approve the minutes of the previous meeting held- January 21,

Kingsford: Not present at this time so we will come back to this
item.
ITEM #2: MAX BOESIGER, INC.: REQUEST FOR EXTENSION OF
PRELIMINARY PLAT ON THE VINEYARDS SUBDIVISIDN W/MODIFICATIONS:
Boesiger: I'm here tonight representing the developer of this
subdivision and we would like to ask tonight that you do two
things for us. Number one that you extend the preliminary plat
approval for the Vineyards Subdivision that was approved last
March 20, 1990. Also that you would approve the modifications
that we have made to the preliminary plat since that date and for
that I would like to spend a few minutes explaining why these
modifications had to be made and why the delays have some about
because of those modifications. Explained original plat to
Council. We have discovered that people are willing to pay for
frontage not depth. We have decided to redesign this project so
that it would more accurately fit what we felt the market was
buying and we did that. We had your staff start looking at this
and just about that time the City adopted a Flood Plain Ordinance
and it was at that time we realized that our entire phase I was
affected by that Ordinance. The reason for that is not because
of low ground but because of a flow restriction there where the
Five Mile Canal runs under Cherry Lane. The solution to that

problem is that we create more flow under Cherry Lane by adding
culverts or increasing the size of the one that was there, that's
a simple solution. The problem is is to get that flood plain
area off of the maps it requires a year to go through the
approval process, the modification of the maps, and so forth and
by the time you get all those approvals done, it's taken a year
to do that. That being the case we can to the realization that we
had to once again change our plan of attack and to start our
first phase in a different portion of the project that wasn't in
this flood plain. As we were ready to submit it again we had
another problem. Nampa Meridian Irrigation District called us
and said that there is a 40 foot strip of land to the south of
the project, along the ditch there that until now has been
farmed, and it's a 40' wide part of ground that Nampa Meridian
Irrigation District doesn't want to maintain forever. It's
actually owned by the Bureau of Reclamation but it's actually
maintained by Nampa Meridian. Once we put our subdivision in
then we will have a 40 foot strip of ground there that nobody is
going to take care. Well the obvious thing to do was to include
that 40' foot piece of ground within our subdivision. So then we
began the process to purchase the forty acres. Each of these
things that have came up have caused us same delay and
modifications to our plat. We did go ahead and plat those five
commercial lots on the corner there. We hadn't remembered that
Meridian had adopted this Ordinance requiring developers to
update their preliminary plats every twelve months. We were
never notified that our preliminary plat was expiring nor did we
remember to have it updated and approved. (Explained further -
see tape) Price ranges will be between 5130 and fi40 thousand
now because of this new design. Can I answer any questions?
Tolsma: There is lot 11 and lot 21 that are a triangle shape off
to the left?
Boesiger: That's on site retention.
Tolsma: I like that layout a lot better than the other one.
Kingsford: A agree I think I like that better. I'm not so sure
we aren't violating our own Ordinance by saying that we'll
accomm6date this preliminary plat without going through that
platting process.
Crookston: I think that the most you could do would be to have
them request a variance from the Ordinance. The Ordinance about
the time limitation is there and has been there for about 10
years.

ITEM iil: HDLLY HOUFBURG, ARTEC, REGARDING SIDEWALK ALONG
FRANKLIN RDAD:
Houfburg: The ACRD is requesting that we produce a sidewalk on
Franklin in front Df our new site. I really don't have a problem
with eventually putting a sidewalk in on this site, however right
now it's going to be the only one there and I don't know what use
it is going to provide at this point. I'm sure that it would be
more cost efficient if we did that all at one time when they
decide to widen the rest of Franklin. So what I'm asking is for
a waiver for that particular request right now.
Kingsford: I have visited with Holly about this and Jack and I
went out to this site last week and have a couple of problems
each way. (Explained further - s ee tape)
Houfburg: We've had some preliminary landscaping plans drawn up.
Yerrington: Are you putting in sidewalk on the west side of your
building?
Houfburg: No.
Tolsma: How is that street sighted, I've been down that street.
Could we put a restriction on it?
Kingsford: I don't have a problem with that. I wasn't aware
that you weren't putting it in on 5th Street. On a subdivision
we would require a 5 foot sidewalk. Is that not required in
Industrial?
Eng. Smith: In the Central Valley Corporate Park Development
they did build that asphalt walkway and I think that was a deal
that was struck with the Highway District and the Developer.
The Motion was made by Tolsma and seconded by Yerrington to grant
the request regarding the sidewalk along Franklin Road contingent
upon a deed restriction if and when Franklin Road is redesigned
or widened that sidewalk be installed at that time.

Request for Extension of Preliminary/Final Plat Approval
and Approval of Modifications to the Preliminary Plat
Dear Mr. Niemann:
This letter is to request the Mayor and Council to take two actions regarding the preliminary
plat of Vinevards Subdivision.
These actions are:
1. Extend the preliminary approval of the Preliminary Plat approved by Council on March 20,
1990.
2. Approve modifications to that approved preliminary plat which improve the circulation
pattern but does include two culdesacs longer than your recent code amendment allows
and some block lengths which are longer than the standard identified by code.
Our basis for these requests have several supporting reasons which we have summarized
below for the review of you and the Council. We will discuss these in more detail at the
Council meeting.
1. After approval of the preliminary plat by Council, we proceeded with engineering of the
first phase and actually completed the design, submitted the plans and the plat to the City
for final approval of Phase One.
By then, the middle of 1990, the market had changed and it was necessary to redesign
the concept to eliminate the long spine road concept which was used in the approved
preliminary. Another feature of that concept which we disliked was the depth of the lots,
with some being extremely deep.
2. After the project had been replanned, we were again preparing to begin the first phase
when the City adopted its Flood Plain Ordinance. When our engineers examined the
flood plain maps they found that our entire first phase would be affected by the 100 year
flood plain designation by FEMA. This was after we had stubbed an 8" water main across
Cherry Lane before ACHD repaved Cherry Lane last Summer.

Our engineers have conducted an extensive flood analysis and decided upon the
necessary improvements to the Nine Mile Creek crossing of Cherry Lane to eliminate the
flood plain problem, but it will take at least a year for the federal agencies involved to
complete their review and approval. So, it became necessary to start our first phase of
The Vineyards farther east than we intended.
3. The federal government owns the right-of-way of the Nine Mile Drain. The Bureau of
Reclamation and Nampa-Meridian Irrigation District recently decided that they owned
surplus width for the drain along the south boundary of The Vineyards and they could
relinguish that land to us. The inclusion of this 40' strip of land created the need for
another redesign of the preliminary plat.
4. Last year, the Ada County Highway District adopted an ordinance imposing impact fees
on new development. The effect and implementation of this imposition are still being
determined and we still do not know how our construction along Cherry Lane frontage will
be treated. We don't know what improvements will be required, nor do we know what
credit, if any, we will receive for making improvement to Cherry Lane.
All these items have combined to cause us considerable, although busy, delay. We have
been trying to move forward, even to the extent of having a first phase designed and
presented to the City for approval. We have also purchased and begun another project,
Crystal Springs, across the street from The Vineyards on property which was not affected by
the problems listed above.
So you see that our delay was not caused by inactivity or lack of interest in the Meridian area,
but instead by concerns over which we have no control.
Therefore, we request the City Council to grant our two requests:
1. Extend the preliminary approval previously granted by the Council in March, 1990, and
2. Approve the modifications which we have made to the preliminary plat which we believe
make it a better place to live and also improve the traffic circulation. These modifications
include culdesacs and block lengths which exceed those listed in your ordinances.
We will be present at the Council meeting on Tuesday to present this request and to answer
questions.

ITEM #6: FINAL PLAT ON PHASE #I OF THE VINEYARDS SUBDIVISION:
Kingsford: Does the City Engineer have co~m~ents?
Engineer Smith: My concern is about access off of Cherry Lane Road , concerning left turn
on the west bound traffic into the subdivision. That is one concern we really couldn't
reach an agreement on because we really didn't have enough information on the development
plans.
Kingsford: Of course that is something that Ada County Highway District has to sign off.
The Motion was made by Tolsma and seconded by Myers to Approve the Final Plat on Phase 1
of the Vineyards Subdivision.

ITEM #7: COVENANTS ON MERIDIAN MANOR #6: TABLED AT LAST MEETING:
Kingsford: We haven't received revised covenants on Item #6.

ITEM #B: COVENANTS ON CRESTWOOD #5:
Engineer Smith: .They make a co~m~ent that this continuance of the covenants from Crestwood
#3 to this subdivision #5 is because it's contiguous ta~_~1o.3, but it is not.
Crookston: There shouldn't be an incorrect statement in the covenants.

City Council of the City of Meridian will hold a public hearing
at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho,

Shearer: My only comment on this would be that I don't think that they need to put
forth that financial commitment, because that's going to be the LID, which I presume
will betaken care of, the four foot walk on Carlton, that's a separate item.
Why aren't we going for a rezone?
Johnson: Carlton is the boundary for Old Town.
Rountree: Just make sure the sign you are going to put out doesn't get into the site
triangle of E. 1st and Carlton.
Shoemaker: We park on Carlton now, we would just delete some of our yard there and just
have it there.
Hepper: Would the garage there have to be moved?
Shoemaker: No, the driveway is quit wide there.
Alidjani: So what you are proposing is the parking would be on Carlton Street.
Shoemaker: Right, I think it would look slot nicer if we could keep it off of East First.

ITEM #3: PUBLIC HEARING: PRELIMINARY PLAT ON THE VINEYARDS SUBDIVISION:
Johnson: Is there a representative here, please come forward and be sworn in.
Max Boesiger, 1399 E. Monteray Drive, Boise, was sworn by the Attorney.
Boesiger: Our firm developed Sunnybrook Farms here in Meridian, also some others in Boise.
As you know it's located at the intersection of Cherry Lane and Linder. We have to
compete with Boise and we have some expenses here that we wouldn't have in Boise,

one of those is the fact that we have to develop an irrigation system, pressurized
system here in Meridian that's not yet required in Boise, also the domestic water system,
in Boise the system we have there part of the developers costs are reimbursed as hookups
are brought on, plus the system here itself is more costly than the one in Boise.
Since we can't really compete well on a cost basis, we believe that by putting in a
better designed product, one that is more better suited for the market place we think
we can compete with that Boise market. We plan to do that with deeper lots. These
will average about 130 ft deep. We are tageting houses that range from $85,000 to
$130,000., lot prices will range from $18,000 to $22,000. Going up and down Cherry Lane
and Linder where our project abutts to those streets, there will be about a 7ft. distance
between back of sidewalk and the property line. We like to burn that up so that the
property line is right about the top of that harm, and then landscape with sod, trees and
shrubs or whatever that 7 ft. distance. We also intend to put in a real nice lighted
entry sign with landscaping around it also. Explained further about the Co~miercial
corner. We intend to plat in May and start foundations hopefully in June. We expect that
we will probably be finishing up the last phase in 1998.
Rountree: Where is the sign located?
Boesiger: In the corner where it is more visible.
Hepper: Are we addressing the irrigation.
Crookston: I have a question on the fence on the bur-, how tall of a fence are you talking
about?
Boesiger: I should think four feet possibly five feet.
Crookston: The height including the fence and the bunt, is maximum 6 ft.
Rountree: One point of clarification, that harm and f~_nce is around the entire perimeter.
Boesiger: Just about, there is an existing house, we c;ouldn't be doing thst of course.
Johnson: Thank you very much. I will now open the Public Hearing at this time.
Gary Lee, 1990 Turnberry Way, Meridian, was sworn by the Attorney.
Lee: I am with JUB Engineers, as Max indicated we are the engineers on this project.
We have worked with Max Boesiger inc. in preparing the preliminary plat and all the
documents you have on this project. The project is 70'~ acres total, there is about
66'Z acres which is residential. There is a trunk line sewer that runs along the south
border of the project along the west that falls back of the Nine Mile Drain and that
will be our tie in as far as sanitary sewer. On the west end a 20.ft. wide public right
a way that Mr. Smith had mentioned in his camients, we had planned to run the sanitary
sewer and the storm drain line. I have discussed this with ACRD and I think we are
going to reach a conclusion that we can use an easement there. There is an existing 10"
main that runs along Linder and also along Cherry Lane, we'll tie into that main line
on Elm Drive with an 8 inch, then along the road and connect back in at Cherry Lane on the
Northwest corner of the property.

Lee: Went over ACHD requirements, irrigation, etc. (TAPE ON FILE)
Clerk Niemann: I might mention that Gary submitted his comments on the variance request
and he didn't have any problem with letting them defer that irrigation until we had
some, doing the dry lines and stuff, and also on the 70 ft. lot frontages.
Rountree: You show a utility easement along Nine Mile Drain on the West end, is that going
to be fenced or just be in somebody's back yard and platted that way.
Lee: The easement will be there, the fence will go along the lot side of the easement
thereby leaving the access open to the Nine Mile Drain.
Rountree: On the south side along that same corridor, I was wondering what the distance
was for Nine Mile Creek, but that must be the main line sewer. There is a corner in the
southwest corner of the area that's not part of the development it's between Nine Mile
Drain and the Rutlege Drain, I think it's on the back portion of the Church, .is that going
to be land lor]ce~br is that owned by adjacent property or what's the situation with that?
Lee: As far as I know it's not land locked.
Rountree: You said you didn't have any problems with ACHD's cou[nents, would you run
by what your proposals is :for curb, gutter and sidewalk on the perimeter of the project?
Lee: That will be a widened section. we will be adding a lane on the south side
of Cherry Lane.
Rountree: Have you given any consideration to a turn lane or a turn median?
Lee: What they are thinking about doing is painting the center media and go with the
three lane section. There is also an irrigation ditch that has to be piped.
Johnson: How many lots are th~_-z in the first phase?
Lee: Twenty Seven (27) Lots.
Rountree: an your appllicatiori you indicate there is 3z acres set aside for cacmercial,
and we have an action next month that indicates that is 4.5 acres.
Lee: Probably the difference is the 4.5 measures to the center line and the 3z didn't.
Rountree: Are you sure that you mailed notices to all the people on the mailing list?
Hepper: Is the irrigation system something we want to discuss on the preliminary plat?
How are these people going to water their yards for the next tvu or three years until these
dry lines are activated?
Clerk Niemann: City Water I suppose if the Council approves.
Hepper: Would there be some sort of security or bond or something to insure that
that would be completed?
Boesiger: That's a reasonable request.
Rountree: In You covenants are you going to have mandatory membership in the homeowners
association and some kind of tool that the homeowners association can land on these -

people to take care of those things. What kinds of thoughts do you have on the irrigation
system:
Lee: We have an access right now at the SE corner right off Linder next to the Nine Mi e
Drain and everything irrigates to the west, we can pick that water up there and by
sizing the pipes large enough we can deliver the water pretty effectivly from one point.
There is a delivery point that crosses Linder.
Boesiger: I might just say that there is two obstacles in the irrigation system that I
think we face, and the two major issues are #1 the irrigation water comes into the ditches
about a month after you want to start watering your lawn, #2 is the screening. We need
to resolve these problems as a community.
Crookston: Did I understand that ACRD has dropped this requirement about .making
Burgandy a culdesac?
Johnson: It's an either or situation.
Crookston: I think you need-
Johnson: Is there anybody else that wishes to testify, if so please come forward and be
sworn.
Louise Bird, 1915 W. Cherry Ln., Meridian, was sworn by the Attorney.
Bird: I'm the one that is effected the most by this. I've owned that land all my life,
that land is some of the most prime farm land in the Meridian area. That land has been
improved, it's been leveled it has approximately 2000 running feet of cement ditches on
there, which is not that big of a deal until you figure that the government paid for those
ditches, there is no legal obligation for the new owners to repay the government for that
cost on those ditches, but there is a moral obligation there as far as any of us who have
farmed ar; the government helped with those ditches. I won't go into the wildlife that's
there etc. When sitting at the intersection of Cherry Lane and Linder you would look
directly .:,to the houses back~~ards, the most unkept part of a house. Voiced some concerns
about the landscaping & traffic. How about some real concerns, how about City services,
right noM we are running our Fire Department on a strictly volunteer basis, is it fair to
put the resaonsibility of 209 more homes onto the backs of volunteers. The Police
Department has twelve on it's staff, that's a pretty limited staff considering that big
of an addition. Also some concerns about school overcrowding. Ffiat are the kids going to
do for recreation? I hope that this subdivision would be completed in a timely manner
and not just let go for the weeds. On your lots 6 & 7, has our septic tank drain field
water stands there in the spring when there is a high water table. i would hate to owners

Dear Gary:
I have reviewed your submittal with my water and sewer
superintendents and, in accordance with the policies and
standards of the Meridian City Public Works Department,
have the following comments:
SEWER: The access shown between Lot 7,B1k.3 and Lotl,Blk.4
needs to be fenced and gravelled for all-weather
access. What is the ownership of this parcel?
WATER: The water line sizes are shown on the review draw-
ings.
• The Valve, hydrant and blow-off locations are shown
on the review drawings.
• When water lines are discontinued at phase boundaries
a blowoff may be needed with a valve to allow for
continuance and uninterrupted service to the deve-
loped lots. On Elm Drive, the phasing will require
line, valve and tee installation at the next adja-
cent intersection.
STREETS: Street light locations need to be shown on the
master plan. A bond or letter of credit for $1200.
per light must be filed with the City Clerk prior
the City signing of the final plat.
• Submit documentation of who will maintain the sub-
surface disposal pits.
• The street names need to correspond to the approved
names from the Ada County Street Name Committee.

On February 8, 1990, the Commissioners of the Ada County Highway District
(hereafter called "District") approved the Preliminary Plat subject to the
conditions as stated below:
SZTE SPECZFZC CONDITIONS:
1. Dedicate 33-feet of right-of-way from the centerline of Cherry Lane
abutting parcel.
2. Dedicate 33-feet of right-of-way from the centerline of Linder abutting
parcel.
3. Curb, gutter, 5-foot sidewalk and match paving shall be constructed on
Cherry Lane abutting parcel. Improvements shall be constructed to a
52-foot back-to-back street section.
4. Curb, gutter, 5-foot sidewalk and match paving shall be constructed on
Linder abutting parcel. Improvements shall be constructed to a 52-foot
back-to-back street section.
5. widen the intersection of Cherry Lane and Linder Road to an 80-foot
right-of-way and a 65-foot roadway section in compliance with District
policy.
6. Revise the intersection of Burgundy and Sauvignon to a "tee" type inter-
section without the protuberant, or make Burgundy Avenue a cul-de-sac.
STANDARD CONDITIONS:
1. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies.
2. Dedicated streets and drainage systems shall be designed and construct-
ed in conformance with District standards and policies.

3. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACHD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
4. Written approval shall be obtained from the appropriate irriga-
tion/drainage district authorizing storm runoff into their system.
5. Obstructions (utility facilities, irrigation and drainage appurte-
nances, etc.) shall be relocated outside of the proposed street improve-
ments. Authorization for relocations shall be obtained from the appro-
priate entity.
6. Existing irrigation and drainage systems shall be continued across
parcel.
7: Three sets of street construction plans shall be submitted to the Dis-
trict for review and appropriate action.
8. Direct lot or parcel access to Cherry Lane and Linder is prohibited, in
compliance with District policy. Lot access restrictions shall be
stated on the final plat.
9. A right-of-way permit must be obtained from ACHD for all street and
utility construction within the public right-of-way. Contact Quality
Control at 345-7667 (with zoning file number) for details.
10. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of
Engineering Services within 15 calendar days of the original Commis-
sion action. The request shall include a statement explaining why such
a requirement would result in substantial hardship or inequity.

ment Services section at 345-7662.
In order that the Final Plat may be considered by the District for accep-
tance, the Developer shall cause the following applicable / standard condi-
tions to be satisfied prior to District certification and endorsement:
1. Drainage plans shall be submitted and subject to review and approval by
the District.
2. If public street improvements are required: Prior to any construction
within the existing or proposed public right ofway, the following shall
be submitted and subject to review and approval by the District:
a. Two complete sets of detailed street construction drawings pre-
pared by an Idaho Registered Professional Engineer, together
with payment of plan review fee.

b. Execute an Inspection Agreement between the Developer and the
District together with initial payment deposit for inspection
and/or testing services.
c. Complete all street improvements to the satisfaction of the Dis-
trict, or execute Surety Agreement between the Developer and the
District to guarantee the completion of construction of all street
improvements.
3. Furnish copy of Final Plat showing street names as approved by the
Local Government Agency having such authority together with payment
of fee charged for the manufacturing and installation of all street
signs, as required.
4. If Public Road Trust Fund deposit is required, make deposit to the
District in the form of cash or cashier's check for the amount speci-
fied by the District.
5. Furnish easements, agreements, and all other datum or documents as
required by the District.
6. Furnish Final Plat drawings for District. acceptance, certifications,
and endorsement. The final plat must contain the signed endorsement of
the Owner's and Land Surveyor's certification.
7. Approval of the plat is valid for one year. An extension of one year
will be considered by the Commission is requested within 15-days prior
to the expiration date.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that the
Planning and Zoning Commission of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 o'clock p.m., on February
13, 1990, for the purpose of reviewing and considering the

of Meridian Subdivision Ordinance for a Preliminary Subdivision Plat submittal
for the above proposed subdivision. As stipulated by said ordinance, please find
enclosed:
1. 27 copies of the completed Preliminary Plat Application.
2. 27 copies of the Preliminary Plat, 24" x 36" at a scale of 1" = 100'.
3. 27 copies of the Vicinity Map, 814" x 11" at a scale of 1" = 300'
showing properties within 300' of the proposed development.
4. 27 copies of the General Vicinity Map, 8S4" x 11" showing surrounding
areas within one-half mile.
5. 7 copies of the Conceptual Engineering Plan, 24" x 36" showing all
existing and proposed public improvements.
6. 3 copies of the Subdivision Legal Description.

for the Preliminary Plat Application Fee.
As noted in the Preliminary Plat, we hereby request two waivers to the ordinance
requirements. First, since the single-family lots are quite large, an average
of approximately 10,000 square feet, with a minimum of 8,500 square feet, we wish
to request that the minimum lot Frontage of 70 feet be reduced for a few of the
larger cul-de-sac lots. Second, with the new ordinance requirement of separate
irrigation facilities, we would propose that the first three phases of the
development, about 90 lots, be constructed with "dry" irrigation lines, with the
installation of the irrigation pumping facility during Phase 4 of the develop-
ment. As we discussed, a formal Variance Request will follow.
