The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for this site. Design Review: This site and proposed structure has been reviewed for compliance with the design guidelines for suburban developments contained in the City's Design Manual and UDC 11-3A-19. Staff determined that the portable classroom as proposed by the applicant did not meet several of the minimum required design standards listed in UDC 11-3A-19 and guidelines in the Design Manual. Rather than comply with the noted design standards, the applicant requested City Council review of the Director's decision on the matter. The City Council heard the request on August 25, 2009. Because the structure is considered portable and not permanent, Council approved the plans submitted by the applicant contingent upon the applicant submitting a request for Alternative Compliance, which the applicant has done. Landscaping: NA (No landscaping is proposed to be installed with this application.) Site Plan: The Site Plan prepared by Hutchison Smith Architects, dated July 21, 2009, labeled Sheet A1.0, is approved (stamped "Approved" on 8/26/09 by the Meridian Planning Department) with no changes. The approved site plan is not to be altered without prior written approval of the Planning Department. Elevations: The building elevations prepared by Hutchison Smith Architects, dated July 2009, labeled Sheet A3.0, are approved (stamped "Approved" on 8/26/09 by the Meridian Planning Department) with no changes. Irri ation: NA. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Departnent Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11 -3B -10-C.5. Parking: No new parking is proposed or approved with this application. Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fiilly vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Li tin : Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all federal handicap -accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy. The two year period will begin on October 27, 2009 and end on October 27, 2011. At such time, if the portable classroom structure still exists and is proposed to remain on the site, staff will initiate a new application for design review. The portable classroom structure will be reviewed for compliance with design standards in effect at X that time Staff will send out a letter of decision on the design review application to all property owners within 300 feet of the site, the School District, and the Mayor and City Council. City Council review of the Director's decision on the design review application may be requested by the applicant, the Director, or a party of record in accord with UDC 11-5A-6 upon submittal of the appropriate application and fee. Mr. Haddock is now contiguous with the Meridian city limits and has requested City Council waiver of annexation fees. UDC 11 -5A -7B. grants the Council the authority to waive fees based upon a hardship. In a letter dated October 14, 2009, Mr. Haddock requested a waiver and outlined the reasons for the request. Items 8.A — Paramount Elementary School Portable Classroom Appeal (AP -09-002) Location: The school site is located at 550 W. Producer Drive, east of N. Linder Road & north of W. McMillan Road. Application: Request for reconsideration of the Council's decision on the appeal by the Joint School District No. 2 of the Planning Director's decision on the architectural and design features of a portable classroom at Paramount Elementary School. History: • A Certificate of Zoning Compliance & Design Review application was submitted for a 1,792 square foot portable classroom structure at Paramount Elementary School. Staffreviewed the application & found the proposed structure does not comply with the minimum design standards listed in UDC 11-3A-19 as follows: 1) the building facades visible from the public street (W. Dietrich Ave.) do not incorporate modulations in the fagade; 2) the primary building entrance is not clearly defined by the architectural design of the building; and 3) the roof design does not provide variations in profile through modulation and/or articulation in accord with the Design Manual Additionally, landscaping on the site and the architectural character of the building is not consistent with the objectives and guidelines in the Design Manual. Therefore, staff requested the applicant revise the plans submitted with the CZC to comply with the aforementioned standards. • In response, the applicant requested City Council Review of the Director's decision on this matter as they did not wish to revise the plans to comply with design standards. City Council approved the request to overturn the Director's decision regarding compliance with design standards and approved the site plan and building elevations submitted by the applicant, subject to submittal of a request far Alternative Compliance. • A Request for Reconsideration of the City Council's decision was field by Keith Watson, an adjacent neighbor to the elementary school. Mr. Watson states that he did not receive notice of the public hearing for City Council Review of the Director's decision; therefore, he (and other interested parties) did not have the opportunity to present testimony at the hearing. There was some confusion as to the appropriate noticeJgiven that it was Council Review of a Director decision instead of a Planning and Zoning Commission decision. At the time, Legal and Planning departments determined that the code was somewhat ambiguous as to whether the full hearing notice provisions were necessary. We opted for a minimal notice as required by State Law that does not include a neighborhood meeting or direct notification to surrounding property owners. (Please note: to avoid this situation in the future, staff will clam the UDC requirements.) Outstanding Issue(s) for City Council: The City Council should reconsider the Directors denial of the design review application of the portable classroom. In particular, Council should consider the additional testimony regarding the present color scheme of the portable classroom structure and the compatibility with the associated elementary school building. This request for reconsideration is in response to the City Council's approval of the temporary classroom building at the Paramount Elementary School. (Aug 25 Meeting, Item #8 — AP 09-002). I have been informed by the City Attorney's office that no written notice of the City Council Meeting, which included this agenda item, was required to be mailed to any property owners likely to be impacted by any decision. Consequently, no Paramount residents presented either oral or written testimony at the Council meeting. The CCR's of the Paramount Subdivision are quite specific as to architectural design and color schemes. Though our residents would prefer not to have temporary classrooms spread through the school grounds, we understand and accept the need for such structures. However, we believe that both Planning and Zoning and the Council's decision in this approval process failed to take into account our community standards in regards to color scheme. The installed structure's exterior paint color is not compatible with these standards. In fact, the structure in its present color is extremely annoying, can potentially lower our property values and denies us quiet enjoyment of our adjoining properties. I have tried to engage the Meridian School District on this matter but they have been either unresponsive or argumentative. Instead or working on the issues addressed by the Planning and Zoning staff, the district circumvented the process and went straight to the Meridian City Council for approval. The district needs to be held account table for their actions and needs to following the guidelines just as any other resident. We are only asking for the Request for Reconsideration so we as residents can be engaged in the process, just as we should have been from the beginning. We initially expressed our concerns with the Superintendant of the district and there was no response. The mobile structure has us as homeowners, which border Paramount Elementary, concerned in the following ways: Paramount .Elementary is a new school, the need for a mobile structure to us seems extremely premature and the mobile structure as it, stands is an eyesore (the color and the structure itself resembles a mobile home) and we are concerned it will affect our property values.
