Will we have those? Dave Collins: Yes, they are required at the end of every stub road with the exception of the most southerly one to the west which is only one lot deep and the intersection then functions as a turn-around there. Corrie: Is this R-4 or R-8~ Collins: R-4. Corrie: The berm will go in at the same time the subdivision goes :n~ Collins: The Highway District is talking an 80 foot right of way at this time, which would take up this seven foot strip that the City has requested we put in adjacent to the 66 foot right of way on each side. Tolsma: The Sewer Department had a comment here that the sewer line runs through Lot 11 - Blk. 1 - Is says no building will be allowed on this lot, is that going to be an easement there? Collins: Coming in from the east yes. The alignment right now is adjacent to the north boundary line of that lot and we are currently looking at using the balance of the lot for a storm water detention system. Idaho Meridian, Idaho 83642 Re: Chateau Meadows East #9 Dear Commissioners: I have just reviewed the preliminary plans for Chateau Meadows East #9 Subdivision. This planned development will accelerate the need for Joint School District No. 2 to construct additional classrooms and/or to adjust school attendance boundaries. Meridian Schools do not have excess capacity. Nearly every school in the district is beyond capacity. The Meridian School District supports economic growth for Idaho and specifically the district's area, but such growth produces a need for additional school construction. We ask for a development fee statute on new home construction or a real estate transfer fee to help offset the costs of building additional school facilities. We require support for these revenue sources from developers and other interests seeking planning and zoning approval for residential projects. If this support is lacking then we ask that additional residential development be denied. School bus service may be restricted if adequate turnarounds and loading areas are not provided. Residents cannot be assured of attending the neighborhood school as it may be necessary to bus students to available classrooms across the district. We ask that you assure the developer will provide walkways, bike paths and safe pedestrian access. A,y~ RE: CHATEAU MEADOWS EAST N0. 9 FINAL PLAT REVIEW I have reviewed this submittal and have the following comments for your consideration as conditions of the applicant during the approval process: 1. This final basically complies with the approved preliminary plat. 2. Show the names of surrounding subdivisions or as unplatted. 3. Show initial point and tie distances. 4. The culdesac length of street should be named E. Meadowprass Court and E. Meadowgrass Street should be labeled west of Sequoia. 5. Show culdesac radius and right of way width. 6. Add note stating "maintenance responsibility of any irrigation ditch or pipe is by the owner of the lot it crosses unless such responsibility is assumed by an irrigation/drainage district". 7. The legal description in the application is not for this subdivision. I don't know what it is for. The legal in the Owners Certificate is short one bearing/distance and ano ther one is wrong. 3. Revise the City Engineer Certificate to simply say he approves the plat. 9. The purpose of this meeting is to discuss early and informally the purpose and effect of this Ordinance and the criteria and standards contained herein, and to familiarize the developer with the Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and such other plans and ordinances as deemed appropriate. The developer may also meet with the Commis- sion or Council prior to submitting an application. 9-604 C. PRELIMINARY PLAT 1. Application'- The applicant shall file with the Administrator a complete subdivision application form and preliminary plat data as required in this Ordinance, not less than thirty (30) days prior to the Commission's public hearing. The Commission will not schedule any hearing or workshops or put the application on the agenda unless the above conditions have been met. 2. Public Hearing to be Held Prior to Subdivision Plat Approval A public hearing'shall be held at the time of presentation of .the preliminary play by the developer to the Commission for the purpose of allowing public input on the proposed subdivision. 3. Combining Preliminary and Final Plats - The applicant may re- quest that the subdivision application be processed as both a preliminary and final plat if all of the following exists: a. The proposed subdivision does not exceed four (4) lots; b. No new street dedication or street widening is involved; c. No major special development considerations are involved, such as development in a floodplain, hillside development or the like; and d. All required information for both preliminary and final plat is complete and in an acceptable form.' Removing our fence without even giving us any notification that a boundary dispute existed was reprehensible and totally unacceptable. Upon discovering the fence removal I contacted my son, Chet Pipkin, who in tuzn contacted Garret Longstreet of Park Pointe Realty, who represented you in an offer for our property. Mr. Longstreet informed us that you had the property surveyed and that the survey showed the property line to be approximately six feet North of the fence line which has been the boundary since before 1977 when we purchased the property and confirmed by a survey at that time as well. Upon consultation with legal counsel in regard to your attempt to change our property line, we were advised to have the property surveyed ourselves. We had Toothman and Orton Engineering company survey the property and found the property line to be where our fence once was and will be again as soon as the weather permits. We further expect you to remove the sewer system that you have installed on our property and pay all costs associated with both. Upon receipt of this letter i think you will agree that a problem exists. The problem can be rectified by reinstating our fence to where it was. To make changes to the property line we can sit down and come to an agreement among our selves, contract an independent arbitrator to assist in settling our dispute or take legal action to have the dispute settled in a court of law. Until and agreement is reached, we feel we have no - - - alternative but to protect our interest and will be sending a copy of this letter to the parties listed below.
