Wolfe: Presented a plan of the building to the Commission and
explained the layout.
Johnson: Any other questions of Mr. Wolfe? No response. Anyone

will close the Public Hearing.
The Motion was made by Rountree and seconded by Shearer that the
Meridian Planning and Zoning Commission hereby adopt and approves
the Findings of Fact and Conclusions of law.

ITEM #2: CONSIDERATION FOR AMENDING THE IMPACT AREA AND THE
URBAN SERVICE PLANNING AREA:
Crookston: So far as the area of impact now we are addressing
expanding the east boundary north and south a quarter mile west
of Cloverdale but the purpose of the meeting is to discuss and
make any recommendations to changes anywhere.

The Motion was made by Rountree and seconded by Shearer that we
change the area of impact for the City of Meridian to include
that area shown on exhibit "A" of City Records #537 and the south
portion referral area be added to the impact area and then the
north boundary of the City impact area add to the new impact area
boundaries the northern referral area extended to the west to
McDermott Road.
DEVELOPMENT AGREEMENT
This Agreement made and entered into this day of June,
1992, by and between McBEE INC., an Idaho Corporation, hereafter
referred to as "DEVELOPER", and the CITY OF MERIDIAN, hereafter
referred to as "CITY"
W I T N E S S E T H:
WHEREAS, the DEVELOPER has submitted an application for
annexation and zoning of certain property described as Government
lot 4, Section 2, Township 3 North, Range 1 West, Ada County,
Idaho, and requested zoning of R-8 Residential and has submitted
a residential subdivision preliminary plat for said property;
WHEREAS, the preliminary plat shows a density of 3.2
residential units per acre, which would be an R-4 subdivision, but
there are seven lots which do not meet all of the R-4 District
requirements; therefore all of the subdivision could not be zoned
R-4;
WHEREAS, DEVELOPER requested the R-8 Residential zoning so
that the lots, which do not meet the standards of the R-4 District
requirements, could all be approved even though they do not meet
the R-4 District requirements;

public hearing before the Meridian City Council as to house sizes
and the values of the houses that would be constructed;
WHEREAS, since the density of the preliminary plat shows a
density of 3.2, the CITY is not inclined to zone the entire piece
of property R-8 just so a few lots can be developed that do not
meet the R-4 designation and requirements and the CITY is more
inclined to only approve an R-4 development in the area in which
the property is located;
WHEREAS, the State of Idaho legislature, in 1991, passed
Idaho Code, 67-6511A, Development Agreements, which provides that
cities may enter into development agreements with developers upon
re-zoning land; that the CITY has not passed a development
agreements ordinance but is in the process of adopting such an
ordinance; that DEVELOPER desires to have his application for
annexation, zoning and subdivision plat approved as quickly as
possible and does not desire to wait until a development
agreements ordinance is passed by the CITY;
WHEREAS, DEVELOPER desires the CITY to enter into a
development agreement, even though the CITY does not have a
development agreements ordinance in force, and is urging and
pursuing this agreement so that DEVELOPER may proceed with its
development, which meets the density requirements of the R-4
District but does not meet all of the other requirements of the
R-4 District;
WHEREAS, the CITY has authority to place conditions and
restrictions upon annexation of property even though it does not

have a development agreements ordinance in force;
WHEREAS, DEVELOPER deems it to be in its best interest to be
able to enter into this agreement and acknowledges that this
agreement was entered into voluntarily and at its urging and
request;
NOW, THEREFORE, IT IS HEREBY AGREED AS FOL~_OWS:
1. That the CITY shall annex the property described as
Government Lot 4, Section 2, Township 3 North, Range 1 West, Ada
County, Idaho, and zone the property described in Exhibit "A" as
R-8 and zone the property described in Exhibit "B" as R-4.
2. That DEVELOPER, in accordance with its representations
before the City Council, shall, on the land described as
Government Lot 4, Section 2, Township 3 North, Range 1 West, Ada
County, Idaho, only construct single-family houses, all such
single-family houses shall have at least 1,420 square feet of
floor space, exclusive of garages, and that all such single-family
houses shall have a minimum value of, and be sold for, at least
$110,000.00.
3. That the property zoned R-8, described in Exhibit "A",

shall have lot sizes of at least 7,000 square feet, which is the
size represented at the City Council hearing, shall have no duplex
units constructed on said property, and, except for the
immediately preceding language in this sentence, the lots may meet
the Zoning Schedule of Bulk and Coverage Controls requirements of
the R-8 District.

lots or the size of lots as shown in the preliminary plat
submitted with the request for annexation, zoning and preliminary
plat approval.
5. That DEVELOPER agrees to abide by all ordinances of the
City of Meridian and the property shall be subject to de-
annexation if the owner or his assigns, heirs, or successors shall
not meet the conditions contained in the Findings of Fact and
Conclusions of Law, this Development Agreement, and the Ordinances
of the City of Meridian.
6. This agreement shall be recorded in the Recorder's
Office of Ada County, Idaho, and shall be binding on the heirs,
executors, successors and assigns of the parties hereto, on all
purchasers of lots or parcels of land in the property annexed and
zoned property, and all persons acquiring an interest in the
annexed and zoned property,
7. DEVELOPER hereby waives any and all rights it may have
to have this agreement declared null and void for failure of CITY
to have a developments agreement ordinance enacted or rules and
regulations enacted governing the creation, form, recording,
modification, enforcement and terminations of development
agreements and specifically agrees to hold CITY harmless and
indemnify CITY in the event that a person or entity not a party
to this agreement institutes actions or proceedings to have this
agreement, or any part of it, declared null and void, including
attorneys fees and costs and agrees to defend CITY in any such
actions or proceedings.

ADDENDUM AGREEMENT
It is intended by the parties hereto that this Addendum be made a
part of that certain Real Estate Purchase Sale Agreement and
Receipt For Earnest Money entered into by the parties on the 2(:,

It is further agreed by the parties that the terms and conditions
contained in this Addendum Agreement shall supersede any
conflicting terms contained in the said Real Estate Purchase and
Sale Agreement.
Seller acknowledges that Buyer is purchasing the subject property
for the purposes of development and subsequent sale of residential
lots.
Buyer's Conditions For Closing.
1. The city of Meridian must first annex the subject real
property.
2. The city of Meridian must approve Buyer's development
plan for 120 or more residential lots.
3. The terms and conditions of approval by the city of
Meridian must not substantially effect Buyer's position.
4. Buyer must be able to obtain acceptable financing for the
development.
5. Development must be economically feasible for Buyer.
6. Seller agrees to subordinate his interest in parcels to
be developed as hereinafter described upon request of
lender.
7. Seller agrees that Buyer shall have a right of first
refusal when, and if, Seller shou121.desire to sell the
approximate 4-acre parcel which he is retaining under the
terms hereof.
8. Seller agrees to connect his retained, approximate 4-acre
parcel to a pressurized water system when available, as
Buyer is concerned about drainage problems which might
result from flood irrigation.
9. Buyer's attorney must review and approve all terms and
conditions of the Real Estate Purchase and Sale Agreement
as well as all addendums thereto.

If built according
To be acceptable, any return flow water into the Ninemile Drain must be
covered in a license agreement. Also, enlargements of crossings must be
covered in a license agreement signed by Nampa 6 Meridian Irrigation District
prior to any construction. The Ninemile Drain has a 60 foot easement: 30
feet from the center both ways. The right-of-way must not be encroached upon
with fences, trees, buildings, etc.
Please contact Andy Harrington, 342-4591, for preparation of a license
agreement.
The District recommends that the developer supply gravity or pressure irriga-
tion to each lot.

provision in our Ordinance that the developer can contribute
to a Well Fund Account in lieu of the pressurized system.
This contribution has been set at $ 371.00 per lot, payable

Kingsford: I will open the Puhlic Hearing and invite a

Pat Tealy, 479 Main Street, Boise, was sworn by the attorney.
Tealy: I am representing the developer McBee, Inc., there is
also another representative of the developer. This is
approximately 41 acres on the corner of Ustick and Ten Mile. We
originally applied for an R-B zone. The only reason we applied
for an R-B was we had about 7 lots in the subdivision down around
7,000 sq. feet, there really wasn't any other way. The density
will be 3.2 units per acre. Nine Mile Drain runs through the
property and it is bordered by two Collector Street's. The
exterior lot size is 11,000 to 12,000 sq. feet and the interior
size 8,000 to 10,000 sq. feet. The houses will be a minimum of
1420 sq. feet - prices were stated to Planning and Zoning from
f150,000 to f200,000, but we would like to change that to from
5110,000 to f160,000.
Corrie: There was one comment from the Fire Department about
Plymouth Way going into adjacent property so there would not be
property land locked.

The undersigned are the de~~eiopers of the Candlelight
Subdivision.
We are corresponding in regards to our concern of the last
statement in section number two of ordinance number 57i which I
quote, "and all such houses sha'_i have a minimum value of, and be
sold for, at least S110,000.00. ?.s developers we feel that the
size of our lots as well as our requirement of 1-120 scuare foot
single story and 1x00 square foot multi-level homes and our
strict adherence of the Covenants, Conditions, and Restrictions
will achieve a development that both the developers and the City
of Meridian can be proud.
However we will be selling the lots to builders and homeowners.
It is our opinion that the market place will dictate sales prices
and we as developers are unable to control sales prices.
Therefore we are respectfully recuesting this item be amended or
stricken from ordinance number 577.
Also, it is our understanding that the City of Meridian is
prepared to supply irrigation water to the Candlelight
Subdivision. We are requesting the fee per lot be established
and the developers be notified.

I have reviewed this submittal and~have the following comments
far your consideration as conditions of the applicant during the
hearing process. The plat does conform to the street and lot
arrangement shown on the approved preliminary plat.
A. Sheet Na. 1:
1. Show an exterior boundary bearing and distance to the
initial point from the section line (centerline of Ten
Mile Road) and revise the next distance (north side of
Lot 1 - Block 2) to 130.00 feet.
2. Change Block 4 to 3 and Block 5 to 4.
3. Show an approved street name for each of the two east-
west streets.
4. Show the area to the west as "Unplatted"
5. Show setback distances to a 70 foot frontage on Lots 6
and 7 Block 1.
6. Show the 20 foot wide sanitary sewer easement inside
the 50 foot wide Nine Mile Creek easement.
7. Add a note stating "The maintenance of any irrigation
or drainage pipe or ditch crossing a lot is the
responsibility of the lot owner unless such
responsibility is assumed by an irrigation/drainage
district".
8. Should the plat title be Candlelight Subdivision No. 1
as shown on Sheet Na. 2?
B. Sheet No. 2:
1. No revisions are necessary unless the plat is not "No.
1".
Since this subdivision will contain a pressurized irrigation
system I recommend the City require a bond or letter of credit to
guarantee the completion and operation of the system.
