They have agreed to put an emergency road in from Franklin down into the Rcademy and put a break-away barrier- at Franklin Road so there would be no through traffic from Lanark out to Franklin Read. N,ingsford: First off, when it came up before I declared conflict of interest and don't know what my role should be in this discussion. Did you want them to inter-act? If so, then Ren should handle that. Giesler: I have visited personally with them and they have no prcblem with those two issues. I did bring up and there's a little bit of a conflict yet that we take a look at this in a year^ to see if we do in fact have some safety problems in here with the traffic off of Lanark. It was my request that we lock at this in a year and if in fact from the police reports and other information we receive, in fact find out that we do need that emergency road as the main road into that Rcademy that that be done. They do have a problem with that condition yet. I would still like that as a condition and have them go to thei;- board and if it is not with their approval then they need to either refile far an appeal to our decision or whatever notes=_ar•v steps will need to be taken on that. i'ingsford: Our concern is not whether or not those children drive down Lanark, our concern is the safety of them. I think .f you look at cur Ordinance that would require an variance from that. Lanark is much longer than a culdesac length and to extend t. at even further, I think personally, requires a variance an^ really constitute a safety issue in my ,judgement. Kingsford: At this time I will turn the meeting over to Mr. Tolsma and step down due to a conflict of interest. Tolsma: Are there anv questions from the Council? Giesler; If the road is requested will the project still go? Chuck Leihe: We budgeted 4188,800.00 for this Academy move from the present location to the Lanark site. The low bid came in at 5209,000.00. We anticipate that the road would cost 515,000.00. To answer your question, yes the school will move anyway and we agreed to abide by your final decision. Gave description of the materials required to put in the road. Briggs engineering stated to plan on 815,000 to 520,000 for the roadway to be built. Time is a factor here also. We feel that Lanark is a public street and it seems out of line for somebody to be saying that our kids shouldn't use that street. It's a public street. We would like you to reconsider your condition put on our request. It is our request that you remove the condition. Tolsma: One of the basic reasons they wanted that road is beca~_ise your putting a school at the end of a dead entl street and for fire and emergency personnel to reach that it could be difficult. This road would give them a secondary access to oet in there. MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 2 Liehe: Lanark is a wide street and especially down at the end, it would take quite a few vehicles in there in an unusual position to block that road. We think that to have a road in there would be mare of a detriment than a help. Giesler: I think we'd require a breakaway barrier up there to where that isn't a through street. I do feel that we need the additional road. I would want a break-away barrier so that wouldn't be a through street, it would be just for that school. Those kids go in and out of that school off of Franklin Road so it wouldn't be a detriment to other businesses. It will have to be done to where the kids do not get down Lanark. Liehe: We have a drawing of the school on poster board. Would you like to see that? Giesler: That would be fine with me. I still feel it's very important. I know spending the extra dollars is a tough issue because it's something we don't have a plot of but I think if nothing else maybe a little bit better planning should have been done before it had gone this far. I feel that this condition we have put on is a very important one. How many kids are at the Academy? Liehe: 130. Corrie: How many of them drive? P. Gorman: About 80. But the buses leave at different times than the kids do. Giesler: You still aren't thinking about the emergency situation. Tolsma: This is not a public hearing. Private schools are allowed as a conditional use in the Industrial Zone; that while the school proposed to operated by the Applicant is in fact operated by Joint School District No. 2, a public school district, the school proposed to be operated is the Meridian Academy which is not in the nature of a public school because of the reason stated above. 7. Other property in the area is generally used for industry and commercial uses; that there are no nearby residences where the school will be located. 8. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. 9. That sewer and water is available to the property. 10. That the City Engineer, Meridian Fire Department, Sewer Department, Nampa & Meridian Irrigation District, and Central District Health Department have submitted comments and they are incorporated herein as if set forth in full herein. 11. That the Ada County Highway District (ACRD) has not submitted comments but they may and they shall be incorporated herein as if set forth in full herein. 12. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. Liehe: I'm representing the Meridian School District tonight and we are requesting a conditional use permit to move the Rlternative School from the 2 1/2 Street address to the end of Lanark Street. The reasons are, first of all we own the property and its larger it would accommodate the school. Evidentally the adjoining property owners don't care because we've had no negative comments about us moving it there and the District has budgeted money to move it. My land lays adjacent, to the east, of the property in question. It is my understanding that this property is zoned for commercial building only, which as I'm sure you realize, a school is not commercial. If you decide against my complaint and relocate the buildings anyway, I would like to address the problem of the property line. There is a practically non-existing fence lying there now, that has been in dis-repair for many years. It is our current intention to place, or cause to be placed, a railroad switch and lead track in the Union Pacific line running East and West across the northern boundary of the subject property. The intent of this construction is to provide access for rail born shipments to and from the FTZ and associated commercial facilities eventually located at this site. Increased rail activity (which will include stopping, sitting, switching and reversing of directions of travel that are common to such a utility) may provide an annoyance or hazard to those occupying the proposed facility. Nothing can be done to mitigate the occasional noise associated with normal railroad operations. On the other hand, we suggest that constructive action can be taken to minimize the potential physical hazards to students and others using the facility. 1. Placement of a fence or other means for the purpose of obstructing, limiting or preventing access to the tracks from the property and, 2. Strict enforcement of a policy forbidding access to or egress from the property to or from the north.
