This Agreement made and entered into this 18th day of December, 1996, by and between
the CITY OF MERIDIAN, a municipal corporation of the State of Idaho, hereafter referred to
as CITY, and ASPEN HILLS ASSOCIATES ,hereafter referred to as APPLICANT, their heirs,
successors, assigns and personal representative.
WHEREAS, The following assessments are calculated by the City based upon information
supplied to the City by the Applicant and/or historical information on record for a similar facility
andJor those established in the City's Ordinances for the proposed type of facility.

NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
That both parties of this agreement acknowledge that these assessments were determined
from the above information, and not actual metered flows, and that the assessments for the
proposed facility will be re-evaluated after a period of twelve (12) months of actual service /legal
occupancy to determine if adjustments are warranted. The City shall refund any overpayment of
assessments resulting from the re-evaluation, or the Applicant shall be responsible for payment
of any shortage resulting from the re-evaluation.

AFFIDAVIT REQUESTING NOTICE OF CHANGE ON THE
ASSESSMENT AGREEMENT FOR ASPEN HILLS ASSOCIATES

I, Gary D. Smith, a licensed Professional Engineer by the State of Idaho and City
Engineer for the City of Meridian, Idaho, do hereby request a change be made to
the Assessment Agreement for Aspen Hills Associates, J.E. ost Subdivision as
recorded in the Ada County Recorder's Office, Instrument No. 97002082 on Jan. 10,
1997 between Aspen Hills Associates and the City of Meridian.
The purpose of this affidavit is to request the Ada County Recorder to make
notation on said Assessment Agreement changing the Legal Description.
The requested change on the Assessment Agreement is as follows:
On Sheet No. 1, the Legal Description of Lot 6, J.E. Pfost Subdivision
should be Par #0707 of Lots 3 & 4 J.E. Pfost Subdivision.
