After our recent meeting at the site to look at the existing
drainage Swale along your west property line I contacted our City
Attorney for some interpretation of our existing City Ordinance
for "piping of ditches" (copy attached).
• Your project engineer has shown this Swale, which has some areas
of standing water, to be filled in with native top soil. Some
concern exists that this is a sub-surface drainage ditch and that
filling in this ditch will cause adjacent ground water levels to
rise. In the first sentence of the "piping of ditches" Ordinance
"all waterways" is referenced. Our City Attorney says this
reference includes this drainage Swale, especially since it has
some areas of standing water. Therefore, unless evidence can be
provided to the contrary, this drainage Swale needs to be piped
with a filter fabric wrapped-drain rock enclosed - perforated
pipe. This detail would be similar to what was used for piping
of the Jackson Stub Drain.

9-605 M PIPING OF DITCHES 1 D~(~°
Tiling of irrigation ditches, laterals or canals. All waterways,
irrigation ditches, laterals or canals, exclusive of natural
waterways, intersecting, crossing or lying adjacent and
contiguous to an area being subdivided shall be covered and
enclosed with tiling or other equivalent covering which has the
same ability to detour access to said ditch, lateral or canal, or
any part of said lands or areas being subdivided which abut
either or both sides of said ditch, lateral or canal. The City
may waive this requirement for covering such ditch, lateral or
canal, if it finds that the public purpose requiring such will
not be served in the individual case. Any covering program
involving the distribution system of any irrigation district
shall have the prior approval of that affected irrigation
district. No subdivision plat' shall be approved where the
subdivision is arbitrarily or artificially laid out to avoid
being adjacent to any waterway, irrigation ditch, lateral or
canal to which it would otherwise be naturally adjacent or which
it would otherwise naturally include.
9-6C6 IMPROVEMENT STANDARDS
9-606 A RESPONSIBILITY FOR PLANS
It shall be the responsibility andliability of every subdivider,
and the owner of the land being subdivided, to construct and
install every improvement shown on the plat of the subdivision or
represented to be included in the subdivision at any presentation
before the Planning and Zoning Commission or the City Council and
this responsibility and liability shall run with the land and
this responsibility and liability shall be shown on the plat of
the subdivision. (Ord. 557, 10-1-91)
9-606 B IMPROVEMENTS, PUBLIC
Every subdivider shall be required to install at his own expense
the following public and other improvements in accordance with
the conditions and specifications, as follows:
1. Monuments - Monuments shall be set in accordance with
section 50-1303, Idaho Code;
2. Streets and Alleys - All streets and alleys shall be
constructed in accordance with the standards and
specifications adopted by the City Council and Highway
District;

The review on Meridian Place Subdivision No. 3 has been completed. It has
indicated that all storm water run-off will be retained on site and that there
will be no encroachment on the Jackson Stub Drain and itsright-of-way will
not be encroached on.
You will need a License Agreement for placing the drain underground. Please
contact Andy Harrington, 342-4591, to start this.
If the subdivision is built according to the plans submitted, I do not believe
it will affect the District's operation. The Nampa & Meridian Irrigation
District recommends that irrigation water is to be delivered to all homes
within this subdivision.

RE: MERIDIAN PLACE SUBDIVISION N0. 3 (Final Plat Review)
I have reviewed this submittal and have the following comments for your consideration
as conditions of the applicant during the approval process:
1. Lark Avenue should be shown as North Lark Avenue.
2. Please show the location of the "Initial Point."
3. Show an easement at the northwest corner of Lot 1 - Block 8 large enough to allow Mr.
Hawe access for operation and maintenance of the existing irrigation control structure.
If the developer isn't going to fence this box out, then a note needs to be added .for Lot
1 stating the lot owner needs to fence it out.
4. Add the following notes:
Q. "The owner of any lot, across which passes a drainage or irrigation ditch or pipe,
is responsible for maintenance of the ditch or pipe unless the maintenance is assumed by
an irrigation and (or) drainage district."
B. "All lots are for single family construction."
5. Show a special front setback dimension for Lot 12 - Block 6.
6. The lot and block numbers do not correspond with the preliminary plat. Is this as a
result of conversations with the Ada County Engineer?
7. A dimension of 5.0 feet needs to be shown on the east side of Lot 23 - Block 5.
8. Only a 10 foot wide easement is shown along the subdivisions south boundary for the
Jackson Stub Drain. In other subdivisions to the east, this easement has been much
bigger. The proposed tiling, and the easement width, of this stub drain must be
approved by Nampa & Meridian Irrigation District with a copy of the approval letter
to me.

9. What is the status of previously discussed fencing along the west boundary and
installation of a perforated the in the short length of drain ditch along the
west boundary?
10. I request that a letter of credit be provided by the developer to cover any im-
provements (e.g., fencing, sewer, water, pressure irrigation, etc.) not completed
at the time we receive requests for building permits. (Note!~This has no reflection
on this particular applicant but this provision should be applied to all subdivision
projects.)

Dear Commissioners:
I have just reviewed the preliminary plans for Meridian Place
Subdivision Ili. This planned development will accelerate the
need for Joint School District No. 2 to construct additional
classrooms and/or to adjust school attendance boundaries.
Meridian Schools do not have excess capacity. Nearly every
school in the district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask for a
development fee statute on new home construction or a real estate
transfer fee to help offset the costs of building additional
school facilities. We require support for these revenue sources
from developers and other interests seeking planning and zoning
approval for residential projects. If this support is lacking
then we ask that additional residential development be denied.
School bus service may be restricted if adequate turnarounds and
loading areas are not provided.
Residents cannot be assured of attending the neighborhood school
as it may be necessary to bus students to available classrooms
across the district.
We ask that you assure the developer will provide walkways, bike
paths and safe pedestrian access.
