The above entitled variance request having come on for
consideration on August 18, 1992, at approximately 7:30 o'clock
p.m. on said date, at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, and the City Council having heard and taken oral
and written testimony, the City Council of the City of Meridian
makes the following:
FINDINGS OF FACT
1. That notice of the public hearing on the variance was
published for two consecutive weeks prior to the scheduled hearing
for August 18, 1992, the first publication of which was fifteen
(15) days prior to said hearing; that the matter was duly
considered at the August 18, 1992, hearing; that copies of all
notices were available to newspaper, radio and television stations.
2. That the notice of public hearing is required to be sent
to property owners within 300 feet of the external boundaries of
the land being considered pursuant to 11-2-416 E., 11-2-419 D., and
11-9-512 B. l.b. of the Revised and Compiled Ordinances of the City
of Meridian; that this requirement has been met.

COVERAGE CONTROLS, requires that in the C-N District structures
must be set back from the front yard lines fifteen (15) feet from
the property boundary.
4. That the Applicant has requested that it be granted a
variance from the above front yard set back requirement and be able
to construct an addition to the building that would be four (4)
feet from the back of the sidewalk.
5. The property in question is described as lots 1, 2, 22,
23, 24, 25 and 26 of J.M. Anderson Second Addition to Meridian, Ada
County, Idaho, and is known by the address 133 West Broadway,
Meridian, Idaho.
6. That the property is zoned Industrial, which under the
Zoning Ordinance requires a thirty-five (35) foot front set back;
the use is an existing use and the set back of 35 feet is not
required.
7. That the Applicant proposes to construct an addition to
its Meridian Senior Citizen's Center.
8. That the present structure has been located on the
property for a substantial period of time and prior to adoption of
the current zoning and development ordinance in April of 1984.
9. That the structure was previously used as a church.
10. That .the Applicant owns the property and structure to the
east of the Meridian Senior Citizen's Center.
11. That the City Engineer, Ada County Highway District,
Nampa & Meridian Irrigation District or the Central District Health
Department may submit comments and they shall be incorporated

herein if submitted,
12. That construction of the proposed addition would likely
interfere with the traffic sight triangle at West 2nd Street and
Broadway.
13. That there was no testimony or evidence submitted
objecting to the application.

1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City has authority to grant variances pursuant
to Section 11-2-419 of the Zoning Ordinance and pursuant to Section
11-9-612 of the Development Ordinances.
3. That the City Council has judged this application by the
guidelines, standards, criteria, and policies contained in the
Zoning Ordinance and upon the record submitted to it and the things
upon which it may take judicial notice.
4. That the Council may take judicial notice of its own
proceedings, those of the Commission, governmental statutes,
ordinances, and policies, and of actual conditions existing within
the City and the State.
5. That the following provisions of Section 11-2-419 A, of
the Zoning Ordinance is noted which is pertinent to the
FINDINGS OF FACT & CONCLUSIONS OF LAW - Page 3
Application:
11-2-419 A.
The Council may authorize in specific cases a
variance from the terms of this Ordinance or
from the Subdivision and Development
Ordinances as will not be contrary to the
public interest where, owing to special
conditions, a literal enforcement of the
provisions of this Ordinance would result in
unnecessary hardship. No non-conforming use
of neighboring lands, structures or buildings
in the same district and no permitted or non-
conforming use of lands, structures or
buildings in other districts shall be
considered grounds for issuance of a variance.
Variances shall be granted only where strict
application of the provisions of this
Ordinance would result in unnecessary
hardship. A variance application does not go
to the Commission unless directed by the
Council.
6. That the specific requirements regarding a variance
that must be evidenced and found by the City Council are as
follows:
11-2-419 C. FINDINGS
A variance shall not be granted unless (as a
result of a public hearing) the Council makes
a statement of supportive reasons based
directly on the evidence presented to it which
supports conclusions that the mentioned
standards and conditions of this Ordinance
have been met by the applicant and unless all
of the following exist:

circumstances or conditions

specified variance will not. be
detrimental to the public's welfare
or injurious to other property in
the area in which the property is
situated;
4. That such variance will not have
the effect of altering the interest
and purpose of this Ordinance and
the Meridian Comprehensive Plan.
7. That there does appear to be a specific benefit or
profit, economic gain or convenience to the Applicant in that the
expansion of the structure into the required set back area is not
allowed and the Applicant has control over the design of the
expansion.
8. That regarding Section 11-2-419 C it is specifically
concluded as follows:
a. That there are no special

affecting the property that the

clearly be unreasonable.

Kingsford: I will open the public hearing.
Mr. Nichols, 2111 S. Linder, Kuna, was sworn by the attorney.
Nichols: I've read your letter and I agree with you 100%
according to the way that it's been looked at. I believe there
is alterations that could be made very simple that would change
your mind if they were looked at in the right direction. On W.
2nd Street there's only four or five pieces of property south of
us and there's no more land down there but the railroad. W. 2nd.
could be made a one way street, Railroad Street is already a one
way street coming out going east, so I don't feel like the
corners of the building would be of any obstruction in that way.
I agree with you that we are going to be short on parking as we
grow. If anyone would like to take another look at this I'd be
glad to meet with them and go over it.
Kingsford: Thank you. Anyone else to testify? No response. I
will close the public hearing.
Corrie: I was down there today looking at this and they
definitely need some expansion. The plans here showing the
existing buildings, is this what your talking about extended?
Nichols: Yes.
Corrie: Rather than leave this courtyard here, make it a square
type building and compensate far this - going up to the sidewalk
and put it all in here and your entrances and having your new
additions on the side. Have you ever thought of doing something
like that?
Nichols: That's our second best. (Explained)

W/CONDITIONAL USE PERMIT BY JOHNSON 8 L.B. PROPERTIES:
Kingsford: I will open the public hearing. Is there anyone
present who wishes to testify?
John Connally, 134 S. 5th, Boise, was sworn by the attorney.
Connolly: I am here representing L.B. Properties. We appeared
on July 14, 1992 at a Public Hearing in front of the Planning 8
Zoning Commission, they unanimously recommended approval to this
Council to annex the property subject to the application and to
approve the commercial zoning and the underlying conditional use
permit. The property is located on Fairview, there is an
existing used car lot an it. My clients would like it
incorporated into the City to expand that use or possibly put
another commercial use on it. I will answer any questions you
have.
Tolsma: The property you want to develop is to the south of the
used car lot?
Connolly: Yes. The preliminary discussion I had with my client
was they were considering putting some sort of a storage
facility.
Tolsma: The person that owns the property directly south of that
this Dennis Baker has concerns about the residential area.
Suggests a berm or a six foot fence be put behind the residential
property.
Connolly: That's correct, Mr. Baker was at the Planning and
Zoning Commission hearing in June. My client spoke with him in
the. meantime and he said he would not be opposing the rezone or
the annexation request tonight.
Kingsford: We received a letter from him this afternoon. He
modified it slightly from the letter that was submitted to the
Planning 8 Zoning. He doesn't speak to as wide of a buffer.

Council of the City of Meridian will hold a public hearing at the
Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 o'clock p.m., on August 18, 1992, for the purpose of
reviewing and considering the Application of the MERIDIAN SENIOR
CITIZENS for a variance from the Zoning Ordinance, Section 11-4-
410 A; which requires a ten foot (10') minimum yard setback from
the side street right-of-way; Applicant requests to be allowed to
expand their present Senior Citizen Center within four (4) feet of
the back of the sidewalk toward Broadway Street, Meridian, Idaho,
which would require a variance from the set-back requirement. The
property is described as lots 1, 2, 22, 23, 24, 25 and 26, Block
2, J.M. Anderson Second Addition, Meridian, Ada County, Idaho, and

The property is now a Senior Citizen's Center. We need to enlarge so
that we can provide the services and programs available to the seniors
of the Meridian area. This center should be the focal point for all
seniors and senior activities in this community.
2. What special conditions and circumstances exist which are pecular to
the land, structure, or building involved and which are not applicable to
other lands, structures, or buildings in the same district?
The Meridiam Senior CitizenssCenter is located in a residential
neighborhood. The required set back limits us from the necessary room we
need to enlarge our facility, to meet the needs of this community's seniors
in the future.
3. Why will a literal interpretation of the provisions of this ordinance
deprive you of the rights commonly enjoyed by other~:properties in the same
district under the terms of this ordinance?
Due to our limited available space we must take advantage of all the
square footage we can and not endanger anyone or cause a hazard in our
community.
4. What special conditions or circumstances exist that were not a result
of your actions?
The original building is too small to accommodate the necessary
room we need to provide the services available to the seniors of this area.
5. Why will the granting of this variance not confer on you any special
privilege that is denied by this ordinance to other lands, structures, or
buildings in the same district?
We are a non-profit association,
providi&g~a public service to all
senior citizens in the western part of Ada County. This center, when
complete, will benefit all citizens of Meridian and surrounding area.

At this point, the Senior Nutrition Program does not intend to
pursue the variance with the Meridian City Council to locate a
walk-in refrigerator-freezer behind Meridian Senior Center.
First, the Ada County Highway District had an expensive process for
us to go through, then our grant request to help pay for the walk-
in unit was not approved. So until there are funds for such a
unit, we cannot proceed.

ITEM #9: BID ON IMPROVEMENTS AT THE SEWER PLANT:
Eng. Smith: Recently we opened the bids for improvements to the
influent screening and compaction system. We had two bidders,
one was Ewing Company of Boise at 591,937.16 and the other bidder
was Trammels, Inc. of Boise at 551,363.00. I have checked
through both bids and both were proper and acceptable. I would
request at this time that the City of Meridian accept the bid for
Trammels, Inc. and give them Notice of Award to be signed by the
Mayor and City Clerk.
The Motion was made by Yerrington and seconded by Tolsma to
approve the bid 6y Trammels, Inc. for the improvements to the
sewer plant and authorize the Mayar and City Clerk to sign the
Award of Bid.

Dale Ryan,. 1603 W. 7th Street, was sworn by the attorney.
Ryan: Our request is just for a variance from the setback requirement to build a walk in
cooler and freezer to supplement the nutrition program. I have with me Cindy Anderson
representing Central District Health for this matter. We would be able to buy in larger
quantities and save money.
Tolsma: Did you see the City Engineer's comments?
Ryan: Yes I have and there is no problem with them.
Eng. Smith: Gave explanation of right of ways. (TAPE ON FILE)
Kingsford: I'm not sure we can grant a variance to build on the property that we don't
have control over. I misunderstood I thought we were talking about allowing you to go
into the setback and I don't have a problem with that. We can't authorize you to build
in the right of way. I think the thing for you to do Mr. Ryan is to approach the
Highway District and see if there is a vehicle by which you could build there.

1. The Meridian Area Senior Citizens Association, Inc. is requesting a
variance of setback requirements to allow construction of a walk-in

2. W. Broadway Avenue has 80-feet of right-of-way (which is adequate),
and is improved with 24-feet of paving.
• 3. W. 2nd Street has 54-feet of right-of-way (which is adequate), and is
improved with 24-feet of paving.
4. The alley has 16-feet of right-of-way (20-feet is required), and is
improved with gravel. No access to the alley is proposed at this time.
5. This project is considered a minor change in use of the property; there-
fore, the standard street improvement requirements are waived.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the City
Council of the City of Meridian will hold a public hearing at the
Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 o'clock p.m., on October 1, 1991, for the purpose of
reviewing and considering the Application of the MERIDIAN SENIOR
CITIZENS for a variance from the Zoning Ordinance, Section 11-4-
410 A; which requires a ten feet (10') minimum yard setback from
the side street right-of-way; Applicant requests to be allowed to
construct a walk-in freezer within seven feet (7') of West 2nd
Street, Meridian, Idaho, which would require a variance from the
set-back requirement. The property is described as Lots 21, 22,
23, 24, 25 and 26, Block 2, J.M. Anderson Second Addition,
Meridian, Ada County, Idaho, and known by the address of 133 West
Broadway, Meridian, Idaho.

APPLICATION FOR VARIANCE
The property at the back of the Meridian Senior Center is the
only suitable place for the walk-in refrigerator freezer
combination adjacent to the building. The building and walk-in
unit proposed will extend to within 7 feet of the property line.
The proposal is to extend use of the land 6 feet out toward
the street from the existing building. The Meridian Senior Center
kitchen is utilized as the central kitchen for the Senior Nutrition
Program in Ada County.
If the variance is allowed and financing for the unit can be
arranged, the walk-in refrigerator/freezer combination would allow
Senior Nutrition to: (1) purchase larger quantities of food at a
discount, (2) eliminate shuffling of food on delivery days due to
lack of storage space, (3) purchase milk at a lower bid price, (4)
load Meals-On-Wheels milk and cold food items directly into the
vans and minimize traffic through the kitchen, (5) accept vendor
cold and frozen food directly to the cooler and freezer and again
minimize traffic through the busy kitchen.

1. What is intended to be done with the property?
Installation of a walk-in refrigerator freezer combination is
planned.
2. What special conditions and circumstances exist which are
peculiar to the land, structure, or building involved and
which are not applicable to other lands, structures, buildings
in the same district?
The land is directly adjacent to the Meridian Senior Center
(to the west) which houses the Senior Nutrition Program's
central kitchen for Ada County.
3. Why will a literal interpretation of the provisions of this
ordinance deprive you of rights commonly enjoyed by other
properties in the same district under the terms of this
ordinance?
Other properties whose buildings are situated farther from the
property lines would be able to make such an addition,
assuming the zoning is correct.
4. What special conditions or circumstances exist that were not
a result of your actions?
The Meridian Senior Center building is located less than 30'
from the edge of the property line.
5. Why will the granting of this variance not confer on you any
special privilege that is denied by this Ordinance to other
lands, structures, or building in the same district?
Other properties whose building are situated farther from the

A variance from the terms of this Ordinance shall not be granted by
the Council unless and until a written application for a variance is
submitted to the Administrator and the Council containing, where
applicable. (Application available from Administrator.):
1. Address of subject property;
2. Name, address and phone number of applicant;
3. Name, address and phone number of owners of subject property;
4. Proof of ownership or valid option on the property or a contract
interest therein with consent of the titled owner;
5. Legal description of subject property;
6. Present use of subject property;
7. What is intended to be done on or with the property;
8. The district that pertains to the subject property;
9. Vicinity map at a scale approved by the Council showing property
lines, existing streets, proposed district and such other items
as may be required;
10. Schematic building plans which indicate typical elevation and
floor plan of any proposed construction;
11. A list of the mailing addresses of all property owners (from
authentic tax records of Ada County) within three hundred (300)
feet of the external boundaries of the land being considered
and a listing of the mailing addresses of all property owners
within the area of Lhe land being considered;
12. Characteristics of subject property which prevent compliance
with the requirements of this Ordinance;

NOTICE OF HEARING
t
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the City
Council of the City of Meridian will hold a public hearing at the
Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 o'clock p.m., on October 1, 1991, for the purpose of
reviewing and considering the Application of the MERIDIAN SENIOR
CITIZENS for a variance from the Zoning Ordinance, Section 11-4-
410 A; which requires a ten feet (10') minimum yard setback from
the side street right-of-way; Applicant requests to be allowed to
construct a walk-in freezer within seven feet (7') of West 2nd
Street, Meridian, Idaho, which would require a variance from the
set-back requirement. The property is described as Lots 21, 22,
23, 24, 25 and 26, Block 2, J.M. Anderson Second Addition,
Meridian, Ada County, Idaho, and known by the address of 133 West
Broadway, Meridian, Idaho.
A copy of the Application is available upon request.
Public comment will be take and is welcome.
