1st St.,) an extension of time on the paving of our parking area.
Having until June 1St will allow us to more adequately meet the
city and county suggestions for the paving.
In talking with the asphalt company, I was told that they
will be able to slant the parking lot to drain the water toward
the rear of the building.

WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to rezone in the said City real property which is
hereinbelow described:

Kingsford: At this time I will open the Public Hearing and
invite the owner to come forward and be sworn in.
Mike Hagood, 903 E. 1st, Meridian, was sworn by the attorney.
Hagood: On the rezoning we are trying to rezone the church at
1203 E. 1st for commercial use, to move the Karate School that's
now at 903 E. 1st into that building.
Giesler: There is nothing going on in that building right now?
Hagood: Right now they are still holding services and we plan to
on Sundays, they will be using it for two hours in the morning
and one hour in the evening until they get their building built.
Tolsma: The Fire Department had a question on the basement of
that? Your not going to be using the basement?
Hagood: Yes we are. We've talked with the Fire Marshal and we
are having them put in a sprinkler system.

Kingsford: You saw the requirements of the Engineer and do you
have any problems with them?
Hagood: No I don't. The only thing on that is we are asking for
a little bit of an extension time possibly with some of the other
pre-construction we are doing - as far as putting back in the
asphalt and the sidewalk according to the City specifications.
Kingsford: Any one else from the public who would like to offer
testimony on this? No response. I will close the Public
Hearing.
Giesler: You stated it was going to take some time to put the
sprinkler system in and so forth?
Hagood: Not the sprinkler system, we have to hook up on the
Washington Street side and that's where they are talking about a
parking lot. The sprinkler will be in before we can get an
occupancy permit.
Giesler: So as soon as that is done, you would go ahead and pave
that though.
Hagood: I guess what I was referring to is some of the costs, we
didn't realize we would be running into the sprinkling system, we
also have to get :t set up for handicap access and that's why I
was asking for an extension.

publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the December 10, 1991,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations;
2. That this property is located within the City of
Meridian and is owned by the Church of Christ, Inc., and the
Applicant, Mike Hagood, has an agreement to purchase the property,
and which property is described in the application which

3. That the Applicants propose to have the property zoned
(C-C) Community Commercial and use the property for a karate
school.
4. That the C-C District is described in the Zoning
Ordinance, 11-2-408 B. 7 as follows:
(C-C) COMMUNITY BUSINESS DISTRICT: The
purpose o~ the (C- istrictT to permit
the establishment of general business uses
that are of a larger scale than a
neighborhood business, and to encourage the
development of modern shopping centers with
adequate off-street parking facilities, and
associated site amenities to serve area
residents and employees; to prohibit strip
commercial development and encourage the
clustering of commercial enterprises. All
such districts shall have direct access to a
transportation arterial and collector and be
connected to the Municipal Water and Sewer
systems of the City of Meridian.

the Policy Diagram at Page 7 of the Meridian Comprehensive Plan
even though not zoned Old Town; the Old Town is described in the
Zoning Ordinance as follows:
(OT) OLD TOWN DISTRICT: The purpose of the (OT)
~6istrict is to accommodate and encourage further
expansion of the historical core of the community; to
delineate a centralized activity center and to encourage
its renewal, revitalization and growth as the public,

quasi-public, cultural, financial and recreational
center of the City. A variety of these uses integrated
with general business, medium-high to high density
residential, and other related uses is encouraged in an
effort to provide the appropriate mix of activities
necessary to establish a truly urban City center. The
district shall be served by the Municipal Water and
Sewer systems of the City of Meridian. Development in
this district must give attention to the handling of
high volumes of traffic, adequate parking, and
pedestrian movement, and to provide strip commercial
development, and must be approved as a conditional use,
unless otherwise permitted.
6. That the property where the complex is to be located
has frontage on East First Street and Washington Street; that the
property in the past has been used as a church but at the present
time the property is not being used.
7. That sewer and water is available to the property, but
the use may require additional charges and fees.
8. That comments may be submitted by the Nampa Meridian
Irrigation District, Meridian Police Department, Ada County
Highway District, Meridian Fire Department, and the Meridian Sewer
Department and other agencies and those comments will be
incorporated herein as if set forth in full herein.
9. That proper notice has been given as required by law
and all procedures before the Planning and Zoning Commission have
been followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
rzo~n~io Planning Act and of the Ordinances of the City of Meridian have

2. That the City has the authority to take judicial notice
of its own ordinances, other governmental statues and ordinances,
and of actual conditions existing within the City and state.
3. That the City of Meridian has authority to place
conditions upon granting a zoning amendment.
4. That the City has judged this Application for a zoning
amendment upon the basis of guidelines contained in Section 11-2-
416 of the Revised and Compiled Ordinances of the City of Meridian
and upon the basis of the Local Planning Act of 1975, Title 67
Chapter 65, Idaho Code, the Comprehensive Plan of the City of
Meridian, and the record submitted to it and the things of which
it can take judicial notice.
5. That 11-2-416 (K) of the Revised and Compiled Ordinances
of the City of Meridian sets forth standards under which the City
shall review applications for zoning amendments; that upon a
review of those requirements and a review of the facts presented
and conditions of the area, the Planning and Zoning Commission
specifically concludes as follows:
(a) The new zoning would be harmonious with and in
accordance with the Comprehensive Plan and no
Comprehensive Plan amendm?nt is required.
(b) The area is in OLD TOWN which is designed for a
mix of uses and a rezone of the subject property is in
line with that designation.
(c) The area around the proposed zoning amendment is
developed in a residential and commercial fashion that
would be allowed in Old Town and the new zoning would
not be contrary to the allowed uses.
(d) There has been a change in the area, the rezoning

of other property to commercial uses and use of
residential property for commercial use, which dictate
that the property should be rezoned.
(e) That the property is not supposed to be re-designed
and therefor will still be harmonious with the
surrounding area.
(f) The propose uses should not be hazardous or
disturbing to the existing or future uses of the
neighborhood.
(g) The property will be able to be adequately served
with public facilities, and connection to municipal
sewer and water is required.
(h) The proposed use would not create excessive
additional requirements at public cost for public
facilities and services and would not be detrimental to
the economic welfare of the community.
(i) The proposed use should not involve any detrimental
activity to any person's property or the general
welfare.
(j) Development should not cause a significant increase
in vehicular traffic and should not interfere with
surrounding traffic patterns in that the property has
substantial street frontage.
(k) That this rezone will not result in the
destruction, loss or damage of any natural or scenic

Annexation and zoning requested by the Applicant for the property

Hagood: I've put money down on this Church building to purchase
to run my Karate School in that building. R11 of this is subject
to the rezoning. If it goes through then we will make the other
adjustments and purchase the building for the school.
Hepper: Did you read the comments from the Ada County Highway
Department and the other City Departments?
Hagood: Yes I did and I do not have any problems with any of the
requirements. As far as the parking area shall be paved and
drainage retained on site. Is this so it will not go into the
city sewer?
Clerk Niemann: So it won't go into the street.
Hagood: You also required that I show a parking plan. Presented
a parking plan to the Commission for their review.

Crookston: I don't know what the condition of the building is
but our Ordinances would require you to bring that up to code,
are you prepared to do that?
Hagood: Yes we are.
Rountree: I have a question for the City Clerk. Could you
explain what the zoning is right now and with the requested

to commercial (CC) for property located at 1203 E. First Street. An
existing church building will be converted for use as a karate school.
2. E. First Street has 80-feet of right-of-way (which is adequate), and
has recently been reconstructed. Any anticipated utility cuts for this
project will have to be made on the Washington Street frontage to avoid
pavement cuts in the new street.
3. Washington Street has 60-feet of right-of-way (which is adequate), and
is improved with 30-feet of paving.
4. The alley has 16-feet of right-of-way (20-feet is required), and is
improved with gravel
5. This project is considered a minor change in use of the property; there-
fore, the standard street improvement requirements are waived.
If the rezone is approved and development proceeds, the District will pro-
vide the following recommendations to the City of Meridian.
SITE SPECIFIC REQUIREMENTS:
1. Utility street cuts is the new pavement on East First Street must be
approved by the District Commission.
STANDARD REQUIREMENTS:
1. Site drainage plans and calculations shall be submitted for review and
appropriate action by ACHD. The proposed drainage system shall re-

Dear Mr. Niemann:
Please find enclosed an Application for Rezone and the necessary
attachments in accordance with the application. On behalf of
the owners and ourselves, Contract Purchasers, we are formally
requesting that the property located at 1203 E. First Street,
Meridian, Idaho, be rezoned from residential (R-15) to commercial
(CC) .
The full legal description of the property is attached hereto as
part of the Application for Rezone.
The names and addresses of the title owners of the subject property,
as well as a notorized request for the zoning change, are also
attached as a part of the Application for Rezone.
This request falls within the provisions of the Meridian Compre-
hensive Plan. It is our belief that the characteristics of this
property make the zoning amendment desirable and would also be
in harmony with the zoning on surrounding property. It is noted
that almost all of the property on the east side of East First
Street is already zoned commercial, and so is most of the property
on the west side of East First Street in this area zoned commer-
cial. We further believe that this would be a beneficial use
of this property since it is well suited for our purpose and of
no small consequence being that the property will be added to
the tax rolls of Ada County, Idaho.

Also attached to the Application for Rezone are the names and
addresses of all of the property owners within 300 feet of the
subject property as required by the Ordinance. These people
are entitled to receive notice of the hearings on this Applica-
tion for Rezone.
This subject property is presently being used as a church, and
the proposed use of this property is for a Karate school. The
Karate school is presently being operated in the building
located at 903 East First Street, Meridian, Idaho, and this
subject property is most suitable for our plans for expansion.
A Warranty Deed showing title in the owners of the property is
attached to the Application. Meridian Church of Christ, Inc.,
is a successor in interest to King Street Church of Christ,
Meridian, Idaho, Inc., an Idaho corporation. Warrior Enterprizes,
Inc., has a signed Earnest Money Purchase Agreement with Meridian
Church of Christ, Inc., covering the subject property.
We also enclose our check in the sum of $160.00 to cover the
filing fee, pursuant to Section 2-422A, of the Ordinance.
