provide the services that we are hired by the taxpayer to provide safely for those taxpayers and safely for our people that provide those services. Clarke: Well, we feel like some of the RV's that are going to be using that park are such as a (inaudible) that is the size of a blue bird bus I mean I'm sure you have seen those and the road is designed to be able to handle vehicles of that travelling over a day to day basis. I think it would be able to handle the emergency vehicles as well. Kingsford: Other questions? Corrie: Mr. Mayor, you mentioned that you would like to see it stay the gravel to slow traffic down but yet in two years you want to black top it then. Clarke: Yes, and to put in speed bumps. Corrie: So, really what we are doing is decaying a two year project. As far as the variance for the piping and tiling of that ditch t hate to see trees removed we need a lot of them. 1 am just concerned about the safety factor again plus the fact that we kind of come of with Meridian City Council July 5, 1994 Page 23 a 48 inch or under would be tiled, you are definitely sure that you can get an agreement from Meridian Irrigation District that they would approve leaving it open. Clarke: We had that agreement with John Anderson in the past in April when we sat down and talked to him. He said that it wouldn't be a problem for him if it wasn't. For them they like to have it tiled but I guess I can understand that, that is less that they have to clean up or worry about maintaining. On the otherhand you have an amenity there that can be used to enhance the area and I think. Corrie: There isn't anyway to the that without removing the trees? Clarke: Not according to the contractor, 1 have talked to a couple of contractors already about what would have to be done. And they said those trees would have to be removed. Kingsford: With regard to the trash, it is possible to put trash racks so as to remove that part of the problem. Clarke: We had already planned on doing that. Kingsford: As it goes out, likewise then stop the problems that they concerns about with regard to children playing. Are you amenable to some sort of license agreement with Nampa Meridian to do those things? Clarke: To do? Kingsford: Hold harmless on the kids at play, the trash racks those sorts of things. Clarke: Yes, 1 believe so. Kingsford: For my own preference I can see, our concerns are primarily for residential subdivisions to have those ditches taken care of in a safe manner. In #his particular kind of endeavor I think my druthers would be that it is open for the reasons that you have outlined. But I share some of those same concerns as John Anderson has with regard to the maintenance. That ought to be your responsibility. Clarke: The thing of it again is Mayor, if it looks ugly that is not going to be a pleasant atmosphere. Of course part of our maintenance would be to make sure that there is no trash going into that ditch or remaining in the ditch or around it. And also keeping down the grass and so on that would be there. Kingsford: Any other questions for Dr. Clarke?
