realignment of that at Gary's request to better facilitate
keeping the ten inch water lane system near the corner. I have

Queen Drive-Inn Restaurant on our property on E. First Street.
The access will be from a new street to intersect. with E. First
Street. The new street w:ll be built by ACRD s-pec3fications.
They require it to be a forty one foot wide street measured back
to Dock of the curbs with a five foot sidewalk on the south side.
The sewer and water will be extended as required.
Corrie: The Fire Department requested either a turn around on
that proposed road or connect up with that other street. Is that
a aroblem?
rion: We'll certainly meet whatever we need to to do that.

rlon: The sewer is on our property to the east and it will come
from where the proposed road will be running east of the site.

William Hon, 3010 State Street, Boise, was sworn by the attorney.
Hon: My request will be a Dairy queen Restaurant of about 3,000
square feet. I have the architect present in case there are any
questions of him.
Hepper: Have you read the comments from ACRD?
Hon: Yes I did just a few minutes ago. It looks like everything
is okay.
Hepper: What kind of landscaping are you going to have along
East 1st Street?
Hon: The plan is to continue along E. 1st with the berm like
Nahas has done. It will be a similar arrangement.
Shearer: I was wondering how much of a hardship it would be on
you to extend the five foot sidewalk past your other lot, north
of the lot you are building on.
Hon: How far did you have in mind?
Shearer: Just by your property.
Hon: Yes we planned on doing that.
Shearer: It is the East 1st sidewalk on the north side.
Alidjani: Does the drive in portion go continuously around the
drive in?
Hon: Yes.

URBAN SERVICE PLANNING AREA:
Crookston: So far as the area of impact now we are addressing
expanding the east boundary north and south a quarter mile west
of Cloverdale but the purpose of the meeting is to discuss and
make any recommendations to changes anywhere.

change the area of impact for the City of Meridian to include
that area shown on exhibit "R" of City Records #537 and the south
portion referral area be added to the impact area and then the

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
January 28, 1992, at the hour of 5:30 o'clock p.m „ the Petitioner
appearing in person, the Planning and Zoning Commission of the
City of Meridian having duly considered the evidence and the
matter makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional
Use Permit was published for two (2) consecutive weeks prior to
the said public hearing scheduled for January 28, 1992, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the January 28, 1992,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations;
2. That this property is located within the City of
Meridian and is owned by the Applicant and is described in the
application which description is incorporated herein.

Service Commercial, which requires a conditional use permit for
the operation of a drive-in facility which the application
requests; that the proposed use is a Dairy Queen restaurant with
a drive-in food service window,
4. That the C-G General Retail and Service Commercial is
described in the Zoning Ordinance, 11-2-408 B. 9 as follows:
(C-G) GENERAL RETAIL AND SERVICE COMMERCIAL: The
purpose of the (C-G) District is to provide for
commercial uses which are customarily operated entirely
or almost entirely within a building; to provide for a
review of the impact of proposed commercial uses which
are auto and service oriented and are located in close
proximity to major highway or arterial streets; to
fulfill. the need of travel-related services as well as
retail sales for the transient and permanent motoring
public. All such districts shall be connected to the
Municipal Water and Sewer systems of the City of
Meridian, and shall not constitute strip commercial
development and encourage clustering of commercial.

5. That the use proposed by Applicant is an allowed
conditional use in the C-G district pursuant to 11-2-409 B., but
does require a conditional use permit pursuant to 11-2-409 B.,

6, That other property in the area is used commercially and
as farm ground; that one other establishment in the area has
drive-in food service window; that the present use of property is
farm ground and for a farm produce sales operation.
7, That proper notice has been given as required by law
and all procedures before the Planning and Zoning Commission have
been given and followed,
8. That sewer and water is available to the property.

9. That the City Engineer may submit comments and they
shall be incorporated herein as if set forth in full herein.
10. That the Ada County Highway District (ACRD) may submit
comments and they will be incorporated herein as if set forth in

CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property;
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant
to 11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian;
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of
the Revised and Compiled Ordinances of the City of Meridian,
Idaho;
4. That 11-2-418(C) of the Revised and Compiled Ordinances

Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and a review of the facts presented and the

conditions of the area, the Planning and Zoning Commission
concludes as follows:
a. The use, would in fact, constitute a
conditional use and a conditional use permit
is required by ordinance.
b. The use would be harmonious with and in
accordance with the Comprehensive Plan but
the Zoning Ordinance requires a conditional
use permit to allow the use.
c. The use apparently would be designed and
constructed, to be harmonious in appearance
with the intended character of the general
vicinity.
d. That the use would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive
additional requirements at public cost for
public facilities and services and the use
would not be detrimental to the economic
welfare of the community.
g. The use would not involve a use,
activity, process, material, equipment or-
conditions of operation that would be
detrimental to person, property or the
general welfare by reason of excessive
production of traffic or noise.
h. That sufficient parking for the property
and the proposed use will be required.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major
importance.

I have reviewed this request and have the following comments:
1. Water Suooly: A 12 inch diameter water line exists in E.
1st St. approximately 5 feet from the east right of way
line. It will be necessary for the applicant to install an
appropriate sized tee in the 12 inch diameter line and a
valve in the new line that will need to be built in the new
street. The new water line will need to be extended to the
end of the new street. Plans will need to be submitted and
approved for this water line installation.
2. Sewaoe Disposal: An 8 inch diameter sewer line exists in
Corporate Drive and a main trunk line exists on the east
side of the Nine Mile Drain, approximately 1100 feet east
and 100 feet north of this site. Plans need to be submitted
and approved for a sewer line to serve this site.
3. Parkino: (Ordinance Requirements)
Drive-In Portion = 5 spaces
Restaurant = 1 space per 200 S. F, of floor area
50 spaces provided; 22 spaces required
4. Surface Drainaoe: Must be retained and disposed of on-site
via subsurface method. Plan to be approved by City
Engineer.

FACTS & FINDINGS:
1. William Hon is requesting conditional use approval to construct a fast
food restaurant with drive-up lane on property located on the east side
of E. 1st Street, north of Central Valley Drive.
2. E. 1st Street is designated a minor arterial street on the 2010 Urban
Functional Street Classification Map requiring a minimum 66-foot right-
of-way and 52-foot street section with 4 traffic lanes.
E. 1st Street has 80-feet of right-of-way (which is adequate), and is
improved with six paved lanes (2-southbound, 1-turn lane, 2-north-
bound with an additional acceleration/deceleration lane. There is curb
and gutter on both sides and subject parcel has sidewalk along the
frontage. The "new" street has no right-of-way or street improve-
ments. There are curb return already set up for a new street at that
location.
3. The developer has proposed a new public street along the north side of
subject parcel. This street will be serving commercial uses and, there-
fore, will need to be built to a collector standard with a paved public
turnaround at the end with appropriate easement or right-of-way.
4. The westerly curb cut as proposed is too close to the intersection with
E. 1st Street. It should be at least 75-feet away from the easterly
curb line of E.-1st to the westerly edge of the curb cut.
5. This application for public hearing by the Meridian Planning & Zoning
Commission on January 20, 1992.
The following requirements are provided to Meridian Planning & Zoning as
conditions for approval.

1. Locate curb cuts a minimum of 75-feet away from street intersections in
accordance with District Policy.
2. The proposed street shall be constructed to collector standards (91-foot
street section) with a paved public turnaround at the end and appropri-
ate easement or right-of-way.
3. Direct lot or parcel access to East 1st Street is prohibited, in compli-
ance with District policy. Lot access restrictions shall be stated on the
final plat.,.,.
STANDARD RE UIREMENTS:
1. Street and draihage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies.
2. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACHD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
3. Provide written approval from the appropriate irrigation/drainage dis-
trict authorizing storm runoff into their system.
4. Locate obstructions (utility facilities, irrigation and drainage appurte-
nances, etc.) outside of the proposed street improvements. Authoriza-
tion for relocations shall be obtained from the appropriate entity.
5. Continue existing irrigation and drainage systems across parcel.
6. Submit three sets of street construction plans to the District for review
and appropriate action.
7. Submit site drainage plans and calculations for review and appropriate
action by -ACHD. The proposed drainage system shall retain all storm
water on-site.
8. Provide design data for proposed access to public streets for review
and appropriate action by ACHD.
9. Developer shall provide the District with a copy of the recorded plat
prior to the installation of street name signs.
10. A, right-of-way permit must be obtained from ACHD for all street and
utility construction within the public right-of-way. Contact Quality

11. A request for modification, variance or waiver of any requirement or

NOTICE IS HEREBY GIVEN that the Planning and Zoning
Commission of the City of Meridian will hold a special meeting at
5:30 o'clock p.m., Tuesday, January 28, 1992, at the Meridian City
Hall, 33 East Idaho Street, Meridian, Idaho. This special meeting
was previously noticed for the purpose of conducting a public
hearing on the application of William Hon for the issuance of a
Conditional Use for drive-in Dairy Queen restaurant. That Hearing
will still be held and testimony and evidence will be taken, The
purpose of this amended notice is to give notice that said meeting
will also be for consideration by the Planning and Zoning
Commission of amendments to the Area of Impact of the City of
Meridian and the Urban Service Planning Area.
The public is welcome and public comment or testimony will
be taken regarding the Conditional Use Application of William Hon

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of
the City of Meridian and the laws of the State of Idaho,
that the City Council of the City of Meridian will hold a
public hearing at the Meridian City Hall, 33 East Idaho St.
Meridian, Idaho at the hour of 7:30 o'clock, p.m., on
February 18, 1992, for the purpose of reviewing and consid-
ering the application of William Hon for a conditional use
permit for a drive-in restaurant for a Dairy Queen at the
property described as a portion of the SW 1/4 Section 18,
Township 3 N, Range 1 E, B.M., Ada County, Idaho. The
property is generally located adjacent to Central Valley
