facility for purposes of silt and grease detention. The pond outlet is
located in an in-line position with the inlet. This type of arrangement will
not satisfy the needs of Nampa & Meridian Irrigation District in regard to
discharge. Please resubmit the design for final approval.

Eng. Smith: I sent the minutes out to the committee members and
I'm waiting for a response from them to make sure everything is
the way it was discussed. I had previously contacted the Highway
District requesting studies on Locust Grove with emphasis on
signalization at Locust Grove and Fairview. I specifically
requested a counter be placed on Locust Grove north of Fairview
and also one north of Chateau so we can see what kind of traffic
there is being generated on there right now.
The Motion was made by Talsma and seconded by Giesler to approve
the preliminary plat on Kearny Subdivision.

Cowie: On item ii7 on the comments are they going to put that
turn around over there for the fire department?
Max Boesiger: We do intend to put that in. What we will do is
put in a temporary turn around just beyond the end of this
platted subdivision for service vehicles and so forth to turn
around in.
Tolsma: You didn't have any other problems with any of the other
comments?
Boesiger: I don't believe so.
Tolsma: Did you see the School District's comments about the
buses?
Boesiger: Yes. No problems.

Corrie: Settlers Irrigation said that the pipe is in place but
not been connected to the open ditch and they haven't received
the plans from Roy Johnson for the concrete inlet box, those two
things are on their January 13th letter.
Johnson: Yes that's correct, but the ditch has been connected
but there is a box that we have to put right at the beginning and
I do not have that to them but will try to get it to them within
the next few days.

Right now we have access to the lift station off of Linder Road
on a gravel road but there wasn't enough room left down there to
turn around and so once the maintenance man gets into the lift
station then the only way to get out is to back all the way out
to Linder. So what I was proposing is that the access road,
which is a canal bank road for the irrigation district, that it
be maintained in an all weather situation so we can go on down to
this phase and come in through the subdivision and go back out on
Linder.

Idaho, hereby certify that at a special meeting of all the members
of this corporation, called for the expressly stated purpose, held
at the office of the corporation in Boise, Idaho. on January 3,
1992, at which meeting all of the members of the .corporation were
present and voted, the following resolution was, by unanimous vote

1. Article II. subsection 1 shall read upon amendment as

record will be SUNBURST SUBDIVISIONS NO. 1 and NO. 2 with
additional property to be annexed to this Corporation by filing
for record of plats and additional Protective Restrictions and
Covenants referencing this Corporation.
2. Article IV. section 1., subsection (a) shall read upon
amendment: a. The record title owners of all or any portion of
the lots in SUNBURST SUBDIVISIONS NO. 1 and DTO. 2 in Ada County,
Idaho, according to the official plats thereof filed, or to be
filed, in the office of the County Recorder of Ada County, Idaho,
whose Declaration of Protective Restrictions and Covenants
reference this Corporation, shall automatically be Members of this

D. Hunemiller the developers of SUNBURST SUBDIVISIONS NO. 1 and
No.2. I hereby certify that the legal documents for the above
Development are in compliance with all of the following RUD legal
requirements.
I. Articles of Incorporation of SUNBURST HOMEOWNERS
ASSOCIATION, INC.
1. Every person or entity who is a record owner of any
lot is entitled to membership and voting rights in
the association. Membership is appurtenant to, and
inseparable from, ownership of the lot.
2. If the association is dissolved, the assets shall
be dedicated to a public body, or conveyed to a
nonprofit organization with similar purposes.
3. Amendment of the Articles of Incorporation requires
the approval of at least 2/3 vote of the lot owners.
4. Annexation of additional properties, mergers and
consolidation, mortgaging of Common Area,
dissolution and amendment of the Articles, requires
prior approval of HUD/VA as long as there is a Class
B membership. (There are no Class B memberships.)
II. Declaration of Covenants of SUNBURST SUBDIVISIONS NO.1
and No.2.
1. A legal description of the Development is
contained therein.
2. All lots in the Development are subject to the
covenants.
3. Every owner has a right and easement of enjoyment
to the Common Area, which is appurtenant to the
title to the lot.
4. The lien of any assessment is subordinate to the
lien of any first mortgage (deed of trust).
5. Mortgagees are not required to collect assessments.
6. Annexation of additional properties, dedication of
Common Area, and amendment of this Declaration of
Covenants, Conditions and Restrictions, requires
HUD/VA prior approval as long as there is a Class
B membership. (There are no Class B memberships).
7. Failure to pay assessments does not constitute a
default under an insured mortgage.
8. The covenants assure lot owners of automatic
membership and voting rights in the association.
9. Each lot owners is empowered to enforce the
covenants.
10. The approval of at least 2/3 of the lot owners is
required to amend the covenants.
11. The Common Area cannot be mortgaged or conveyed
without the consent of at least 2/3 of the lot
owners (excluding the developers).
12. If ingress or egress to any residence is through the
Common Area, any conveyance or encumbrance of such
area is subject to lot owner's easement.
13. There is no provision in the covenants which
conflicts with the HUD requirement that the Common
Area, if any, shall be conveyed to the association
free and clear of all encumbrances before HUD
insures the first mortgage in the development.
14. Absolute liability is not imposed on lot owners for
damage to Common Area or lots in the development.
15. Class B membership provisions do not apply for the
reason that there are no Class R memberships.

1. The By-Laws are consistent with the Articles of
Incorporation and Declaration of Covenants.
2. The provision on HUD/VA veto power does not apply

I have reviewed this plat in accordance with city ordinances
and policies and have the following comments:
1. Street name approval for "W. Duke Dr." needs to be obtained
from the Ada County Street Name Committee.
2. Show an easement at the north end of lots 1-2, block 6
for the street drainage detention pond. Also show an
easement for access to the detention pond.
3. Renumber the lots in Block 3 and Block 1 to conform with
the sequence started in the No.l subdivision.
4. Block 4 shown should be shown as Block 5.
5. The exterior boundary distance shown on the subdivisions
east side should be from the property corners to the
Initial Point.
6. The Sunburst Subdivision No.l name should be shown as
adjacent platted land.
7. The westerly property line distance of Lot 29-Block 3
needs to be corrected from what is shown.
8. A note needs to be added on sheet 2 of this plat, under
"Certificate of Owners", advising that domestic water is
provided to this subdivision by City of Meridian.
9. The subdivision "No.2" needs to be added into the approval
of City Council statement.
10. The boundary distances and bearings are shown in rather
small print and would be much more readable if they were
enlarged.
The scale of the plat meets the minimum requirement but
the plat would be much more readable if the scale could be
increased.

The Board of Directors of Settlers Irrigation District has
previously approved the plans for relocating and piping the
Settlers canal in the above referenced subdivision.
The pipe is in place but has not been connected to the open
ditch. The Board of Directors requires that this project be
completed no later than April 1, 1992.
We have not received the plans from Roy Johnson for the
concrete inlet box as previously agreed.

Dear Meridian Planning & Zoning:
This subdivision's storm water will run off into Reclamation's Nine Mile Drain
operated and maintained under contract by the Nampa Meridian Irrigation District.
We request prompt Reclamation and Nampa Meridian Irrigation District review of
storm water drainage structure design. Assuming BMP infiltration/detention and
treatment satisfactory to Reclamation and the Nampa Meridian Irrigation District,
we probably won't require a permit for ACHD's increased storm water discharges
to these United States drains at existing points.
While we assume on-subdivision storm water detention and treatment, another
alternative would be downslope facilities nearer the drain(s) treating and
detenting ACHD flows from this and other urban areas.

Dear Members:
i have reviewed the preliminary plans for Sunburst Subdivision
No. 2 and have concerns about approving such a subdivision with
no provisions being made to house additional students in our
schools. The addition of Pioneer Elementary will provide some
relief at the elementary level, but our secondary schools
continue to become more over-crowded,. We need help and support
to provide adequate classroom space.
We need developers cooperation in selecting an elementary school
site in this area.
I have two additional comments that may be on interest to you.
The first is that busses may not enter the subdivision until our
transportation director has inspected the turns for radius. The
second is that these children may not attend the most local
schools currently serving the area. It may be necessary to
transport them to any school in our district with available space.

"A" - OVERHEAD LIGHTING - COMPANY-OWNED SYSTEM
The facilities required for supplying service, including fixture, tamp, control
relay, mast arm for mounting on an existing utility pole, and energy for the operation
thereof, are supplied, installed, owned and maintained by the Company. All necessary
repairs, maintenance work, including group lamp replacement and glassware cleaning,
will be performed by the Company during the regularly scheduled working hours of the
Company on Company schedule. Individual tamps will be replaced on burnout as soon as
reasonably possible after notification by Customer and subject to Company's operating
schedules and requirements.

"B" ORNAMENTAL LIGHTING - CUSTOMER-OWNED SYSTEM
The customer's lighting system, including posts or standards, fixtures, initial
installation of lamps and underground cables with suitable terminals for connection to
Company's distribution system, is installed and owned by the Customer.
Service supplied by the Company includes operation of the system, energy, lamp
renewals, cleaning of glassware, and replacement of defective ballasts and photocells
which are standard to the Company owned street light units. Service does not include
the labor or material cost of replacing cables, standards, broken glassware or
fixtures, or painting or refinishing of metal poles.

SERVICE LOCATION AND PERIOD
Street lighting facility locations, type of unit and tamp sizes, as changed from
time to time by written request of Customer and agreed to by Company, shall be as shown
on an Exhibit A for each Customer receiving service under this Schedule. The
in-service date for each .street lighting facility will be maintained on Exhibit A.
The minimum service period for any street lighting facility is ten (10) years.
Company, upon written notification from Customer, will remove a street lighting
facility:
1. At no cost to Customer, if such facility has been in service for no less
than the minimum service period;
2. Upon payment to Company of the removal cost. if such facility has been i.n
service for less than the minimum service period.

The monthly bill rendered for service supplied hereunder is payable upon receipt,
and becomes past due fifteen (15) days from the date on which rendered.
