Here is a photocopy of the map I have on file of your- property, with a legal description, and a copy of the Sunburs± No. Subdivision that is located adjacent to your north boundary line. Yo~_Ir^ map distance, from the section corner at Ten Mile RoadiCherry Lane Road to your northwest property corner is 512.50 feet. The distance shown on the Sunburst No. 3 plat, from this same section corner to the subdivisions southwest corner, is 512.53 feet, Therefore, the map distance, to the same corner, on your survey map and on the Sunburst Plat are the same within 0.03 foot. To me this says your north boundarv line and Sunburst No. 3 Subdivisions =_outh boundary are the same line. According to the survey notes on the map done for Rich Allison, from whom you purchased Parcel "A", the northwest and northeast pr^operty corners set were "witness corners". These witness corners are 7.50 feet from your actual property corner. I am assuming, based on what you have said, that yoLlr fence is actually installed on a line between the witness corners and not the property corners. According to the legal description of Parcel "A", prepared by Hubble Engineers for Rich Rllison, the 7,50 foot wide strip shown on the map is an irrigation easement. I don't know where the ditch was, before it was moved by Hlmemiller, bl.it one could make the sss~_imption the 7.50 foot wide easement was for the ditch, As I mentioned during your visit, a developer is required by Ordinance to pipe any ditch crossing the developing property and a developer cannot move a ditch outside their property boundary, without adjacent property owner approval, to avoid piping. One of my biggest concerns was the easement width of the sanitary sewer cressir,g that lot, whether or not there's enough roam there to accommodate the sewer easement plus the house setbacks and so forth. The provided plat of Sunburst #3 has no drainage details so we cannot provide comment other than, per our comments to the previous Sunburst subdivision plat reviews, "We request prompt Reclamation and Nampa Meridian Irrigation District review of storm water drainage structure design. Assuming BMP infiltration/ detention and treatment satisfactory to Reclamation and the Nampa Meridian Irrigation District, we probably won't require a permit for ACHD's increased storm water discharges to these United States drains at existing points." While we assume on-subdivision storm water detention and treatment, another alternative would be downslope facilities nearer the drain(s) treating and detenting ACHD flows from this and other urban areas. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. We require support for these revenue sources from developers and other interests seeking planning and zoning approval for residential projects. If this support is lacking then we ask that additional residential development be denied. School bus service may be restricted if adequate turnarounds and loading areas are not provided. Residents cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. we ask that you assure the developer will provide walkways, bike paths and safe pedestrian access.
