1. Application: After the approval or conditional approval of
the preliminary plat, the subdivider may cause the total
parcel, or any part thereof, to be surveyed and a final
plat prepared in accordance with the approved preliminary
plat. The subdivider shall submit to the Administrator the
following: (Ord. 430, 4-2-84)
�a. Thirty (30) folded copies of the final plat sh-- i
lot arrangement and the other requirements and
(2) copies of the signature page of the final plat..

Five (5) copies of the final engineering construction
drawings for streets, water, sewers, sidewalks and
other public improvements; and
C. Ten (10) prints of the final plat at a scale of one
inch equals three hun ed feet (1" = 300').
2. Contents of Fsnal Plat: Trefinal plat shall include and be
in compliance with all items required under Title 50,
Chapter 13 of the Idaho code. The final plat submittal
shall include at least:
a. A written application for approval of such final plat
as stipulated by the Commission;
b. Proof of current ownership of the real property
included in the proposed final plat and consent of
recorded owners of the plat;
C. Such other information as the Administrator or
Commission may deem necessary to establish whether or
not all proper parties have signed and/or approved
said final plat;
d. A statement of conformance with the approved
preliminary plat and meeting all requirements or
conditions thereof;

This Final plat complies with the adopted Meridian
Comprehensive Plan. Lots 1, 2 of Block 8 are single family
detached residential dwelling lots. Lot 3 - Block 8 is an
extension of the common recreation area that runs through the
Waterbury Park Subdivision. The unplatted area in between these
lots is the drainage retention pond owned and maintained by ACHD.
As a condition of approval, request Mr. Roy Johnson to pursue
obtaining a possible lot and block designation for the ACHD
drainage parcel to allow future annexation and efficient record
keeping.

Nampa & Meridian Irrigation District's Finch Lateral courses along the north
boundary of the project. The right-of-way of the Finch Lateral is 80 feet: 40
feet from the center each way. See Idaho Code 42 -1208 --RIGHTS-OF-WAY NOT
SUBJECT TO ADVERSE POSSESSION. The developer must contact John Anderson or
Bill Henson at Nampa & Meridian Irrigation District, 466-0663 or 345-2431, for
approval before any encroachment or change of right-of-way occurs.
All laterals and waste ways must be protected. Municipal surface drainage
must be retained on site. If any surface drainage leaves the site, Nampa &
Meridian Irrigation District must review drainage plans. It is recommended that
irrigation water be made available to all developments within Nampa & Meridian
Irrigation District. The developer must comply with Idaho Code 31-3805.

Board of DirectQr9' Policy for ChangMs of Land Use or Site
Develomment
Developments or land use changes or site developments which affect
irrigation and/or drainage, within the boundaries of Nampa &
Meridian Irrigation District must be approved by the District Board
of Directors. An application form may be obtained at the District
office which will provide necessary preliminary information for
District review.
A. DRAINAGE:
1. There will be no acceptance of any increased flow in
storm run-off, drainage, or any contaminated waters for
which the District might be made liable by the Federal
and/or State Clean Water Laws
2. Existing or replacement of on-site drainage or run-off
facilities or modification thereto must be perpetually
maintained by the site owner or owners.
3. Drainage plans prepared by a registered engineer may be
required where deemed necessary by the District even
though on-site modifications to the District drainage
system are not required in the development plans.
4. If a drainage lateral owned and maintained by the
District courses the site, no alterations of the lateral
nor encroachment or its right ofwayshall be permitted
without a license agreement. No access to such drain
shall be denied to the District.
B. IRRIGATION
1. The water rights of this District are not the same
throughout the District. Neither are these always the
same on one tract of land. often these can be simplified
without changing the Court confirmed status of the
rights, if arrangements are made with the Secretary of
the District in the advance planning stages.
2. Any irrigation supply lateral or canal which is owned and
operated by the District and which may course the site,
must not be obstructed nor encroachment made on its
rights of way.

3. Any alteration from the original delivery point must be
approved by the Water Superintendent and transfers to
accomplish this alteration must be arranged with the
Secretary of the District as part of the system plan
acceptance by the Board of Directors.
4. No alteration or enclosure of an irrigation canal or
lateral shall be permitted without a license agreement.
No access to such canals or ,laterals shall be denied to
the District.
5. If irrigation service is not to be -provided to the
individual properties, all property owners must -be
notified 'that the District tax is an obligation of all
lands in the Irrigation District. This notification is
in compliance with Idaho Law.
6. No destruction, interference, nor limitation upon water
flows which are appurtenant to the property rights of
others shall be permitted.
7. If development plans include `providing irrigation,
operation and maintenance of the system may -be -undertaken
by a Lateral Ditch Water User' s, Association, in which
case the District assumes no responsibility beyond the
original point of delivery for the tract.
a. The District cannot provide permission for alteration of
waterways belonging to and being a part of the property
rights of individual land owners and to which waters flow
from the system of the District. Permission must be
granted from each of the property owners having ditch and
water rights in the waterway.
C. REVIEW AND APPROVAL PROCESS
1. Applicant shall complete and submit the attached
application form to the Secretary of the District. Two
(2) copies of the proposed plans shall be submitted with
the application.
2. Upon approval of the original application, plans and
specifications for construction, prepared by a registered
-engineer, shall be submitted for review to the District.
Plans and specifications shall be reviewed by the
District Water Superintendent and/or the District's
engineers. If acceptable, -the developer will be
notified. Prior to actual construction an estimate of
the cost of construction shall be provided to the
District.

3. If a license agreement is required to conform to
specifications of the District and/or recommendations of
its engineers, the Secretary of the District will then
make arrangements for an appropriate license agreement
for which the licensee shall be liable for payment of
attorney fees.
4. The District shall be notified prior to commencement of
construction. Inspection by representatives of the
District or its engineers will not constitute approval of
all or any part of the system and shall in no way relieve
the developer or his contractor of the responsibility for
providing a sound, workable system.
5. Within ten (10) days after completion of construction the
developer's engineer must certify to the District that
the system was installed in accordance with plans and
specifications, and furnish as -built drawings to the
District.
6. The developer and/or his contractor shall be responsible
for the repair of all defects, leaks or failures
occurring in the installation for a period of three (3)
years after completion of construction. A maintenance
and warranty bond in the amount of 10% of the estimated
or actual construction cost, whichever is greater, shall
be furnished to the District within thirty (30) days
after completion of construction. If the owner or his
contractor fails to make required repairs or replacements
promptly, the District shall make them, and the cost
thereof shall be paid by the owner, his contractor or the
surety.

7. Attorney fees will be required only where a license
agreement is required and these will be payable directly
to the law firm of the District's attorney.

hereby ordered to send copies of this resolution to all planning
and approval agencies in Ada and Canyon Counties and in the Cities
of Boise, Meridian, and Nampa, to the County Commissioners of Ada
and Canyon Counties and to the Mayors of Boise, Meridian and Nampa
to provide sufficient copies of the policy and application form for
the continual administration and use thereof by all interested
parties.

Re: Waterbury Park Subdivision
Dear Commissioners:
I have reviewed the application for Waterbury Park
Subdivision. This planned development will accelerate the need
for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools do not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask your support for
a development fee statute on new home construction or a real
estate transfer fee to help offset the costs of building
additional school facilities. If this support is lacking then we
ask that additional residential development be denied.
Residents of the new subdivision cannot be assured of attending
the neighborhood school as it may be necessary to bus students to
available classrooms across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.

of this annexation process ... then 1 believe that the City could amend the
annexation description without additional public hearings because it
involves public property which was intended for annexation. If this area

file an annexation request with the City and proceed with the formal
annexation process.
I contacted ACHD and their staff indicates that the District assumed
from the beginning of this project that their property would be annexed into
the City as a routine matter. They do not object to cleaning up this

Roy Johnson, 4658 Yorgason, Boise, was sworn by the attorney.
Johnson: I'm sure you have reviewed the plat, we have 140 lots
proposed on the forty acres called the Peterson Place off
Meridian Road. We are planning on doing the project in two
phases, 70 lots being the first phase and approximately 70 lots
in the second phase. The south slough project has the main line
which is going right through here to be done sometime in the next
90 days or so. I have read the Engineer's comments and I have no
problems with anything. One of the things that we went through
with the planning commission was the access. We have two access
points on Meridian Road, we have proposed one access to the north
through the project and none to the south. The Engineer and the
Clerk have both stated they would like to have an access to the
south connecting into the subdivision so we can have both sewer
and water access. We've talked to ACHD and they have no problem
with us not having the access to the north and using that access
and placing it in the south so we have provided the access as
requested by the City. I will answer any questions you may have.
Corrie: The Fire Department made a comment about the entrance
into Meridian Manor Sub., is that going to be an entrance?
Johnson: That's what I'm talking about now.
Kingsford: Any other questions? Anyone else from the public who
would like to offer testimony on this issue? No response. I
will close the Public Hearing. You have the Findings before you,
any questions on those?
Tolsma: How about the comments from Beledco.
Johnson: Their comments pertain to the road we are talking about
Putting into their subdivision.
Engineer Smith: My request was to have that access from Meridian
Manor into Waterberry in order to gain access for a sewer line
from Meridian Manor to the south slough sewer so we wouldn't have
to construct or the developer would not have to construct a lift
station which we don't want to do. The request by the developer
to eliminate the access to the north side though, I wonder if we
are going to have a problem them with block length then on the
north boundary of the subdivision. The access to the south
slough sewer from the property to the north of the south slough

is going to have to cross the slough to get to it, and that
access road that was planned on the north boundary would have
served as a way for that property to access the slough. (Further

Johnson: I'd like to comment on this because this is something
that I haven't discussed with him. What we proposed on the south
side there when we didn't have a road in there was to put a 20
foot access through that strip, in fact clear across the other
subdivision, we can do the same thing on this one here. We have
a strip along the south slough that we've set aside as a park
like area, a place for the people here to use. We can provide a
20 foot access to get through there to take care of that so that
You'll still be able to get your vehicles through.
Kingsford: What sort of an access are we talking about and how
would it be maintained?
Johnson: It will be maintained by the Homeowners Association

Rountree: Could we have discussion on this? First off I think
the idea of taking the park out of the area, having a fair amount
of experience with parks, is probably not a bad idea. The
Collector Street into the area is a good idea, however, I would
like to see access totally restricted on the Collector Street to
side streets which would impact at least one building lot. Fire
Department stated concerns about one access. If it is going to
be phased in this fashion there should be an additional access
provided. Then also the final concern is density.
The Motion was withdrew by Shearer and the second withdrew by
Alidjani.
The Motion was made by Rountree and seconded by Shearer to have
the attorney prepare Findings of Fact and Conclusions of Law
containing an additional two conditions related to access into
this development, that at such time there is a minimum of 100

ITEM #7: PUBLIC HEARING: ANNEXATION & ZONING REQUEST
W/PRELIMINARY PLAT BY PETERSON & CAPITAL DEVELOPMENT
Johnson: I will now open the Public Hearing. Is there someone
from the applicant that would like to come forward.
Roy Johnson, 9390 Ustick Rd. #10, Boise, was sworn by the
attorney.
Johnson: What we are proposing is 143 lots on approximately 43
acres giving us a density of 3.34 per acre. We are requesting a
Zone of R-4. I have a couple of questions concerning the remarks
from the City Engineer. One of the comments that Gary asked is
that we should include the little parcel of land from ACHD in our
plat.. That corner has been deeded to ACRD, we don't have any
access to it so that would have to be something that would have
to come from ACHD. The second item is that we need to go to the

center of the road, however ACHD claims the first 25 feet and
they have been deeded an additional 10 feet for a total of 35
feet as part of the widening of Meridian Road. We have been
talking with Gary about the location of the sewer line.
Irrigation, I do not have any small irrigation lines that
continue through. We have the south slough on the north side and
the Creason Lateral along the west side but other than that there
are no local irrigation ditches crossing through the property. I
do have some lots that are less than 8,000 sq. feet and I will
fix that and have it back to you before the next meeting.
Regarding the plat on the roadway, Gary has asked that we have a
second access to the south which would go into Meridian Manor.
Certainly we would prefer not to put a roadway through there we
could give it emergency access.

Eng. Smith: Explained request for another access. My big
concern is we are getting a lot of sewer lines that are running
between lot lines and we've already experienced one problem in
Glennfield Manor where it was set up that the sewer line was to
have an access road constructed over it, a fence was to be built
to separate it and what happened is they sold the lot, the lot
owner went in and built everything over the sewer line and there
is no access now.
Discussion. (See tape)
Johnson: We do have a couple of nice parks in here and we do
feel like the parks are an asset. The developer will improve the
park and provide the grass. Along the south slough, the
requirements of Nampa Meridian are that we have 40 feet from the
center line to the lot line. We have approximately 25 feet along
the top which we are going to level out and also plant that area
so that it is also a park setting. The other comment was that
the maximum length of lots in the City is 1,000 ft. we have some
problem with that. Explained. We ask for a variance on the
length of the requirements. I will be happy to answer any
questions.
Rountree: The access to the one section you show private park, on
the easterly, it looks pretty skinny for maintenance vehicles and
such.
Johnson: It's 10 feet wide, it is fairly adequate to get a
vehicle in there.

Alidjani: I would rather see it wide enough so that if you do
need an emergency vehicle in there you could get it in there.
Rountree: What's the easement shown on lots 14 and 15?
Johnson: That is an access point.
Hepper: What is the minimum square footage of the houses?
Johnson: We would like to have our square footages mixed.
Hepper: Didn't the school district have something in there about
how they would like to see the prices ranges of the houses be
from $75 to $90. I'd like to see the 1300 sq. ft. instead of the
mix myself.
Rountree: Have you dealt with the covenants for this subdivision
at this time?
Johnson: We have not.
Chairman Johnson: We need to enter a letter from Bedelco, Inc.
dated 12-04-91 into the record. They state three basic
objections to this request. Is there anyone else that would like
to testify on this application?
Veryl King, 2518 N. Meridian Rd., was sworn by the attorney.
King: I would like to recommend there be an access on the west
side of this and I have no problems other than that.

Venable: I represent my mother and the other owners on Venable
Lane. We have the property west of this subdivision, as Mr. King
stated I think we need an access to the west.

Flaten: I agree with Mr. Hepper about protecting the square
footage. When the homes are protect a little better, we've got

Ramon Yorgenson, 5000 Fifeshire, was sworn by the attorney.
Yorgensen: The development business is an economic business.
Explained another project that has a mixed footage in the
Meridian area and how nice it will be. This is not a low end
project. I would respectfully request that we could have the
mixed footages. Secondly we have gone with larger lots and have
provided a park for the subdivision. There has been discussion
about having an access to the west, the access would probably
cost about $25,000.00 and we don't think it would be an as
desirable subdivision with this. One option I would like to
propose is that possibly we could move that access from the north
to the west to satisfy some of these requests that have been
made.
Rountree: This looks like a good project and I feel the way that
it is laid out there is room for flexibility.
Alidjani: Back to the easement that is ten foot. Can you
negotiate a little bit to give it a few feet?
Yorgensen: We are trying to meet all the minimum requirements.
We will have our engineer look at this and see if there is a way
to get a couple more feet.

Re: Peterson - Capital Development Hearing

This letter is in regard to the advertised hearing for annexation and zoning of
the above referenced property. Please accept this letter as our testimony, as we
will be unable to attend the hearing on December 10, 1991.
We are the owners of the Meridian Manor Subdivisions that abut this property
on the south. We are now in the process of developing Meridian Manor No. 7
Subdivision adjoining the Peterson - Capital Development property. We have
great concern about three items: (1) we apparently will have a dead end street
running to the south boundary of the Peterson - Capital Development tract, (2)
will the City still assure us that we will have access to the new interceptor sewer
running along the South Slough, and (3) how will our water line loop through
the Peterson - Capital Development tract in order to give our developments a
looped water system.
Originally our preliminary subdivision plat showed a cul-de-sac at the west end
of our northerly road. At the request of the City we agreed to eliminate the cul-
de-sac and turn this road north to the boundary of the Peterson - Capital
Development tract. This was agreed to in conjunction with the comments in the
next paragraph concerning sewers. This connection between the properties
was to eventually give another access to our subdivisions, eliminating a dead-
end street, and also allowing for interconnection of the water, sewer and other
utility systems. If, at this late date, this road connection is eliminated, we protest
vigorously.
In the planning of our property north of Five Mile Creek we negotiated an
arrangement with the City to install a temporary sewage lift station to pump
sewage under Five Mile Creek. This temporary lift station became necessary
because the interceptor sewer on the south side of Five Mile Creek had not
been installed low enough for a gravity sewer under the Creek, and no other
sewer was available in the area. It was decided to allow the installation of a
temporary lift station until the time a sewer line was available to serve our
subdivisions by gravity. As your know, the City is now in the process of
installing an interceptor sewer along the north side of Five Mile Creek to about
the northwest corner of our property, then north along a major ditch and then
east along the South Slough to Meridian Road. When we became aware the
City was planning this sewer interceptor, we delayed our development (about a
v year now) in ore^,u cooperate with the City and '*7 install the temporary lift
station. Instead of installing the lift station we agreed to participate with the
same amount of money to aid in constructing a sewer line to connect to the
interceptor, and also locate the sewer line to provide future service to a portion
of the Peterson - Capital Development tract. We were told that the City would
acquire the necessary easements to accomplish this: After postponing our
development for a year, we are now greatly concerned whether the easement
and sewer line will be provided. If the development of the Peterson - Capital
Development tract does not provide for this line in the immediate future, we
protest vigorously.
We were asked by the City, and agreed, to provide a 10" water main in our
northerly road for a future looped water system through the Peterson - Capital
Development tract. Our Engineer has designed, and the City has approved, the
design of our water system based on this assumption. We believe that the
looped water system is beneficial to the fire protection water flows for our
development and also for the Peterson - Capital Development tract, as it would
provide another water source toward the westerly end of their development. If
this looping will not be provided, we protest vigorously.
As an additional comment, in reviewing the subdivision layout accompanying
the Notice of Hearing it appears that the block arrangement violates the
Meridian "Subdivision and Development Ordinance". Section 9-605 of this
Ordinance requires that "---; blocks shall not be less than five hundred feet
(500) nor more than one thousand feet (1,000) in length. It appears that only
one block in the entire development conforms to this requirement. We have
always carefully followed the Ordinance in planning our developments, and
hope that the City will require the same of this developer. We would like to be
adjacent to a development comparable to ours. In our opinion, long straight
streets of 1,000 to 1,500 feet does not enhance any neighborhood. When a
tract of land is of sufficient total size, all land development design manuals
strongly suggest that curvelinear streets should be used.
We regret we cannot attend the Hearing; however, please enter this letter in the
record as our testimony.

taken oral and written testimony and the Applicant, Capital
Development appearing through Roy Yorgason, and through the

3. That the property is presently zoned by Ada County as
RT (Rural Transition and the proposed use would be for R-4
Residential.
4. The general area surrounding the property is used
agriculturally and residentially.
5. That the property is adjacent and abutting to the
present City limits.
6. The Applicant Doran Peterson is the owner of record and
the other Applicant, Capital Development has a purchase agreement
and both parties have requested the annexation and zoning.
7. That the property included in the annexation and zoning
application is within the Area of Impact of the City of Meridian.

forth in Policy Diagram in the Meridian Comprehensive Plan; that
under Housing Development on page 25 and 26 of the Comprehensive
Plan property inside the Urban Service Planning Area may be
developed at greater densities than one dwelling unit per acre
and it is the Policy that a density of greater than 1 dwel 1 ing
unit per 5 acres may not be exceeded outside of the Urban Service
Planning Area.
12. That in the Rural Area section of the Comprehensive Plan
it does state that land in agricultural activity should so remain
in agricultural activity until it is no longer economical to
exclude orderly growth and development to maintain agricultural
pursuits.
13. That Meridian has, and is, experiencing a population
increase; that there are pressures on land previously used for
agricultural uses to be developed into residential subdivision
lots.
14. That the property can be serviced with City water and
sewer.
15. Ada County Highway District, the Department of Health,
Settlers Irrigation District, City Engineer, Bureau of Reclamation

(R-4) LOW DENSITY RESIDENTIAL DISTRICT: The
purpose of the (R-4) District is to permit
the establishment of low density single-
family dwellings, and to delineate those
areas where predominantly residential
development has, or is likely to occur in
accord with the Comprehensive Plan or the
City, and to protect the integrity of
residential areas by prohibiting the
intrusion of incompatible non-residential
uses. The (R-4) District allows for a
maximum of four (4) dwellings units per acre
and requires connection to the Municipal
Water and Sewer systems of the City of
Meridian.
17. That proper notice was given as required by law and all
procedures before the Planning and Zoning Commission were given
and followed.
CONCLUSIONS
1. That all the procedural requirements of the ►Local

annexation is not upon the initiation of the City of Meridian.
8. That since the annexation and zoning of land is a
legislative function, the City has authority to place conditions
upon the annexation of land.
9. That the development of annexed land must meet and
comply with the Ordinances of the City of Meridian and in
particular Section 11-9-616 which pertains to development time
schedules and requirements; that the Applicant will be required
to connect to Meridian water and sewer; that the property will be
subject to Site Planning Review and the Subdivision and
Development Ordinance; that all waterways and canals within the
property will have to be tiled; that the development of the
property as a residential subdivision will require meeting the

10. That proper and adequate access to the property is
available and will have to be maintained, however the interior
accesses may have to be adjusted to meet any of the requirements
of the Meridian Fire Department.
11. That since the Applicant's property is in the CAIRNS
NEIGHBORHOOD of the Comprehensive Plan, the annexation and zoning
Application is in conformance with the Comprehensive Plan and does
not conflict with the Rural Areas policies.
12. Therefore, based on the Application, the testimony and
evidence, these Findings of Fact and Conclusions, and the
Ordinances of the City of Meridian, it is ultimately concluded
that Applicant's property should be annexed and zoned as
requested; that the development of the property shall be at a
density of not greater than four (4) dwelling units per acre; that
the conditions should be those stated above and upon issuance of
final platting and other conditions to be explored at the City
Council level; that such annexation would be orderly development
and reasonable if the conditions are met; that the property shall
be subject to de -annexation if the R-4 density is exceeded and no
dwellings other than single family dwellings shall be allowed and
this restriction shall be noted on the plat of the subdivision.
13. That all ditches, canals, and waterways shall all be Med
as a condition of annexation and if not so tiled the property
shall be subject to de -annexation.
14. That any of the requirements of the Nampa Meridian or

15. With compliance of the conditions contained herein, the
annexation and zoning or R-4. Residential would be in the best
interest of the City of Meridian.

adjacent to the north boundary of Meridian Manor No.7

east corner be included in the annexation and in the plat.
It is the site for a storm drainage detention basin for con-
tainment of runoff from Meridian Road.
3. One distance shown on the plat map varies from the
distance shown in the legal description.

half of the length of Meridian Road adjacent to this property.
B. WATER:
1. Water service will be available from a 10 inch dia-
meter line in Meridian Road when that present road rebuild
project is completed.
2. Valving for system control and the developers phasing
is being transmitted .to Engineer Johnson.
3. The fire hydrant locations shown are adequate. Some
minor relocations may be necessary.
C. SEWER:
1. Sewer service will be to the South Slough interceptor
(presently in final design) to be constructed by spring 1992.
This development is proposing we construct a length of the
interceptor in their W. Woodbury Drive. The interceptor plans
will need to be revised for this alignment and the cost of the
revision should be borne by this development.

detached residential dwelling lots. Lot 3 - Block 8 is an
extension of the common recreation area that runs through the
Waterbury Park Subdivision. The unplatted area in between these
lots is the drainage retention pond owned and maintained by ACHD.
As a condition of approval, request Mr. Roy Johnson to pursue
obtaining a possible lot and block designation for the ACHD
drainage parcel to allow future annexation and efficient record
keeping.
