Dear Members,
I am submitting a preliminary plat for the approval
of a 15 lot single-family, residential subdivision
lying adjacent to the east boundary of Clarinda Fair
Sub., which is on Pine Street between 11th and 8th.
Streets.
The current zoning is R-4, and I have designed all
the lots to be in excess of 9,000 square feet.
Existing utilities are present at the end of State
Street on my west boundary and will be extended into
my subdivision.
All storm drainage will remain on-site and within
the ACHD right-of-way. All street improvements will
be constructed to the ACHD and City of Meridian
Standards. Pine is currently improved with pavement,
curb, gutter and sidewalk. I will be dedicating an
additional 5' of right-of-way to the public.
There is an existing home on Lot 10 and another due
east of Lot 9. I am requesting allowance for 2 more
homes fronting Pine Street - Lots 9 and 11. ACHD
is opposed to continuing the proposed State Court
through to Pine Street and prefers the cul-de-sac
arrangement instead. The homes on these lots will
be in the range of $90,000 - $125,000 and will be
compatible with the surrounding area. Thank you for

I have reviewed this submittal and have the following comments for your information and or use as
conditions of the applicant during the hearing process:
It appears that sanitary sewer service to a parcel of ground, between the church property and the
multi -family property along this parcel's east boundary, is in jeopardy unless measures are taken
to provide a sewer line extension from this parcel.
ACHD has discussed extending State Street via State Street Court to N.W. 8th which would
allow an extension of the sewer to this undeveloped parcel.
2. The chord dimension frontage of culdesac/ bulb lots must be at least 40 feet. Lot 4 does not
comply with this requirement.
3. A street light needs to be located at the end of the culdesac.
4. The culdesac length, as measured from the intersection of White Lily in Clarinda Fair to the
center of the culdesac, appears to be more than the maximum allowed 450 feet. A variance is
needed unless it can be shortened.
5. What is the plan to pipe the irrigation ditch(es) presently crossing this parcel?
6. Submit street and subdivision name approval memo from the Ada County Street Name
Committee.
7. The highest seasonal groundwater elevation needs to be established to assist builders in
locating the bottom of their footings one foot above that elevation.
8. Submit proposed restrictive covenants and or deed restrictions.

SUBJECT: Preliminary Plat for State Street Extension Subdivision in
an R-4 Zone
This 15 -lot proposed plat is located east of Clarinda Fair, south of
Gregory Subdivision No. 2, west of an unplatted area, and north of Pine
Avenue.
1. Note 3 needs to be revised to indicate a minimum of 1400 square
feet of living space (excluding garage).
2. Lot 4 needs to have a minimum 40' chord.
3. Buffering for adjacent existing residential areas must be
provided.
4. There are ditches along the eastern and northern boundaries of
this property that will need to be tiled. Execution of an
agreement between Nampa -Meridian Irrigation District and the
developer is required prior to any final plat submittal. Any
downstream water users must also approve plans.
5. Three lots are shown with frontage on Pine Street, which is
classified as a major collector. One lot has an existing home on
it. Applicant has indicated ACHD is opposed to extending State
Court through to Pine Street. My preference would be to have
direct access to this subdivision from Pine Street in lieu of
three lots having direct access. These three lots will never
truly be part of the subdivision in the present configuration.
The difficulties involved with infill projects of this sort may
warrant special consideration.
6. Idaho Power has recently started requesting 10' rear easements on
each side of property lines. The front yard setback requirements
for lots fronting on Pine is 301; lots fronting local streets
require 20' front yard setbacks.

7. All lots must meet minimum of 8,000 square feet exclusive of
easements. Lot area shall be determined exclusive of rights -of -
ways, irrigation easements and land which is used for the
conveyance of irrigation water, drainage water, creek or river
flows. This requirement also applies to any sewer line easements,
which will need to be deeded to the City as separate lots if
crossing somewhere besides existing street right-of-way. Adequate
right-of-way for Pine Street needs to be shown as directed by
ACRD.
I recommend further investigation into possibility of extending State
Court to Pine Street to make a cohesive subdivision. As a condition of
approval, the developer must enter into a Development Agreement. This
agreement must be approved by the City prior to Final Plat approval.

Re: State Street Extension Subdivision
Dear Councilmen:
I have reviewed the application for State Street Extension
Subdivision and find that it includes approximately 15 homes at
the median value of $100,000. We also find that this subdivision
is located in census tract 103.12 and in the attendance zone for
Meridian Elementary, Meridian Middle School and Meridian High
School.
Using the above information we can predict that these homes, when
completed, will house 6 elementary aged children, 5 middle school
aged children, and 4 senior high aged students. At the present
time Meridian Elementary is 110% is at capacity, Meridian Middle
School is at 130% of capacity and Meridian High School is at 116%
of capacity.
The Meridian School District is not opposed to growth in our
district, however this subdivision will cause increased over-
crowding in all three schools. There is little opportunity to
shift attendance boundaries since the surrounding schools are
also well over capacity. Before we could support this
subdivision, we would need land dedicated to the district or at
least made available at a minimum price for a school site in this
area. The site would need water and sewer service available. In
addition we would need to pass another bond issue for the
construction of schools.
The cost per student for newly constructed schools, excluding
site purchase price and offsite improvements, exceeds $5,000
per elementary student and $10,000 per middle or high school
student.

SUBJECT: STATE STREET EXTENSION SUBDIVISION - PRELIMINARY PLAT
On May 11, 1994, the Commissioners of the Ada County Highway
District (hereafter called "District") took action on the
Preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for
acceptance, the Developer shall cause the following applicable
standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and
approval by the District.
2. If public street improvements are required: Prior to any
construction within the existing or proposed public right-of-
way, the following shall be submitted and subject to review
and approval by the District:
a. Three complete sets of detailed street construction
drawings prepared by an Idaho Registered Professional
Engineer, together with payment of plan review fee.
b. Execute an Inspection Agreement between the Developer and
the District together with initial payment deposit for
inspection and/or testing services.
C. Complete all street improvements to the satisfaction of
the District, or execute Surety Agreement between the
Developer and the District to guarantee the completion of
construction of all street improvements.

4. Provide written approval from the appropriate irriga-
tion,drainage district authorizing storm. run-off into their
-system.
5. Locate obstructions (utility facilities, irrigation and drain-
age appurtenances, etc.) outside of the proposed .street im-
provements. Authorization for relocations shall be obtained
from the appropriate entity.
6. Continue existing irrigation and drainage systems across par-
cel.
7. Submit three sets of street construction plans to the District
for review and appropriate action.
3. Submit site drainage plans and calculations for review and
appropriate action by ACRD. The proposed drainage system
shall conform to the requirements of Meridian and shall retain
all storm water on-site.
Public street drainage facilities shall be located in the
public right-of-way or in a drainage easement set aside specif-
ically for that use. There shall be no trees, fences, bushes,
sheds, or other valuable amenities placed in said easement.
Drainage easements and their use restrictions shall be noted
on the plat.
9. Provide design data for proposed access to public streets for
review and appropriate action by ACHD. .
10. Locate driveway curb cuts a minimum of 5 -feet from the side
lot property lines when the driveways are not being shared
with the adjacent property.
11. Developer shall provide the District with a copy of the record-
ed plat prior to the installation of street name signs.
Street signs will not be ordered until all fees have been paid
and a copy of the recorded plat has been provided to ACRD
staff. The copy of the recorded plat shall show the recording
information as inscribed by the Deputy County Recorder.
12. Install a stop sign on every unsignaliz.ed approach of a
project street to an intersection involving a collector or
arterial as the cross -street. The stop sign shall be in-
stalled when the project street is first accessible to the
motoring public.
13. A right-of-way permit must be obtained from ACHD for all
street and utility construction within the public right-of-
way. Contact Construction services at 345-7667 (with zoning
file number) for details.

Enclosed is a Copy of ACHD's review and approval letter on the
referenced subdivision preliminary plat. As you will see from
reading it, the District does not favor the extension of State
Court out to Pirie Street. It is our opinion that this will open up
the Clarinda Fair Subdivision to out -through and other unwanted
non -local traffic. Additionally, it would place another street
connection to Pine Street which is a collector roadway to which
our policy is to discourage numerous unnecessary connections.
It seems to me that the extension of State Court out to pine street
will allow a lot of undesirable traffic to use the street to cruise
through the neighborhood, rather than just those people who live
there.
We have been asked by a resident of Clarinda Fair if the District
would approve the termination of State Street at the boundary of
the two subdivisions. This would be a very undesirable situation
that the District would not accept.
If the City requires the developer to extend State court out to
Pine street, the District will acquiesce to the City's wishes, but
we believe that the residents of Clarinda Fair will come to wish
they had the Quiet closed -street neighborhood atmosphere rather
than a through street.

Alidjani: Gary, is there any problem with that item #4?
Smith: Mr. Chairman, Commission members, I received a small reduced copy of the plat,
it has been revised showing a longer culdesac. I think that was done at the request of the
Highway District to provide access to the lots that back up to Pine Street right now. I know
there was quite a bit of concern from this Commission at the public hearing concerning
access to the subdivision from Pine. I am trying to recall but 1 think the Commission
requested a letter be sent to the Highway District requesting that access, is that correct?
Johnson: That is the way I recall it, I know the feeling is that there is a curb cut already
existing there and that for fire and safety reasons that long culdesac situation there is not
desirable by the Commission or members of the City Council. I believe they would like to
see an access onto Pine there for those reasons and for other reasons including traffic.
Smith: Right, that is what I remember and 1 had an opportunity to talk to Larry Sale today,
he mentioned to me that if the City feels strongly enough about that access going through
that he didn't feel the Highway District would have a problem requiring it.
Johnson: Yes, because that subdivision doesn't have a stub street going anywhere. Even
on those we approve at least there is a stub street for future development, but that would
be the end of it the way it is platted now.
Smith: The other item I had was providing sewer service to the property to the east of this
parcel. Mr. Madsen was in a week or so ago and talked to me briefly about it. As far as
1 can tell the sewer service to that parcel that is undeveloped between the Church and the
multi -family dwellings I think they are four-plexes or a series of duplexes, has to be into
this parcel. There is a possibility that the sewer could be built in 8th street to the north and

connect to the line that serves the Church, but I am not familiar with what the exact size
of that line so I don't know if it is appropriate or not. But I did reiterate to Mr. Madsen that
we had to have a sewer line serve this parcel of ground and that it would probably be most
necessary to exit his subdivision with it.
Johnson: Any further questions?
Hepper. Yes, Mr. Chairman, there is a note on the preliminary plat here the small one that
we have that says notes, #3 homes will be a minimum of 1300 square feet and that is with
an R-4 zoning designation, that needs to be corrected to 1400 square feet minimum.
Johnson: Item #3?
Hepper: Yes
Johnson: Okay, that is kind of difficult to read, Okay, what did we decide here?
Crookston: I have a question for Wayne, if we would condition this that the access would
be provided on Pine wouldn't it have to come back for a hearing or would the. City's hearing
take care of that?
Crookston: Well, if there is a substantial change in the plat it needs to come back. The
plat is amended and it is a decision by the zoning administrator, but if it is significantly
amended it needs to come back.
Johnson: Well, it is his call as to whether it is substantial change?
Crookston: Yes, it is only it is her.
Johnson: What are you thinking Charlie?
Rountree: Well the applicant really is not going to get ACHD to change their position
without.some kind of input from the City.
Johnson: I think that is true.
Rountree: My thoughts are something along the lines of having the Zoning Administrator
work with ACHD on the possibility of providing that access and that be a condition of
passing this onto City Council for approval.
Johnson: Well, I think you are right, but Gary indicated they were receptive if the City staff

SUBDIVISION BY FLOYD AND VICTORIA MADSEN:
Johnson: I will now open is public hearing, is someone representing the applicant
would you please come forward and address the Commission.
Floyd Madsen, 5005 West Hillside Avenue, Boise, was sworn by the City Attorney.
Madsen: We propose to build a 15 lot subdivision within the Meridian impact area
which is the infill area also. Upon purchasing this property I've done a lot of research
into it at the time I think the gentleman's name is Wayne Forrey was the Planning &
Zoning, I came in to talk with Shari Stiles who was just new at the job. And got a
little guidance from them, she suggested I go to the Highway Department and also
get their input into this project. Which I did and in talking to the Highway Department
I followed their suggestion and the Planning & Zoning suggestion. My original intent
was to have a street come off Pine Street going into the subdivision and connecting
into State Street. I was informed that it is not a good idea, the Highway Department
preferred that I would run State Street Extension into a culdesac and not have it go
into Pine Street, Pine Street being a thoroughfare. They didn't want anymore roads
going into that thoroughfare. We have followed all the guidelines, it is in an R-4
zoning, 8,000 minimum square foot, we have followed that. The only thing is we
requested 1300 minimum square foot, I was notified that they would prefer 1400
square foot which is not a problem. We will provide a buffer zone as required. There
is an irrigation ditch across the property which we will re-route according to the
irrigation recommendations. We plan to build quality homes there, we will be the only
builder. I have built many homes in Meridian and if any of you know I build a good
quality home. As it is planned it would be an extension of Clarinda Fair subdivision

Madsen: Well, I don't know
Johnson: Does anyone else have any questions of Mr. Madsen? Thank you, this is
a a public hearing, anyone else like to address the Commission?
Jolynn Cavenor, 1048 West State, was sworn by the City Attorney.
Cavenor: Commissioner and Commission I would like to submit to you a signed
petition of the are neighbors and residents of the Clarinda Fair subdivision. My
personal opinion is I would like you to reject this application for a couple of reasons.
First for me is when we moved to Meridian, Clarinda Fair, it was designed for family
children atmosphere where children can thrive. If you route all the traffic for this new
subdivision down State Street ACHD says it will probably 100 trips a day. To me
Pine Street is the collector street, Pine Street should be where that traffic is collected
and routed not through the subdivision. I would like to see.you do a reverse culdesac
for that subdivision go in off of Pine, do the culdesac to the other end of the
subdivision and have the access off Pine and out of Pine instead of going through a
really nice subdivision. This new subdivision is not an extension of Clarinda Fair it is
a different developer. Our developer developed our subdivision in a very quality well
rounded atmosphere. All of our mailboxes match, all of our light poles match. 1 don't
think that 1400 square foot homes is the same light that our homes are built in. We
are proud of our homes and we just don't want to see our property values brought
down. I find it interesting that the developers here tonight all live in Boise and not in
Meridian where we live.
Alidjani: There is not a single developer that lives in Meridian they all live in Boise.
Cavenor: Isn't that interesting, I would want to live in the subdivision where the
developers live.
Johnson: You couldn't afford to live there.
Cavenor: That is a really good point and I want to live in the subdivision I live in.
Johnson: I'm just kidding you, there are developers that live in Meridian.
Cavenor: I think it is very logical that access should be granted off Pine Street and
not through a subdivision. I don't understand why it is not granted off of Pine street
that seems a logical place. Lot 9 would grant that access you don't have to rip down
a home there is no buildings to tear down. There is enough room to put in a street.
So I would submit you reject the application as it stands.

is not an extension of Clarinda Fair, it is a total separate development. I understand
that their covenants (End of Tape) His original application was for a 1300 square foot
home, the homes in Clarinda Fair average around 1750 that was a concern. If he is
going to build lower end homes, it is not an extension. It is not an extension of our
homes.
Hepper: But there are some houses by the entrance of Clarinda Fair that are down
about 1500.
Cavenor: There are, right off on Pine because of the size of the lots. And his size of
the lots are comparable to that so we know that those homes are going to be smaller
homes. If it is a separate subdivision I feel it should have a separate entrance. If you
route all that traffic down 11 th street, that is the street where all the junior high kids
travel. What are you going to do with a hundred more kids or a hundred more cars.
They are saying a hundred more in our lines of traffic everyday and all those kids
travelling to school. 1 think you get the cars out on Pine Street where the traffic
should travel right away.
Hepper: You have to talk to the Highway District on this.
Cavenor: We went to the meeting last Friday.
Hepper: Are they at all responsive?
Cavenor: They want to limit the accesses and so they had Mr. Madsen extend the
culdesac down further to the south. Which I don't think is appropriate, it is a
separate subdivision.
Johnson: Anyone else from the public?
Mark Cannon, 1090 West State Street, was sworn by the City Attorney
Cannon: I would like to start off by saying that I also protest the development of this
subdivision and protest the access through Calrinda Fair. I would like to also address
Commissioner Hepper's question that he addressed to Jolynn, I kind of feel like that
question is addressed to me also since 1 live on State Street. When I moved into that
subdivision Clarinda Fair, 1 realized there was a stub there and there could be some
potential for that road to go through to the subdivision that would be developed
adjacent to us. At that time I did assume that if they did develop a subdivision there
it would be comparable to ours first of all. Second of all I never dreamed there would
be only access through our subdivision being that Pine is a major street. I always

going to have. So they are driving around counting foundations. Secondly, I know
we don't have unlimited sewer capacity, I'm wondering where do we run out. When
I drive around I see jillions of lots going in and we are saying sitting here tonight
approving or recommending approval of more. The other one is just something I have
observed the last few evenings this spring coming home. This subdivision is directly
south of Meridian middle school, every evening coming by there were 2 adult teams
out there playing on the back stop fields playing baseball and softball. There are 10
little T -ball teams stacked in one corner, those kids are 6 to 7 years old. Five years
from now you can't stack them even 3 or 4 you can't stack them in that one area.
I looked at the master park plan and there is one baseball field. I think we are building
as we keep approving subdivision after subdivision one big juvenile delinquency
problem in the future. And what I watch at Middleton, Al Cavenor whose wife just
testified their 7 year old son is playing at Chief Joseph, they have 12 teams stacked
together there at once. We are not addressing those problems. Our subdivision has
a very small park it is part of our community association we are responsible for it. I
don' t see any provision in any of this for parks. And water, right now I don't want
to have a fire some portions of the day, because I tum on the home faucet and watch
it. I don't want the fire department fitting that fire with that kind of water pressure.
And we are saying we are going to run some more in there. The second thing is I
thought the little letter that we got the notice on this thing was misleading too. It
says 8th and Pine Street, this is really 11 th and 8th Street. Thank you for your time.
Johnson: Anyone else?
Willy Wood, 1080 11 th Street West, was sworn by the City Attorney.
Wood: Mr. Chairman, members of the Commission, I have no wish to go over plowed
ground. I just want to reinforce some of the comments that have been made by the
other people. I live in Clarinda Fair, I live at the corner of 11 th Street West and State
Street. I have 2 concerns, one is the impact that the proposed development as I
understand will have on the property values in Clarinda Fair. I think that one of the
previous speakers, Ms. Cavenor was a bit conservative when she said that the
average in square footage in Clarinda Fair was 1750 1 see it more closer to 2000
square feet. My home is 1800 square feet on a 9600 square foot corner lot. And I
say again to orient you the corner of 11 th Street West and State Street.
Shearer: Which corner?
Wood: The northeast corner. Now we have lived there for 2 years and we have
enjoyed every minute of it and we appreciate our neighbors and we appreciate the

Hepper: It is lower it is 1300 because the original R-4 designation for Clarinda Fair
was 70 foot frontage tot with 1300 square feet within the last year and 1/2 to 2
years we have changed the R-4 designation to 1400 square feet with 80 foot lots.
So this one will actually have a higher minimum than your subdivision. I don't know
maybe he is going to build right to minimum and maybe not.
Shearer: Not to pick on you personally but this has been brought up by everyone that
has been here. I am sitting here looking at a drawing and looking at this drawing I
would say that the lots in this subdivision are bigger than lots in your subdivision.
Wood: I believe the applicant mentioned 8,000 square foot.
Shearer: That is minimum, and in fact your particular lot I would say there is probably
there is maybe 2 lots in this subdivision maybe 3 lots that might be as small as yours
but I would guess that they are all bigger than yours just looking at it.
Wood: Well, my lot is approximately 9600 square feet. It is 120 by 80.
Shearer: Well, this one is one of the smaller ones and it is 80 by 121 which is
probably the same exact size as yours. Just looking at it in general these lots are
comparable size or larger. The minimum house size is comparable or larger, actually
larger. I don't know, I have to agree with you I think that road should have gone
from State right on through to Pine but I'm not with ACRD. That is all thank you.
Johnson: Anyone else?
Charles Younger, 1080 West Clarinda Drive, was sworn by the City Attorney.
Younger: Mr. Chairman, Commissioners I have lived in the subdivision here since it
began little over 2 years ago. And I have noticed the amount of traffic that has
increased of course everytime they build another house on the lot you are going to
get that many more people. Our subdivision itself is not totally filled up yet and if you
look around at the average home they are going to have at least 2 to 3 cars in each
driveway. If you are looking at 13 lots you are looking at several cars over 26 at
least. My concern to is like everyone else in this is the safety for our children. I am
recommending to you gentlemen that you cancel this until they do have proper access
other than Clarinda State street subdivision access. At 7:30 in the morning I am
trying to get out on 11 th street, it is a problem even going into Pine. Then when you
come up to Pine street and its car to car, bumper to bumper all the kids waiting to get
out the the street you can see it is going to be nothing but a traffic problem right
there especially without a stop light. My recommendation is to totally cancel this until

right past my house with nowhere else to go and I don't want my kids hit by a car,
I also do not think that the stub was there for no reason. But I did truly think it would
come off of Pine. I don't understand why ACHD will approve the subdivision on
either side off of Pine but not this one. Maybe somebody knows, did the rules
change in a month. Because this one over on the other side certainly hasn't gone up
very long. Again I am not opposed to the subdivision but I would like a little bit of
guarantees from the developer. If it is going to be an extension of Clarinda Fair are
these people going to pay the same homeowners dues that we do?
Johnson: Well, we might have a problem with semantics here when we talk about
extension. From the developers standpoint and our standpoint or designers
standpoint extension just means it connects it doesn't mean it is a replica of. I think
we have a problem here tonight with extension being a continuation like kind of
quality in planning terms that is not what that is necessarily. It means it connects and
goes through.
Newell: Originally they asked for 1300 square feet they didn't even check around to
see what Meridian minimum was at the time. That concerns me a little bit.
Johnson: Well, that is partly our fault, because we have changed that minimum
recently. We re -wrote our minimum requirements in the last couple of years a couple
of times and changed our square footage requirements. We did that recently when
we re -did the Comprehensive Plan recently.
Newell: Again I am concerned about the access, I am concerned about schools,
traffic. I am concerned about where our kids are going to school next year. My
husband an I have already moved our kids into private schools because these schools
are already overcrowded. I realize that is our prerogative but we do pay good tax, we
shouldn't have to do that. It is not the only issue and to tell you the truth my biggest
concern in the access and the fact that ACHD says okay to this guy okay to that guy
and no to this one. I just don't think it is laid out very well.
Johnson: Did you go down to meet with ACHD with the other people?
Newell: I didn't
Johnson: Who went down there, did that access come up? What I was interested
in is what they actually told you, their reason to not allow that access there. Because
I know they want to limit their number of cuts onto a collector street like that, but
what did they tell you?

Cavenor: Absolutely, it was my concern, it was 15 years ago, it was 2 years ago,
it is now and I bet it will be in 15 more years: And I hope that there is responsible
development and I will still want to live here in 15 years and I hope my kids will want
to live here. And I think that is our job as the public and that is your job and I hope
that we can come to terms and I hope that it is acceptable. Like I said I am not
opposed to development I just want it responsible. And I don't think this is a
responsible development and the number 1 reason is because of the access. The rest
of the things are public knowledge we see it the school board people talk about, the
water people talk about it, the sewer people talk about we all know it. I don't have
to tell you, you are as well aware of it as I am. But this particular one is in my
backyard and it is the access that concerns me more than anything. Just like the rest
of my neighbors. And the Highway District doesn't seem to be responsible and I
asked them to so I am asking you the same thing. If the Highway District won't be
I am asking you to reject it until they can come up with a feasible alternative and I
think it is there. I think there is a real feasible alternative and it is called Pine Street
and that is why I am here. If there is nothing else thank you very much.
Johnson: Wayne Forrey, would you like to comment for these people just an
overview of sewer and water in Meridian, the capacities.
Shearer: Don't we have water pressure there now with the new well?
Wayne Forrey, 52 East Franklin Road, was sworn by the City Attorney.
Forrey: Mr. Chairman, members of the Commission, I'll have to recall some figures
from memory. I did read a report at the beginning of this meeting about sewer
capacity. The City of Meridian currently has just under 3 million gallons per day
treatment capacity. And I believe the flow is approaching about 85% of that capacity.
But there are a couple of components to treatment the City has a hydraulic limitation
right now not an organic limitation. In other words the City could probably treat up
to 5 million gallons per day of organic load but the amount of water that would be
with that would overload the current system. The City is actively upgrading the
Waste Treatment plant. Gary Smith and others the City Engineer are working with
EPA to obtain permission to increase the capacity of the plant upward to about 5
million gallons. And that is an active ongoing process of the City of Meridian. Water
system is much the same. The City is always in a situation it appears where wells
can't be developed fast enough but they are coming on line. And the City has
completed a major water system master plan. The City has identified a location for
new wells, the type of storage, the type of generators necessary to keep the water
pressure in accordance with a standard in the community. There probably are
neighborhoods where there are low pressure areas at certain times of the day and the

would like to see access off of Pine. Personally the streets are not Meridian's they
are ACHD's streets. And they make that decision where those cuts are going to be.
Cavenor: So, I guess the City of Meridian, the people of Meridian do we have no
control over what access can be granted there? So, then the only thing we can do
if we see their granting of it is unreasonable might have to be a park for the future.
Johnson: Well there are other alternatives, (inaudible) but they do have total control
over that.
Cavenor: Would you agree with access through Clarinda Fair subdivision as being the
only access to that?
Johnson: We work here from a relative and comparative standpoint and I don't think
that too many of these commissioners would consider 15 lots being developed a
major item. Not when we are looking at subdivisions that are 200 and some lots.
You are lucky what you have is a fill in almost there. Once that is done you won't
have to worry about anything else. For a lot of these subdivisions being developed
there are still totally surrounded by land. So you have a 200 lot thing with another
600 to 800 potential now those are the major problems that we see. Everything is
relative, and I understand where you are coming from because it is in your backyard.
That is something we often hear. When you are talking in terms of traffic you are
talking to people that lived in Los Angeles and dealt with those problems there too,
so it is a relative thing. We all have kids, everybody has kids and we all have the
same concerns about the safety of your kids as we do.
Cavenor: No, and I realize that and I am from Long Beach actually so I realize the
kind of traffic problems you can have but I guess I am just hoping the Commission
will remember tonight to give us some direction on what we can do to help grant
some other kind of access or at least consider that is a major ordeal. That is all I
have.
Johnson: I think you guys have made your points well. Is there anyone else?
Newell: Can we appeal to ACHD before you give a full ruling on this? Can we appeal
the access before you deal with this one?
Johnson: I don't think it is an appeal process.
Crookston: I have no idea, I don't deal with ACHD matters.

Donahue: Okay where mu subdivision is going in at my neighborhood on North
Locust Grove I mean they stop right in the middle of the road. They park the trucks,
people have to go around at 50 mile an hour and hope they don't hit head on and
there are no ordinances, they can just park in the middle of the street.
Shearer: How many lots exit past your house?
Donahue: We don't have lots yet. There are no city ordinances to protect us in the
City?
Alidjani: Considering what you are saying, every Wednesday at 9:00 sometimes or
6:00 sometimes or 2:00 in the afternoon there is 40 foot semi right by the sidewalk
they have 2 restaurants on each side they have to deliver. That is part of cost of
business and its uncomfortable. They are not being inconsiderate they also have a
job to do and a family to feed. You have to look at it the other way. We had a cop
stop my garbage truck on Meridian Road they said no truck goes by, I said fine we
go on strike you guys have trash all over the City. That is how it works we have to
get through the town and we have to go through the alleys and streets and do the
job.
Donahue: But there is no back alley that you could access to run those trucks until
the final phase.
Alidjani: If you would consider the original owner of the original Clarinda Fair
together you couldn't by that 5 acre or 10 acre or whatever it is and add on to it and
nobody would no the difference today. It could have been part of it, it didn't happen
unfortunately and some of you are unhappy.
Johnson: I know we are getting past 10:30 because I am losing control, is there
anybody else? I am not good past 10:30 1 just wrote him a note no more meetings
past 10:30. Okay, I don't see anyone so I will close the public hearing.
Shearer: These people don't know how lucky they are, they only have 20 lots exiting
when this is in exiting past them.
Johnson: I agree, I would like to see more Clarinda Fair's I really like this.
Shearer: In a lot of subdivisions there are 3 times 4 times that exiting past.
Johnson: What would you like to do here before the night leaves us.

DECLARATION OF COVENANTS,
CONDITIONS AND RESTRICTIONS
THIS DECLARATION, made on the date hereinafter set forth by
FLOYD G. MADSEN and VICTORIA D. MADSEN, hereinafter referred to as "Declarant."
WITNESSETH:
WHEREAS, Declarant is the owner of certain property in the City of Meridian,
County of Ada. State of Idaho, which is more particularly described as:
Lots 1 through 7, inclusive Block 1, Lots 1 through 9 inclusive block 2, and Lot 1
inclusive Block 3 of Canna Lily Estates located in SE 1/4 of the NW 1/4 of Section
12, T. 3N., R 1W., B.M. Meridian, Ada County, Idaho.
NOW, THEREFORE, Declarant hereby declares that all of the properties described
above shall be held, sold and conveyed subject to the following easements, restrictions,
covenants, and conditions, which are for the purpose of protecting the value and desirability
of, and which shall run with, the real property and be binding on all parties having any right,
title or interest in the described properties or any part thereof, their heirs successors, and
assigns, and shall inure to the benefit of each owner thereof.
DEFINITIONS
Section 1. ' KOwnee' shall mean and refer to the record owner, whether on or more
persons or entities, of a fee simple title to any Lot which is part of the Properties, including
contract sellers, but excluding those having such interest merely as security for the
performance of an obligation.
Section 2. ' Properties" shall mean and refer to that certain real property hereinbefore
described and such additions thereto as may hereafter be brought within the jurisdiction of the
Association.
Section 3. ''Lot" shall mean and refer to any plot of land shown upon any recorded
subdivision map of the Properties with the exception of any Common Area, is there is any.
Section 4. 'Declarant" shall mean and refer to Floyd G. Madsen and Victoria D.
Madsen, husband and wife, their successors, and assigns if such successors or assigns should
acquire more than one undeveloped Lot from the Declarant for their purpose of development.

GENERAL COVENANTS, CONDITIONS, AND RESTRICTIONS
Section 1. "Approval of Plans" - No building, fence, wall, structure, improvement, or
obstruction shall be placed or permitted to remain upon any part of said properties unless a
written request for approval thereof containing the plans and specifications, including exterior
color scheme, has been approved in writing by the Architectural Committee. The approval of
the Committee shall not be unreasonably withheld if the said plans and specifications are for
improvements which are similar in general design and quality, and generally in harmony, with
the dwellings then located on said properties.
Section 2. 'door Area" - The floor area of a one-story house in the Subdivision shall
not be less than 1400 square feet. For the purpose of the Covenants, eaves, steps, and open
porches shall not be considered as part of a building, provided, however, that this shall not be
construed to permit any portion of a building on a Lot to encroach upon another Lot.
Two-story and tri -level homes shall have not less than 1600 square feet, exclusive of
covered porches, entrances, or patios. No split entry homes, or moving pre -built homes into
the Subdivision, will be allowed. No residence shall be in excess of two stories above
ground.
Section 3. %arages" - All area requirements shall be exclusive of the required two -
car garage area and shall be well -constructed of good quality material and workmanship. All
houses shall have an enclosed garage which holds no less than two cars and no more than
three.
Section 4. "Value" - The value of any residence shall exceed $105,000.00 based on
May 1994 values.
Section 5. 'Exterior Appearance" - Each house in this Subdivision shall include some
brick, stone, or stucco on the front exposure. Bay windows, broken roof lines, gables, hip
roofs, etc., are strongly encouraged. Roofs must be of at least 4 in 12 pitch. No gravel roofs
will be allowed. All Lots shall be provided with driveway and a minimum of two off-street
automobile parking spaces within the boundaries of each Lot.
Section . 'Colors" - Exterior colors of earth tones or light blues or greys shall be
encourages for the body of the house. Bright or bold colors or very dark body colors shall be
discouraged. Approval of exterior colors must be obtained from the Architectural Committee.
Section 7. 'tight Pole" - Each home is required to have a photo sensitive pole light
installed in the front yard within ten (10) feet of the property line, designed to switch on
automatically at sunset and off at sunrise with a minimum bulb power of 60 watts.
Completion is the specific responsibility of the Builder.
Section 8. 'landscaping" - Landscaping of front yard must be completed within thirty
(30) days of substantial completion of home and is to include sod in the front yard, one
flowering tree of at least 1.5" caliper or pine tree of at least six (6) feet in height, five (5)
five gallon plants, and five (5) two gallon shrubs. Benrn and sculptured planting areas are
encouraged. In the event of undue hardship due to weather conditions, this provision may be
extended for a reasonable length of time upon written approval of the Architectural
Committee. Grass shall be planted in the back yard within one year of occupancy. Rock or
gravel may not be used as landscaping to provide for parking adjacent to driveways.

Section 9. 'Fences" - Fences are not required. If a fence is desired, plans for it shall
be approved by the Architectural Committee prior to construction. Fences shall be of good
quality and workmanship and shall be properly finished and maintained. Fences may be built
of wood, such as 6 -foot dog-eared cedar. Chain link fences are not allowed except along
common areas and/or ditches.
Fences shall not be built closer to the font of the lot than five (5) feet behind the front
corner of the house on either side. Fences shall not extend closer than twenty (20) feet to
any side street right of way without the express approval of the Architectural Committee. No
fences shall be higher than six (6) feet.
The location of fences, hedges, high plantings, obstructions, or barriers shall be so
situated as not to unreasonably interfere with the enjoyment and use of neighboring properties
and streets and shall not be allowed to constitute and undesirable, nuisance, or noxious use.
The determination of the Architectural Committee shall be binding on all parties as to
whether and undesirable, nuisance, or noxious use exists.
See "Vehicle Storage" (Section 10) as it pertains to fencing and the amount of setback
required if the vehicle height extends above the fence.
Section 10. "Vehicle Storage" - Parking of boats, trailers, motorcycles, trucks,
truckcampers, motor homes and like equipment, or junk cars or other unsightly vehicles, and
like items, shall not be allowed on any part of said properties nor on public ways adjacent
thereto excepting only within the confines of an enclosed garage or other approved enclosure,
and no portion of same may project beyond the enclosed area. Parking of automobiles or
other vehicles on any part of the properties or on public ways adjacent thereto shall be
prohibited except within garages, carports, or other approved areas. Garage driveways shall
not be extended on either side for additional parking without first securing Architectural
Committee approval. For the purpose of this Section, an approved area may be beside the
house but not on a street side and consist of a six (6) foot solid board fenced enclosure. If
the height of the stored item is greater than the height of the front fence, the item must be
stored two feet farther from the front fence for each part of a foot the item extends above the
fence, and the item must be store two (2) feet away from any side yard fence for each part of
a foot it extends above said fence, but in no case will the item be allowed to be stored it its
height is greater than nine (9) feet or length greater than twenty-five (25) feet. The
Architectural Committee shall be the sole and exclusive judges of approved parking areas.
Section 11. "Animals" - Keeping or raising of farm animals or poultry is prohibited.
All dogs and cats or household pets kept on these premises shall be fed and cared for and
shall be adequately fenced as not to annoy or trespass upon the use of the property of others.
Dogs shall not be allowed to run at large. No more than two (2) animals may be kept
at one time, except that a litter of young may be kept until eight (8) weeks old.
Section 12. "Antennae and Satellite Dishes" - Installation or radio and/or television
antennae or satellite dishes is prohibited outside of a building without written consent from
the Architectural Committee which would require them to be screened from the street view.
Section 13. 'Setbacks" - No building shall be located on any Lot nearer than twenty
(20) feet from the front line and fifteen (15) feet from the rear line nor nearer than five (5)
feet per story to any side line.

Section 14. "Additional easements" - In addition to the easement shown on the
recorded plan, an easement is further reserved five (5) feet on each side of all other lot lines
for installation and maintenance of utilities, irrigation, and drainage.
Within these easements no structure, planting, or other material shall be placed or
permitted to remain which may damage or interfere with the installation and maintenance of
the utilities or which may change the direction of the flow of the water through drainage
channels in the easements. The easement area of each Lot and all improvements in it shall be
maintained continuously by the Owner of the Lot, except for those improvements for which a
public authority or utility is responsible.
Section 15. ' Unst wfion Time" - Construction of any residences in the Subdivision
shall be diligently pursued after commencement thereof, to be completed within twelve (12)
months.
Section 16. No building shall be moved onto the premises.
Section 17. '91* of Residence" - No shack, tent, trailer house, or basement only
house, shall be used within the Subdivision for living quarter, permanent or temporary.
Section 18. TkAbuildirgs" - Only one outbuilding per Lot will be allowed. All
outbuildings shall be constructed of quality building material, completely finished and painted
on the outside, and shall be of quality and character that will be in harmony with the other
buildings on said properties. All outbuildings must be approved by the Architectural
Committee.
Section 19. "Offensive Items" - Nothing of an offensive, dangerous, odorous, or noisy
endeavor shall be conducted or carried on, nor shall anything be done or permitted in said
Subdivision which may be or become an annoyance or nuisance to the other property owners
in said Subdivision. Weeds shall be cut to less than four (4) inches.
Section 20. ' Conducting Business on Properties" - No commercial or industrial
business or activity whatsoever shall be conducted on the above property. No signs shall be
installed to advertise said business. No oil exploration or development of any nature or kind
or mining exploration, development or structure shall be permitted upon the Lots in this
Subdivision.
Section 21. 'Irrigation and Water" - The Declarant has made provisions that provide
for delivery of irrigation water to the individual Lots, the operating expense of said system is
the obligation of the Canna Lily Estates' Neighborhood Association, at their option and not
Declarant.
Section 22. "Sewer Locations" - All bathroom, sink, and toilet facilities shall be
located inside dwelling house or other suitable appurtenant building and shall be connected by
underground pipe to wet line sewer connection lines which have been provided to each Lot.
Section 23. "Signs" - No sign of any kind shall be displayed to public view on any
building or building site on said properties except a professional sign of not more than five
(5) square feet advertising the property for sale or rent by an owner to advertise the property.
If a property is sold or rented, any sign relating thereto shall be removed immediately, except
that a "Sold" sign may be posted for a reasonable period following the sale. Notwithstanding
any provision to the contrary, signs of any and all sizes and dimension may be displayed by
the Declarant, without limitation thereto, on Lots owned by said Declarant. The Declarant or
the Neighborhood Association, if there is one, may display a sign of any size and dimensions,
without limitation thereto, for subdivision identification.

Section 24. "Waste Disposal" - No Lot or building site included within this
Subdivision shall be used or maintained as a dumping ground for waste material. Incinerators
are not permitted. Receptacles for storage of trash, garbage, etc., shall be maintained in a
sanitary and clean condition.
Section 25. 'Unstn cdon Egtdpment" - No machinery, building equipment, or
material shall be stored upon site until the Builder is ready and able to immediately
commence construction. Such building materials must be kept within the property line of
such building site upon which the structure is to be erected.
Section 26. 'Damage to bnprovements" - It shall be the responsibility of the Builder
of any residence in this Subdivision to leave street, curbs, sidewalks, fences, tiled irrigation
lines, if any, and utility facilities free of damage and in good and sound condition at the
conclusion of the construction period. It shall be conclusively presumed that all such
improvements are in good sound conditions at the time building is begun on each Lot unless
the contrary is shown in writing at the date of conveyance or by date of possession,
whichever date shall first occur, which notice is addressed to a member of the Architectural
Committee.
Section 27. The Architectural Committee's decision is final and binding on all issues.
Section 28. Lot 5 & 6 of Block 1 to be exempt from covenants, conditions, and
restrictions, because of nonconformity to the Subdivision.

ARCHITECTURAL CONTROL
"Architectural Committee" - A committee of three persons shall act as an Architectural
Committee and shall, prior to any new construction in said Subdivision, be furnished with one
set of detailed plans and specifications of any proposed building to be located in said
Subdivision and shall be allowed fifteen (15 days to review said plans, drawings, and
specifications. Is said Committee shall approve the proposed building, or any modification or
alteration thereof, they shall so indicate by the dating and signing of the set of plans by a
member of the Committee, and their approval shall be construed as full compliance with the
provisions of these Covenants. Said Committee shall have sole discretion to determine what
shall be substantial compliance with said Covenants. No building shall occupy any portion of
said Subdivision without prior consent of said Committee.

Committee members shall appoint an Owner of a Lot in said Subdivision to serve on said
Committee, all of whom serve without compensation.
Upon the sale of the last Lot of the last Phase in said Subdivision, the work of the
initial Committee shall be deemed completed, and said Committee members shall then be
automatically released from all responsibilities thereto.
If there is a Neighborhood Association, notwithstanding any other provision to the
contrary in the Covenants, Conditions and Restrictions for this Subdivision, after the
Declarant has sold all the Lots in the properties, and not before, the then seated Directors of
the Neighborhood Association shall automatically become the Architectural Committee.
Amending this instrument shall not affect this provision.
In the event there is not a Neighborhood Association for the Subdivision, it is the
responsibility of the Home Owners to select among themselves an Architectural Control
Committee.

Section 1. ' Uwners's Easement of Enjoyment" - Every owner shall have the right and
easement of enjoyment in and to the Common Area which shall be appurtenant to and shall
pass with the title to every Lot, subject to the following provisions:
(a) the right of the Association to charge assessments for the maintenance of the
Common Area;
(b) the right of the Association to suspend the voting rights and right to use of the
Common Area by an owner for any period during which any assessment against his Lot
remains unpaid; and for a period not to exceed sixty (60) days for any infraction of its public
rules and regulations;
(c) the right of the Association to dedicate or transfer all or any part of the Common
Area to any public agency, authority, or utility for such purpose and subject to such
conditions as may be agreed to by the members. No such dedication or transfer shall be
effective unless an instrument agreeing to such dedication or transfer signed by two-thirds
(2/3) of each class of members has been recorded.
Section 2. 'Delegation of Use" - Any owner may delegate, in accordance with the
Bylaws, his right of enjoyment to the Common Area and facilities to the members of his
family, his tenants, or contract purchasers who reside on the property.

MEMBERSHIP AND VOTING RIGHTS
Section 1. 15&mbeiship" - Every owner of a lot which is subject to assessment shall
be a member of the Association. Membership shall be appurtenant to and may not be
separated from ownership of any Lot which is subject to assessments. Every person or entity
who is record owner (including contract sellers) of a fee or undivided fee interest in any lot
located within said property shall, by virtue of such ownership, be a member of the
Association. When more than one person holds such interest in any occupied lot, all such
persons shall be members. The foregoing is not intended to include persons or entities who
hold an interest merely as security for the performance of an obligation. The Association
shall maintain a member list and may require written proof of any member's lot ownership
interest.
The financial reports, books, and records of the Association may be examined, at a
reasonable time, by any member of record.
Section 2. "Voting Rights" - Each member shall be entitled to cast one vote or
fractional vote as set forth herein for each lot in which he holds the interest required for
membership. Only one vote shall be cast with respect to each lot. The vote applicable to any
lot being sold under a contract of sale shall be exercised by the contract vendor unless the
contract expressly provided otherwise and the Association has been notified, in writing, of
such provision. Voting by proxy shall be permitted.
Section 3. 'Ufficeis and Directors" - At an annual meeting called pursuant to notice
as herein provided for the establishment of annual assessments, a Board of Directors of the
Association shall be elected by ballot of those attending said meeting or voting by proxy.
There shall be three directors elected to serve for a period of one year.
Section 4. 'Common Area Matters" - The Association shall have the right to dedicate
or transfer all or any part of the common areas to any public agency authority, or utility for
such purpose and subject to such conditions as may be agreed to by the members. No such
condition or transfer shall be effective unless authorized by members entitled to cast two-
thirds (2/3) of the majority of the votes at a special or general member's meeting and an
instrument signed by the Chairman and Secretary has been recorded in the appropriate county
deed records, agreeing to such dedication or transfer, and unless written notice of proposed
action is sent to every member not less than ten (10) days nor more than fifty (50) days prior
to such dedication or transfer; and the Association shall have the right to suspend any voting
rights for any period during which any assessment against said member's property remains
unpaid; and for a period not exceeding sixty (60) days for each infraction of its published
rules and regulations.

COVENANT FOR MAENTENANCE ASSESSMENTS
Section 1. ' Ureation of the lien and Peisonal Obligation of Assessments" - The
declarant, for each Lot owned within the Properties, hereby covenants, and each Owner of
any Lot by acceptance of a deed therefore, whether or not it shall be so expressed in such
deed, is deemed to covenant and agree to pay to the Association: (1) an initial assessment of
One Hundred dollars ($100.00) for each lot payable at closing, and (2) annual assessment or
charges, and (3) special assessments for capital improvements, such assessments to be
established and collected as hereinafter provided. The annual and special assessments
together with interest, cost, and reasonable attorney's fees, shall be a charge on the land and
shall be continuing lien upon the property against which each such assessment is made. Each
such assessment, together with interest, costs, and reasonable attorney's fees, shall also be the
personal obligation of the person who was the Owner of such property at the time when the
assessment fell due. However, the personal obligation for delinquent assessments shall pass
to his successors in title.
Section 2. 'Puupose of Assessments" - The assessments levied by the Association
shall be used exclusively to promote the recreation, health, safety, and welfare of the residents
in the Properties and for the improvement and maintenance of the Common Area.
Section 3. ' Mmdmum Annual Assessment" - Until January 1 of the year immediately
following the conveyance of the first Lot to an Owner, the maximum annual assessment shall
be One Hundred and No/100 dollars ($100.00) per Lot.
(a) From and after January 1 of the year immediately following the conveyance of the
first Lot to an Owner, the maximum annual assessment may be increased each year not more
than 5% above the maximum assessment for the previous year without a vote of the
membership.
(b) From and after January 1 of the year immediately following the conveyance of the
first Lot to an owner, the maximum annual assessment may be increased above 5% by a vote
of two-thirds (2/3) of each class of members who are voting in person or by proxy, at a
meeting duly called for this purpose.
(c) The Board of Directors may fix the annual assessment at an amount not in excess
of the maximum.
Section 4. 'Special Assessment for Capital Improvements." -In addition to the annual
assessments authorized above, the Association may levy, in any assessment year, a special
assessment applicable to that year only for the purpose of defraying, in whole or in part, the
cost of any construction, reconstruction, repair, or replacement of a capital improvement upon
the Common Area, including fixtures and personal property related thereto, provided that any
such assessment shall have the assent of two-thirds (2/3) of the votes of each class of
members who are voting in person or by proxy at a meeting duly called for this purpose.

Section 5. 'Notice and Quorum for Any Action Authorized Under Sections 3 and 4" -
Written notice of any meeting called for the purpose of taking any action authorized under
section 3 and 4 shall be sent to all members not less than 10 days nor more than 50 days in
advance of the meeting. At the first such meeting called, the presence of members or of
proxies entitled to cast sixty percent (60%) of all the votes of each class of membership shall
constitute a quorum.
Section 6. "Uniform Rabe of Assessment" - Both annual and special assessments
must be fixed at a uniform rate for all Lots and may be collected on a monthly, quarterly, or
annual basis at the discretion of the board.
Section 7. 'Date of Commencement of Annual Assessments: Due Dates" - The
annual assessments provided for herein shall commence as to all Lots on the first day of the
month following the conveyance of the Common Area. The first annual assessment shall be
adjusted according to the number of months remaining in the calendar year. The Board of
Directors shall fix the amount of the annual assessment against each Lot at least thirty (30)
days in advance of each annual assessment period. Written notice of the annual assessment
shall be sent to every Owner subject thereto. The due dates shall be established by the Board
of Directors. The Association shall, upon demand, and for a reasonable charge, furnish a
certificate by an officer of the association setting forth whether the assessments on the
specified Lot have been paid. A properly executed certificate of the Association as to the
status of assessments on a lot is binding upon the Association as of the date of its issuance.
Section 8. "Effect of Nonpayment of Assessments: Remedies of the Association!' -
Any assessment not paid within thirty 30) days after the due date shall bear interest from the
due date at the rate of 18% per annum."Me Association, or any owner, may bring an action
at law against the Owner personally obligated to pay the same, or foreclose the lien against
the property. No owner may waive or otherwise escape liability for the assessments provided
for herein by non-use of the Common Area or abandonment of his Lot.
Section 9. "Subordination of the Lien of Mortgages" - The lien of the assessment
provided for herein shall be subordinate to the lien of any first mortgage. Sale or transfer of
any Lot pursuant to mortgage foreclosure or any proceeding in lieu thereof, shall extinguish
the lien of such assessments as to payments which became due prior to such sale or transfer.
No sale or transfer shall relieve such Lot from liability for any assessments thereafter
becoming due or from the lien thereof.
Section 10. 'Property Exempt from Assessments" - The following property subject to
this declaration shall be exempt from the assessments created herein:
(a) all properties expressly dedicated to and accepted by a local public authority;
(b) any local properties owned by the Association;
(c) Lots 5 & 6 of Block 1 of this subdivision.
Section 11. "Association Duties" - The Association is authorized, but not limited, to
performance of the following: prepare an annual budget which shall indicate anticipated
management, operating, maintenance, repair, and other common expenses for the Association's
next fiscal year and which shall be sufficient to pay all estimated expenses and outlays of the
Association for the next calendar year growing out of or in connection with the maintenance
and operation of common areas and improvements and may include, among other things, the
cost of maintenance, management, special assessments, fire, casualty and public liability

insurance, common lighting, landscaping, care of grounds, repairs, renovations and
paintings to common areas, snow removal, wages, water charges, legal and accounting fees,
management, fees, expenses and liabilities incurred by the Association from a previous
period, and the creation of any reasonable contingency or other reserve fund, as well as all
costs and expenses relating to the common area and improvements.
The Association shall be responsible for the repairs, upkeep and maintenance, normal
servicing, gardening, rules and regulations for use, care, and safety, annual planting flowers
(if any), payment of bills and related expenses for any Common Area.
ARTICLE VII
GENERAL PROVISIONS
Section 1. 'Enforcement" - Enforcement against any person or persons violating or
attempting to violate any covenant herein after ten (10) days notice thereof in writing served
on the offending parry shall be had by any property owners either at law or equity. In the
event of judgement against any person for such, the Court may award injunction against any
person for such violation, require such compliance as the Court deems necessary, award such
damages, reasonable counsel fees, and Court costs as may be suffered or incurred, and such
other or further relief as may be deemed just and equitable.
Any Owner, shall have the right to enforce, by any proceeding at law or equity, all
restrictions, conditions, covenants, reservations, liens, and charges now or hereafter imposed
by the provisions of this Declaration. Failure by any Owner to enforce any covenant or
restriction herein contained shall in no event be deemed a waiver of the right to do so
thereafter.
Section 2. "Severability" - Invalidation of any one of these covenants or restrictions
by judgment or Court order shall in no wise affect any other provisions which shall remain in
full force and effect.
Section 3. "Amendment' - This Declaration may be amended during the fust thirty
(30) year period by an instrument signed by not less than sixty-seven percent (67%) of the
Lot Owners. Any amendment must be recorded.
Section 4. Mme Extension for Covenants" - The Covenants set forth in this
instrument shall run with the land and shall be binding on all persons owning a Lot(s) under
them for a period of thirty (30) years from the date of this recording thereof, after which time
such Covenants shall be automatically extended for successive periods of ten (10) years,
unless at any time after the initial recording of this instrument and instrument signed by sixty-
seven percent (67%) of the Lot Owners of this Subdivision has been recorded agreeing to
terminate said Covenants, in whole or in part.

the real problem is and go about solving the problem as best we can. Councilman Corrie
is correct with respect to the speed bumps. If this project goes forward it will be 2 or 3
years before these residences come on line. Hopefully by that time there will be more
traffic planning that has been done and more roads that have been constructed to mitigate
some of these things that we have discussed this evening. The school system is a
different issue. Quite candidly on my short time on the City Council here I have never ever
seen a member here from the School District or the School Board attend any of the
meetings to have a clue what is going on and the things that we are struggling with. I don't
know how we solve that problem we need to solve it somehow so it is cooperative effort.
But that is an area that we will be looking into also. So, I would ask, the point of the soap
box so to speak, is to look at the overall picture and somewhat personalize it also,
Because some of the things you are asking you wouldn't ask your own relatives or friends,
but yet you are asking that of your neighbors. That concludes my remarks.

Floyd Madsen, 5005 Hillside Avenue, Boise, was sworn by the City Attorney.
Madsen: First of all that I would like to say that I am a native Idahoan and I was one of
those that had to leave the state to seek decent employment when I was younger, so I
know where he is coming from. I think we forget where our livelihood is coming from and
I think in the Boise area it is coming from the growth. What we propose to do is an infill
area, it is a 14 lot subdivision. It would come off of State street and go into Pine, the
frontage would be off of Pine Street which we have we propose to make a common area
with an island in the center and put some greeneries out there to make it decent looking
entry way. Most of the lots in the subdivision are I think there are 2 of them that are 9,000
square feet the others are around 10,000 square feet so they are (inaudible). We propose
to build 1400 square foot minimum square foot houses. Irrigation presently crosses the
property, we propose to run that along the east side and north side boundaries as per
Meridian's irrigation requirement. We will put pressurized irrigation to all of the lots. That
is basically what we propose, do you have any questions to ask?
Tolsma: Any questions of the Council?
Madsen: Thank you.
Morrow: I have questions for Gary and Shari.
Gary Smith, 33 East Idaho, was sworn by the City Attorney.
Morrow: Gary, you have on your letter as of May 6 you have 8 issues, have those issues
been dealt with?
Smith: Well, the subdivision has changed a little bit since that review was made, the
access has been revised to Pine Street rather than connecting back totally through the
adjacent subdivision.
Morrow: So, you access it from 2 places then?
Smith: Yes, I think that was done primarily to satisfy the wishes of the adjacent property
owners as they testified at the previous hearings.
Morrow: So, item 4, a variance is no longer needed is that correct?
Smith: That is correct.
Morrow: Were all the rest of the issues covered and agreed to?

Morrow: How does this plat differ, are there any other substantial differences from the one
that you are working from there as opposed to what we have?
Smith: I think the one that you have is the one that I have, doesn't it show the street going
out to Pine, the big plat?
Morrow: Right, I have no other questions.
Tolsma: Do you have a question of Shari?
Morrow: Yes, just her comments that her comments have been addressed to her
satisfaction.
Shari Stiles, 33 East Idaho, was sworn by the City Attorney.
Stiles: Councilman Morrow, I believe most of my comments have been addressed. Ada
County Highway District has indicated that if the Council makes it a condition of this plat
for that to go through they will allow that to go through to Pine Street. However, I am still
concerned about 3 accesses directly onto Pine Street, I don't know what can be done or
if anything can be done. A private drive off of that street to access the other 2 lots it just
seems to be a really cumbersome layout there. That is basically my only concern right
now.
Morrow: You said there are 3 lots that go onto Pine Street?
Stiles: There will be the access onto Pine Street, and then the lot immediately to the west
will access Pine Street and then the next lot to the west will also access Pine Street.
Morrow: Lot 6 is an existing house, is that correct?
Stiles: Right
Morrow: So there will be a net of 2 accesses to Pine Street.
Stiles: Right, but those 2 lots will not be a part of the subdivision still, they will be
separated from the remainder of that subdivision.
Morrow: And ACHD's position was that they didn't want this subdivision to access onto
Pine Street, is that correct.

Stiles: They didn't want to, but if the Council makes it a condition they will go by whatever
the Council wants. They sent us a letter saying that the residents in Clarinda Fair want
that a through a way from Pine Street to Clarinda will probably have more of an effect than
it would have had it been just a culdesac.
Morrow: It will have more of an effect on the people in Clarinda Fair.
Stiles: That is what ACHD has stated.
Tolsma: Any questions for Shari? Anyone else from the public like to offer
testimony?
Jolene Cavener, 1040 West State, was sworn by the City Attorney.
Cavener: Council, I live in the Clarinda Fair Subdivision which is adjacent to this proposed
subdivision and we fought long and hard to get the Pine Street access. ACHD said that
with the access being only off of State street it would add 150 trips a day down State
Street. We felt the best situation for the current homeowners would be to route them out
directly onto Pine instead of running all of those cars through an existing Subdivision
where small children do play. We were really pleased to see that Planning and Zoning
agreed with our findings and that they did stipulate that Mr. Madsen could go ahead with
the development based on the fact that an access through Pine Street would be granted.
So we were pleased to see that and would hate to see that changed this evening. I do
have a couple of other things I wanted to direct to Mr. Madsen, I have asked several times
for copies of his covenants and they have not been made available at this point. The copy
of the plat that you currently now show reflects that his minimum square footage is to be
1300 square feet, he has been asked 3 times to change that 1400 square feet. It reflects
that it still has not been done. I know that there are some minimum requirements in
Meridian for a 1400 square foot housing and I want to make sure that is addressed again
so that he knows that it has to be 1400 square feet. One other comment that was made
during the Planning and Zoning meetings by Mr. Forrey was that currently the City of
Meridian is at 85% of their sewer limits. Listening to the growth here tonight 1 don't know
are there plans to expand the sewer. I am kind of worried listening to all of these
approvals and homes that we have going. We were at 85% in May, I don't know we are
at now. That is all I have.
Tolsma: Anyone else wish to testify?
Linda Cope, (Inaudible), was sworn by the City Attorney.
Cope: I really don't have testimony so much as I have a question. I have a serious

question about whether the property line as the developer sees it is the same as I see it.
(Inaudible) and I would like to know if there is any provision that requires the developer
to prove to the (Inaudible). (Inaudible) have a fence line that is established (Inaudible).
Crookston: If you feel as though there is a boundary line problem you need to talk to Mr.
Madsen or possibly his Title Insurance Company to see where that is and if they are
recognizing the line and you probably ought to enter into a boundary line agreement if they
are not then you are going to have to pursue whatever remedies are available to you.
Cope: So, there is no kind of protection against somebody who is too poor to hire high
priced lawyers and so forth.
Crookston: I am afraid not. We are going to have to have some proof that he owns it or
else we can't plat it.
Cope: What about my contract of sale, can we compare the 2 when you do that kind of
thing?
Crookston: No necessarily.
Cope: Can you?
Crookston: If there is a discrepancy with your legal description but just because your
fence is somewhere that isn't going to control us.
Cope: Well, can the decision be made to postpone this, I have talked to lawyer who is
going to (inaudible) and I wouldn't want to have them drive in one night and find out that
has been bulldozed before we find out it is even their property or not.
Crookston: That would be up to the Council.
Cope: I am officially asking them also. The irrigation ditch on our property which we use
was cut off by a development that went in the past year behind the house, nobody ever
asked if we were using it. Nobody talked to Nampa Irrigation District, is there anything that
can be done after the fact to make them open that up so that now water.
Morrow: There is no water that you can get at all?
Cope: We can get water but it won't flow through the ditch because they cut it off and
filled in the ditch at the end of our property.

Morrow: So the water doesn't come to your property?
Cope: The water comes to our property it can't leave the property. It is supposed
(inaudible).
Morrow: So, you have become the dead end of the ditch.
Cope: Yes, and according to Nampa Meridian they didn't talk to anybody about that.
Crookston: They don't
Cope: The developer doesn't talk to the irrigation company when they fill in their ditches.
Crookston: Depends on where they are at, whether they are going to turn off the water.
If they are downstream from the head gate they don't.
Cope: And the fact that the irrigation company says they should have.
Crookston: That is up to the water users association to determine that.
Cope: And who makes up the water users association?
Crookston: In your area I have no idea.
Cope: So, where do I go to find the answer to these questions?
Crookston: I think you should start with the Irrigation district and they may be able to help
you find out who, if there is one, a water users association.
Morrow: Generally water users associations are people that have use for that particular
ditch. You would be a member of that water users association. Somewhere along the line
the ditch rider tum the water in out of the lateral into the ditch that services your property.
The minute the water leaves that lateral, then it is up to the water users to control it take
care of it, set up the rotation schedules and so on and so forth. It doesn't sound to me like
you and your neighbors who utilize the ditch have a water users association.
Cope: My brother lives in the house I am buying it so I don't know too much about the
daily uses of the ditch. One other thing, I hear there is an access onto Pine, I haven't seen
any maps or anything where is that?

Tolsma: Is there anyone else that wishes to offer testimony?
Alan Cavner, 1048 West State, was sworn by the City Attorney.
Cavner: I would like to urge the City Council to pass this as amended. I think Mr. Madsen
has made some real concessions and I appreciate it. I think it is in Clarinda Fair's best
interest, Mr. Madsen's best interest and the citizens of Meridian best interest to pass it with
the access on Pine. I am not sure why the Highway District opposes it. I went to their
meeting and talked to them. I am not a traffic engineer but I am a citizen that drives and
lives in the neighborhood. I think it is for the best. One thing I would like to address if they
are only 60 days away from being able to collect impact fees it seems to me we would
want to wait 60 days to approve some of these subdivisions. As far as having to move
away to obtain decent employment] think that is unfortunate, but I think we need to
consider that if our kids are being educated on a stage or in a hallway in the lunchroom
if they don't have adequate education where are they going to go to get a job. I would like
to see them stay here too, I would like to see my kids stay here and I think it is my
responsibility to as much as possible to create an atmosphere and economy, jobs,
neighborhood, government that will encourage them to. I think we can do that and I would
encourage you to act responsibly and make the correct decisions.
Morrow: If I can make a comment with respect to the impact fees, the impact fees are
going to be assessed when they become a reality at the point of building permit. So that
any subdivision or any model or any project that is built no matter when the subdivision
was approved even if it was 10 or 15 years ago will pay an impact fee. What we have
determined in our committee under Councilman Corrie's chairmanship is that we will
collect those impact fees at building permit point so that everybody pays and not just
subdivisions that were approved after a certain given time.
Cavner: Good, so there will be some retroactive payments due then?
Morrow: No, for example if the ordinance went into effect tomorrow everybody that applied
for a building permit to build any residence within the City of Meridian would pay an impact
fee irregardless of when their subdivision was approved.
Cavner: I see, so it would be on an as house residential basis.
Morrow: That is correct.

Brad Luma, 1107 Leadville, Boise, was sworn by the City Attorney.
Luma: First of all, forgive me for bringing my little boy we are just recently moving into that
neighborhood in Clarinda Fair we just struck a deal there the other day. So we were kind
in on the tail end of this thing, my wife is in another meeting in Boise on another deal and
she has the other child. We have 2 small children and the side of our house will be on that
west State Street. If we had any idea this other development would have been going in
there with traffic we probably would not have bought that lot but we are already locked into
it so we are going to own it. So, I have a comment as far as putting access on that Pine
Street in my opinion is almost mandatory, to increase that traffic on State Street, our patio
is 10 feet from that street. The side of our house where the kids are going to have their
access is right on that State street side and if they are going to do something there maybe
you should let us put our fences a little taller on that State Street side. If I am correct I
think it is a 3 foot maximum on State Street (inaudible). So, if we can get the fences up a
little bit if you are going to have more traffic going down State Street, I just wanted to
implore you to make sure that there is some kind of access onto Pine for that subdivision
or we are going to have a lot of traffic. That is a cute subdivision with some nice homes
in there and I would also like Mr. Madsen to make sure he puts 1400 minimum square foot
homes in there and have some nice little features like our Clarinda Fair does with the
street lamps and mailboxes and so on and forth. I apologize for him being a little
disruptive.

Madsen: First of all I want to apologize for the 1300 square foot on these prints, it was
Hubble Engineering fault they kept making the changes. They will be 1400 minimum
square foot, that is what the plan says. As far as this ditch on the west boundary I did hire
(inaudible) to go out there and survey the property line so I know where the boundaries
was on it. The ditch that they are referring to is actually mine personally on my property.
All summer I have been out there and the last 4 months there has never been water in this
ditch, I think it was actually an established ditch that was there when it was a large farm.
Most of the ditch is on my property and it has been surveyed. So the boundaries have
been established. And we will maintain, I will be building all the homes myself. We will
have very strict covenants. I am a quality builder, I have been in the area for over 20
years, I do most of my home building in Meridian and I do build quality homes. So, folks
don't have to worry about the homes not being up to standard, I am sure they will be of
equal or superior to what Clarinda Fair is.
Morrow: I have a question with respect to irrigation ditch, that irrigation ditch does service
Ms. Cope's property?

Madsen: That may be I don't know. Most of the ditch is on my property though. If they,
I have never seen them use it, I asked the gentleman how he got it, he said he sticks a
pump in it once in awhile but I never, I have been out there all summer and I have never
seen anybody use the water or the ditch.
Morrow: I think the point that I am after is if the ditch, even though it is an end use ditch
now, which is fine, but if their water rights need to be maintained, if the ditch is on your
property then I would think it would be contingent upon you to make sure that either a new
ditch at your expense is placed on he property or you make some provision to get her
irrigation water to property. Whether they use it or not wouldn't matter to us, the point is
you have made the provision to get them the water and in the amount that the ditch is
supposed to carry. 1 think we have been fairly consistent as a Council over the last 6
months in making sure that the irrigation rights pass through irrigation rights are
maintained and supported. So that those users can continue to use that irrigation water.
Madsen: I planned on maintaining their water rights. As far as bulldozing her fence and
flowers over, she has very beautiful flowers there they are hybrids I guess and I didn't
have any intentions of bulldozing them over. My intent was to get the property line as to
maintain that minimum 80 foot frontage for that lot over there. I don't know that we will
have to move the fence line.
Morrow: Is there a conflict between the fence line and the actual property line?
Madsen: The fence is actually 4 foot onto my property.
Morrow: By way of survey of Mr. Howard?
Madsen: By JJ Howard Engineering and their surveyor. And it is parallel to the fence that
goes along the east boundary of Clarinda Fair.
Morrow: Have you turned in the CC&R's to the Attorney to review?
Madsen: No, we are not sure where we are going with the thing. We will get some made
up.

Cope: We haven't used the ditch back there so much this year because we have been
concerned, we don't know what our rights are. We have used the ditch bank for the last
11 years and when they developed in the back the cut up our water flowing through so we
have had to put a dam to keep the water in the ditch bank and we have had to use the
pump to keep the water going into the ditch bank but we haven't had the flow. We have
used the ditch bank to flood our front yard. He hasn't seen it because we didn't know what
our rights were with the ditch bank and we are just now proceeding to find out what our
rights are for the ditch bank.
Tolsma: Anyone else wish to offer testimony on this project?
Smith: On an average daily basis or an average monthly basis we are running about 78%
of capacity on the treatment plant. We are finding that as more of the farm land is turned
into subdivisions our infiltration is decreasing in our sewer system. I think we have had
a lot of inflow from the irrigation of the farm land that we were not able to catch up with.
One budget item that we are putting in this year for the wastewater plant will be the
construction of a tertiary filter which will increase the capacity of the plant to 4 million
gallons right now it is at 2.82 mgd. We are scrambling with growth as all the other
services in the City are but we are not putting our head in the sand. We have to provide
these services and it takes a while, it takes planning and it takes time to get the services
built both water and sewer.
Morrow: I think to answer your question with a little bit more with respect to the sewer
thing, what we have found is the City we have a tremendously large problem with ground
water here as you know is very shallow. It does infiltrate in the City lines and it is taking
up quite a bit of our capacity in terms of the sewer plant. We have chosen to attack that
from 2 standpoints one is that all subdivisions now are required to have pressurized
irrigation. That is an attempt to take the water right that we have from the surface water
and utilize that so we don't lose it at some point in the future. The other thing is an attempt
to make those irrigation things more efficient so that it helps to solve the groundwater
problem. The second part of the pressurized irrigation thing is that in many subdivisions
they will use shallow wells that will draw from that ground water aquifer and have the lawn
watering come from that. Two things will happen then one it helps solve the problem with
respect to the sewer operation and secondly it will lighten the load on our domestic line
so that we won't have a tremendous cost and problems trying to use good domestic water
for watering lawns. That is how we are attacking the problem.
Corrie: Mr. President, I might add too that one of the other things that you were talking
about the size of the homes, the 1400 square foot will be put on the plat.

Corrie: I have one comment that when State Street goes clear to Linder and come around
that you don't have a lot of traffic coming from that high school down there to get to Pine.
That is the only thing that bothers me about opening to Pine Street. 1 am afraid you are
going to see a lot more traffic than anticipate. I hope I am wrong, but it could be that you
are going to get a lot of cruising down Street.

approval in reference to property line problems or anything like that?

I am submitting the final plat for the approval of
a 14 lot single-family, residential subdivision lying
adjacent to the east boundary of Clarinda Fair Sub.,
which is on Pine Street between 11th and 8th. Streets.
The current zoning is R-4, and I have designed all
the lots to be in excess of 9,000 square feet. This
final plat is in conformance with the approved
preliminary plat and meets all the conditions or
requirements, conforms to the requirements and
provisions of the City of Meridian's Zoning Ordinance,
and the improvement plans conform to acceptable

of legal title of not less than two-thirds (2/3) of the platted
lots, by an instrument or instruments in writing duly signed and
acknowledged by them, shall terminate or amend said Protective
Restrictions and Covenants and such termination or amendment shall
become effective upon filing of such instrument or instruments for
record in the office of the Recorder of Ada County,.Idaho. Such
instrument or instruments shall contain proper references by volume
and page numbers to the record of this Declaration in which the
Protective Restrictions and Covenants are set forth and all
amendments hereof.
A. Annexation of Phases. Declarant presently intends to
develop Phases I through IV of the property. The annexed
property (Phases II, III and IV), at the Declarant's sole
discretion, may be used and developed for any purpose allowed
under appropriate zoning regulations. Such other phases may
be brought within the provisions of this Declaration by
Declarant, it's successors or assigns, at any time and from
time to time, without the approval of any owner, the
Association or its Board of Directors.
B. Additional Properties. Subject to the provisions of
Paragraph A above, all provisions contained in this
Declaration shall apply to the annexed properties in the same
manner as if they were originally covered by this Declaration,
subject to such modification, changes and deletions as
specifically provided in any Supplemental Declaration.
C. Procedure for Annexation. The additions authorized under
Paragraph A above shall be made by filing of record a
Supplemental Declaration or other similar instrument with

In no event is any building to be located with setbacks in
violation of City of Meridian zoning regulations in effect at
the time of the recording of these documents. All foundations
shall be of a height to assure and provide for proper slope
and drainage from all lots.
E. Prosecution of Construction Work. The construction of each
dwelling and associated structures shall be prosecuted
diligently and continuously from time of commencement thereof
until such dwelling and associated structures are fully
completed and painted. All structures shall be completed as
to external appearance, including finish painting, within
three (3) months from the date of commencement of construction
unless prevented by causes beyond the control of the owner or
builder and only for such time as that cause continues:
F. Moving of Building Outbuildings. No outbuildings or
y structures shall be moved onto said real property or building
iA site except a new fabricated structure of a type and design
approved by the Architectural Control Committee. Further
provided, that a new fabricated building or structure shall
have a HUD -FHA structural engineering bulletin issued and in
current existence. No trailer houses or mobile homes shall be
parked in any street or within building setback lines. No
f mobile home, basement, tent, shack, garage, barn or other

G. Billboards - Sigmas. No sign of any kind shall be displayed to
the public view on any residential building site except one
professional sign of not more than five (5) square feet
advertising the property for sale or rent, or signs used by a
Iy( builder or the Declarant to advertise the property during the
construction and sales period.
H. Mining and Drilling Operations. No portion of the property
or
any lot shall be used for the purpose of mining, quarrying,
drilling, boring or exploring for or removing water, oil, gas,
or other hydrocarbons, minerals, rocks, stones, gravel, earth,
or steam.
I. Excavation. Defacing of Landscape. No excavation for stone,
sand, gravel, earth, or minerals shall be made upon a building
site unless such excavation is necessary in connection with
the erection of an approved structure thereon.
J. Refuse Disposal - Material Storage. No lot shall be used as
a dumping ground for rubbish or as a storage site for building
or other materials, trash, garbage, ashes and other waste or
refuse. Such materials shall be kept only in suitable

Morrow: My questions would be to Gary Smith, with respect to the letter dated September
15th, have all of those conditions or issues been agreed to by the applicant?
Smith: Just a moment let me check. I think the only thing, Councilman Morrow, that we
need to get some feed back on is that sewer line easement that we were talking about
getting sewer over to that lot on the east side of the subdivision, the undeveloped lot that
fronts onto NW 8th. There is a sewer line that exits the church property which is near the
NE comer of the subdivision that flows to the east between some lots and into a trunk line
that is on the west side of Applegate Subdivision. Now whether or not that sewer line has
enough to serve this property, this undeveloped property to the south of the church I don't
know. But if that doesn't have the necessary depth then the only access that this
undeveloped piece of property to the east side of Canna Lily subdivision would have would
be back into Canna Lily subdivision so that needs to be solved.
Morrow: How about item #4 with respect to the minimum frontage on the culdesac lots?
Smith: That needs to be changed so that it is (inaudible). But it is not as, I looked at the
plat that we reviewed for the applicant, it doesn't appear that would be any kind of a
problem. It just means moving of a lot line, that would take care of it.
Kingsford: Any other further questions for Gary? Any questions for anyone else, Shari or
the developer?
Morrow: There is no development agreement involved with this?
Kingsford: No
Morrow: Mr. Mayor, I would move we approve the final plat for Canna Lily Estates

Re: Final Plat for Canna Lily Estates Subdivision
Dear Councilmen:
I have reviewed the application for The Hollows Subdivision and
find that it includes approximately 14 homes at a median value of
$115,000. We also find that this subdivision is located in
census tract 103.12 and in the attendance zone for Meridian
Elementary, Meridian Middle School and Meridian High School.
Using the above information we can predict that these homes, when
completed, will house 3 elementary aged children, 3 middle school
aged children, and 2 senior high aged students. At the present
time Meridian Elementary is at 108% of capacity, Meridian Middle
School is at 130% of capacity and Meridian High School is at 130%
of capacity.
The Meridian School District is not opposed to growth in our
district, however this subdivision will cause increased over-
crowding in all three schools. There is little opportunity to
shift attendance boundaries since the surrounding schools are
also well over capacity. Before we could support this
subdivision, we would need land dedicated to the district or at
least made available. In addition we would need to pass another
bond issue for the construction of schools.
The cost per student for newly constructed schools, excluding
site purchase price and offsite improvements, exceeds $5,000
per elementary student and $10,000 per middle or high school
student.

We are in a difficult position and need your help in dealing with
the impact of growth on schools.

STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that the first one half inch of stormwater be
pretreated through a grassy swale prior to discharge to the
subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of
this project should obtain current best management practices for
stormwater disposal and design a stormwater management system that
is preventing groundwater and surface water degradation. Manuals
that could be used for guidance are:
