FOR VALUE RECEIVED, CAPITAL DEVELOPMENT. INC.~aQ9, GR TOR
hereby grants, bargains, sells, conveys, and transfers unto Cl~ 4,~a M~_ RI,~#,AN, ~~
municipal corporation, GRANTEE, its successors and assigns, a `~~r'r~'i'~a~Lrit easement"
and right-of-way for the purpose of locating, establishing, con~~~cting, ma_intaining,._,__
repairing and operating underground sewer and water lines and n~~;tc~gether. with tq~T ~~
right to excavate and refill ditches and/or trenches for the location of said sewer and
water lines or mains, the right to remove bushes, trees, undergrowth and other
obstructions interfering with the location, construction and maintenance of said sewer
and water lines and mains and right of ingress and egress in, from, to and over said
easement for the purpose of inspecting, maintaining and repairing such sewer and water
mains and lines.
The perpetual easement and right-of--way hereby given, granted, conveyed and
transferred for maintaining, repairing and operating underground sewer and water lines
and mains is described in general language as follows:
PARCEL 1 (SANITARY SEWER EASEMENT):
A 15.00-foot wide Sanitary Sewer Easement being 7.50 feet on both sides of the
following described centerline lying in the SE1/4 of the NW1/4 of Section 9, T.3N., R.1 E.,
B.M., Meridian, Ada County, Idaho, and more particularly described as follows;
Commencing at the section corner common to Sections 4, 5, and 8 and the said
Section 9; thence South 1 °08'10"West 2,649.45 feet along the Westerly boundary of the
said NW1/4 of Section 9 to a point marking the one-quarter corner common to the said
Sections 8 and 9; thence South 89°21'14" East 1441.38 feet along the Southerly
boundary of the said NW1/4 of Section 9 to a point; thence North 0°04'04"West 968.86
feet to a point, also said point being the REAL POINT OF BEGINNING; thence North
80°01'43" East 11.92 feet to a point; thence South 71°58'12" East 400.00 feet to a point;
thence South 58°26'05" East 65.15 feet to a point; thence South 33°32'52" East 287.63
feet to a point; thence South 54°58'46" East 164.89 feet to a point; thence South
49°48'32" East 333.94 feet to a point; thence South 47°09'37" East 134.70 feet to a
point; thence South 90°00'00" East 142.18 feet to a point on the Easterly boundary of
the said NW1/4 of Section 9, also said point being the POINT OF ENDING of the above
described 15.00-foot wide Sanitary Sewer Easement and comprising 0.537 acre (23,406
square feet), more or less.
PARCEL 2 (WATER LINE EASEMENT):
A 15.00-foot wide Water Line Easement being 7.50 feet Northeasterly of, Northerly
of, Northwesterly of, Northeasterly of and Northerly of, respectively, and 7.50 feet
Southwesterly of, Southerly of, Southeasterly of, Southwesterly of and Southerly of,
respectively, and parallel with the following described centerline lying in the SE1/4 of the
NW1/4 of Section 9, T.3N., R.1 E., B.M., Meridian, Ada County, Idaho, and more
particularly described as follows; Commencing at the section corner common to
Sections 4, 5, and 8 and the said Section 9; thence South 1°08'10" West 2649.45 feet
along the Westerly boundary of the said NW1/4 of Section 9 to a point marking the one-
quarter corner common to the said Sections 8 and 9; thence South 89°21'14" East
1992.62 feet along the Southerly boundary of the said NW1/4 of Section 9 to a point;
thence North 0°38'46" East 200.66 feet to a point, also said point being the REAL

TO HAVE AND TO HOLD the said perpetual easement, rights, and rights-of-way
to City of Meridian, its successors and assigns forever, except the GRANTOR reserves
the right to occupy, use and cultivate the surface of said easement for all purposes not
inconsistent with the right herein granted. Further, the GRANTEE agrees and covenants
with the GRANTOR to restore the subsurface and surface of the easements and right-of-
way herein granted and conveyed, to a like condition existing prior to the grant of this
easement and right-of-way and to indemnify and save and hold harmless GRANTOR
from any and all losses, claims, actions, or judgments for damages or injuries to persons
or property arising out of or from, or caused by, the construction, operation, maintenance
and use of the aforesaid easements and rights-of-way.
