I am a concerned homeowner located in the Merrywood subdivision.
This letter addresses current situations within the subdivision
and the response of the developer to correct them. Your support
and action on past issues this summer was vital in prompting the
developer into action. As homeowners we feel helpless. The
realtors have abandoned us and the developer still controls the
homeowner association. Many of the items addressed below should
have been completed before any lot was sold. It is also, very
frustrating that the only way any work is initiated in this
subdivision, is through threat of city council action. However,
it seems to be our only course. Your support is again requested
on the following items.
1) An open irrigation ditch remains within the eastern border of
the subdivision. The north half has been piped, however, the
south half remains open. Also, the property line on this eastern
border was never handled between the developer and the adjacent
landowner. It has been left for each individual homewner to
resolve. This should not be. The landowners fence ranges from
2-3 feet on subdivision property. The irrigation ditch needs to
be piped and covered before the fence can be properly moved.
2) There has been no weed control on many of the open lots.
Weeds are over 4 feet tall. There are also, many patches of the
noxious weed, Canadian thistle, thriving on these open lots.
3) Within the plans for this subdivision a well was to be
constructed for irrigation water for yards and front subdivision
landscaping. Irrigation has been temporarily connected to
Meridian City water. There has been no initiation for
construction of a well or hookup to a nearby Nampa -Meridian
irrigation canal.
4) The front landscaping has just recently been mowed. The grass
and annual weeds were over 6 inches in height. There still
remains many patches of sickly white poplar suckers that should
have been cleared out. The island at the entrance to the
subdivision never was never landscaped. It has remained unsightly
rocks. It looks, however, that sod will be installed soon.
The engineer in charge of this subdivision has been informed of
the above items and has started to address some of the items,
such as, landscape maintenance. It is the intent of this letter
to also inform you so as to monitor the progress of these items.
We've heard many promises, but only got results when the city
council stepped in. It is disturbing to note that realtors and
builders in this area are not bringing people into this
subdivision. We would like to see this situation turned around.

Crookston: My wife very sincerely asked me to thank you for the
Proclamation and to except that on behalf of the Miss Meridian
Board.
ITEM #1: UPDATE ON MERRYWOOD SUBDIVISION:
Crookston: I am officially stepping down due to a conflict of
interest.
Jack Riddlemoser: In review of the site it indicates that the
fence along the railroad side of the property is in. The
pressurized irrigation system is hooked up and available. Dirt
has been hauled in for the berm, some of the water line for the
sprinkler system on the berm has been installed and it is evident
there is some testing being done. As far as any finish work on
the berm, considerable needs to be done and there is no
landscaping.
Kingsford: Do you have a recommendation to the Council?
Riddlemoser: No I don't believe under these circumstances I have
a recommendation.
Corrie: Roy Johnson asked for a couple of weeks to get this
completed. I assumed that he was going to have it completed by
then.
Giesler: Is there any other problems that we are not aware of or
is it just the completion they would like done?

Sheri Schweitzer, 703 N. Rotan. We did get water, it was August
1st, we did get a fence that came in August 2nd. I was afraid if
you didn't really stay on top of it the rest of it wouldn't get
finished either. We still have no front landscaping, that was a
priority you know if might promote the sale of the subdivision or
rather the rest of the lots out there.
Tolsma: Mr. Johnson said the last time when we had this down
here we discussed a $300.00 fine and I'd suggest to you that if
its not done post—haste then I think that's fair. It was
supposed to be completed in two weeks. Maybe if we instituted
the fine it would be done a little faster.
Bill Hammons with Caldwell Banker — Aspen Realty. I believe the
fine is probably in order, I don't think she has any problem with
that. Mrs. Arnold will be returning tonight and she does send
her apologies. I have a little problem with it. If our
landscapers would have performed, it would have been done.
Explained reasons for landscaping not being done yet.
Kingsford: I recommend that the Council vote the $300.00 fine
starting tomorrow.

institute the $300.00 a day fine against Merrywood Subdivision.

Kingsford: We will begin with an item of old business, Mr.
Riddlemoser if you•would come forward and tell the Council of the
situation at Merrywood Subdivision. Mr. Riddlemoser is
representing the City of this issue because of a conflict of
interest with our City Attorney.
Riddlemoser: It appears there that there has been nothing done
towards the fencing requirements along the railroad right of way.
There is activity out there now working toward connecting the
City water to the pressurized irrigation system. I understand
that is to be completed sometime tomorrow. As far as the
construction landscaping of the berm is concerned, the only thing
that has happened in that regard, that at least is visible is
they scratched some weeds up. They do not have a berm up there
and there is no landscaping. I talked to Mr. Johnson, the
Engineer, this afternoon and I had suggested that both he and
Mrs. Arnold come to explain the situation as it is going to be
done in the future, because what is visible out there and what
needed to be done and frankly in conversations with Mr. Johnson
on two occasions a week ago last Friday, even though the letter
went out on Monday there was two conversations on Friday the 10th
in which he was advised there as to the actions of the City and
that the letter was forthcoming and on the second conversation
assured me that things had started to happen that afternoon.
They are here to talk to you. From what it appears there hasn't
been much done in the last ten days.

Roy Johnson: Mrs. Arnold has been out of town for about two
weeks. She is unable to be back in town for probably another
week or two. What we have done to date is we hired a landscape
company to come in there and do the landscaping work and he was
to start a two weeks ago yesterday and he's been very slow
getting it done. They were digging the trenches to hookup to
City water today when I was out there. Possibly they can hook it
U0 by tomorrow night but it depends on whether the backflow
preventor required by the City is available. I stopped the
landscape people that were going to do the sprinkler today
because the berms are not as high as they should be. Explained.
Mrs. Arnold gave us the go ahead to contract to construct the
fence and the berms along the back. She did this today from out
of town and we will contact some fence company's and try to have
that going just as soon as the fence company can get it. We will
be contacting them tomorrow. I apologize for it not being done
and it has been very slow. We would ask the Council to give us a
couple of weeks to get this thing completed.
Tolsma: Wright Construction is going to build the berm and then
the landscape will be done as soon as the berm is filled?
Johnson: Yes.
Tolsma: Is that the berm that goes up along the railroad tracks
also?
Johnson: Yes we are going to do it all at the same time.
Kingsford: Mr. Johnson, developers and engineers come in here
and want everything done yesterday. Yet when the tables turn
what your supposed to be doing is done at your convenience and
I'm starting to loose patience with it. We discussed a $300.00
fine and I suggest to you that if that's not done post—haste that
that will be instituted.
Johnson: I think that's fair.

Dear Members of the Commission:
We are submitting herewith for your review and approval, our
Application and support documents covering the Merrywood
Preliminary Plat and Merrywood Phase I.
We would ask that your review and approval of these items be
approached concurrently since a good deal of the preliminary layout
and design was accomplished during the recent rezone of the
property.
The Preliminary Plat considers 173 single family lots with an
additional 9 parcels to be dedicated for open space or right-of-way
uses. Phase I will take advantage of the existing grove of trees
and preserve them as part of the project entrance. This entrance
area will be held in common ownership and maintained by the
property owners association. Additional phases will continue this
open space along West Pine Avenue, providing it with earth berming,
landscaping and a meandering walkway/jogging path.
It is anticipated that construction on Phase I will commence
in July of this year, readying 50 lots for a late summer/early fall
marketing program. Early construction is also necessary to allow
underground improvements to occur on Pine Street prior to the ACHD
overlay program scheduled for this summer.
The following Statements of Compliance are offered in
accordance with the Ordinance Requirements:
All street improvements are to be constructed in
accordance with the Standards of the Ada County Highway
District and the City of Meridian Ordinances. All
sidewalks in the public right-of-way will be 5 feet in
width.

6. Street names shown have been selected by the
owner/Developer. However, it is understood that any
conflict with the Meridian City Grid System will require
an appropriate alteration of these names. Please make
changes known to us as soon as possible such that all
documents will have the correct name.
The development features will include the following:
a. A land plan which is in harmony with the
surrounding neighborhood, the site itself, the
Meridian Comprehensive Plan and Ordinances, the Ada
County Highway District Standards and good
engineering and design practice.
b. All utilities will be installed in accordance with
the Standards of the City of Meridian and the
utility providers. Easements will be provided
where necessary.
C. The drainage system for the development will
generally follow the current lay of the land and
runoff, if any, will exit the property in a
controlled manner at the current general locations.

major canals will be fenced.

d. The south boundary of the development lying
adjacent to the Union Pacific Railroad right-of-way
will be bermed using onsite earth materials. CC&Rs
will promote a uniform type and height of fencing
on all exterior lines of the development.
e. Landscape and open space is being provided at the
entrance and along the frontage of West Pine
Avenue, as well as the western end of the
development adjacent to Pine Avenue. These areas
will be attractively bermed using onsite earth
material and planted in trees, shrubs, ground cover
and grasses. These improvements are planned to

equipped with a 5 foot wide meandering sidewalk for
walking or jogging. Landscape areas will be fitted
with an underground sprinkler system and will be

through an underground pipe network and pumping
system deriving its source from either an onsite

Dear Members of the Commission:
We are submitting herewith for your review and approval, our
Application and support documents covering the Merrywood
Preliminary Plat and Merrywood Phase I.
We would ask that your review and approval of these items be
approached concurrently since a good deal of the preliminary layout
and design was accomplished during the recent rezone of the
property.
The Preliminary Plat considers 173 single family lots with an
additional 9 parcels to be dedicated for open space or right-of-way
uses. Phase I will take advantage of the existing grove of trees
and preserve them as part of the project entrance. This entrance
area will be held in common ownership and maintained by the
property owners association. Additional phases will continue this
open space along West Pine Avenue, providing it with earth berming,
landscaping and a meandering walkway/jogging path.
It is anticipated that construction on Phase I will commence
in July of this year, readying 50 lots for a late summer/early fall
marketing program. Early construction is also necessary to allow
underground improvements to occur on Pine Street prior to the ACHD
overlay program scheduled for this summer.
The following Statements of Compliance are offered in
accordance with the Ordinance Requirements:
All street improvements are to be constructed in
accordance with the Standards of the Ada County Highway
District and the City of Meridian Ordinances. All
sidewalks in the public right-of-way will be 5 feet in
width.

2. The uses as set forth in the Merrywood Subdivision are in
compliance with the City of Meridian Comprehensive Plan.
3. Existing utility services will be extended to the
Merrywood Subdivision which will, in turn, connect to
Meridian City public water supply and sanitary sewer
systems.
4. The design of the development will be in compliance with
Meridian City Ordinances.
5. Easements will be shown on the Preliminary Plat where
known. One of the purposes of routing the Preliminary
Plat will be to gain input from utility providers and
others which may require right-of-way or easements in
which to place their facilities. All easements will be
made a part of the Subdivision plats.
6. Street names shown have been selected by the
Owner/Developer. However, it is understood that any
conflict with the Meridian City Grid System will require
an appropriate alteration of these names. Please make
changes known to us as soon as possible such that all
documents will have the correct name.
7. The development features will include the following:
a. A land plan which is in harmony with the
surrounding neighborhood, the site itself, the
Meridian Comprehensive Plan and Ordinances, the Ada
County Highway District Standards and good
engineering and design practice.
b. All utilities will be installed in accordance with
the Standards of the City of Meridian and the
utility providers. Easements will be provided
where necessary.
C. The drainage system for the development will
generally follow the current lay of the land and
runoff, if any, will exit the property in a
controlled manner at the current general locations.
Through site irrigation systems will be preserved,
major canals will be fenced.

d. The south boundary of the development lying
adjacent to the Union Pacific Railroad right-of-way
will be bermed using onsite earth materials. CC&Rs
will promote a uniform type and height of fencing
on all exterior lines of the development.
e. Landscape and open space is being provided at the
entrance and along the frontage of West Pine
Avenue, as well as the western end of the
development adjacent to Pine Avenue. These areas
will be attractively bermed using onsite earth
material and planted in trees, shrubs, ground cover
and grasses. These improvements are planned to
enhance the attractiveness of the Pine Avenue
frontage, provide a buffer to the housing units and
provide an attractive linear park like atmosphere
equipped with a 5 foot wide meandering sidewalk for
walking or jogging. Landscape areas will be fitted
with an underground sprinkler system and will be
maintained by the Homeowner's Association.
f. In addition to the public water supply, the lots
will be furnished with an irrigation water supply
through an underground pipe network and pumping
system deriving its source from either an onsite
well or existing irrigation facilities.
