Conditions of Approval: Project is subject toall current City of Meridian ordinances and previous development
applications associated with this site (AZ-08-014, development agreement # 109088809). The issuance of this
CZC does not release the applicant from any previous requirements of the other permits issued for this site.
Design Review: This project has been reviewed for compliance with the guidelines for suburban developments
contained in the City's Design Manual. Staff finds that the proposed improvements to the site are consistent with
the required design standards; therefore, the applicant's request for design review is approved for this site.
Landscaping The Landscape Plan prepared by The Land Group on 8/17/09, labeled Sheet CZC3, is approved
(stamped "Approved" on 9/4/09 by the Meridian Planning Department) with no changes.
The approved landscape plan is not to be altered without prior written approval of the Planning Department. No
field changes to landscape plan permitted; prior written approval of all material changes is required. Prior to final
inspection and sign off for this project, a written certificate of completion shall be submitted to the Planning
Department, prepared by a landscape architect, landscape designer or qualified nurseryman responsible for
the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify
that all landscape improvements, including plant materials and sprinkler installation, are in substantial
compliance with the approved landscape plan.
Site Plan: The Site Plan prepared by The Land Group, on. 8/17/09, labeled Sheet CZC1, is approved (stamped
"Approved" on 9/4/09 by the Meridian Planning Department) with no changes. The approved site plan is not to be
altered without prior written approval of the Planning Department.
Elevations: Elevations prepared by The Land Group on 8/17/09, labeled Sheet CZC2, are approved (stamped
"Approved" on 9/4/09 by the Meridian Planning Department) with, no changes from the Planning Department.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved
specifications and in accordance with UDC 1:1-3A-15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the
Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks
Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees
prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-3B-10-C.5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and 11-3B. Project
engineer/architect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans
with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed
accessible.
Curbing: Per UDC 11-3B-SI, all landscape, areas adjacent to driveways, parking lots, or other vehicle use areas,
must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for
storm water runoff. .
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior
to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall
be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18
Li tin :Lighting shall not cause glare. or impact the traveling public or, neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signa~e: No signs are approved with this, CZC. All business signs will require a separate sign permit in
compliance with UDC 11-3D.
Trash Enclosure: All dumpster(s) must be screened in accordance withUDC-11-3A-12. Trash enclosures must be
built in the location and to the size .approved by SSC.
Handicap-Accessibility: The structure, site improvements and parking areas must be in compliance with all federal
handicap-accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes
must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the
City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. All changes in occupancy need. to comply with the requirements of the Building Department. It is
unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy.
A certificate of occupancy or temporary certificate of occupancy is obtained from the Building Department (208)
887-2211 after inspections are complete and the field inspection record is returned to the Building Department.
Plan Modifications: The approved Site Plan, Landscape Plan, and Elevations, stamped "Approved" on 9/4/09, are
not to be altered without prior written approval of the Planning Department. No significant field changes to the site
or landscape plans are permitted; prior written approval of all changes is required.
Note: If the plat for the subdivision in which this property lies has not been recorded, all subdivision

of the King's Congregation project- located at 1150 E. Pienza St. The CZC application
submitted here is for approval of .the Phase 1 development. The Phase 2 conceptual
layout was included for the completed annexation and rezone, in an effort to give a
master planned look at the overall. property as a vision into the future use and layout of
the property. This specific CZC application is for the Phase 1 development only which is
the reuse of the existing Locust Grove Grange building with improvements to bring the
project into conformance with the zoning and annexation approved for this property on
March 10th, 2009 (AZ 08-014).
The required information for this submittal is listed below with explanations added:

AFFIDAVIT OF LEGAL INTEREST. Attached is a completed affidavit on your form.

ADDRESS VERIFICATION: Attached is the address verification letter from Public Works.
SITE PLAN: Four full size plans and one reduction to 81/2" x 11" of sheet CZC1 are
attached.
Description:
The Phase 1 Site Plan incorporates the use of the existing building on site, no additions
to-the building. The existing building will continue to be used as a meeting place forboth
the Locust Grove Grange and the King's Congregation Church.
The existing building is currently serviced by an existing septic system for sewer and
private well for domestic water. As a condition of the annexation these services are
planned to be converted to city services. The new services for sewer, domestic water,
and fire sprinklers will be completed in accordance with Public Works requirements and
standard details. The existing septic system will be abandoned according to Central
District Health requirements and the existing well will be converted to landscape
irrigation use.
The property is assessed with surface water rights for irrigation by the Nampa-Meridian
Irrigation District; however they cannot provide the needed 24hr service for pressure
irrigation. Therefore, the existing well will be converted to landscape irrigation use as
the source for irrigation water.
All requirements from ACHD in response to the annexation and zoning approval have
been incorporated for this Phase 1 development, and a copy of the plan has been
provided to ACRD for comment. All access point to Victory road are shown to be
removed and access is provided from of E. Pienza St. The site plan includes a 48' ROW
dedication (from centerline of Victory Rd.), a 25' RO,W dedication for the future
extension of S. Mesa Way, a 5' sidewalk set 41' from the centerline of Victory Rd, and
an easement for a turnaround at the termination of E. Pienza St. as requested by
ACHD.
The plan also incorporates a pedestrian pathway providing a pedestrian connection
from Tuscany Village subdivision to the future Elementary School site as well as
Cavanaugh Subdivision..

DESCRIPTION:
The landscape upgrade is shown for the Phase 1 portion of the project only. The
balance of the site will remain as existing pasture until such. time as phase 2
improvements are completed. The design shown meets all requirements of the code -
see the calculation table on the plan including the buffer requirements noted in the
annexation and zoning approval and subsequent Development Agreement. The design
includes the removal of two existing trees and this has been coordinated with Elroy Huff,
who has- viewed the trees and assessed no value to them. The balance of the trees on
site will be retained and protected during construction activities.
Building Elevations: Four full size signed plans and one reduction to 81/2" x 11" of
sheet CZC2 are attached.
DESCRIPTION:
The building elevations submitted with the annexation and rezone are included in this
submittal for the existing building improvements contemplated. These improvements are
limited to cosmetic upgrades and no structural additions to the building.

The required information explaining how the proposal addresses the Meridian Design

ARCHITECTURAL CHARACTER:
The building elevations included herewith, incorporate the use of the existing building on
site, no additions to the building are planned at this time.
The facades, entrances, roof lines, fenestration and mechanical equipment are all
existing to remain. The existing materials are to all be updated with new paint or other
finishes as shown on the elevation .sheet CZC2. The existing blue metal roof on the
building will remain and colors on the building have been chosen to be compatible with
this existing color and provide a harmonized color palate. An awning over the main
entrance door has been added in accordance with D-2.4.2.1.3. and D-2.4.2.1.4. of the
Design Manual. The existing mechanical units for the structure are not visible to the
public and therefore comply with section D-2.4.2.3 of the Design Manual.

This approach to the Architectural Character is consistent with the elevations shown for
the annexation and rezone approved by the City Council.
COLOR AND MATERIALS:
The existing materials are to all be updated with new paint or other finishes as shown
on the elevation sheet CZC2. Color chips have been included on the elevation sheet
CZC2 with the package as .requested.
SITE PLAN AND BUILDING LAYOUT:
The Phase 1 Site Plan incorporates the use of the existing building on site; no additions
to the building are contemplated at this time. The existing building will continue to be
used as a meeting place for both the Locust Grove Grange and the King's Congregation
Church. Because of this reuse of the existing building the building location sections of
the Design Manual do not apply to this project.
Parking areas, have been designed' in accordance with all of section 1.4 of the Design
Manual with the exception of sections 1.4.2.3 (on-street parking) and 1.4.2.4 (plazas
and parking structures).
All requirements from the ACHD in .response to the annexation and zoning approval
have been incorporated for this Phase 1 development, and a copy of the plan has been
provided to ACHD for comment and we have received approval from Mindy Walace. All
access points to Victory Road are shown to be removed and access is provided from of
E. Pienza St. in accordance with section 1.2 of the Design Manual. The site plan
includes a 48' ROW dedication (from centerline of Victory Rd.), a 25' ROW dedication

ayrequires alicense agreement with ACHD. ACRD wouldn't let us landscape their right of way...
Roger Collins is sending you their comments. Church would like to landscape, but may not be able to
afford it now. Please forward the letter from ACHD to me; typically, they don't have a problem with

Good news to some items, see below:
As to the rest, I will have to discuss what the Church can still afford to do. We have exceeded the available funds
for the work done to date.
As you know, times are tough and so is giving for a small church like Kings. We can definitely do some more
painting at this time, but stone veneer is about $15 per square foot and does not provide for enhanced safety of the
building occupants as did many of the other items that inspectors have required.
Please consider my responses below and lets see if we can reach a satisfactory solution required by the City for a
certificate of occupancy that can be limited to self-help and paint by the Church at this time.

of their comments that address landscaping within the ROW:
12. Sheet C4.01. At the detail for the Swale 'E' Section (Victory Road swale), please clarify that grass
can be located on the back-slope only. No grass is allowed in the bottom or the fore-slope (street side) of
the swale.
13. Show the asphalt cut line
As you can see ACHD will not allow us to seed the area from the bottom of the slope of the Swale on the sidewalk
side to the asphalt edge at Victory. We submitted the drawings as approved in the CZC, but are unable to place the
landscaping in question.

PLAN REVIEW COMMENTS
For the Ada County Highway District to accept the plans for the above referenced project, please
complete requirements listed below. An impact fee will be assessed after ACHD accepts the Civil
Plans and also reviews the Architectural Plans.
General Comments
1. Pay $200 Plan Review Fee. Fee must be paid prior to plan acceptance.
2. Provide a note on Sheet C1.00 to specify that all construction in the public right-of-way shall
conform to the current edition of the ISPWC and the ACHD Supplemental Specifications. Specify
that no exceptions to District Policy, Standards and the ISPWC will be allowed unless specifically
and previously approved in writing by the District.
3. Review the vicinity map on Sheet C1.00. It appears as though the site location is shown too far
west (should be at the terminus of E. Pienza Street).
4. Since the only pedestrian outlet at the terminus of E. Pienza Street is on private property, a
sidewalk easement should be provided. Please provide a sidewalk easement for the pedestrian
ramps at the E. Pienza Street terminus. The Easement cannot be processed until proof of
ownership, name, address and title of signatory are provided. Sidewalk easements can be
described with an exhibit showing the easement without need for a legal description. Exhibits must
be on 8'/z X 11 sheets, exhibits must show the following minimum information;
• Section township and range
• Ties to government monuments
• Easement dimensions and widths from the right-of-way
• Surveyor's stamp and signature
Note: Show sidewalk easement and Instrument number on face of plat.
AIIow 30 days for processing.
Easement must be completed prior to plan acceptance.
5. The District will require a license agreement for landscaping (including grass) and drainage facilities
within the right-of-way; agreement must be approved prior to plan acceptance. A link has been
provided at the end of this letter to access the License Agreement application guidelines.
6. Provide dedication of 25-feet of right-of-way along the future S. Mesa Way by Warranty Deed.
Right-of-Way dedication must be completed griorto plan acceptance. Provide legal
description, plan showing dimensioned easements and location on 8.5 x 11 sheet, roof of

7. Provide dedication of 48-feet of right-of-way (or 38-feet with a 10-foot sidewalk easement) along
E. Victory Road by Warranty Deed. Right-of-Way dedication must be completed prior to plan
acceptance. Provide legal description, plan showing dimensioned easements and location on 8.5
x 11 sheet, proof of ownership, name, address and title of signatory for processing. Allow 30
days for processing.
The Professional Land Surveyor who stamps the legal descriptions shall verify all legal
descriptions for right-of-way acquisitions and easements close properly. Submit copy of printed
plot to ensure metes and bounds descriptions are correct: Provide exhibit showing ties to section
corners.
E. Victory Road is an arterial roadway listed in the current Capital Improvement Plan (CIP), ACHD
can purchase the right-of-way, if funds are available. Provide copy of closing statement to establish
SF offer price for right-of-way Purchase and Sale Agreement.
Note: The 25-foot of prescriptive right-of-way and 23-foot of non-prescriptive right-of-way must be
on separate (or identified separately) legal descriptions.
Note: Corridor Preservation Funds are limited at this time.
8. Provide a turnaround easement for E. Pienza Street. Provide legal description, plan showing
dimensioned easement and location on 8.5 x 11 sheet, proof of ownership, name, address and title
of signatory for processing. Allow 30 days for processing.
The Professional Land Surveyor who stamps the legal descriptions shall verify all legal
descriptions for right-of-way acquisitions and easements close properly. Submit copy of printed
plot to ensure metes and bounds descriptions are correct. Provide exhibit showing ties to
section corners.
Easement must be completed prior to plan acceptance.
9. Provide fire department approval for the turnaround at the terminus of E. Pienza Street. Approval
must be submitted prior to plan acceptance.
PLAN-PROFILE Comments
10. Review the 25-foot right-of-way dedication. for S. Mesa Way on the plan view; it does not appear to
scale at 25-feet as shown. All private improvements (i.e. sidewalk, parking area, drainage facilities,
etc.) should terminate at or before the new right-of-way.
11. Please clarify; is the existing fence adjacent to E. Victory Road going to be removed or relocated?
13. Show the asphalt cut line, minimum 2-foot, for the pavement match on E. Pienza Street.
14. Provide centerline survey control with ties to known government or local monuments. Show
centerline stationing. Note: The sidewalk on E. Victory Road must be constructed to match
centerline elevation, or be no more than 1-foot above the centerline.
15. The drainage area detail for E. Victory Road did not show a 1-foot flat landing on each side of the
sidewalk. Please revise detail to clarify.
16. Provide minimum 4-foot wide asphalt ramp to transition sidewalk to edge of pavement at the west
sidewalk terminus.
17. Provide Type. II Terminus Barricades at the sidewalk termini. Per MUTCD Provisions Section 6D.02;.
barricade must include a kick plate at the base of the sign to provide cane detection.
18. Provide signage at the terminus of E. Pienza Street identifying the termination of ACHD right-of-way
and/or the entrance to private property.
19. Please clarify; is any of the existing gravity irrigation going to be affected by the right-of-way
improvements? There is concern because the plan shows an irrigation box on the north side of E.
Victory Road, at the intersection of S. Mesa Way, and no additional detail is provided.
SPECIAL NOTICES and REMINDERS
20. Per Idaho state statute 55-1904, surveyors are required to file a record of survey within 90-days of
performing a survey that changes a boundary line or corner. The professional land surveyor shall
acknowledge understanding of this requirement for legal descriptions submitted to ACHD.
21. Due to the number of comments received, new comments may become apparent on future reviews.
22. Submit one coov of the revised civil plans to ACHD for review. Once approved, the District will
require 1 ea 11x17 and 1 ea 22x34 copy of the final stamped plans.
Standard Requirements:
1. Any request for variance of District policy must be made in writing and reference the appropriate
section(s) of the ACHD Policy Manual or ISPWC. To be valid, the District must approve the
variance request in writing
2. Any private sewer, water or other non PUC regulated utilities must be located outside of the right-of-
way.
3. Any existing irrigation facilities shall be relocated outside of the right-of-way.
4. All utility relocation costs associated with improving street frontages abutting the site shall be borne.
by the developer.
5. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
6. Construct all utility cuts and street repairs per SD-301 and SD-303. A traffic control plan will also
be necessary for any utility cut. Submit all traffic control plans to the District's Construction
Services Division for review and approval. It is strongly recommended that the number of utility
cuts within a street be reduced to the fewest possible.
7. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details.
8. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
9. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
10. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
11. Payment of applicable road impact fees is required prior to building construction in accordance with
Ordinance #202, also known as Ada County Highway District Road Impact Fee Ordinance.
12. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in
the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
13. No change in the terms and conditions of the approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative. and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
14. Any change by the applicant in the planned use of the property which is the subject of this
development, shall require the applicant to comply with all rules, regulations, ordinances, plans, or
other regulatory and legal restrictions in force at the time the applicant or its successors in interest
advises the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at
the time the change in use is sought.

Let me just preface that we don't know for certain until it is actually designed. With that in mind and going off
of what was originally required when the land was rezoned in 2008, that report indicated sidewalk to 6e built no
closer than 41-feet from centerline. Estimating a 5-foot buffer between face of curb to sidewalk you would be
looking at curbing approximately 36-feet from centerline. Again this is all dependent on what actually transpires
with the design. Hope this helps!

5, CONDITIONS GOVERNING. DEVELOPMENT OF SUBJECT
PROPERTY:
5.1 Owner/Developer shall develop the Property in accordance with the

of, and all costs associated with, the sewer and water service
extension and connection to such City services
2. Any and all exisdng domestic wells and/or septic systems within this
project will have to be removed from their domestic service, per City

of Meridian. Wells may be used for non-domestic purposes such as
landscape irrigation.
3- No signs are approved with the subject annexation approval. All
business signs will requite a separate sign permit in compiiance with

the site are prohibited unless approved by ACRD and the City of
Meridian.
7. Prtrvide a pedesuian pathway through this site for interconnectivity
between Tuscany Village Stbdivision and Cavanaugh Subdivision
and for access to the future school site to the west, as depicted on the
' Conceptual Master Plan.. Said pathway shall be con§wc[ed prior ro
issuance of Certificate of Occupancy for the cxisting church building
in Phase 1.

Agreement to Owner/Developer and if the Owner/Developer fail s to cure such far Ime within

g INSPECIiON: Owner/Developer shall, immediately upon completion of

not consistent w/those approved with the Development Agreement; the stone veneer around the lower portion of
the structure has been replaced with a contrasting paint color. Provision #12 of the DA states, "Development of
this site shall substantially comply with the conceptual master plan and building elevations, including construction
materials, submitted with the subject annexation application." In order to change the materials, you would need to
request approval of a DA modification at City Council (application fee is $502).
