NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
1. That both parties of this agreement acknowledge that these assessments were determined
from the above information, and not actual metered flows, and that the assessments for the
proposed facility will be re-evaluated annualy until the final phase of construction of completed
to determine if adjustments are warranted. The City shall refund any overpayment of assessments
resulting from the re-evaluation, or the Applicant shall be responsible for payment of any shortage
resulting from the re-evaluation.

2. That "Latecomer Fees" will soon be calculated for the sanitary sewer and domestic water
main line extensions, as paid for by the City of Meridian, and that this applicant will be
responsible to compensate the City of Meridian at that time in an amount equal to the number of
assessed sewer and water ERU's mulitplied by the respective water and sewer ERU latecomer fee.
