The Motion was made by Corrie and seconded by Tolsma that the City Council of the City of Meridian does hereby approve these Findings of Fact and Conclusions. FOR JACK- IN-THE BOX: The Motion was made by Tolsma and seconded by Currie that the Meridian City Council hereby adopts and approves these Findings of Fact and Conclusions. Giesler: In the decision it says that the application may be reopened if there should be traffic problems. If we do have traffic problems what do we do just take another look at that and make some chances or? Kingsford: As I looked at that I assumed that that dealt with signage, possibly doing something different with the North curb. Crookston: The intent of that is that there becomes a traffic problem or signage problem, it is an attempt to keep it open for further review. That Ordinance 11-9-605 B 6., STREETS, requires that a FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 1 street that ends in a cul-de-sac or dead end shall be no longer than four hundred fifty feet. 4. That the Applicant has requested that he be granted a variance from the above cul-de-sac requirement and be .allowed to exceed the maximum length of cul-de-sacs on Pine Creek and Blue Creek streets in Parkside Creek Subdivision. 5. The entire property in question is described in the subdivision application and is incorporated herein as if set forth in full. 6. That the property is zoned R-4 Residential. 7. That the Applicant proposes to exceed the maximum cul- de-sac lengths on Pine Creek Street and Blue Creek Street and to allow these two streets to exceed the maximum cul-de-sac lengths will require a variance of the 450' from the ordinance. 8. That the Applicant owns the property. g, That no people appeared at the hearing objecting to the variance application. 10. That the Meridian Fire Department and Meridian Police Department submitted comments objecting to the length of the cul- de-sacs. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. That the strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the subdivider because of unusual topography, other physical conditions or other such conditions which are not self-inflicted, or that these conditions would result in inhibiting the achievement of the objectives of this Ordinance; c. That the granting of the specified variance will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated; d, That such variance will not violate the provisions of the Idaho Code; and e. That such variance will not have the effect of nullifying the interest and purpose of this Ordinance and the Comprehensive Development Plan, 7. That there does appear to be a specific benefit or profit, economic gain or convenience to the Applicant in that the streets to be constructed were not in existence at the time that he purchased the property; that since the property is zoned R-4 Residential it is not unreasonable to grant a slight variance. 8. APPROVED: DISAPPROVED: FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 6 Eng. Smith: don't have any problem with the appropriate drainage agency variation from Nampa-Meridian. Nampa-Meridian, as I understand it is the maintaining agency for the Bureau of Reclamation and on other ditches that we've dealt with in the past they have been the agency that we have written license agreements with for use within their easement. However that shapes out either Bureau of Reclamation or Nampa-Meridian i don't have a problem with that. The Ten Mile Creek designation instead of Ten Mile Drain, I guess that's between the developer and the 1 appr-opriate aoer,cy. I was asked my Nampa Meridian to refer to that as a drain and that's the reason for my comment. I believe they had a variance on #1 and #2 far street lights but the Ordinance states the street light requirement and that's the reason for that statement. Typically the street lights are located at approximately the same locations as fire hydrants. Giesler: I have a question far Don, the street will hook into Mesa Way then? Hubble: That street will be constructed. The Motion was made by Tolsma and seconded by Yerrington to approve the Meridian Greens #3 preliminary plat with the conditioned up on application for culdesac variance , street light variance and an agreement between the land owner and the developer- with regard to the property to the west that is being landlocked. Motion Carried: All Yea: ITEM #,3: PUBLIC HEARING: PRELIMINARY PLAT PARKSIDE SUBDIVISION W/VARIANCE: }(ingsford: I will open the Public Hearing. Is there anyone present to testify? Don Hubble, 7025 Emerald, was sworn by the attorney. Hubble: This preposed project is located south of Cherry Lane and west of Ten Mile Road. The existing Fuller Park is on the southerly boundary. The proposed project consists of 290 lots on about 90 acr-e=_. The topography is basically flat. All roads within the project will be public roads, owned and maintained by Ada County Highway District. We will have two access points onto Cherry _ane and one onto Ten Mile Road. One main street running MERIDIAN CITY COUNCIL JULY 7, 1992 PRGE 8 through the middle of the project is a Collector Street according to ACHD classifications. We have numerous culdesacs within the subdivision, two of which are longer than the ordinance allows. The variance has been filed and we are requesting your consideration for that on the culdesac lengths. The developer will install fire hydrants as necessary in these long culdesacs so there will be adequate fire facilities. Sanitary sewer will be provided by the City. Explained where existing sewer runs - see tape. There is approximately ten acres on the west end that the developer is proposing to installea temporary lift station to pump back to the gravity line. Then someday if a pump line or interceptor is installed down along Ten Mile Creek, it can be connected to that and gravitated out. Domestic water will be provided by the City. It too is located up in the street north of Cherry Lane and over here in Ten Mile Road. Water lines will be looped through and connected with the existing water line. The developer has not decided whether to contribute the money to the City's irrigation fund or to provide irrigation water to each of the lots. That decision will be made during the final platting. No areas of this project are within the 100 year flood plain. Fuller park is at the southerly end of this project. The developer is currer:tly working with the park people to try to pr-ovide not only an access but parking facilities. I'd be happy to answer an y questions. Tolsma: You say they are working on that parking lot. I though*. the parking lot was part of the original plan. Hubble: There's an existing parking lot there within the Fuiier Park boundary, but this new parking lot would be constr~.icted on the developers land. That is additional parking of 90 spaces. Tolsma: The access roads that are there now are no longer eoing to be there then, is that correct? Hubble: That's right, existing roadways will be abandoned once this public access is connected. Tolsma: Isn't that going to make it a little unhandy sometime=_ for a; many people that run hack and forth through there that :lse that facility? Hubble: Presented a map of the project to the Commission. This project is located near the intersection of Cherry Lane and Ten Mile Road. The project site consists of about 90 acres, the proposed project shows 290 single family residential lots. We are proposing to develop this thing, take an access in three spots from the existing roadways. We'll have an access on Ten Mile Road and two on Cherry Lane. The street going through the middle of the property will be designed as an ACRD Class Collector Road. It will be 60 feet of right of way, the pavement will be 41 feet from back of curve to back of curve and they have indicated that their desire to have this classified as a collector. The balance of the streets in here will be defined as ACHD residential streets. We have two culdesacs that are longer than the City Ordinance of 500 feet, so we are also asking for a variance from that requirement of less than 500 feet. The developer is willing to put in adequate fire protection facilities, fire hydrants as necessary at thlese long culdesacs. The project is going to be served by City Sewer. Presently the existing sewer is over on the north side of Cherry Lane Road. We are proposing to gravity the eastern two thirds of this project down to a point which would probably gravity into this existing main line. (Explained two options - see tape) The project will be served by City Water, we've got a 10" main line on the north again and we've got a 10" main line over here in Ten Mile Road. We are proposing to connect the two from the project so the water system will he looped and will also provide a full loop wherever possible. All the public utilities will be provided. As far as irrigation, the developer hasn't decided whether to provide a deposit in for the City trust fund for water development or to put on site irrigation, but he aware of that requirement. I would like to point out a Flood Plain Study that has been done on Ten Mile Creek. The boundary of that 100 year flood plain is off this proposed project. The developer is proposing to provide the land and construct the improvements for a parking lot which can be used MERIDIAN PLANNING & ZONING JUNE 9, 1992 PRGE 8 Johnson: Any more questions for Mr. Hubble? Alidjani: What's the possibility of having more parking spaces, I don't feel that 100 parking spaces is adequate for that area? Hubble: The final design for that parking lot hasn't been done and I guess I could speak far the developer in saying that he is willing to work with the City if there is additional need. Hepper: On the Collector Street, normally Rda County Highway District, and they may have something in their comments about having access onto a Collector Street, normally that's not allowed. From what I can see an your map there, you've got several lots that front onto the Collector Street, is that right? Hubble: Yes, I believe we have eight lots that front onto that street. In discussions with the new Development Services Manager down there, his interpretation of that frontage requirement may be a little bit different than what they've had in the past. What they have requested in the past is that any lot that front's onto that Collector Street must have an on-site turn-around, so what they are trying to discourage is anybody having to back onto that Collector Street they want to be able to turn around an their lot and pull out in a forward direction. Hepper: So how do you provide for that on an 80 foot frontage lot? Hubble: What we'd like to do is present that to ACHD. We don't believe that this is going to function as a true Collector Street. Hepper: Here in your application you say the minimum square footage of the structures is to be 1500 square feet, is that correct? Hubble: Yes. Crookston: How do the accesses onto Cherry Lane align with the current accesses into Cherry Lane Village? Hubble: The most westerly access point is several 100 feet off- set from that existing street. Then the other access point is directly across the street so it's in alignment. Crookston: I would have some concerns about having intersections that aren't aligned. It's difficult to control traffic that way I understand. My other question is on the well that was referenced in the discussion prior, do you know how deep that well is? MERIDIRN PLANNING & ZONING JUNE 9, 1992 PRGE 10 Bryon: Yes but it didn't do any good. I complained about my ditch being eliminated, I complained about my fence being buried, I complained about not getting paid for the irrigation I put in but I was complaining to a developer and he was just lying to me. Rex Harrison, 1300 N. Ten Mile Rd., was sworn by the attorney. Harrison: I just live across the street from this property on Ten Mile there. My driveway is directly across the street from that road that's going through there. I feel that this subdivision is an example of somebody trying to get every last inch out of a large piece of property. The families that go in there aren't going to have enough room to have a garden or anything else. I feel it's up to you to ensure that the developer gives them a decent size lot to work with. I'm opposed to the density of that subdivision. Johnson: Thank you. Anyone else? Charlie Rountree, 3851 Woodmont, Meridian, was sworn by the attorney. Rountree: I'm here tonight to represent Western Ada Recreation District as the Chairman of the District. In that capacity this evening I do not speak for the entire board, we've not yet been able to convene and discuss this issue. But as Chairman and the operator's and owners of Fuller Park, we have been in discussion with L & R Development for about four weeks. We have some concerns, they have heard our concerns and they made a proposal to us and it's my opinion that some of the recommendations or proposal's they have made to us will not be acceptable to the Board. (Further explanation - see tape) The parking as proposed in terms of space, I think is adequate. Hepper: Would a fence between the residential area and the park be a possible partial solution to the complaints? Rountree: I don't know that establishing your territory in that way would resolve this. I have a major concern educational facilities available for as this town. Who is going to pay for th hear from you to tell me that you facilities and who is paying for them. with the development or that we don't have the rapid as we are expanding ese schools? I want to have planned for school Johnson: There's been a lot of discussion about the impact fees with respect to educational facilities but the State Law prohibits it and it would have to go to the Legislature to get it changed. England: I hope you take into consideration whether or not we have enough fire, ambulance, sewer, water, etc. - It seems that development is absolutely going rampid in Meridian. Johnson: It certainly We do have a letter concern. The Meridian and what we try to do which is the City of growing area and will concerns. is. There was a proposal before the Legislature to require impact fees and they granted the ability far various local governing bodies to impose impact fees, but the only entity that it didn't grant that to were School District's. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. We require support for these revenue sources from developers and other interests seeking planning and zoning approval for residential projects. If this support is lacking then we ask that additional residential development be denied. School bus service may be restricted if adequate turnarounds and loading areas are not provided. Residents cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. E. /"~'~i- RE: PARKSIDE CREEK S/UBDIVISION (Preliminary Plat) I have reviewed this submittal and have the following comments far your consideration during the hearing process as conditions of the applicant. 1. Culdesac Length Variance Request: a. An additional fire hydrant will be required in each Culdesac. b. Pecause of the dog-leg, a street sign should be posted at each entrance to inform vehicular traffic this is a dead-end/no through traffic. c. Pine Creek Ct. could connect with Fir Creek Ct. to eliminate one of the long culdesacs. 2. Several lots appear to 6e less than 8,000 square feet in area: Lot 27 - Block 1; Lots 2, 45, 47 - Block 3; Lots 3, 6, 7 - Block 4; Lots 8, 9, 10, 23 - Block 5; Lot 22 - Block 6 (Is the rear lot line the centerline of Eight Mile Lateral?). 3. Cherry Lane and Ten Mile Road need to show 40 feet of right of wav from centerline. The roadway section to fit this width should be built at this time. 4. Show lot numbers for the well lot and the landscape lot along Ten Mile Road. 5. Is the exterior boundary line along Block 6 also the centerline of Eight Mile Lateral? Is so, show it that way, if not show the centerline as it relates to the boundary. 6. Park Creek Way needs to break into two streets for east/west and north/south street number designations. 7. All streets need to conform with the Ada County Street Name Committee comments for names, directional designations and length of names. -1- 8. It is rumored that the Meridian School District will purchase a I2 acre site adjacent to this subdivisions south boundary. A school site access road should be provided from an adjacent culdesac with a water line/sewer line stub. 9. Who will own and maintain the walkways shown from culdesacs to the Fuller Park areal 10. Because of the location of the park access (Lot 75 - Block 1) is the walkway between Lot 72 and 73 - Block 1 necessary? il. There is a fair amount of off-site storm drainage system shown. Who owns and maintains this system? I don't feel a homeowners association is equipped to own and operate a storm drainage system. 12. Sanitary Sewer System: a. Investigation should be made to see how much of the east side of this subdivision can sewer to the Ten Mile Road sewer line to lessen the impact on the Cherry Lane Village lift station. b. An engineering analysis needs to be made by the applicant as to the impact of this subdivision on the Cherry Lane Village lift station. It is conceivable, because of this developments size, that the existino Cherry Lane Village lift station, to be relocated by the Golf View development, be further relocated to Plackcat Road and sized for the developments of Cherry Lane Village, golf View and Parkside Creek. The downstream gravity line also needs to be reviewed for capacity. 13. Domestic Water System: a. Show the water main layout for the entire subdivision with fire hydrants and valuing. b. Water mains shall tie through the subdivision from Cherry Lane Road to Ten Mile Road. The tie at Ten Mile Rd, will require an extension of the existing water main under the Eight Mile Lateral. 14. Fuller Park access and water service line must be maintained by this developer until this development provides these in a manner acceptable to the Western Ada Recreation District. -c- 15. Ten Mile Creek should be called Ten Mile Drain. Plans for disposal of surface drainage to Ten Mile Drain must be reviewed and approved by the Nampa and Meridian Irrigation District. 16. Street lights shall be shown for the entire subdivision. Generally, locations are at street intersections/fire hydrants but na more than 400 foot spacing. 17. Plat note 5 states, "Storm water runoff will be collected on-site and discharged to adjacent drainage ponds and ditches." Assuming this means our Ten Mile Drain and street drainage responsibility will be with ACHD, ACHD will need a permit from Reclamation to discharge to the drain. Conditions of the permit will be storm water detention to the pre-development condition and BMP treatment acceptable to Reclamation and our contractor, the Nampa Meridian Irrigation District. The developer should submit drainage plans and calculations along with 3650 review fee to the Nampa Meridian Irrigation district. The United States' Ten Mile Drain right of way acquired in 1916 extends 60 ft. each side of the centerline. We request the plat show the easement line and that conditions of plat approval be ACHD's obtaining a permit from Reclamation for storm water discharge to the drain. The proposed "Fuller Park" pond lies quite near the Ten Mile Drain easement area. We look forward to working closely with the City in planning this greatly needed park. The plat should show Nampa Meridian Irrigation District's Eight Mile Lateral Canal easement. The irrigation district office can provide specifics of it. Parkside Creek is a 290-lot single family residential subdivision located on the south side of Cherry Lane, and the west side of N. Ten Mile Road; 14,520-feet of new public streets are planned. 2. Cherry Lane is designated a minor arterial street on the 2010 Urban Functional Street Classification Map requiring a minimum 66-foot right- of-way and 52-foot street section with 4 traffic lanes. Staff is of the opinion that 40-feet should be provided as shown on the preliminary plat for the following reasons: 1) Meridian will require 90-feet; 2) This will allow a meandering bike/ped lane landscape buffer which will both enhance the project and avoid conflicts with future installation of curb, utilities and pavement widening. This proposed development contains 290 single-family residential lots that are 8,000 square feet or greater. Access to this subdivision will be provided by two points on Cherry Lane and one point on Ten Mile Road near the Eight Mile Lateral. The streets will be public and wilt be constructed in accordance with the Ada County Highway District standards. The proposed Pine Creek and Blue Creek cul-de-sacs exceed the maximum length allowed, therefore, we are requesting a waiver from the maximum length for those two streets. Sanitary sewer service will be provided from an extension of the City's existing main in Interlachen Street. The Westerly 10 acres will be serviced by a new pressure line that will pump to our proposed gravity sewer. We will be working with Gary Smith to obtain approval of our master sewer plan. Domestic water service will be provided from an extension of existing water mains in Cherry Lane. Storm water runoff will be collected on-site and cleaned and discharged to the existing pond and Ten Mile Creek. Approval for the same will be sought from the Park District, the U.S. Bureau of Reclamation, and the Nampa and Meridian Irrigation District. This project is located adjacent to Fuller Park and will provide access to the park through the new streets. The owners are currently working with the District's Board to finalize their approval of the same. Additionally, the developers of the proposed Parkside Creek Subdivision are working to obtain approval from the Park District that would allow storm water runoff discharge to the pond in the park.
