This Agreement made and entered irno this 14th of .lone, 2000, by and between the CITY OF
MERIDIAN, a municipal corporation of the State of Idaho, hereafter referred to as CITY, and
WALMART STORES INC, hereafter referned to as APPLICANT, then heirs, successors, assigns
and personal representative.
WITNESSETH:
WHEREAS, The following assessments are calculated by the City based upon information
supplied to the City by the Applicant and/or historical information on record for a similar faedity
and/or established in the City's Ordinances for the proposed type of facility.

NOW, THEREFORE, IT IS I3EREBX AGREED AS FOLLOWS:
1 • The above recitals are contractual and binding on the parties
2. Both partres to this agreement acknowledge that the above assessmerns were determined
from the information referenced is the Sist recital, and not actual meterEd flows, and that the
assessments for the proposed facility will be re-evaluated after a period of eighteen (18}
momhs of full service, final occupancy, to determine if adjustments are warranted. The City
shall refund any overpayment of assessments resulting from the re-evaluation, or the
Applicant shall be respons~bte for, and shall pay within (10) days the shortage of payment
resuhing from the re-evaluation.
