(Dan Wood) _~ hereafter referred to as "DEVELOPER", and the CITY OF MERIDIAN, a municipal corporation of the State of Idaho, hereafter referred to as "CITY". RECITALS: 1. DEVELOPER is the owner and developer of _ Kearney_Place _ Subdivision, hereafter referred to ~`~_--. as SUBDIVISION, a subdivision located in Meridian City, Ada County, Idaho, more particularly described on Exhibit "A" hereto and incorporated by this reference as if set forth in full herein. 2. DEVELOPER has obtained the approval of the preliminary plat for SUBDIVISION and is seeking the approval of the final. plat for a portion of the SUBDIVISION, consisting of approximately ____` acres, more particularly described in Exhibit "B" attached hereto and incorporated herein by this reference as if set forth in full herein. 3. The portion of the SUBDIVISION now being applied for to be finally platted consists of 2~____~~_ residential lots. 4. Under Meridian City Ordinance Section 11-9-606 B. 14. (Ordinance No. 557 passed October 1, 1991) the DEVELOPER must either install a pressurized irrigation system to each lot within a residential subdivision and provide the water source or in the PRESSURIZED IRRIGATION AGREEMENT Page - 1 alternative, this requirement may be waived by the CITY upon the DEVELOPER either (a) deeding to the CITY land for a well, drilling the well and placing the well on line with the CITY water system, including the necessary pumps, piping, valves, pressure equipment, water storage, and all other equipment and facilities necessary, and which well depth and capacity are determined by the CITY, or b) deposit, give and grant sufficient funds to the CITY to meet the requirements of paragraph 4(a) and put the well on line with the CITY water system. This latter option (b) may mean depositing with the City sufficient funds or posting a letter of credit payable to the CITY in a sufficient amount for the City to meet the requirements of paragraph 4(a) to provide water for irrigating the lots from the City's existing domestic water system. 5. This Agreement is in satisfaction of DEVEI_OPER's AGREEMENT as a developer under the latter alternative set forth in 4(b) above. NOW, THEREFORE, in mutual consideration of the covenants contained herein, the parties agree as follows: I. DEVELOPER hereby agrees to pay to the City the sum of FIDE HUNDRED DOLLARS ($500.00) per lot for each lot in that portion of the SUBDIVISION that DEVELOPER is requesting a final plat for, which sum is calculated at an approximate cost for the CITY to meet the requirements of paragraph 4(b) to provide each lot in the SUBDIVISION pressurized sprinkler irrigation water. 2. DEVELOPER hereby deposits or agrees to immediately post PRESSURIZED IRRIGATION AGREEMENT Page - 2 a letter of credit in the amount of $ 11,500.00 binding DEVELOPER and a surety acceptable to City, to pay any obligations due under this Agreement. 3. The parties acknowledge that they are unable to determine at this time what the actual cost to the City of providing additional domestic water necessary to provide sprinkler irrigation water for the lots in the SUBDIUISION will be and thus are agreeing to enter into this Agreement and provide a letter of credit in the above amount specified amount, which represents the best estimate now obtainable that DEVELOPER, as the developer and owner of the SUBDIVISION, would be obligated to pay towards meeting the requirements of paragraph 4(a) to serve the SUBDIVISION with pressurized sprinkling irrigation water. 4. The actual amount of DEVELOPER'S payment and contribution towards a well system shall be determined by the CITY'S Engineer, who shall calculate the total amount of the cost to meet the requirements of paragraph 4(a) to provide irrigation water for sprinkling in the SUBDIVISION. It is agreed that the CITY engineer shall make a good faith effort to arrive at the cost to DEVELOPER realizing that other subdivisions may be able to be service out of one well; however it is also specifically agreed that any well drilled by the CITY will not be drilled solely for irrigation water purposes but shall be available to supply water for the domestic water supply of the CITY. 5. DEVELOPER shall be obligated to, and agrees, to pay the PRESSURIZED IRRIGATION AGREEMENT Page - 3 cost as determined above and it is specifically agreed that if the cost is less than $500.00 per lot the CITY shall either draw on the letter of credit only that amount sufficient to pay the actual cost determined by the CITY engineer or the DEVELOPER may pay that amount in cash to the CITY and the letter of credit shall be returned to DEVELOPER. It is further specifically agreed that if the $500.00 per lot is insufficient to pay the actual costs as determined by the City Engineer, DEVELOPER shall pay, and hereby agrees to pay, to the CITY any difference between the $500.00 per lot, as posted in the letter of credit, and the actual cost of meeting the requirements of paragraph 4(a) as determined by the CITY Engineer. 6. The City Engineer, acting on behalf of the City, shall make such determination and calculation as soon as is reasonably practical and shall notify DEVELOPER in writing of his determination. DEVELOPER shall pay the amount due under this Agreement to the City prior to obtaining any building permits for the construction of homes in the SUBDIVISION. 7. Prior to final platting of any other lots in said SUBDIVISION, DEVELOPER agrees to meet the requirements of Ordinance 11-9-606 B. 14. 8. That in the event that either party to this agreement pursues legal action to enforce the terms of this agreement the prevailing party shall be entitled to their attorney fees, court costs, and out of pocket costs. The addition of Pioneer Elementary will provide some relief at the elementary level, but our secondary schools continue to become more over-crowded. We need help and support to provide adequate classroom space. I have two additional comments that may be of interest to you. The first is that busses may not enter the subdivision until our transportation director has inspected the turns for radius. The second is that these children may not attend the most local schools currently serving the area. It may be necessary to transport them to any school in our district with available space.
