The Motion was made by Rountree and seconded by Shearer that the Meridian Planning and Zoning Commission hereby adopt and approves the Findings of Fact and Conclusions of law. Motion Carried: All Yea: ITEM #2: CONSIDERATION FOR AMENDING THE IMPACT AREA AND THE URBAN SERVICE PLANNING AREA: Crookston: So far as the area of impact now we are addressing expanding the east boundary north and south a quarter mile west of Cloverdale but the purpose of the meeting is to discuss and make any recommendations to changes anywhere. Discussion Held. (See Tape) The Motion was made by Rountree and seconded by Shearer that we change the area of impact for the City of Meridian to include that area shown on exhibit "A" of City Records #537 and the south portion referral area be added to the impact area and then the north boundary of the City impact area add to the new impact area boundaries the northern referral area extended to the west to McDermott Road. DEVELOPMENT AGREEMENT This Agreement made and entered into this day of June, 1992, by and between McBEE INC., an Idaho Corporation, hereafter referred to as "DEVELOPER", and the CITY OF MERIDIAN, hereafter referred to as "CITY" W I T N E S S E T H: WHEREAS, the DEVELOPER has submitted an application for annexation and zoning of certain property described as Government lot 4, Section 2, Township 3 North, Range 1 West, Ada County, Idaho, and requested zoning of R-8 Residential and has submitted a residential subdivision preliminary plat for said property; WHEREAS, the preliminary plat shows a density of 3.2 residential units per acre, which would be an R-4 subdivision, but there are seven lots which do not meet all of the R-4 District requirements; therefore all of the subdivision could not be zoned R-4; WHEREAS, DEVELOPER requested the R-8 Residential zoning so that the lots, which do not meet the standards of the R-4 District requirements, could all be approved even though they do not meet the R-4 District requirements; WHEREAS, DEVELOPER desires to have all of the lots approved AMBRQSE, FITZGERALD B CROOKSTON AttornaYe ere Counselor F.O. BOa 127 MsrlCisn, IMSo 83812 TsISPNUns eBBlNt public hearing before the Meridian City Council as to house sizes and the values of the houses that would be constructed; WHEREAS, since the density of the preliminary plat shows a density of 3.2, the CITY is not inclined to zone the entire piece of property R-8 just so a few lots can be developed that do not meet the R-4 designation and requirements and the CITY is more inclined to only approve an R-4 development in the area in which the property is located; WHEREAS, the State of Idaho legislature, in 1991, passed Idaho Code, 67-6511A, Development Agreements, which provides that cities may enter into development agreements with developers upon re-zoning land; that the CITY has not passed a development agreements ordinance but is in the process of adopting such an ordinance; that DEVELOPER desires to have his application for annexation, zoning and subdivision plat approved as quickly as possible and does not desire to wait until a development agreements ordinance is passed by the CITY; WHEREAS, DEVELOPER desires the CITY to enter into a development agreement, even though the CITY does not have a development agreements ordinance in force, and is urging and pursuing this agreement so that DEVELOPER may proceed with its development, which meets the density requirements of the R-4 District but does not meet all of the other requirements of the R-4 District; WHEREAS, the CITY has authority to place conditions and restrictions upon annexation of property even though it does not DEVELOPMENT AGREEMENT Page - 2 have a development agreements ordinance in force; WHEREAS, DEVELOPER deems it to be in its best interest to be able to enter into this agreement and acknowledges that this agreement was entered into voluntarily and at its urging and request; NOW, THEREFORE, IT IS HEREBY AGREED AS FOL~_OWS: 1. That the CITY shall annex the property described as Government Lot 4, Section 2, Township 3 North, Range 1 West, Ada County, Idaho, and zone the property described in Exhibit "A" as R-8 and zone the property described in Exhibit "B" as R-4. 2. That DEVELOPER, in accordance with its representations before the City Council, shall, on the land described as Government Lot 4, Section 2, Township 3 North, Range 1 West, Ada County, Idaho, only construct single-family houses, all such single-family houses shall have at least 1,420 square feet of floor space, exclusive of garages, and that all such single-family houses shall have a minimum value of, and be sold for, at least $110,000.00. 3. That DEVELOPER agrees to abide by all ordinances of the City of Meridian and the property shall be subject to de- annexation if the owner or his assigns, heirs, or successors shall not meet the conditions contained in the Findings of Fact and Conclusions of Law, this Development Agreement, and the Ordinances of the City of Meridian. 6. This agreement shall be recorded in the Recorder's Office of Ada County, Idaho, and shall be binding on the heirs, executors, successors and assigns of the parties hereto, on all purchasers of lots or parcels of land in the property annexed and zoned property, and all persons acquiring an interest in the annexed and zoned property, 7. DEVELOPER hereby waives any and all rights it may have to have this agreement declared null and void for failure of CITY to have a developments agreement ordinance enacted or rules and regulations enacted governing the creation, form, recording, modification, enforcement and terminations of development agreements and specifically agrees to hold CITY harmless and indemnify CITY in the event that a person or entity not a party to this agreement institutes actions or proceedings to have this agreement, or any part of it, declared null and void, including attorneys fees and costs and agrees to defend CITY in any such actions or proceedings.
