Hunemiller: We agree with what the Planning b Zoning brought up ~ at their meeting and I have a copy of the site plan with the drainage and the moving of She street light and the sand and grease trap that is in the sewer easement at this time. The Motion was made by Tolsma and seconded by Yerrington to approve the preliminary and final plat on Mr. Sandman subdivision conditioned upon meeting all the Engineers requirements including the moving of the grease trap. Motion Carried: All Yea: ITEM #B: PETER COVINO: APPEAL DECISION FROM BUILDING CODE BOARD OF APPEALS: Peter Covino: Handed out copies of the building code showing two categories - showing assembly hall or amusement building with their appropriate definitions. My problem is with the definitions in the book, I want to follow definitions as written in the code book and the person who issues these codes out doesn't see the code the same way that I do. Take a look at those definitions and understand that the definition that says amusement was based on this code because of a haunted house situation. As you know I'm trying to put in a plat gun recreation and in this facility across the street I plan to build a few structures. In this structure there are exit signs, the building is lite at all times during the games and nobody is forced to go in any specific direction. From any place you stand you may see exit signs and exit paths out. Because of that, some people have offered an explanation of what your looking at. Briggs: The plat proposed is 3 lots, the reason for the subdivision plat is that there is to be a restaurant constructed and perhapsone other buildin^ later on under sliohtly different owner^shios. In order to transfer the property it has to be subdivided. There are no new streets createtl. The main water system is in and will iust have to be extended to the b~_uldinos. The sewer is available. Alidiana: Do you have any problems with the City Engineer's comments? Briggs: Yes I have seen them. I think either Gary or Russ will speak to that. We have no problem with the corrections to be made. We don't have a problem with givin^ an easement across that property and then whoever needed the sewer on to the so~_ith there co~_ild put it in but we don't want to put at an. You would rather not have to out that ln. Hunemiller: That's correct. Then addressing #1 iust above that, we don't have a problem signing an agreement with the Citv that if they ever had to work on that sewer line that we would replace that grease trap and street light using that sewer easement. Chairman Johnson: We appreciate that but this board really can't make a recommendation one way or another but those comments will go onto the next step in this process and eventually on to the City Council and the Engineer. Alidjani: Have you had any conversation with Gary at ally Clerk Nlemann: I think it's our policy that they have to extend it through their property isn't it Wayne Crookston: It's reouired by Ordinance.
