GRANT OF EASMENT
The undersigned Grantor(s) for and in consideration of Ten Dollars ( 10.00) and
other good and valuable consideration, the receipt whereof is hereby acknowledged, do
hereby grant and convey unto the Ashford Greens Owners Association and any down
stream users who possesses water rights in the Langley irrigation ditch, hereinafter
referred to as "Grantees", whose address is (Ashford Greens Owners Association) 12426
W. Explorer Drive, Suite 220, Boise, ID 83713 and (Langley) 3185 N. Blackcat Road,
Meridian, ID 83642, its successors, assigns, lessees, licensees and agents a perpetual
easement to construct, operate, maintain and repair such irrigation facilities to include
irrigation pipelines, clean out structures, measuring devices and appurtenances, from time
to time, as Grantees may require upon, over, under and across the following described
land situated in the County of Ada ,State of Idaho ,which the Grantor owns or in

Grantor further conveys to Grantee the following incidental rights:

(1) A temporary right-of--way to be used during all periods of construction,

(2) The right of ingress and egress over and across the lands of Gra~i~r-to• and' from the
above-described property.
Grantee shall indemnify Grantor for all damage caused to Grantor as a result of Grantee's
negligent exercise of the rights and privileges herein granted.
Grantor reserves the right to occupy, use, landscape and develop easement for all
purposes not inconsistent with the rights herein granted.
Grantor hereby covenants that no building, structure or obstruction will be constructed,
erected, built or permitted on said easement area.
The rights, conditions and provisions of this easement shall inure to the benefit of and be
binding upon the heirs, executors, administrators, successors and assigns of the respective
parties hereto.

the 114 corner common to Section 4 and the said Section 3, from which the northwest
corner of said Section 3 bears North QO°38'27" East, 2697.49 feet; thence South 00°38'11"
West, 188.00 feet to the REAL POINT OF BEGINNING of a 10.00 foot wide strip of land
being 5.00 feet left and right of the following described line:

SW1/4 of Section 3, T.3N., R.1 W., B.M., Ada County, Idaho, more particularly described as follows:
Commencing at the 1/4 comer common to Section 4 and the said Section 3, from which the
northwest comer of said Section 3 bears North 00°38'27" East, 2697.49 feet; thence North
90°00'00" East, 56.51 feet to the REAL POINT OF BEGINNING of a 10.00 foot wide strip of land
being 5.00 feet left and right of the following described lines: South 00°00'46" East, 134.67 feet;
South 57 ° 11'25" West, 18.95 feet;
North 57°11'25" East, 18.95 feet;
North 00°00'46" West, 267.83 feet;
North 6°21'45" East, 156.65 feet;
