Sunshine Addition PP & FP. DECLARATION OF PROTECTIVE CO~ANTS CONDITIONS AND RESTRICTIONS AFFECTING DIANA J. STANLEY SURVEY WHEREAS, DIANA J. STANLEY, an Individual, hereinafter referred to as "Declarant", is the owner of certain real property situated in the City of Meridian, in the County of Ada, State of Idaho, known as DIANA J. STANLEY SURVEY. WHEREAS, DIANA J. STANLEY SURVEY is a duly recorded survey; and. WHEREAS, the Declarant desires to declare of public record certain Protective Covenants, Conditions and Restrictions upon the ownership of said property: NOW THEREFORE, in consideration of the foregoing, the Declarant does hereby declare that the '"~'.lr.,~i_n,, Protective Covenants, Conditions and Restrictions: 1. PROPERTY SUBJECT TO THESE COVENANTS: Declarant hereby declares that all of the real property described above is held and shall be held, conveyed, hypothecated, encum- bered, used, occupied, and improved subject to these covenants. B. LAND CLASSIFICATIONS AND DEFINITIONS 1) Parcel A Parcel shall be any plot or tract described in the above recorded survey. All said Parcels shall be used for resi- dential purposes. C. BUILDING RESTRICTIONS 1) Residential Use No ,Parcel .shall be improved except with a dwelling or a residential structure designed to accommodate no more than a Page 1 all •sessments levied by the i~gation entity; c) that the purchaser shall be responsible to pay such legal assessments; d) that the assessments are a lien on the land within the irrigation entity. 7) Fences No fence or wall exceeding six feet in height shall be erected or placed or permitted to remain on any Parcel. Fences shall be well constructed of suitable fencing materials, and conform to the City of Meridian ordinances. 8) Offensive Activity No noxious or offensive activity shall be carried on upon any Parcel, nor shall anything be done thereon which may be, or may become an annoyance or nuisance to the neighborhood. 9) Business and Commercial Uses No trade, craft, business, profession, commercial or similar activity of any kind shall be conducted on any Parcel, nor shall any goods, equipment, vehicles, materials or supplies used in connection with any trade, service or business be kept or stored on any Parcel, excepting the right of any home- builder and the Declarant to construct residences on any Parcel, to store construction materials and equipment on said Parcels in the normal course of said construction. 10) Sians No sign of any kind shall be displayed to the public view on any Parcel or improvement, except one professional sign of no more than six square foot for advertising the property for sale or rent. This does not apply to signs used by the builder during the construction and sales period. il) Parkina Parking of boats, trailers, motorcycles, trucks, truck- campers, and like equipment shall not be allowed on any part of said property nor on public ways adjacent thereto excepting only within the confines of an enclosed garage, storage structure, or screened area, and no portion of same may pro- ject beyond the enclosed area. Page 3 single ~ily and structures nor~y accessory to such residences, excepting the right of any homebuilder and the Declarant to use any single family residence as a model home. 2) Dwelling Size The ground floor area of the main structure, exclusive of one- story open porches and garages, shall not be less than 1,400 square feet for a one-story dwelling, nor shall the main level be less than 900 square feet for a dwelling of more than one story. Each single family dwelling shall be provided with a private garage of adequate size to shelter not less than two standard size automobiles. 3) Setback Restrictions All dwellings constructed upon said property shall conform to the setback restrictions of the City of Meridian. 4) Easements Easements for the installation and maintenance of utilities are reserved as indicated in the recorded plat. Within these easements, no structure or planting or other material shall be placed or permitted to remain which may damage or interfere with the installation and maintenance of utilities. The easement area of each Parcel and all improvements in it shall be maintained continuously by the owner of the Parcel except for those improvements for which a public authority or utility company is responsible. 5) Temnorarv Structures No structure of a temporary character, trailer, basement, tent, shack, garage, barn or other outbuilding shall be used on any Parcel at any time as a residence, either temporarily or permanently. 6) Irrigation In accordance with the provisions of Idaho Code, Section 31- 3805, the Declarant assumes no responsibility for providing water for irrigation purposes other than through the domestic system, and the purchaser acknowledges the following: a) that irrigation water deliveries have been provided; b) that the purchaser of the Parcel must remain subject to Page 2 '1~1 Animals • • No animals, livestock or poultry of any kind shall be raised, bred or kept on any Parcel, except that two dogs, cats or other household pets may be kept provided that they are not kept, bred or maintained for any commercial purposes and provided they are not a nuisance to neighbors, and conform to the City of Meridian ordinances. 13) Trash and Rubbish No part of said property shall be used or maintained as a dumping ground for rubbish, trash, garbage or any other waste. No garbage, trash or other waste shall be kept or maintained on any part of said property except in appropriate sanitary containers for proper disposal and out of public view. All incinerators or other equipment for the storage or disposal of such materials shall be in a clean and sanitary condition. 14) Construction Completion Construction of any dwelling shall be completed including exterior decoration within eight months from the date of the start of such construction. All Parcels shall, prior to the construction of improvements thereon, be kept in a neat and orderly condition and free of brush, vines, weeds, debris, and the grass thereon cut or mowed at sufficient intervals to prevent creation of a nuisance or fire hazard. 15) Exterior Finish The exterior of all construction on any Parcel shall be designed, built, and maintained in such manner as to blend in with the natural surroundings, existing structures and land- scaping within the adjoining area. Exterior trim, fences, doors, railings, decks, eaves, gutters, and the exterior finish of garages and other accessory buildings shall be designed, built and maintained to be compatible with the exterior of the structure they adjoin. 16) Landscape Completion All front yard landscaping must be completed within eight months from the date of occupancy of the residence constructed thereon. GENERAL PROVI~NS • 1) Term These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of thirty (30) years from the date these covenant& are recorded, after which time said covenants shall be automa- tically extended for successive periods of ten (10) years unless an instrument signed by a majority of the then owners of the Parcels has been recorded, agreeing to change said covenants in whole or in part. 2) Enforcement Enforcement shall be by proceedings at law or in equity against any person or persons violating or attempting to violate any covenant either to restrain violation or to recover damages. 3) Severability Invalidation of any one of these covenants by judgment or court order shall in no way affect any of the other pro- visions which shall remain in full force and effect. There is an additional ditch along the north boundary which would also be along the proposed ten foot easement for the benefit of sewer irrigation water which would stay in place for the benefit of some homeowners that are on West Washington Street. Kingsford: Anyone else to testify? Mike Farley, 1222 W. 4th, was sworn by_ the attorney. Farley: Questioned the access for children to get through this proper±y to get to school. Can easement be used for children to go back and forth to school? Allison: This is one thing that should be addressed and I have talked to Dan Mabe about this specific thing and that is part of the reason they were selling the property is because they were having a problem with people parking on W. 4th Street and so forth. Upon reviewing with Dan Mahe, he indicated that if in fact we did provide an easement which would be fine, that they would want that easement fenced and they would want a gate provided at that point where they enter the school. Kingsford: but he's not talking about a problem as far as children access? Aii:san: Children access during the school year is absolutely no orebiem. ~;ing=ford: Anyone else to testify? Trudy Hadley, 225 Cherry Ave., was sworn by the attorney. Hadley: Expressed concern about children walking to school if not allowed to use this access. Kingsford: Anyone else to testify? No response. Crookston: Have concern about the waiver requirements. I think that if you ar-e going to grant the short subdivision plat MERIDIAN CITY COUNCIL FEBRUARY 18, 1992 PAGE t3 Roy Johnson, 4658 Yorgason, Boise, was sworn by the attorney. Johnson: I'm sure you have reviewed the plat, we have 140 lots proposed on the forty acres called the Peterson Place off Meridian Road. We are planning on doing the project in two phases, 70 lots being the first phase and approximately 70 lots in the second phase. The south slough project has the main line which is going right through here to be done sometime in the next 90 days or so. I have read the Engineer's comments and I have no problems with anything. One of the things that we went through with the planning commission was the access. We have two access points on Meridian Road, we have proposed one access to the north through the project and none to the south. The Engineer and the Clerk have both stated they would like to have an access to the south connecting into the subdivision so we can have both sewer and water access. We've talked to RCHD and they have no problem with us not having the access to the north and using that access and placing it in the south so we have provided the access as requested by the City. I will answer any questions you may have. Corrie: The Fire Department made a comment about the entrance into Meridian Manor Sub., is that going to be an entrance? Johnson: That's what I'm talking about now. Kingsford: Any other questions? Anyone else from the public who would like to offer testimony on this issue? Na response. I will close the Public Hearing. You have the Findings before you, any questions on those? Tolsma: How about the comments from Beledco. Johnson: Their comments pertain to the road we are talking about putting into their subdivision. Engineer Smith: My request was to have that access from Meridian Manor into Waterberry in order to gain access for a sewer line from Meridian Manor to the south slough sewer so we wouldn't have to construct or the developer would not have to construct a lift station which we don't want to do. The request by the developer to eliminate the access to the north side though, I wonder if we are going to have a problem them with block length then on the north boundary of the subdivision. The access to the south slough sewer from the property to the north of the south slough MERIGIAN CITY COUNCIL FEBRUARY 18, 1992 PAGE 12 procedure, I think that's fine but you need to make a finding under the ordinance that the parcel's have the appropriate improvements on the lots and then on the other request some of the subdivision requirements if you don't find that then it needs to have a request for a variance for those other items they want waived. Giesler: Withdrew his motion to approve. Yerrington: Withdrew his second to approve. The Motion was made by Giesler and seconded by Yerrington that we approve of the preliminary and final plat short version with findings to warrant the improvements being satisfactory. Each parcel containing in excess of 12,000 sq. ft., we received all the requirements under ACHD, the City, Meridian Sewer Department and the Engineer's, we are here asking tonight that you consider under section 9-604A that when an existing subdivision lot be divided only into two parcels that you can waive a normal subdivision requirements and are asking that you consider waiving the requirements under ACHD since there 15 already an existing roadway, sewer on site, water on site, power, gas and all normal utilities required. Riso on the plat we have provided for easements for additional utilities, one of which is to be built in the extension of the sewer line from the north part of the property back to the second parcel. We further would abide by the requirements as outlined by the City Engineer. Site drainage plans and calculations shall be submitted for review and appropriate action by ACHD. The proposed drainage system shall re- tain all storm water on-site. 8. Design data for proposed access to public streets shall be provided for review and appropriate action by ACHD. 9. Driveways shall be located a minimum of 5-feet from the side lot proper- ty lines. 10. Water service to these 2 lots will be from an existing city main line in W. 4th St.. Developer to contact Bruce Stuart (888-5242) for water service location. 2. Sewer service will be to an existing city sewer lateral that has its upper terminus near the northeast corner of Lot 1. This lateral does not extend into W. 4th St. therefore, we must have access to the manhole from W. 4th St.. To accomplish this we need a 16 foot wide sanitary sewer easement along the north boundary of lot 1. We are asking that one of the conditions, the irrigation be waived on this application. The pressure irrigation is just quite expensive for a four lot subdivision. If there are any questions I'd be glad to answer. Kingsford: Your proposing to sprinkle with City water? Tealy: Correct. Kingsford: So you choose to go with the funding of the City well's for that then? Tealy: i believe that's the option that we would go with. How does that work now? Kingsford: We are setting up basically a fund that will allow us to drill wells to satisfy that irrigation requirement. Tealy: What is the cast per lot? Kingsford: We haven't decided that yet. Rny other questions? Carrie: What's the dwelling size? Tealy: 1300 square foot minimum. uiesier: Do you know anything about this problem the Fujii's talk about with the leak on the box? Tealy: Mrs. Fujii can probably explain that. But what I believe it is is there is a main line that runs along the north side of Cherry Lane and it has a pressurized irrigation system and some of the boxes that carry the water to the north into this land to the north of Cherry Lane leak and cause quite a bit of water to collect in the lower portions of the lots 1n there. Giesler: Is this the same one that was brought up when we were discussing Deerfield? Tealy: It is the same one that has come up in Deerfield and Field of Dreams Subdivisions. The only solution is to some how seal that main pressure line along Cherry Lane and I don't know whc is responsible for that. MERIGIAN CITY COUNCIL FEBRUARY 18, 1`392 PAGE 12 procedure, I think that's fine but you need to make a finding under the ordinance that the parcel's have the appropriate improvements on the lots and then on the other request some of the subdivision requirements if you don't find that then it needs to have a request for a variance for those other items they want waived.
