This Agreement made and entered into this 2nd day of November, 1498, by and between the
CITY OF MERIDIAN, a municipal corporation ofthe State of Idaho, hereafter refen~ed to as CITY,
and MICHENER INVESTIVIENTS, hereafter referred to as APPLICANT, their heirs, successors,
assigns and personal reprexntative.
WHEREAS, The following assessments are calculated by the City based upon information
supplied to the City by the Applicant and/or historical information on record for a siuniiar facility
and/or established in the City's Ordinances for the proposed type of facih'ty.

NOW, TF~EREFORE, IT IS HEREBY AGREED AS FOLLOWS
The above recitals are contractual and binding on the parties
2. Both parties to this agreement acknowledge that the above assessments wCre determined
from the information referenced in the first recital, and not actual metered flows, and that the
assessments for the pr°poscd faces' ~ be re-evaluated after a period of twelve (12) months
of full service, final occupancy, to determine if adjustments are warranted. The City shall
refund any overpayment of assessments resulting from the re-evaluation, or the Applicant
shalt be responsible for, and shall pay within (10} days the shortage of payment resulting from
the re-eva[uation.
