We did sometime ago when we were doing the first preliminary plat, which consisted of 90 lots. They didn't express any interest at that time. When we submitted the application for the second preliminary plat again we approached the School District asking if they were interested in a school site in our property areas there and they declined. They felt it was not central with.the area they wanted to locate. Hepper: Did you have any problems with the City Engineer's comments? Turnbull: No. The traffic study is underway now. Hepper: Do you plan on piping those ditches? Turnbull: They hadn't addressed that. There is the Kennedy Lateral which could be re-piped. Hepper: This development is large enough to afford a partial development of a City Park. It doesn't appear that you have anything in here. Turnbull: No but we are willing to address that. Hepper: Do you have a comment on why the applicant couldn't go R-8 rather than R-4? Turnbull: Basically weave been going as you can see, if you take the first preliminary plat and the second preliminary plat as a total we have something in the order of 430 lots. We have done some larger lots in the current phase. We've been trying to maintain that, but when we get down by the freeway and are impacted by problems that the freeway causes, it's just a matter of marketing. Chairman Johnson: I think what you'll run into there with the City's attitude is`=to buffer that between the freeway with an R- 4. At this point we are discouraging an R-A zone. The secondary access to this subdivision continues to be a question that has not been answered. Kingsford City of Meridian 33 East Idaho Ave. Meridian, ID 83642 Re: Tiling of Kennedy Lateral Dear Mayor Kingsford: We are proceeding with the Kling of the Kennedy Lateral. In the process of putting this tiling project together, two issues have arisen. The first is that since the northern property boundary of The Landing No. 7 is the center line of the Kennedy Lateral, we therefor own only half the lateral. Tiling is not only required for our side, but will also be required of the property owner(s) on the north side of the lateral when the property develops. A "Late Comers" ordinance pertaining to tiling of waterways is therefore appropriate. At your direction, Wayne Forrey has begun to draft such an ordinance and will be submitting it for Council approval shortly. The second issue which has arisen is as follows: The Kennedy Lateral runs through or along our Landing No. 7 project for approximately 1200 feet. Of the 1200 feet, we co-own approximately 610 feet of the lateral with Mr. Gary Forr's (Mr. Forr's frontage is marked in yellow of the attached plat), and we co-own 326.67 feet of the lateral with the lot owners of the already developed Landing No. 4 (marked in pink). We did not develop The Landing No. 4. It appears that the developer for phase 4 was not required by the City to file the Kennedy along phase no. 4's frontage. However, we are being required by the City to dle our frontage. The City's decision to not require one entity, but later require another entity (Skyline) to file that same section of ditch (all under.the same ordinance) is inconsistent and appears arbitrary. Which raises the issue at hand: If the Kennedy Lateral is to be tiled for that 326.67 foot section, who is to pay for the Landing No. 4 (pink) half of it7 A late comers condition is not possible for the 326.67 feet because the development of phase 4 is complete. We firmly hold that we are not responsible for tiling the North half of the 326.67 feet. The approximate per foot cost of tiling this ditch (materials only) is $60.00. Thus, the cost of one-half of the 326.67 feet would be approximately $9,800.00. There seems to be only two possible solutions. Its' a 10 acre piece that adjoins the Mallard Landing Subdivision on the west and a little bit on the south. Its an expensive piece of ground and the only reason I try to build is to get another access in there as has been requested previously. The Annexation has been requested by both myself and the land owner who intends to retain ownership of about 2.5 acres of land on the northwest corner of the parcel. I read the conclusions that have been prepared and i only have 2 questions. I haven't seen any. agreements, any development agreements nor have I in the 27 years of developing have entered into one so I don't know what that contains but I'm sure it can be worked out. We have not prepared to address the question of variance, we don't know what your pleasure is in terms of pursuing that question. Our engineering people have indicated that based on their calculations 54 inch pipe would be required through that ditch. There is a 6 foot squash pipe on the one end and a 6 foot round pipe on the other end. His calculations indicate a 54 inch pipe would be the minimum requirement. Depending upon your pleasure, we could either present more data on that or we could work with the City Engineer as the time comes to determine whether or not that variance is going to be allowed or not. The other issue has to do with one comment made here which I think was probably a bit of a misunderstanding in the conversations in the Planning and Zoning hearing, paragraph 14 about the middle, it mentions a buffering from I-84. The question of the buffering on I-84 was raised really as I remember the conversation with regard to what was going to happen with the balance of our ground further to the east and south. The south boundary of this particular l0 acre parcel is a 1/4 mile away from the I-84 and for that reason we don't think that there is any need for buffering exists. We have full plans and specifications prepared for buffering that portion of the other ground the 40 acres to the south and east as it abuts the freeway but it doesn't have anything to do with this piece, like I say its a 1/4 mile away. I think it was a misunderstanding in the conversation. Often these can be simplified without changing the Court confirmed status of the rights, if arrangements are made with the Secretary of the District in. the advance planning stages. 2. Any irrigation supply lateral or canal which is owned and operated by the District and which may course the site, must not be obstructed nor encroachment made on its rights of way. -1- 3. Any alteration from the original delivery point must be approved by the Water Superintendent and transfers to accomplish this alteration must be arranged with the Secretary of the District as part of the system plan acceptance by the Board of Directors. 4. No alteration or enclosure of an irrigation canal or lateral shall be permitted without a license agreement. No access to such canals or laterals shall be denied to the District. 5. If irrigation service is 'not to be provided to .the individual properties, all property owners must be notified that the District tax is an obligation of all lands in the Irrigation District. This notification is in compliance with Idaho Law. 6. No destruction, interference, nor limitation upon water flows which are appurtenant to the property rights of others shall be permitted. 7. If development plans include _providinq irrigation, operation and maintenance of the system may be undertaken by a Lateral Ditch Water User's Association, in which case the District assumes no responsibility beyond the original point of delivery for the tract. 8. The District cannot provide permission for alteration of waterways belonging to and being a part of the property rights of individual land owners and to which waters flow from the system of the District. Permission must be granted Prom each oP the property owners having ditch and water rights in the waterway. C. REVIEW AND APPROVAL PROCESS 1. Applicant shall complete and submit the attached application form to the Secretary of the District. Two (2) copies of the proposed plans shall be submitted with the application. 2. Upon 'app`roval of the original application, plans and specifications for construction, prepared by a registered engineer, shall be submitted for review to the District. Plans and specifications shall be reviewed by the District water Superintendent and/or the District's engineers.' If acceptable, the developer will be notified. Prior to actual construction an estimate of the cost of construction shall be provided to the District. -2- 3. If a license agreement is required to conform to specifications of the District and/or recommendations of its engineers, the Secretary of the District will then make arrangements for an appropriate license agreement for which the licensee shall be liable for payment of attorney fees. 4. The District shall be notified prior to commencement of construction. Inspection by representatives of the District or its engineers will not constitute approval of all or any part of the system and shall in no way relieve the developer or his contractor of the responsibility for providing a sound, workable system. 5. The flows for the Kennedy Lateral that were provided the engineer were based on a year in which Nampa and Meridian Irrigation District could provide a full one inch per acre to every delivery. A margin of approximately 15 per cent for evaporation water was included. These calculations were used to obtain the size of the pipe in case that we ever have need to deliver this amount of water. However, with the urbanization within the area, the odds of the District ever running maximum flows are slim. Even with the known surface run-off upstream from The Landing No. 7 Subdivision, I do not believe that the District would have a problem with the ditch over flowing during a rain storm. Therefore, in order to clarify what I had written prior to this, I believe that a 48 inch pipe is adequate and I believe that it will work quite well. If the pipe line is installed according to approved plans, Nampa & Meridian Irrigation District will assume responsibility for the operation and maintenance. The information that I reviewed included storm water calculations and what I believe to be a demonstration on how the engineers for this project perceive Nampa & Meridian Irrigation District's system is ogerated. I would like to outline for you Nampa & Meridian Irrigation District's operation of the Creason Lateral. The Creason Lateral is measured downstream from the head works structure which is located at the confluence of the Finch Lateral and the Creason Feeder. The Creason Feeder carries water from the Fivemile Drain. When the Nampa & Meridian Irrigation District wants to divert water into the Creason Lateral from the Fivemile Drain, we have a check structure located downstream and to the west of the Creason Feeder. This cheek structure must-have boards placed in it to divert the water as the water is forced into the Creason Feeder. In a storm of the magnitude of the one that is being used in the demonstration by Brian Smith, I can assure you that these boards would be removed and, therefore, no water would be forced into the feeder. One of the potential water sources that was mentioned by Brian Smith was the Flack Drain. I do not believe that I even want to address the Flack Drain as the amount of water that comes into the Creason Lateral from the Flack Drain is insignificant. The Finch Lateral's main water source is the Ridenbaugh Canal-located off Maple Grove Road just north of Franklin Road in Boise. The Finch Lateral does generate some additional surface water but, in the case of a-storm of great magnitude,. the Creason Lateral has a check structure just below the confluence of the Creason Feeder and Finch Lateral in which boards can be placed. When this check structure is activated it pushes the water directly down the Creason Feeder into the Fivemile Drain, thus regulating the flow into the Creason Lateral. 2 do not believe water can even reach the Creason Lateral in the magnitude discussed in this report. The Finch Lateral had a syphon placed in it for a road crossing west of this vicinity. This syphon is approximately 48 inches in diameter and the size was based on flow calculations provided by Hubble Engineering. In summary, Nampa & Meridian~Irrigation District has owned and operated these facilities for well over 100 years. We have a current staff that is very dedicated and they are capable of dealing with a variety of situations including rain storms during water delivery season. I do not believe that this important fact was given any consideration when the report was prepared. The total issue happens to be, "Is it possible to operate and maintain H~ the Creason Lateral in the vicinity of Waterbury No. 5 Subdivisions with a 48 inch pipe and will the pipe run 2,000 inches?" In the ~ brief discussion that I had this morning with the Districts engineer, John Sharp, he agreed that a 48 inch pipe should be more than adequate to handle the flow of the Creason Lateral. I believe that a 48 inch pipe would be more than adequate and that it should work quite well. If the pipeline is installed according ~~Ayi to approved plans, Nampa & Meridian Irrigation District will assume all responsibility for the operation and maintenance. What your Engineer has suggested is probably a very good course of action and that's to encourage the Highway District to get a date and to get a budget figure tacked onto that project. Kingsford: Didn't the Highway District come up with a computer modeling for the whole County, a traffic flow that they are supposed to keep updating? Dobie: There's a model that's been maintained by ITD and by APA that's been in existence for over a decade. I don't think that it's been updated recently. Explanation further. Giesler: Mr. Dobie on a 20 second delay, what does that consider is it like three cars sitting at the sign or waiting? Dobie: It would be about six vehicles. Kingsford: For the Council's information, we did receive a letter on September 15th from Gary Fors with regard to an agreement that was apparently struck between Mr. Ted Johnson himself on an earlier phase that both parties agreed to a-fence between the properties that has not been accomplished. An application form may be obtained at the District office which will provide necessary preliminary information for District review. A. DRAINAGE: 1. There will be no acceptance of any increased flow in storm run-off, drainage, or any contaminated waters for which the District might be made liable by the Federal and/or State Clean Water Laws. 2. Existing or replacement of on-site drainage or run-off facilities or modification thereto must be perpetually maintained by the site owner or owners. 3. Drainage plans prepared by a registered engineer may be required where deemed necessary by the District even though on-site modifications to the District drainage system are not required in the development plans. If a drainage lateral owned and maintained by the District courses the site, no alterations of the lateral nor encroachment or its right of way shall be permitted without a license agreement. No access to such drain shall be denied to the District. B. IRRIGATION i. The water rights of this District are not the same throughout the District. Neither are these always the same on one tract of land. Oftsn these can be simplified without changing the Court confirmed status of the rights, if arrangements are made with the Secretary of the District in the advance planning stages. 2. Any alteration from the original delivery point must be approved by the Water Superintendent and transfers to accomplish this alteration must be arranged with the Secretary of the District as part of the system plan acceptance by the Board of Directors. 4. No alteration or enclosure of an irrigation canal or lateral shall be permitted without a license agreement... No access to such canals or laterals shall be denied to the District. 5. Zf irrigation service is not to be provided to the individual properties, all property owners must be notified that the District tax is an obligation of all lands in the Irrigation District. This notification is in compliance with Idaho Law. 6. No destruction, interference, nor limitation upon water flows which are appurtenant to the .property rights of others shall be permitted. 7. If development plans include providing irrigation, operation and maintenance of the system may be undertaken by a Lateral Ditch Water User's Association, in which case the District assumes no responsibility beyond the original point of delivery for the tract. 8. The District cannot provide permission for alteration of waterways belonging to and being a part of the property rights of individual: landowners and to which waters flow from the system of the District. Permission must be granted from each of the property owners having ditch and water rights in the waterway. C. REVIEW AND APPROVAL PROCESS 1. Applicant shall complete and submit the attached application form to the Secretary of the District. Two (2) copies of the proposed plans shall be submitted with the application. 2. Upon approval of the original application, plans and specifications for construction, prepared by a registered engineer, shall be submitted for review to the District. Plans and specifications shall be reviewed by the District Water Superintendent and/or the District's engineers. If .acceptable, the developer will be notified. Prior to actual construction an estimate of the cost of construction shall be provided to the District. -2- 3. if a license agreement is required to conform to specifications of the District and/or recommendations of its engineers, the Secretary of the District will then make arrangements for an appropriate license agreement for which the licensee shall be lfabls for payment of attorney fees. 4. The District shall be notified prior to commencement of construction. Inspection by representatives of the District or its engineers will not constitute approval of all or any part of the system and shall in no way relieve the developer or his contractor of the responsibility for providing a sound, workable system. 5. Within ten (30) days after completion of construction the developer's engineer must certify to the District that the system was installed in accordance with plans and specifications, and .furnish as-built drawings to the District. 6. The developer and/or his contractor shall be responsible for the repair of all defects, leaks or failures occurring in the installation for a period of three (3) years after completion of construction. A maintenance and warranty bond in the amount of 108 of the estimated or actual construction cost, whichever is greater, shall be furnished to the District within thirty (30) days after. completion of construction. If the owner or his contractor fails to make required repairs or replacements promptly, the District shall make them,. and the cost thereof shall be paid by the owner, his contractor or the surety. The fees required will be: 5650.00 7. Johnson, Vice President of Skyline Corporation. Mr. Johnson states that Skyline Corporation is being required to the the Rennedy Lateral that runs through or along The Landing #7. Be states that a portion of the Rennedy Lateral runs between both The Landing #4, which you developed, and The Landing #7, in which he is in the process of developing and he states it appears that the developer for phase 4 was not required by the city to the the Rennedy Lateral along phase number four's frontage. Section 11-9-605 M, PIPING OF DITCHES, which requires that irrigation ditches, laterals, or canals intersecting, crossing, or lying adjacent and contiguous, or which canals, ditches or laterals touch either or both sides of the area being subdivided, shall be covered and enclosed with tiling, was passed by the City Council in October of 1991. Therefore, this tiling requirement was required to be met by Brighton Corporation when they developed The Landing #4 Subdivision. Gary Smith commented on April 10, 1992, regarding The Landing #2 Subdivision Preliminary Plat, which Preliminary Plat included the land that was developed as The Landing #4, and he commented as follows: "6. Also, in the request for subdivision approval for the preliminary plat of The Landing Subdivision #4, submitted by Skyline Corporation, a copy of which is attached, it states in Item #4 under STATEMENTS OF COMPLIANCE as follows: "4. Development will comply with city ordinances." Also, in City Engineer, Gary Smith's, comments on The Landing Subdivision #2 preliminary plat, which included the land which was subsequently developed as The Landing #4, Mr. Smith commented as follows: "5. Any and all irrigation and drainage ditches passing though this subdivision shall be piped, with material acceptable to the users or maintaining agency, with cleanout structures at maximum 300 foot intervals and grated inlet structure." I have attached a copy of this comment also for your information and use. Also, Mr. Turnbull, at the Planning and Zoning public hearing on April 14, 1992, regarding this land, Ted Hepper and you had a short discussion which is quoted below: HEPPER: Did you have any problem with the City Engineer's comments? TURNBULL: No. The traffic study is underway now. HEPPER: Do you plan on piping those ditches? TURNBULL: They hadn't addressed that. There is the Rennedy Lateral which could be re-piped. I have also enclosed a copy of that portion of the minutes of the hearing for your use. The tiling Ordinance was in effect and required to be met at the time of the preliminary plat for what was subsequently developed as The Landing #4 Subdivision. It also was in effect when the final plat for The Landing #4 Subdivision was approved. The City adequately put Skyline Corporation on notice that the piping of the ditch was required. Mr. Ted Johnson, in the request for subdivision approval, stated that development will comply with all City Ordinances. Section 11-9-605.M, PIPING OF DITCHES, was an Ordinance that was in effect at the time of submission of the preliminary plat of The Landing Subdivision #4. I certainly do not know at what point in time the title to the land that you developed as The Landing #4 was transferred from Skyline Corporation to Brighton Corporation, but any representation's or commitments about the land made by Skyline are binding on Brighton Corportion. That date, however, is irrelevant since your predecessor, Skyline ~ • Corporation, was duly informed of the requirement of the tiling of the Kennedy Lateral and, therefore, you are deemed to have notice of the requirement and the City Ordinances in a =oval and when you Corporation submitted their request for plat app purchased the property, required that all ditches within a subdivision or adjacent thereto, be tiled. Brighton Corporation, therefore, had the duty to comply with the Ordinances of the City of Meridian and the the Kennedy Lateral. Brighton still has that duty. The irrigation water has been shut off for the winter season, and you should have no difficulty in completing that tiling on or before November 30, 1995. if the tiling is not completed on or before November 30, 1995, the City will pursue additional action to specifically enforce the provision of the Meridian Ordinance requiring that the Kennedy Lateral be tiled. Just a comment to you. I have attached a copy of Tucker M. Johnson's letter to Mayor Ringsford. It states that the approximate per foot cost of tiling this ditch is $60.00 and the cost of one-half of the 326.67 feet which crosses both the land owned by Brighton Corporation, in The Landing #4, and the land within The Landing #7, owned by Skyline Corporation, and it would definitely appear that both Brighton Corporation and Skyline Corporation could well cooperate in this matter and achieve this tiling at a reasonable cost, as stated in Mr. Johnson's letter, of $9,800.00 for each land owner. In the process of putting ffiis tiling Project together, two issues have arisen. The first is that since the northern ProP~Y boundary of The Landing No. 7 is the center line of the Kennedy Laterat, we therefor own only half the lateral. Tiling is not only required for our side, but will also be required of the property owner(s) on the north side of the Lateral when the property develops. A "Late Comers" ordinance pertaining to tiling of waterways is therefore appropriate, At your direction, Wayne Forrey has begun to draft such an ordinance and will be submitting it for Council approval shoNy. The second issue which has arisen is as follows: The Kennedy Lateral runs though or along our Landing No. 7 project for approximately 1200 feet. Of the 1200 feet, we co-own approximately 610 feet of the lateral with Mr. t.rary Forr's (Mr. Forr's frontage is marked in yellow of the attached plat), and we co-own 326.67 feet of the lateral with the lot owners of the already developed Landing No. 4 (marked in pink). We did not develop The Landing No. 4. It appears that the developer for phase 4 was not required by the City to file the Kennedy along phase no. 4's frontage. However, we are being required by the City to file our frontage. The City's decision to not require one emity, but later require another entity (Skyline) to file that same section of ditch (all under.the same ordinance) is inconsistem and appears arbitrary. Which raises the issue at hand: If the Kebeedy Lateral is to be tiled for that 326.67 foot section, who is iA pay for the Landing No. 4 (pink) half of it? A late comers condition is not possible for the 326.67 feet because the development of phase 4 is complete. We firmly hold that we are not responsible for tiling the North half of the 326.67 feet. The approximate'per foot eost of tiling this ditch (materials only) is 560.00. Thus, the cost of one-half of the 326.67 feet would be approximately $9,800.00. There seems to be only two possible solutions.
